PLEDGE OF
ALLEGIANCE The Pledge of Allegiance was led by Trustee Ronald Ellerbe.
President Bergtraum welcomed everyone to the August 12, 2021 meeting of the
Nassau BOCES Board of Education. She also welcomed everyone on livestream
and stated, unfortunately, the Board Meeting is not in-person as would have been
wished for at this juncture. She further stated Nassau BOCES will continue to move
forward and be flexible. She hopes everyone is having a pleasant and regenerative
summer and is looking forward to the beginning of the new school year.
MINUTES
APPROVAL Dr. Dillon stated prior to this evening’s scheduled presentation, the
Communication’s Office has put together a short video in an effort to continue
Nassau BOCES’ initiative to put the BOCES’ name out in a favorable light. He
then turned the floor over to Ms. Angela Marshall, Public Information Officer.
Ms. Marshall stated that the video was created by the Jerusalem Avenue School’s
regional summer school program which highlighted the children’s dreams for the
world. She thought the video was adorable and wanted to share it.

Dr. Dillon introduced Dr. Carla Theodorou, Executive Director of
the Regional Schools and Instructional Programs and Ms. Judith
Hynes, Assistant Director of the Regional Schools and
Instructional Programs who will present tonight.
Dr. Theodorou thanked the Board and the District Superintendent
for the opportunity to present a program analysis of the 2021/2022
needs for the Department of Regional Schools and Instructional
Programs (RSIP). She conveyed the entire presentation in a power
point format and explained RSIP’s programs slide by slide. She
informed that among other programs RSIP includes six In-District
programs and 12 Twilight alternative education programs, which
supports the districts with summer Regent’s administration, credit
recovery and high school equivalency completion.
Dr. Theodorou went on to summarize the details of the chart

referring to the In-District CTE and Twilight Programs for the
2021-2022 school year regarding the total student enrollment,
Administrators and the programs offered. She stated these
programs are located within the component districts and have a
different supervisory model and fee structure from the other
Nassau BOCES programs. The maximum enrollment is
determined by the districts and district fees directly cover the costs
of these programs. She further explained the enrollment numbers
on the chart are preliminary. The districts usually finalize
enrollment numbers in late September. Dr. Theodorou stated since
In-District programs and Twilight alternative education programs
are housed in the home districts and are supported by the regular
building staff, the need for administrative support is not as high as
in some other Nassau BOCES programs. She further highlighted
that a newly hired Program/Work-based Learning (WBL)
Coordinator will oversee all In-District CTE programs and
Twilight alternative education programs. This person will provide
administrative support to all teacher aides assigned to the districts
along with WBL guidance for placement in the job sites.
She then explained the administrative structure of the Twilight
alternative education programs: one Principal oversees all
locations and is also supported by a program coordinator. She also
shared that students may return to the regular program at the end
of the year or can stay in Twilight program from year-to-year.
Valley Stream is the newest Twilight program for the 2021-2022
school year.
Dr. Theodorou discussed the needs of Nassau BOCES career and
technical education programs which serve a much larger
population of students located in Nassau BOCES owned or leased
buildings. She cited the anticipated enrollments indicated on the
power point presentation for the Fall conveyed the breakdown of
Barry Tech, GC Tech and Long Island High School for the Arts
(LIHA) students. She further shared how the programs at each
school are structured differently than regular high schools. The
supervisor responsibilities were stated in detail along with the
CTE technical endorsement requirements, what the full scope of
supervision and monitoring entailed for these programs, what the
CTE administrators do to assist in the management of
infrastructure needs, how they monitor budgets for supplies and
equipment, oversee clinical rotations for health programs,
supervise all recruitment and marketing activities and oversee the
challenging New York State program re-approval process.
Dr. Theodorou also discussed the Adult Education Program,
which includes adult English as a second language, high school
equivalency, adult basic education and career training programs
and how they are funded. She stated early recruitment appears
promising. The programs are managed by one principal and two
assistant principals. The Adult Learning Center also oversees six

satellite locations. She then explained the information listed on the
chart and discussed the belief that Nassau BOCES will return to
“pre-COVID” numbers during the upcoming school year.
Dr. Theodorou further discussed RSIP’s programmatic needs and
explained the recommendations presented in the program support
and analysis timeline covering the period 2021 through 2024. She
further went over the chart summarizing the Personnel Proposal
and Budget Implications. She discussed the financial and
budgetary matters regarding transitioning art programs and adding
new programs at Barry Tech.
Trustee Weinick requested clarity of the budget implication chart
regarding creating and filling a principal’s position at $56,000. Dr.
Theodorou stated it is the difference in the cost between the
assistant principal currently running the program and a new
principal. The plan is to eliminate the coordinator position and
have an assistant principal and principal.
Mr. Weinick then stated he has the same question regarding
LIHSA. Dr. Theodorou stated in this instance the program
coordinator position will be eliminated and an assistant principal
position will be created.
Mr. Schoen stated he noticed Nassau BOCES added a program at
Long Beach and wanted to know what the program was. Dr.
Theodorou turned the floor over to Ms. Hynes to answer the
question.
Ms. Hynes replied the program is a medical assistant In-District
program. Ms. Hynes stated the program will be at the Nike Center
on Lido Boulevard, which was closed for the last year and a half
due to COVID. The room has been completed. It is brand new and
state-of-the-art. Currently eight students are enrolled and more
enrollment is anticipated at the start of the new semester. She
stated, Mr. Gallagher, the Superintendent, would like to add at
least two new programs over the next few years and would like to
have their CTE center run through Nassau BOCES.
Mr. Schoen asked if the capital investment at the Nike Center is
theirs? Ms. Hynes answered yes, it is all theirs. Dr. Theodorou
also added the district incurs all costs. Ms. Hynes shared
additional news regarding an old ceramics room being turned into
a barbering unit which will be ready in September. It will be the
first program at Nassau BOCES that will allow Twilight students
to do a CTE program in the afternoon and early evening. Ms.
Hynes mentioned Uniondale is also interested.
Ms. Langsner stated, “based on what was stated about eliminating
program coordinators earlier,” will the administrator to staff ratio
remain the same? Dr. Theodorou stated it would remain the same,

but the program would no longer be linked to the Principal at
Barry Tech.
Ms. Langsner stated it appears that the ratio is considerably more
favorable at GC Tech and LISHA than it is at Barry Tech. Dr.
Theodorou said yes but they are proposing to backfill the assistant
principal position in the 2022/2023 school year. Dr. Theodorou
clarified that they must fill a position vacated by the assistant
principal who was transferred to GC Tech.
Mr. Schultz asked how many students do you anticipate going
from Barry Tech to the art programs at LISHA? Dr. Theodorou
responded that this year one animation program will transition
from GC Tech over to LIHSA and there are about eight students
merging with other classes that already exist at LIHSA, so they
are not new. For Barry Tech, plans are to move game design over.
Audio production and video production will move within the next
two years. She discussed infrastructure and teacher assignments
and phasing in so students who start programs at Barry Tech
would complete the programs at Barry Tech.
Mr. Schultz stated his concern is transportation because LIHSA
does not have a lot of space for buses. Dr. Theodorou explained
that there will be an increase in enrollments and more districts are
now sending and arranging for transportation. The bus flow goes
from back to front in a well-organized manner and runs smoothly.
She does not foresee a problem with space.
President Bergtraum asked if there are students leaving Barry
Tech would that free up room for other programs or increase
enrollment in the programs that exist? Dr. Theodorou stated yes
there have been years when Barry Tech has maxed out their
physical space. A committee would be formed to explore what
potential new programs could be opened at Barry Tech once there
is space to do so or expand some of the more popular programs.
This will be explored over this coming year and then the following
fall when the move is made, the space will be available for new
programs.
President Bergtraum questioned the number of teachers reported
in the Twilight programs. Are they all teaching and/or are they
shared positions? Ms. Hynes stated yes and yes. Some teachers
teach two nights a week and others teach four. Some teach
multiple classes and some only teach one depending on their
certifications.
President Bergtraum thanked them both for the informative and
clear presentation.

a proposal from VHB Engineering, Surveying, Landscape Architecture and Geology, P.C. to
assist with the administration of the State Environmental Quality Review Act (SEQRA) for the
proposed transformer replacement at the Jerusalem Avenue School (Capital Project#8474). The
estimated fee for service is $2,000.00 in accordance with their Board-approved contract dated
June 27, 2019.

Mr. Schultz stated while reading several contracts he noticed language in contracts
that say they must comply not only with Nassau BOCES policies but with the policies
and laws regarding students’ right to privacy, etc. Mr. Schultz inquired what
mechanisms are in place to know when Nassau BOCES contractors enter into
agreements with subcontractors that these polices are maintained? Mr. Fierro stated
when Facilities hire prime contractors, they must provide Nassau BOCES with a list of
their subcontractors which are then vetted. If new or substitute subcontractors come in,
Nassau BOCES must be informed. Nassau BOCES’ construction managers and
architects will vet them to make certain the necessary requirements have been met.
Mr. Schultz also inquired about the contracts that supply technical services that are
used by teachers and students for internet projects, films and videos, etc. The prime
contracts have standard language regarding complying with Nassau BOCES policies
and the state and federal laws pertaining to students’ right to privacy. When these
contractors subcontract the services, what is in place to monitor them? Ms. Laverne
Mitchell, Associate Director, Curriculum, Instruction and Technology Department
stated typically those consultants hired for programs and student and professional
development do not subcontract. There is a clause in the consultant contract that
requires the vendor to list all consultants/organizations associated with them and they
are all vetted. Typically, the hired consultants do not subcontract out.
Mr. Schultz stated his concern is the contract gives them permission to subcontract
and would like that fact to be addressed with Nassau BOCES’ attorney, Ms. Sadowski.
Dr. Dillon stated that can be revisited.

WHEREAS, the Board of Cooperative Educational Services of Nassau County (“Nassau
BOCES”) has established a Retirement Contribution Reserve Fund (“Reserve”) under General
Municipal Law Section 6-r for the payment of all or any portion of the amount payable by the
Nassau BOCES to the New York State and Local Employees’ Retirement System (“ERS”); and
WHEREAS, Nassau BOCES has accumulated funds in the Reserve for the purpose of limiting
the impact of Employer Contribution Rates from ERS;
NOW, THEREFORE, BE IT RESOLVED, that the Board of Cooperative Educational Services
of Nassau County authorizes an expenditure of accumulated funds in the amount of
$1,128,535.29, from the Reserve to finance the cost of ERS Employer Contributions for the
period of April 1, 2021 through June 30, 2021.

WHEREAS, the Board of Cooperative Educational Services of Nassau County has adopted
Policy 9370.1 - Confidential Employees; and
WHEREAS, Policy 9370.1 - Confidential Employees provides for the payment of a differential in
an amount as recommended by the Nassau BOCES District Superintendent (hereinafter referred
to as the “Confidential Differential”); and
WHEREAS, upon recommendation of the Nassau BOCES District Superintendent, the
aforementioned Confidential Differential was established as $3,000.00 in the 2020-2021 school
year; and
NOW, THEREFORE, BE IT RESOLVED, that the Nassau BOCES Board, having adopted
Policy 9370.1 - Confidential Employees, accepts the recommendation of the Nassau BOCES
District Superintendent for the sum of $3,000.00 to be paid to those Confidential employees for
the 2021-2022 school year.

WHEREAS, the Board of Cooperative Educational Services of Nassau County
(hereinafter known as the “Board”) has adopted Policy 9370.1 - Confidential Employees; and

WHEREAS, Policy 9370.1 - Confidential Employees provides for the payment of a
differential in an amount as recommended by the Nassau BOCES District Superintendent
(hereinafter referred to as the “Confidential Differential”); and
WHEREAS, upon recommendation of the Nassau BOCES District Superintendent, the
aforementioned Confidential Differential is $3000 for the 2021-2022 school year, as established
by board resolution at the August 12, 2021 Board meeting; and
WHEREAS, upon recommendation of the Nassau BOCES District Superintendent, an
employee with the title “Principal Typist Clerk,” not previously designated as Confidential, will
be encumbering the “Confidential” role of providing clerical support to the Nassau BOCES
Attorney for Employee Relations and the Assistant Director of Human Resources, and should
therefore be considered for award of the aforementioned Confidential Differential effective
September 1, 2021; and
NOW, THEREFORE, BE IT RESOLVED, that the Board, having previously adopted
Policy 9370.1 - Confidential Employees, accepts the recommendation of the Nassau BOCES

October 19, 2011 whereby the Nassau BOCES Board values and supports participation in
research projects that will contribute to instructional best practice and requires final approval of
any research project; and
WHEREAS, the Graduate School of Education at Fordham University is requesting Nassau
BOCES' assistance in a research study related to using grade level team meetings to support
reading through the lens of disability, race and trauma; and
WHEREAS, the research study seeks to collect information from the student records and from
the teachers at the Jerusalem Avenue Elementary School; and
WHEREAS, the research study will be conducted by Shaundrika Langley-Grey, a Special
Education Principal, at Nassau BOCES' Jerusalem Avenue Elementary School and will consist of
(1) professional learning on teaching through the intersection of disability, race and trauma; (2)
the Renaissance STAR Reading Assessment outcomes; (3) teacher interviews and surveys; and
(4) class behavioral and reading data; and
WHEREAS, the Nassau BOCES Research Review Board has found this study to be exemplary
and promises to further knowledge and instruction in our educational programs; and
WHEREAS, the District Superintendent is recommending that the Nassau BOCES participate in
this research study; now therefore,

Ms. Langsner stated she was pleased to see the timeline for State Education
approval has diminished. Discussion ensued.
President Bergtraum then announced the following regarding the 2021-2022
Districtwide Safety Plan:
“Pursuant to Education Law section 2801-a and 8 NYCRR 155.17 (C)(3)
notice is given that a public hearing is being held at the meeting of
September 23, 2021 of the Nassau BOCES Board to solicit comments on
the Nassau BOCES Districtwide Safety Plan. The plan will be available to
the public for comment on Nassau BOCES’ website from August 13, 2021
through September 22, 2021. The plan will be adopted at the September 23,
2021 Board meeting.”
Mr. Greenstein asked what is the procedure for comments on the Districtwide
Safety Plan? Dr. Dillon stated comments are to be submitted to the District Clerk. If
there are comments noted on the website, they will be read in addition to those
submitted to the District Clerk at the meeting before the adoption of the 2021-2022
Districtwide Safety Plan. Discussion ensued.
SUPERINTENDENT'S
REPORT Dr. Dillon introduced Mr. Peter LaDuca, Executive Manager, Curriculum,
Instruction and Technology Department, to talk about what Nassau BOCES has
done regarding COVID regulations and additional plans.
Mr. LaDuca stated Nassau BOCES is in a good position regarding COVID
compliance. A substantial reopening plan was put into place last year and going
into the new school year minor adjustments have been made to the plan. The
new additions will center around social distancing, contact tracing and a
handful of other issues. Mr. LaDuca commended everyone involved. He stated
the leadership of Dr. Dillon, Dr. France, Mr. Widmer, Executive Directors and
the Principals in the buildings have been outstanding.
Mr. LaDuca stated the following additions to the reopening plan:
1. Instructional Buildings:
Follow the same procedures as last year, wear masks and six-feet
social distancing in those buildings as much as possible. When we
cannot social distance, maintain masking. Masking is now a very
controversial topic, but Nassau BOCES will continue to mask.
2. Non-Instructional Buildings:
Continue six-foot social distancing, wear mask and possibly utilize
hybrid model in administrative buildings.

3. In-Person Events:
Areas typically used for Conferences, limit capacity to 25 people.
Six-feet social distancing encouraged, wear a mask and no food at
meetings, but if necessary, pre-packaged and single serve.
4. Notifications of Positive Cases:
Notification of positive COVID cases will continue to be made
available to staff.
5. Quarantining Changes:
According to CDC: in classrooms - students go to three-feet social
distancing instead of six. Teachers still require six-feet social
distancing. Everyone else in the building must also be six feet apart.
Everyone must wear a mask. If Nassau BOCES decides to go to
three-feet social distancing and students are masked, we can take
advantage of that. This will be discussed internally.
Mr. LaDuca said the Agency will continue to encourage everyone to get
vaccinated. Nassau BOCES will not require individuals to be vaccinated.
Visitors to the building will be discouraged at this juncture. If visitors are
coming to the buildings, they must wear a mask and social distance six feet.
Mr. LaDuca suggested continuing to undertake a conservative approach versus
loosening up at this time due to the increase in COVID cases. Discussion
ensued.
Dr. Dillon introduced Mr. Fierro to speak about the Summer Building Tour.
Mr. Fierro stated the draft for the summer buildings tour is tentatively
scheduled to take place on Tuesday, August 31, 2021. He stated the visit will
include four locations: The Long Island High School of the Arts, Carmen Road
School, Rosemary Kennedy School and Jerusalem Avenue School. Participants
will view different projects that have been worked on all summer. Also listed in
the tour is a listing of some of Nassau BOCES’ other significant operational
projects being done at other locations. Mr. Fierro stated for each school visit
there is building information, plans, site plans and building data. The present
status of all capital projects and other operational projects is included. The tour
will conclude at Farber where a lunch meeting discussion will be held.
NEW
BUSINESS Mr. Weinick reported the Foundation had a brief meeting on July 27, 2021. He
stated the meeting focused primarily on how to get the word out about the
Foundation and what it does. It was decided Mr. Fierro will address the Cabinet
about the Foundation. Mr. Weinick shared he made a video this morning
welcoming back the staff for the new school year and noted in the address what the

Foundation is and does and its present need for new members. In addition, he
reported the Foundation will compose a letter detailing what it does to be placed in
all teachers’ folders. They further discussed locating a new venue to hold the
Foundation’s Gala on March 30, 2022. Crest Hollow Country Club has raised their
rates tremendously. Discussion ensued.
President Bergtraum reported the Policy Committee met and discussed the
following:
1. Vaping and Tobacco Use on Nassau BOCES Properties.
2. Acceptance of Gifts.
3. Donations.
4. Requests to Nassau BOCES.
5. Non-Discrimination Statement.
President Bergtraum further reported the next meeting will address the DASA
Policy, which is now called “Dignity for All.”
Mr. Widmer stated the good thing about reporting on the Policy Committee
meetings it brings to the forefront how frequently the committee meet, the number
of hours spent on policies, and the preparation (homework) required before
meetings. He then commended the Committee for their diligence.
Mr. Weinick stated he was happy to see under “New Business” the list of
committees the Board members serve on. He requested a section entitled “loose end
items” be added as a reminder of items still pending.
