Board Member Orientation, August 30, 2016. 8:30 a.m. – 12:30 p.m., State Capital Auditorium

The EO reported that Ms. Napoleon will be attending. NLC Cohort Meeting, September 22, 2016, Rosemont, Illinois – EO The EO reported initially she was not going to attend, however because we are

very concerned with the fiscal impact, she will attend so she can ask questions and gather more information at this meeting. She is currently working with NCSBN staff on getting them statistics of the number of Hawaii licensees by state so they can determine the fiscal impact on Hawaii. She has seen one other state has increased their license fees as a way to offset cost, so this is something that may still be possible if the Board is still interested. Right now no state is allowed to require an application form or fees for anyone who has a compact license, which would also mean no collection of the Hawaii State Center for Nursing fees.

The DAG asked didn’t they at one time say they would provide funding? The EO stated, yes, but now they are saying you have to pay to join the compact.

Besides that, part of your license fees also goes to pay for investigation cost. So if a complaint is filed against someone, RICO will still have to conduct and pay for an investigation.

Regulation 2030 Meeting, October 2-3, 2016, Chicago, Illinois The EO reported the Chair will be attending. International Nurse Regulator Collaborative Symposium, October 4-5, 2016,

Chicago, Illinois The EO reported that Ms. Napoleon will be attending. 2016 NCSBN Scientific Symposium, October 6, 2016, Chicago, Illinois The EO reported that Ms. Napoleon will be attending. 2016 Legislature – Status Report

The EO reported on the following: HB 2707, HD1, SD2, CD1 – Relating to Medical Marijuana (Act 230, SLH 2016,

approved by the Governor on July 1, 2016) The EO reported part of this bill now allows APRNs to qualify patients for medical

marijuana. So a question came up about the Exclusionary Formulary. On the current exhibit is states…, “The Exclusionary Formulary shall consist of: Medical marijuana as restricted in HRS section 329-121”… No one, not even physicians can write a prescription for medical marijuana because it is a Schedule I.

Attached is a draft proposed Exclusionary Formulary that adds a clarification for medical marijuana. It is still included in the Exclusionary Formulary, but it clarifies that APRNs can now qualify a patient.

APRN with Prescriptive Authority, Exclusionary Formulary The Board reviewed a draft of a proposed Exclusionary Formulary that adds

clarification for medical marijuana and the Joint Formulary Advisory Committee. Upon a motion by Mr. Joslyn, seconded by Ms. Kodama it was voted on and

unanimously carried to approve the proposed draft of the Exclusionary Formulary and post it onto the Board’s webpage.

CDC Checklist for Prescribing Opioids for Chronic Pain The Board reviewed a “Checklist for prescribing opioids for chronic pain” prepared

by the CDC. The EO asked if due to the concern regarding over prescribing of opioids, if this is

something the Board would like to have posted to their webpage for APRNS with prescriptive authority?

Upon a motion by Mr. Joslyn, seconded by Ms. Kodama it was voted on and

unanimously carried to post the CDC Checklist for Prescribing Opioids for Chronic Pain onto the Board’s webpage.

2016 Legislation Act 183, SLH 2016 Relating to Advance Practice Registered Nurses –

Certify Cause of Death The EO reported she had a summary of the 2016 Legislative Measures posted

onto the Board’s webpage. It is a summary of all the bills that passed this legislative session that affects nursing. She also had posted a separate one for Act 183 related to APRNs – Certify Cause of Death.

Amendments to Title 16, Chapter 89 – Status Report

The EO reported she is still proofing the draft.

Continuing Competency Program

The EO reported she is working on drafts of information to be posted on the Board’s webpage pertaining to providers of CE and recognized national certifying organizations. She will try to have the drafts ready for the Board’s review by the October meeting.

Hawaii State Mr. Reichhardt stated they are still looking for a program lead, which will include Center for Nursing: 30% time involved with the Academic Progression for Nursing Program initiatives. Correspondence; LPN Scope of Practice Questions

The Board reviewed and discussed an email inquiry and after careful consideration, responded to the questions as follows:

1. What is the LPN's scope of practice in private duty/personal care?

The scope of practice of a nurse, as defined in Hawaii Revised Statutes §457-1.5 is the same in any setting:

§457-1.5 Practice of nursing. (a) Nursing is a scientific process

founded on a body of professional knowledge. It is learned profession based on an understanding of the human condition across the lifespan of a client and the relationship of a client with others and within the environment. It is also an art dedicated to caring for others. The practice of nursing means assisting clients in attaining or maintaining optimal health, implementing a strategy of care to accomplish defined goals within the context of a client-centered health care plan, and evaluating responses to nursing care and treatment. Nursing is a dynamic discipline that is continually evolving to include more sophisticated knowledge, technologies, and client care activities. Nursing applies evidence-based practice to promote optimal client outcomes.

(b) The scope of nursing practices established in this chapter and by the rules of the board shall serve as general guidelines and are not intended to address the appropriateness of the use of specific procedures in any particular work setting or to grant permission to implement specific procedures in any particular work setting.

2. What can and what can't LPN's do?

The LPN's scope of practice is defined in HRS 457-2 as follows:

"The practice of nursing as a licensed practical nurse" means the performance of those acts commensurate with the required educational preparation and demonstrated competency of the individual, whereby the

individual shall be accountable and responsible to the consumer for the quality of nursing care rendered. The foregoing may include, but shall not be limited to: implementation of basic nursing procedures in the plan of care; observing and caring for individuals at all levels of the health spectrum, giving counsel and acting to safeguard life and health and functioning as a part of the health care team, under the direction of a dentist, physician, osteopathic physician, registered nurse, osteopath, or podiatrist licensed in accordance with chapter 448, 453, 457, 460, or 463E, or under the orders of a physician assistant licensed pursuant to chapter 453, practicing with physician supervision as required by chapter 453, and acting as the agent of the supervising physician; administration of treatment and medication as prescribed; promotion of health maintenance of individuals, families, or groups; or teaching and supervision of auxiliary personnel.

In addition, HRS 457-2.6 also states:

§457-2.6 Licensed practical nurse. Practice as a licensed

practical nurse means the directed scope of nursing practice, regardless of compensation or personal profit, that takes place under the direction of a registered nurse, advanced practice registered nurse, licensed physician, or other health care provider authorized by the State, and is guided by the scope of practice authorized by this chapter, the rules of the board, and nursing standards established or recognized by the board including but not limited to: (1) The National Council of State Boards of Nursing Model Nursing

Practice Act, Article II, Scope of Nursing Practice, Section 3; and (2) The National Council of State Boards of Nursing Model Nursing

Administrative Rules, Chapter Two, Standards of Nursing Practice, Sections 2.3.1 through 2.3.3; provided the NCSBN shall have no legal authority over the board and shall have no legal authority or powers of oversight of the board in the exercise of its powers and duties authorized by law.

3. For example can the LPN do home assessments?

An LPN may not perform assessments. They may evaluate and inform the RN provided the RN is directly supervising the LPN.

4. Can LPN's delegate tasks to personal care assistants (unlicensed

assistants)?

Although only an RN may delegate nursing care tasks to unlicensed assistive personnel pursuant to HRS 457-7.5, it was the Board's informal interpretation that an LPN that is directly under the supervision of an RN may delegate nursing care tasks, functions and activities to unlicensed assistive personnel.

5. Does the LPN need a RN manager to be supervising private duty/personal

care clients?

Yes, see HRS 457-2.6 above.

In accordance with Hawaii Administrative Rules §16-201-90, the above interpretation is for informational and explanatory purposes only. It is not an official opinion or decision and is thus, not binding on the Board.

Working Solutions July 2016 Issue The Board was provided with a copy of an insert from the Working Solutions July 2016 issue for their information with topics such as:

Lightning Safety Tips for Employees; Emotional Intelligence in Customer Service; Avoid Academic Summer Slump; and See Early Signs of Alcoholism.

Delegation The EO reported that she received an inquiry on “delegation” and after doing some research of the nurse practice act, she found the NCSBN/ANA Joint Statement on Delegation that also includes the Decision Tree for Delegation of Nursing Assistive Personnel and the ANA Principles of Delegation. The Board reviewed HRS 457-7.5 and HAR 16-89-100 and it was the consensus of the Board to recognize the NCSBN/ANA Joint Statement on Delegation that also includes the Decision Tree for Delegation of Nursing Assistive Personnel and the ANA Principles of Delegation. The EO stated that she will contact NCSBN and get their permission to post the information on the Board’s web page.

Applications: The Board moved into Executive Session. Executive Session: At 9:20 a.m. upon a motion by the Vice Chair, seconded by Ms. Daub, it was voted

on and unanimously carried to move into Executive Session in accordance with HRS, 92-5(a) (1) and (4), “To consider and evaluate personal information relating to individuals applying for nurse licensure;” and “To consult with the board’s attorney on questions and issues pertaining to the board’s powers, duties, privileges, immunities, and liabilities”.

At 10:34 a.m. upon a motion by Ms. Kodama, seconded by Ms. Daub, it was voted on and unanimously carried to move out of executive session.

Chapter 91, HRS The Vice Chair called for a recess from the meeting at 10:34 a.m., to discuss and Adjudicatory Matters: deliberate on the following adjudicatory matter pursuant to Chapter 91, HRS:

In the Matter of the License to Practice Nursing of Eddie Jo Batliner, R.N.; RNS 2015-37-L, Settlement Agreement Prior to Filing of Petition for Disciplinary Action and Board’s Final Order Upon a motion by Ms. Daub, seconded by Ms. Napoleon, it was voted on and unanimously carried to approve the Board’s Final Order:

In the Matter of the Nursing License of Francisco Mungia; RNS 2015-26-L,Settlement Agreement Prior to Filing of Petition for Disciplinary Action and Board’s Final Order; Appendix “1” Upon a motion by Ms. Kodama seconded by Ms. Daub, it was voted on and unanimously carried to approve the Board’s Final Order: In the Matter of the License to Practice Nursing of Jessica A. Rooney, RNS 2009-8-L, Monitor’s Report for Period Covering April – June 2016 Upon a motion by Ms. Kodama, seconded by Mr. Joslyn, it was voted on and unanimously carried to accept the final monitor’s report and documents substantiating Ms. Rooney’s compliance with the above mentioned Board’s Final Order for the period covering April - June 2016.

The Board also wished to thank Ms. Patricia Mosher for her service as Ms. Rooney’s monitor for the last five years. Ms. Mosher’s voluntary contribution in this matter has been very much appreciated.

Valdez, RNS 2010-25-L, Hearings Officer’s Findings of Fact, Conclusions of Law and Recommended Order Granting Petitioner’s Motion for Summary Judgement, Exhibits “A” through “C” and Board’s Proposed Final Order Upon a motion by Ms. Napoleon, seconded by Ms. Kodama, it was voted on and unanimously carried to accept the Board’s Proposed Final Order. Following the Board’s review, deliberation, and decisions in these matters, pursuant to Chapter 91, HRS, the Vice Chair announced that the Board was reconvening its scheduled meeting at 10:45 a.m.

Ratification List Upon a motion by the Vice Chair, seconded by Mr. Joslyn, it was voted on and

unanimously carried to ratify the attached list of LPNs – 18582 to 18621.

LPN Applicants with Conditional License – Question on Condition(s) Upon a motion by Mr. Joslyn, seconded by Ms. Daub, it was voted on and unanimously carried to grant applicant’s request to have Dr. Bird, her direct supervisor, submit quarterly reports to the Board pertaining to her conduct as it relates to the practice of nursing. The Board’s decision was based on the definition of the “Practice of nursing as a licensed practical nurse” under Hawaii Revised Statutes section 457-2. Kellen Smith

The Board considered the prior disciplinary actions of the Wisconsin and California Boards of Nursing that resulted in the voluntary surrender of her Wisconsin and California nurse licenses and that the voluntary surrender of these licenses is

considered an encumbrance on these license and therefore denied the application based on the following Hawaii Revised Statutes and Hawaii Administrative Rules:

§457-12 Discipline; grounds; proceedings; hearings. (a) In addition to

any other actions authorized by law, the board shall have the power to deny, revoke, limit, or suspend any license to practice nursing as a registered nurse or as a licensed practical nurse applied for or issued by the board in accordance with this chapter, and to fine or to otherwise discipline a licensee for any cause authorized by law, including but not limited to the following:

(6) Unprofessional conduct as defined by the board in accordance with its

own rules;

(8) Revocation, suspension, limitation, or other disciplinary action by another state of a nursing license for reasons as provided in this section;

§436B-19 Grounds for refusal to renew, reinstate or restore and for

revocation, suspension, denial, or condition of licenses. In addition to any other acts or conditions provided by law, the licensing authority may refuse to renew, reinstate or restore or may deny, revoke, suspend, or condition in any manner, any license for any one or more of the following acts or conditions on the part of the licensee or the applicant thereof:

(13) Revocation suspension, or other disciplinary action by another state or

federal agency against a licensee or applicant for any reason provided by the licensing laws or this section;

§457-7 Registered nurses; qualifications; licenses; fees; title;

existing licensed nurses; verification of licenses; eligibility. (a) An applicant for a license to practice nursing as a registered nurse shall submit an application on a form prescribed by the board and shall provide written evidence that the applicant has completed a nursing program approved by the board.

(b) Licenses shall be granted either by: (1) Examination: The applicant shall be required to pass a written

examination in nursing subjects as determined by the board. Upon the applicant's passage of the examination and compliance with the applicable requirements of this chapter and the rules of the board, the board shall issue to the applicant a license to practice nursing as a registered nurse; or

(2) Endorsement: The board may issue a license to practice nursing as a registered nurse by endorsement to an applicant who has been licensed as a registered nurse under the laws of another state, territory, or foreign country if the applicant has an unencumbered license and, in the opinion of the board, the

applicant meets the qualifications required of registered nurses in this State at the time of graduation. Pending verification of a valid,

unencumbered license from another state, a temporary permit may be issued for employment with a Hawaii employer.

§16-89-60 Types of unprofessional conduct. The types of unprofessional

conduct covered in this provision shall include, but are not limited to, the following: (6) Performing unsafe or unacceptable patient care or failing to

conform to professional standards required of a nurse which poses a danger to the welfare of a patient which shall include: (D) Failing to take appropriate action in safeguarding a

patient from incompetent health care practices; (7) Engaging in any act inconsistent with the practice of nursing as

defined in section 457-2, HRS, for that of a licensed practical nurse or a registered nurse including: (A) Engaging in conduct which evidences a lack of ability or

fitness to discharge the duty owed by the licensee to a patient;

any other actions authorized by law, the board shall have the power to deny, revoke, limit, or suspend any license to practice nursing as a registered nurse or as a licensed practical nurse applied for or issued by the board in accordance with this chapter, and to fine or to otherwise discipline a licensee for any cause authorized by law, including but not limited to the following:

(6) Unprofessional conduct as defined by the board in accordance with its

own rules;

(8) Revocation, suspension, limitation, or other disciplinary action by another state of a nursing license for reasons as provided in this section;

§436B-19 Grounds for refusal to renew, reinstate or restore and for revocation, suspension, denial, or condition of licenses. In addition to any other acts or conditions provided by law, the licensing authority may refuse to renew, reinstate or restore or may deny, revoke, suspend, or condition in any manner, any license for any one or more of the following acts or conditions on the part of the licensee or the applicant thereof:

(13) Revocation suspension, or other disciplinary action by another state or

federal agency against a licensee or applicant for any reason provided by the licensing laws or this section;

§457-7 Registered nurses; qualifications; licenses; fees; title;

existing licensed nurses; verification of licenses; eligibility. (a) An applicant for a license to practice nursing as a registered nurse shall submit an application on a form prescribed by the board and shall provide written evidence that the applicant has completed a nursing program approved by the board.

(b) Licenses shall be granted either by: (1) Examination: The applicant shall be required to pass a written

examination in nursing subjects as determined by the board. Upon the applicant's passage of the examination and compliance with the applicable requirements of this chapter and the rules of the board, the board shall issue to the applicant a license to practice nursing as a registered nurse; or

(2) Endorsement: The board may issue a license to practice nursing as a registered nurse by endorsement to an applicant who has been licensed as a registered nurse under the laws of another state, territory, or foreign country if the applicant has an unencumbered license and, in the opinion of the board, the applicant meets the qualifications required of registered nurses in this State at the time of graduation. Pending verification of a valid,

unencumbered license from another state, a temporary permit may be issued for employment with a Hawaii employer.

§16-89-60 Types of unprofessional conduct. The types of unprofessional

conduct covered in this provision shall include, but are not limited to, the following: (6) Performing unsafe or unacceptable patient care or failing to

conform to professional standards required of a nurse which poses a danger to the welfare of a patient which shall include: (D) Failing to take appropriate action in safeguarding a

patient from incompetent health care practices; (7) Engaging in any act inconsistent with the practice of nursing as

defined in section 457-2, HRS, for that of a licensed practical nurse or a registered nurse including:

3. That you shall provide written notice and documentation within 30 (thirty) days

to the Board of any judgment, award, disciplinary sanctions, order, or other determination, which adjudges or finds that you are civilly, criminally or otherwise liable for any personal injury, property damage or loss caused by your conduct in the practice of nursing; and

4. That you understand that failure to comply with any of the conditions may

result in disciplinary action against your Hawaii RN license.
