DIVISION 3. Code Enforcement Board Sec. 2-92. Creation, establishment, jurisdiction.

(1) There is hereby created and established the city code enforcement board. The board is created and established pursuant to the authority granted in F.S. ch. 162.

(2) The code enforcement board shall have jurisdiction over alleged violations of the following provisions of the Code of Ordinances: (a) Section 5-32, animals running at large (b) Section 5-41, removal of defecation; (c) Article III of chapter 10, noise; (d) Chapter 14, solid waste, excluding sections 14-17 and 14-18 (e) Section 10-26 et seq., chapter 10, lot clearings; and (f) Any other provision of the Code of Ordinances not within the jurisdiction of the special master.

(Code 1966, § 2-217; Ord. No. 3891, § 1, 11-27-90; Ord. No. 4494, § 1, 2-8-00) Sec. 2-93. Composition; qualifications of members; terms of office; reappointment; filling of vacancies; removals from office.

(1) The code enforcement board shall be composed of 7 regular members appointed by city council. Members of the code enforcement board shall be residents of the city. Appointments shall be made in accordance with applicable law and ordinances on the basis of experience or interest in the subject matter jurisdiction of the code enforcement board, in the sole discretion of the city council. The membership of the code enforcement board shall, whenever possible, include an architect, a business person, an engineer, a general contractor, a subcontractor and a realtor.

(2) Any appointment shall be made for a term of 3 years. A member may be reappointed upon approval of the city council. An appointment to fill any vacancy on the code enforcement board shall be for the remainder of the unexpired term of office. If any member fails to attend 2 of 3 successive meetings without cause and without prior approval of the chairman, the code enforcement board shall declare the member’s office vacant; the city council shall promptly fill such vacancy. The members shall serve at the pleasure of the city council and may be removed at any time by a majority vote of the city council according to the procedures for removal of board members as set forth in section 2-48 et seq.

(3) Each regular member appointed to the board shall possess the following minimum qualifications: (a) The architect and the engineer shall be registered under state law regulating the practice of architecture and

engineering, or shall possess similar qualifications under the laws of other states, or shall have actual experience deemed by the city council to be equivalent to such registration.

(b) The general contractor and the subcontractor shall possess a valid certificate of competency and have proof of a current and valid business tax receipt, recognized and accepted under state law and the ordinances of the city regulating the business of contracting and, where required, state registration as a contractor, or shall possess similar qualifications under the laws of other states, or shall have actual experience deemed by the city council to be equivalent to such certification.

(c) The realtor shall be licensed under state law licensing real estate brokers as either brokers or salesmen, or shall possess similar qualifications under the laws of other states, or shall have actual experience deemed by the city council to be equivalent to such licensing, and shall hold a current and valid business tax receipt issued by the city.

(d) The businessman shall be actively engaged in any lawful business within the city, and shall hold a current and valid business tax receipt issued by the city or shall be an officer or employee of a business entity holding a current and valid business tax receipt issued by the city.

(e) Each member shall be a resident of the city. In addition to the above qualifications, the city council shall consider and be guided in its selection by members by the candidate’s experience or interest in code enforcement within the city. Members of the code enforcement board shall serve without compensation, but may be reimbursed for such travel expenses, mileage expenses and other per diem expenses as may be authorized by the city council and approved by the city manager. Sec. 2-95. Organization, election of officers. (1) The members of the code enforcement board shall elect a chairman, who shall be a voting member, from among

the members of the board. The board officers shall consist of the chairman, a vice-chairman and such other officers as the board shall deem necessary.

(2) Officers of the board shall be elected by a majority vote of the membership at the first meeting after their initial appointment and annually thereafter.

(3) A member of the board may be elected to serve as an officer without restriction as to the number of terms served. (Code 1966, § 2-220) Sec. 2-96. Authority to adopt rules, regulations. The code enforcement board may adopt such rules and regulations as are not inconsistent with the provisions of this division of F.S. ch. 162 which the board finds necessary to carry out the provisions of this division, subject to approval of the city council. (Code 1966, § 2-221) Sec. 2-97. Quorum. Four members of the code enforcement board shall constitute a quorum. (Code 1966, § 2-222) Sec. 2-98. Board clerk, other staff. The city manager shall appoint a city employee to be the code enforcement board clerk, who shall perform the functions assigned to the clerk as set forth in this division. For the purpose of administering this division, the board may call upon the city manager to furnish such other city employees as may be necessary to carry on or assist the board in performing its duties.
