    Chapter 2Definitions

    2.1 GeneralUnlessotherwiseexpresslystated,theabbreviations,terms,phrases,wordsandtheirderivationslistedbelow

    shall,forthepurposeofthisCode,beconstruedassetforthinthischapter.Wordsnotexplicitlydefinedshall

    havetheirordinarilyacceptedmeaningsasthecontextimpliesasprovidedinTheConciseOxfordDictionaryofCurrentEnglish,eighthedition,AllenR.E.,Ed.,OxfordUniversityPress,NewDelhi,1990;andChambersScienceandTechnologyDictionary,W&RChambers LtdandCambridgeUniversityPress,1988 (AlliedPublishers Ltd,Bombay,FifthReprint1992).

    ThetermsdefinedinthispartshallhaveageneralapplicabilitytotheentireCode.Otherthanthese,thereare

    other

    terminology

    and

    definitions

    provided

    in

    different

    parts,

    chapters

    and

    sections

    which

    shall

    be

    applicable

    onlytothatparticularpart,chapterorsectioninwhichtheyaredefined.Incaseofanyconflictorcontradiction

    betweenadefinitiongiveninthispartandthatinanyotherpart,chapterorsection,themeaningprovidedin

    thatpart,chapterorsectionshallgovernfortheinterpretationoftheprovisionsofthatparticularpart,chapter

    orsection.Ingeneral,definitionsgiven ina lower levelshalloverridethemeaningsofallupper levelsforthe

    interpretationoftheprovisionswithinthescopeofthatlowerlevel.

    2.2 DefinitionsofTermsThe terminology used in this Code are defined in this section. Irrelevance of gender, tense and number is

    implicitinthesedefinitionsandthroughouttheCode.Wordsinthemasculinegenderincludethefeminineand

    thefeminine

    the

    masculine.

    Verbs

    used

    in

    the

    present

    include

    the

    future.

    Words

    used

    in

    the

    singular

    include

    thepluralandthepluralthesingular.

    ACCESSORYUSE:Anyusesubordinatetothemajorusewhichisnormallyincidentaltothemajoruse.

    ALTERATION : Any change, addition ormodification in construction such as structural, dimensional, or any

    removalofanypartofabuildingoranychangetoorclosingofanyrequiredmeansof ingressoregressora

    changetothefixturesorequipmentoranychangeinlanduseoroccupancyoruse.

    APPROVED:ApprovedbytheAuthority.

    AUTHORIZED OFFICER : An officer appointed by the Government by notification in the Official Gazette to

    exerciseinanyareathefunctionsofanAuthorizedOfficer.

    AUTHORITY:The

    Authority

    which

    has

    been

    created

    by

    astatute

    and

    which,

    for

    the

    purpose

    of

    administering

    this Code or part thereof,may authorize a committee or anofficial to acton its behalf. (This definitionof

    AuthorityshallapplytoallappearancesoftheterminthisCodewrittenwithacapitalA).

    BUILDING:Anypermanentorsemipermanentstructurewhichisconstructedorerectedforhumanhabitation

    or storageor foranyotherpurposeand includes the foundation,plinth,walls, floors, roofs, chimneys, fixed

    platform,verandah,balcony,cornice,projections,extensions,annexesandanylandorspaceenclosedbywall

    adjacenttoit.Thetermbuildingwillalsoincludethesanitary,plumbing,HVAC,outdoordisplaystructure,signs

    andallotherbuildingserviceinstallationswhichareconstructedorerectedasanintegralpartofabuilding.

    BUILDINGLINE:Thelineuptowhichtheplinthofabuildingmaylawfullyextend.AlsoknownasSETBACKLINE.

    COMMITTEE : A Building Construction Committee constituted for any area in the prescribed manner, if

    necessary.

    CONVERSION:Thechangeinoccupancyorpremisestoanyoccupancyoruserequiringnewoccupancypermit.

    COVEREDAREA:Thegroundareaabovetheplinthlevelwhichiscoveredbyabuildingstructure.Thecovered

    area of a building shall exclude gardens, wells, uncovered water and swimming pool, fountains, drainage

    structures,boundarywall,gates,singlestoreyopenporch,uncovered staircase,watchman'scabin,detached

    pumphouse,electricalsubstations,garbagechutesandotherutilitystructures.

    DEVELOPMENT:Carryingoutconstructionofbuildings,engineering,miningorotheroperations in,oroveror

    under landorwater. Includesredevelopmentand layoutandsubdivisionofany land. 'Todevelop'andother

    grammaticalvariationsshallbeinterpretedaccordingly.

    DRAIN:Aconduitorchannelforconveyingwater,sewage,orotherwasteliquidforsubsequentdisposal.

    DRAINAGE:Thedisposalofanyliquidwithasystemmeantforthispurpose.

    ERECT,TO:Toerectanewbuildingorreerectanexistingbuildingortoconvertabuildingfromoneoccupancy

    toanother.AlsoknownasCONSTRUCT,TO.

    GOVERNMENT:ThegovernmentofthePeople'sRepublicofBangladesh.

    GRADE:Thelowestpointofelevationofthefinishedsurfaceoftheground,pavementorfootpathwithinthe

    areabetweenthebuildingandalinewhichisthepropertylineoraline1.5mfromthebuilding,whichever is

    nearerthebuilding.

    HEIGHTOFBUILDING:Theverticaldistancefromareferencedatumtothehighestpointofthecopingorthe

    parapetofaflatroofortothedeck lineofamansardroofortotheaverageheightofthehighestgableofa

    pitchedorwhippedroof.Thereferencedatumshallbetheelevationofthenearestfootpath,ortheelevation

    ofthenearestroadorstreetorpublicwayatitscentreline,whicheverishigher.

    HIGHRISEBUILDING:Anybuildingwhichismorethan6storeysor20mhigh.

    OCCUPANCYORUSEGROUP:Thepurposeforwhichabuildingorapartthereofisusedorintendedtobeused.

    OCCUPANCY,MAJOR:Themajororprincipaloccupancyofabuildingorapartthereofwhichhasattachedtoit

    subsidiaryoccupancyoroccupanciescontingentuponit.

    OCCUPIER :Apersonpayingor liabletopayrentoranyportionofrentofabuilding inrespectofwhichthe

    ward isused, or compensation or premium on accountofoccupation of suchbuilding and also a rentfree

    tenant.Doesnotincludealodgerandthewords'occupancy'and'occupation'donotrefertothelodger.Insuch

    cases theownerhimselforherself is living inhisorherownbuilding,heor she shallbedeemed tobe the

    occupierthereof.

    OWNER,OFABUILDING:Theperson,organizationoragencyatwhoseexpensesthebuildingisconstructedor

    whohas

    the

    right

    to

    transfer

    the

    same

    and

    includes

    his

    or

    her

    heirs,

    assignees

    and

    legal

    representatives,

    and

    a

    mortgageeinpossession.

    PERMIT:AwrittendocumentorcertificateissuedbytheAuthorityforcarryingoutaspecificactivityunderthe

    provisionsofthisCode.

    PLINTHAREA:Areaofabuildingmeasuredattheplinthlevel.

    PLOT:SeeSITE.

    PUBLICWAY:SeeROAD.

    ROOMHEIGHT:Theclearheadroombetweenthefinishedfloorsurfaceandthefinishedceilingsurfaceorthe

    undersideofthejoistsorbeams,whicheverislower.

    SANCTIONEDPLAN:Thesetofplans,designandspecificationsofabuildingsubmittedtotheAuthorityasper

    provisionofthisCodeanddulyapprovedandsanctionedbytheAuthority.

    SERVICEROAD:Aroadorlaneprovidedattherearorsideofaplotforservicepurposes.

    SETBACKLINE:SeeBUILDINGLINE.

    SITE :Apieceorparcelof landonwhichabuilding is intended tobeorhasalreadybeenconstructed.Also

    knownasPLOT.

    SPECIALIST

    :

    A

    professional

    who

    by

    education,

    research,

    practice

    and

    experience

    specializes

    in

    a

    particular

    branchofabroaderdisciplineandisgenerallyjudgedtobesobytheprofessionalsintherelevantdiscipline.

    STOREY:Thatportionofabuilding includedbetweentheuppersurfaceofanyfloorandtheuppersurfaceof

    thefloorabove,exceptthatthetopmoststoreyshallbethatportionofabuildingincludedbetweentheupper

    surfaceofthetopmostfloorandtheceilingorroofabove.Ifthefinishedfloorleveldirectlyaboveausableor

    unusedunderfloorspaceismorethan1.8mabovethegrade,asdefinedherein,formorethan50percentof

    thetotalperimeteror ismorethan3.6mabovegradeatanypoint,suchusableorunusedunderfloorspace

    shallbeconsideredasastorey.

    STOREY,FIRST:Theloweststoreyinabuildingwhichqualifiesasastoreyasdefinedherein,exceptthatafloor

    levelinabuildinghavingonlyonefloorlevelshallbeclassifiedasafirststorey,providedsuchfloorlevelisnot

    orlackspropermeansofingressoregress,orwhichconstitutesahazardtolifeorproperty.
