    110 THE SITE Description: The site is an area of land which has

    been recently cleared of housing. The site adjoins aschool playground to the east of which it will form apart upon completion of the playing field construction.On the northern, western and southern sides the siteis bordered by local estate roads with housing locatedon the opposite side of the road. A new steel fenceforms the current boundary of the site.

    130 SITE CLEARANCE Works: Carried out under a separate contract and

    completed before the Date of Possession for this

    Contract. Description: Housing demolition and clearance.

    140 EXISTING MAINS AND SERVICES Drawings: (Information shown is indicative only): statu

    tory services drawings are available for inspection byappointment at 2020 Liverpool Offices.

    Other information: all mains and services entering thesite have been disconnected, however Contractorsmust satisfy themselves that the site is safe to carryout works by appropriate investigation/detectionmeasures.

    200 ACCESS TO THE SITE Description: Access to the site is from adjoining local

    road. Removal of two fencing panels plus theintermediate fence post from the boundary fence isrequired to create vehicular access to the site.

    Limitations: Adequate measures to secure theentrance point should be submitted to the CA forapproval. Measures should be taken to protect thefootway crossover from site traffic.

    220 USE OF THE SITE General: Do not use the site for any purpose other

    than carrying out the Works. Limitations: Do not use any areas of the school

    grounds other than that within the site boundary. Useof other areas of the school grounds may be availablefor use if required by pre-agreement with a schoolrepresentative with appropriate authority.

    230 SURROUNDING LAND/ BUILDING USES General: Adjacent or nearby uses or activities are as

    follows:- A school is located to the east of the site. Housinglies to the north, west and south.

    240 HEALTH AND SAFETY HAZARDS General: The nature and condition of the site/ building

    cannot be fully and certainly ascertained before it isopened up. However the following hazards are or maybe present:- contaminated land and underground structures.

    Information: The accuracy and sufficiency of thisinformation is not guaranteed by the Employer or theEmployer's representative. Ascertain if any additionalinformation is required to ensure the safety of allpersons and the Works.

    Site staff: Draw to the attention of all personnelworking on the site the nature of any possiblecontamination and the need to take appropriateprecautionary measures.

    250 SITE VISIT Before tendering: Ascertain the nature of the site,

    access thereto and all local conditions and restrictionslikely to affect the execution of the Works.

    JCLI AGREEMENT FOR LANDSCAPE WORKS The contract: JCLI Agreement for Landscape Works,

    February 2002 revision of 1998 Edition and includingSupplemental Conditions.

    Requirement: Allow for the obligations, liabilities andservices described therein against the followingheadings:

    THE RECITALS

    1st - WORKS, CONTRACT ADMINISTRATOR ANDCONTRACT DOCUMENTS

    The work comprises: excavation of existing surfaceand removal to licensed tip. Importing topsoil to makeup levels. Creation of new school playing fieldsincluding sub- surface land drainage. 1 years groundsmaintenace of completed works.

    Contract Administrator: See clause A10/140. Contract documents: The following have not been

    prepared and will be deleted from the recitals:- Bills of Quantities and schedule of rates.

    2nd - PRICED DOCUMENTS The references to Bills of Quantities and schedule of

    rates will be deleted.

    4th - QUANTITY SURVEYOR The 4th Recital will be deleted.

    5th - CDM REGULATIONS Alternative B1 will apply. Alternatives A, B2 and B3

    will be deleted.

    THE CONDITIONS

    2 - COMMENCEMENT AND COMPLETION

    2.1 - COMMENCEMENT AND COMPLETION The Works may be commenced three weeks from

    date of receipt of tenderand shall be completed by 11eeks aftercommencement.

    2.3 - DAMAGES FOR NON COMPLETION Damages for non completion (liquidated damages): At

    the rate of 443.84 per week or pro-rata theretobetween the aforesaid completion date and the dateof practical completion.

    2.5 - DEFECTS LIABILITY Defects liability period: 12 months.

    2.8A - PLANTS DEFECTS LIABILITY AND POSTPRACTICAL COMPLETION CARE BYCONTRACTOR

    Clause 2.8B will be deleted. Post Practical Completion defects liability periods will

    be:- Grass: 6 months.- Shrubs, ordinary nursery stock trees or other

    plants: 12 months.- Semimature advanced or extra large nursery stock

    trees: 2 years.

    2.9A - MALICIOUS DAMAGE OR THEFT (BEFOREPRACTICAL COMPLETION)

    Clause 2.9B will be deleted.

    3 - CONTROL OF THE WORKS

    3.6 - VARIATIONS Clause 3.6: Will be amended in accordance with the

    deletions in the 1st and 2nd Recitals.

    4 - PAYMENT

    4.1 - CORRECTION OF INCONSISTENCIES Clause 4.1 will be amended in accordance with the

    deletions in the 1st recital.

    4.2 - PROGRESS PAYMENTS AND RETENTION Progress payment: 95%.

    4.3 - PENULTIMATE CERTIFICATE Penultimate certificate percentage: 97.5%.

    occurrences arising out of one event, to be not lessthan: 1,000,000.

    6.3A - INSURANCE OF THE WORKS BYCONTRACTOR FIRE ETC.

    Clause 6.3B will be deleted. Clause 6.3A will apply. The insurance being for the full reinstatement value

    plus 20% to cover professional fees.

    110 SCOPE General: These conditions are supplementary to

    those stated in the Invitation to Tender and on theform of tender.

    145 TENDERING PROCEDURE General: In accordance with JCT Practice Note 6

    (Series 2) 'Main Contract Tendering'. Errors: Alternative 2 is to apply.

    160 EXCLUSIONS

    Inability to tender: Immediately inform if any parts ofthe work as defined in the tender documents cannotbe tendered.

    Relevant parts of the work: Define those parts, statingreasons for the inability to tender.

    170 ACCEPTANCE OF TENDER The Employer and Employer's representatives:

    - Offer no guarantee that any tender will berecommended for acceptance or be accepted.

    480 PROGRAMME Programme of work: Prepare a summary showing the

    sequence and timing of the principal parts of theWorks and periods for planning and design. Itemizeany work which is excluded.

    500 TENDER STAGE METHOD STATEMENTS Method statements: Prepare, describing how and

    when the following is to be carried out:- Proposals for removal of excavated ground fromsite; arrangement fornecessary on site surveys duringthe works;top soil and subsoil reinstatement.

    515 ALTERNATIVE TIME TENDERS General: In addition to and at the same time as

    tendering based upon the date or period specified insection A20, an alternative tender based upon adifferent date for completion or period may be

    submitted. Date for completion: If any such tender is accepted

    the date for completion inserted in the Contract will bethe date stated in the alternative tender or determinedfrom the period stated in the alternative tender.

    530 SUBSTITUTE PRODUCTS Details: If products of different manufacture to those

    specified are proposed, submit details with the tendergiving reasons for each proposed substitution.Substitutions, which have not been notified at tenderstage, may not be considered.

    Compliance: Substitutions accepted will be subject tothe verification requirements of clause A31/200.

    538 SUBSTITUTE PLANTS/ TREES Details: If plants/ trees differing from those specified

    are proposed, submit details with the tender givingreasons for each proposed substitution includingorigin and provenance. Substitutions, which have notbeen notified at tender stage, may not be considered.

    550 HEALTH AND SAFETY INFORMATION Content: Describe the organisation and resources to

    safeguard the health and safety of operatives,

    including those of subcontractors, and of any personwhom the Works may affect.

    Include:- A copy of the contractor's health and safety policy

    document, including risk assessment procedures.- Accident and sickness records for the past five

    years.- Records of previous Health and Safety Executive

    enforcement action.- Records of training and training policy.- The number and type of staff responsible for health

    and safety on this project with details of theirqualifications and duties.

    120 COMMUNICATION Definition: Includes advise, inform, submit, give

    notice, instruct, agree, confirm, seek or obtain

    information, consent or instructions, or makearrangements.

    Format: In writing to the person named in clauseA10/140 unless specified otherwise.

    Response: Do not proceed until response has beenreceived.

    130 PRODUCTS Definition: Materials, both manufactured and naturally

    160 TERMS USED IN SPECIFICATION Remove: Disconnect, dismantle as necessary and

    take out the designated products or work andassociated accessories, fastenings, supports, liningsand bedding materials. Dispose of unwanted

    materials. Excludes taking out and disposing ofassociated pipework, wiring, ductwork or otherservices.

    Fix: Unload, handle, store, place and fasten inposition including all labours and use of siteequipment.

    530 EXISTING TOPSOIL/ SUBSOIL Duty: Prevent over compaction of existing topsoil and
