TERMS & CONDITIONS1. The Cudd Production & Consignment Sale acts as mediator only. ALL RE-

SPONSIBILITY AND GUARANTEES LIES BETWEEN THE BUYER ANDTHE SELLER.

2. The highest bidder will be the buyer, and if dispute arises between two or morebidders, the horse in dispute shall immediately be put up again for advance bids.If there are no advances, the horse shall go to the person from whom the auction-eer recognized the last bid. The auctioneer will decline any bid made by partieswho have defaulted in former purchases, or by persons who, in his judgment arenot responsible bidders.

3. Terms of the sale are cash and payment in full must be made to the cashier im-mediately after the sale.

4. Upon receiving payment for a horse, the cashier will issue an order to obtaindelivery. Buyers are cautioned not to lose these orders. Buyers assume all ex-penses and risks on horses after they have left the auction ring. Buyers mustmake arrangements with the Cudds for care of stock until it can be removed.

5. Upon failure of compliance with any of the above conditions, the lot shall beresold by public or private sale, and the deficiency (if any) attending such resaleshall be made good by the defaulter, immediately.

6. If any person shall purchase a lot and not pay for it as prescribed above, nothingshall prevent the auctioneer or the owner from compelling the purchaser to payfor it if the auctioneer or seller shall so deem it.

7. Every effort has been made to assure correctness of the catalog, but the Cudds,sales management, and auctioneers are not responsible for errors or omissions,and assume no liability on its part or on the part of the seller as to any state-ments, either verbal or written, regarding horses sold.

8. Registration papers will be given to the buyer as soon as checks have cleared orcredit established. THE BUYER SHALL BE RESPONSIBLE FOR TRANS-FER.

9. All known defects will be announced before each horse is started. Every horsewill be sold under this rule. Therefore, no horse can be rejected by buyer whenstruck off by auctioneer. The seller guarantees all mares to be bred to stallionsas indicated in the catalog. We believe them to be in foal, but are selling them asthey are and without return privileges, unless otherwise stated.

10. Immediately after the horse is sold, it will be the sole risk and responsibility ofthe buyer thereof, but possession of the horse cannot be obtained by him untilpayment in full has been made.

11. Buyers unknown to this firm must furnish current signed letter of credit, cash, orcashier’s check.

12. Agent’s Authorization. Persons acting as agents must so indicate on the SaleTicket and file an Agent’s Authorization in form satisfactory to Cudd Near Dis-persal & Consignment Sale simultaneously with settlement of the buyer’s ac-count.

13. Buyers and spectators are cautioned to be careful while on the grounds and par-ticularly while horses are being shown or sold in the sale ring. The managementand Cudd will not be responsible for accidents.
