Minutes of Meeting

The Board of Professional Engineers and Professional Land Surveyors held a regular meeting on June 3-4, 2010 at the Homewood Suites, Boise, Idaho, to conduct Board business. The meeting convened at 8:10 a.m. on Thursday, June 3, 2010 with the following Board members present: Gary Young, James H. Milligan, John W. Howe, David Bennion and George Wagner. Also present was David L. Curtis, Executive Director, Jim Szatkowski, Deputy Director and Jennifer Rowe, Administrative Assistant. i. AGENDA REVIEW - Are there any new agenda items? Mr. Szatkowski completed a Preliminary Investigation for docket FY10.27 and this information will be added to this item for discussion and review by the Board. Mr. Milligan would like to schedule a visit to the new office building in Meridian. The Board will visit the new building Thursday evening.

I. READING OF MINUTES

1. Approval of minutes of the February 11-13, 2010 Board meeting as distributed.

II. REVIEW AND APPROVAL OF CONSENT AGENDA

1. The following items have been continued at previous meetings and staff is unaware of any activity relating to these matters:

a. FY08.23a: Munio, Albert, unlicensed practice FY08.23b: Bessaw, John W., P.E., violations of statutes and Rules of

FY08.23c: Washington Group International, violations of statutes and Rules of Professional Responsibility. An ORDER extending the time until 6 months after the end of litigation has been signed.

b. FY09.25 Tikker, Robert, rules of professional responsibility. This matter is

pending completion of civil litigation. c. FY10.08 Spaulding, Scott, standard of care. This matter is pending

completion of course work.

d. FY10.09 Lund, Michael, Rules of Professional Responsibility. A preliminary investigation has been authorized. On advice of Counsel, the investigation has been halted pending the outcome of an investigation by the Office of the Attorney General.

2. ISPE nominated George Wagner to serve on the Board. Moved by Mr. Milligan, seconded by Mr. Bennion to note the items on the Consent Agenda with no further action. Motion passed unanimously. III. UNFINISHED BUSINESS 1. Review Strategic Plan Objectives. Mr. Young stated that Goal 3 Objective B will

no longer be necessary effective July 1, 2010. Moved by Mr. Milligan, seconded by Mr. Howe to approve changes to Strategic Plan by eliminating Goal 3 Objective B. Motion passed unanimously. 3. A subcommittee of Mr. Young and Mr. Bennion will report progress on reviewing

state job descriptions in terms of engineering without licensure requirements. Mr. Young reviewed the DHR descriptions for engineering and found no discrepancies. Geologist and Geologist Engineering Assistant do not require licensing as an engineer, but require a geologist background. The Board discussed the overlap or “gray areas” of engineering and geology and work being done in the private sector versus the public sector. There are some Public Television Broadcast Engineer descriptions that do not really include professional engineering but rather maintenance and operations. Moved by Mr. Milligan, seconded by Mr. Bennion to authorize the Chair to sign a letter to Mr. Falk stating that the Board reviewed the DHR position descriptions and while the actual unlicensed practice of engineering is a broader issue and has to be dealt with on a case-by-case basis, we do not see the need to pursue the matter further. 5. A subcommittee of Mr. Bennion, Mr. Milligan and Mr. Szatkowski met with representatives of ITD to review whether Storm Water Prevention Plans need to be stamped. There has been no further communication with ITD on this matter.

Moved by Mr. Milligan, seconded by Mr. Howe to close this matter. Motion passed unanimously. 8. An Item Writing Workshop was held March 8 & 9, 2010 in Moscow in advance

of the ISPLS Annual Meeting. The Workshop was conducted by Jack and Steve Warner of TEST, Inc. out of Aurora, Colorado. Staff would like the Board to consider appointing a subcommittee to develop the final July 2010 version of the Idaho State-Specific PLS exam. Mr. Milligan suggested that we should require a listing of a reference to justify the correct answer and that each distracter needs a clear and documented rationale. The Board noted the suggestion and directed Mr. Howe and Mr. Young to evaluate new items and prepare new exam.

11. David Kelly would like to obtain a license in Idaho based on comity with his

Oregon license. He is licensed as a Traffic Engineer and took a State-Specific exam for licensure. Is this exam equivalent to an NCEES PE exam? Staff obtained a copy of the exam from California. Mr. Milligan reviewed the examination and reported to the Board that the examination is sufficient for approval as a Traffic Engineering examination.

Moved by Mr. Milligan, seconded by Mr. Bennion to approve the examination for licensing purposes and if we get a candidate for comity who has taken and passed it, and is otherwise qualified, we should license them as a professional engineer especially qualified in Traffic Engineering. Staff is directed to consider such applicants as non-standard. The Board authorized the Chair to inform Mr. Kelly that if he applies for a license in Idaho his education and experience will also need to meet the requirements of Idaho Code and will be evaluated by the Board. Motion passed with Mr. Wagner voting against the motion. IV. NEW BUSINESS 1. Reports by Board Members and Staff of activities since the March Board meeting.

Mr. Milligan attended a Civil PE exam committee meeting April 22-25, 2010 in Clemson, SC; attended the NCEES Western Zone meeting where he presented the EPE committee report; attended an Architectural Engineering Cut Score Panel May 23-25, 2010 in Kansas City, MO with a follow up telephone call on May 26, 2010. Mr. Milligan has been named Chair of EPE and was asked to be a consultant to the Exam Audit Committee as well as CBT and EPP.

Mr. Curtis participated in a webinar for MBAs on ABET; made a presentation to Boise State University mechanical engineering seniors on the Rules of Professional responsibility; attended the ACEC-Idaho April and May meetings; attended the ISPLS SW Chapter meeting to provide a presentation on Board

issues; attended the APEGGA Annual Meeting in Alberta, Canada; participated in a CBT Conference Call; made a presentation to University of Idaho electrical engineering sophomores on licensing; attended the NCEES Western Zone meeting, and provided a post mortem account of the University of Idaho PE Review class. Mr. Szatkowski attended a subcommittee meeting with architects and subsequent meetings with DBS, DPW AIC, the IDABO Executive Director; attended the NCEES Western Zone meeting, and made a presentation to the Utah Engineers on enforcement trends. Mr. Howe attended the Survey Board Member Forum at ACSM in Phoenix, AZ; attended the NCEES Western Zone meeting; attended the ISPLS Board of Governors meeting; attended 2 ISPLS Northern Section meetings and has been invited to be on the NCEES EPS committee. Mr. Young attended a subcommittee meeting with architects; attended the APEGGA Annual Meeting in Alberta, Canada and attended the NCEES Western Zone meeting.

2. Staff presented an Expense Reimbursement Summary for the Executive Director

from March 1, 2010 to May 31, 2010 for the Board’s review. Moved by Mr. Milligan, seconded by Mr. Bennion to approve the expense reimbursement summary as presented. Motion passed unanimously. 3. ISPLS would like to encourage ISPE to nominate a dual license holder for Mr.

Young’s position on the Board when his term ends in 2011. Moved by Mr. Milligan, seconded by Mr. Howe to note the request. Motion passed unanimously. 4. Lewis-Clark State College is considering offering a Bachelor of Technology in

Surveying through a link to courses at Idaho State University. Moved by Mr. Milligan, seconded by Mr. Howe to request the full curriculum and identification of courses taught by Idaho State University and those by Lewis-Clark State College. The Chair will send a letter to LCSC letting them know that there appears to be deficiencies in relation to the 27 prescriptive credits in the Board Administrative Rules. Motion passed unanimously. 5. If an applicant was continued for additional coursework, what is the minimum

final course grade earned that is acceptable? Moved by Mr. Bennion, seconded by Mr. Milligan to authorize the Chair to send a letter to the candidate and inform him that the Board does not consider a “D” a satisfactory

grade for purposes of qualifying additional education for assignment to a subsequent examination. Motion passed unanimously. 6. Staff drafted a NEWS BULLETIN for the Board’s review. Moved by Mr. Milligan, seconded by Mr. Howe to approve the NEWS BULLETIN as amended. Motion passed unanimously. 7. NCEES Education Criteria has a new proposal for a NCEES Standard for

education. Moved by Mr. Milligan, seconded by Mr. Bennion to note this item as it will be reviewed in more detail at the Board Retreat in August. Motion passed unanimously. 8. Under the current CPD rules, engineers are exempt from the effective date of the

CPD requirement (May 8, 2009) to their next biennial renewal. The Board established a policy that any CPD PDH’s earned by an engineer during the renewal biennium in which the exempt period falls may be carried forward to the next renewal biennium (up to a maximum of 30 PDH’s). If an individual takes and passes the PE exam after May 8, 2008, they are exempt from the CPD requirement during the time between issuance of their license and their next regular biennial renewal. Would the Board approve carrying forward any CPD PDH’s earned by that engineer during the renewal biennium in which that exempt period falls?

Moved by Mr. Milligan, seconded by Mr. Bennion to approve carrying forward any CPD PDH’s earned by an engineer during the renewal biennium in which that exempt period falls up to a maximum of 30 PDHs. Motion passed unanimously. 9. Is it be acceptable for an individual trying to obtain the additional 8 semester

credits needed after failing the FE exam twice to count the FE Review Course in those credits, even though the course was taken previously?

Moved by Mr. Milligan, seconded by Mr. Howe to authorize the Chair to write to candidate and inform her that the FE review course is not allowed as additional education to qualify for assignment to exam, and repeat is not allowed either. Motion passed unanimously. 10. DEQ created a brochure on how to hire an engineer. Moved by Mr. Wagner, seconded by Mr. Milligan to authorize the Chair to send a letter to DEQ complimenting them on their brochure, and suggest that they submit a copy of it to the QBS Facilitation Committee for their comments. DEQ may even want to provide information on that group in the brochure. Motion passed unanimously.

11. Mr. Truchot will be out of the country for an extended period of time making it difficult for him to complete his CPD.

Moved by Mr. Milligan, seconded by Mr. Bennion to authorize the Chair to write to Mr. Truchot and let him know that the Board will allow earning the PDHs required to be postponed for 6 months after returning to the USA for a period of at least 6 months. Staff directed to develop amendments to Administrative Rule for future consideration by the Board. Motion passed unanimously. 12. John Dunn, P.L.S., Latah County Surveyor asked the Board to express an opinion. Moved by Mr. Howe, seconded by Mr. Bennion to authorize the Chair to write a letter to Mr. Dunn and inform him that a Record of Survey is not required for mere replacement of lot corner unless any of the “triggers” in the Record of Survey law exist. Motion passed unanimously. 13. Staff presented proposed meeting dates for calendar year 2011. Moved by Mr. Milligan, seconded by Mr. Wagner to approve calendar year 2011 meeting dates of the following:

• February 10-12, 2011 • April 7-9, 2011 • June 9-11, 2011 • August 4-6, 2011 board Retreat • August 31, September 1-2, 2011 • November 17-19, 2011

Motion passed unanimously with Mr. Bennion absent. 14. Staff provided an update on the Board’s financial status as of April 30, 2010. Moved by Mr. Milligan, seconded by Mr. Howe to note the information. Motion passed with Mr. Bennion absent. 15. Mr. Curtis received an email from NCEES regarding a possible collusion

occurrence on the FE exam. Moved by Mr. Milligan, seconded by Mr. Wagner to authorize staff to work with Mr. Naylor to conduct an investigation using NCEES guidelines and direct staff to not release the exam results to the individuals under investigation. the QBS law and its applications regarding pricing requests from government entities. Mr. Kane researched this matter and discussed his findings with the Board.

Moved by Mr. Milligan, seconded by Mr. Wagner to direct Mr. Kane to look further into the law and rule and re-evaluate interpretation based on Board input. The Board authorizes the Chair to send a letter to Mr. Baker and inform him that we are continuing to discuss the matter and request his authorization to forward his inquiry to QBS. The Board is working with our legal counsel on the matter. Board directs staff to include an article on the QBS Facilitation Council and their role and services in the next NEWS BULLETIN. Motion passed unanimously. 4. Mr. Howe and Mr. Young worked in conjunction with ISPLS to draft

amendments to the surveying laws. Draft document of changes were distributed for comment.

Comments were received on the Discussion Paper on Board Composition. Moved by Mr. Wagner, seconded by Mr. Milligan to authorize Mr. Bennion to contact ACEC-Idaho and authorize Mr. Howe to contact ISPLS and report back to the Board the status of any joint committee of ACEC/ISPE/ISPLS regarding Board composition. Motion passed unanimously. 7. Lance King requested that the Board reconsider some courses outlined in the

Final Order. Moved by Mr. Milligan, seconded by Mr. Young to enter into executive session to consider records that are exempt from disclosure as provided for by Idaho Code 67-2345(1)(d). Mr. Szatkowski updated the Board on the status of the Architects/Engineers

subcommittee progress. AIC and IDABO will be meeting on June 16th in Idaho Falls and the Board subcommittee is invited to attend.
