Republi c ofthe Philippines Office of the Presid ent Housing and Urb an Development Coordinating Council HOU SING AN D LAN D USE REGUL AT ORY BO ARD BOARD RESOLUTION NO. 84l of 2009 , PRESCRIBING A PERIOD FOR THE RESOLUTION OF CASES AND PROVIDING SANCTIONS TO ENSURE COMPLIANCE WHEREAS, the Constitution guarantees the speedy disposition of cases, including those brought before administrative and quasi-judicial bodies; , I WHEREAS , Section 3(f) of Republic Act No. 3019, series of 1960, otherwise known as the Anti-Graft and Corrupt Practices Act, provides that "(n)eglecting or refusing, after due demand or request, without sufficient justification, to act within a reasonable time on any matter pending before him for the purpose of obtaining, directly or indirectly, from any person interested in the matter some pecuniary or material benefit or advantage, 'or for the purpose of favoring his own interest or giving undue advantage in favor of or discriminating against any other interested party" shall constitute corrupt practices of any public officer and shall be punishable under said law; WHEREAS, Section 14, Chapter 3, Book VII of the Administrative Code of 1987 Jays down the administrative procedure to be observed by all government agencies, induding departments, bureaus, boards, offices, commissions and similar bodies, and mandates that said agencies "shall decide each case within thirty (30) days following its submission for resolution"; I r WHEREAS , Section 1.2 of Executive Order (E.O.) No. 26, series of 1992, which prescribes the regulations to fully implement the administrative procedure under the Administrative Code of 1987 requires every officer charged with the resolution of cases or incidents to submit to his immediate superior, head of office, or officer exercising administrative supervision over him, within ten (10) days following the end of every month, a sworn statement of Disposition Of Cases declaring that all cases or incidents submitted to him for resolution have been decided within the prescribed period; WHEREAS , Section 1.7 of E.O. WHEREAS, the Constitution guarantees the speedy disposit ion of cases,including those brought before administrative and quasi-judicial bodies;

. And Providing Sanctions to Ensure Compliance

WHEREAS, there is a need to promote the speedy disposition of the caseshandled by HLURB arbiters, and for this purpose, prescribe a period for the resolution ofthe said cases and provide for sanctions to ensure compliance, consistent with theaforementioned provisions of the Constitution, Anti-Graft and Corrupt Practices Act,Administrative Code of 1987, E.O. No. 26 and other pertinent laws, rules andregulations;

WHEREFORE, be it resolved as it is hereby resolved, prescribing a period ofthirty (30) days for the resolution of all cases handled by HLURB arbiters, reckonedfrom the date the cases shall have been submitted for resolution;

RESOLVED further, allpwing a maximum extension of fifteen (15) days for theresolution of the cases on justifiable grounds, subject to the approval of the RegionalOfficer concerned or the Director of the Legal Services Group;

RESOLVED further, requiring all arbiters to submit to the Regional Officerconcerned or the Director of the Legal Services Group within ten (10) days following theend of every month, a sworn statement of Disposition of Cases listing down the cases

submitted for resolution and declaring that the said cases have been decided within theprescribed period;

RESOLVED finally, directing the withholding of the salary of any arbiter who failsto resolve the cases assigned to him within the prescribed period, until such time thatthe said cases shall have been resolved.
