    Determination of BillingDemand: The billing demand shall be the highest average kilowatt (kW) loadmeasured during the fifteen (15) consecutive minutes of maximum use; or75% of the highest maximum kW demand in the previous eleven (11)months; or fifty (50) kW, whichever is greatest.

    Power FactorAdjustment:

    For the purposes of this computation, the reactive power demand shall bethe highest average kilovar (kvar) load measured during the fifteen (15)consecutive minutes of maximum use during the billing month; the realpower demand (kW) will be the billing demand. When the ratio of the kvarto kW demands thus determined exceeds .33, a power factor correctioncharge shall be applied. This charge shall be $.43 per kvar for each kvarin excess of 33% of the kW billing demand.

    Contract Period: Not less than one year.

    Service supplied under this schedule is subject to the terms andconditions set forth in the Company's rules and regulations, and extensionpolicy on file with the Public Utilities Commission of the State of Colorado.

    For the purposes of this rate, service voltages of less than 4.16 kV line-to-line will be considered secondary voltage levels.

    If metering is at other than delivery voltage, the measured demand andenergy consumption will be increased or decreased by 1% to compensatefor transformer losses.

    A customer remaining on the Company's system for less than the contract

    period each year will only be required to pay customer and demandcharges incurred during the time the irrigation facility was connected to theCompany's system. However, if the customer requests a reconnection ofthe facility within one year of the disconnection date, said customer mustpay, prior to reconnection, all the customer and demand charges thatwould have been due had the facility never been disconnected.

    A new customer requesting the reconnection of a facility disconnectedbefore the current contract period expiration date must give the Companyevidence of a legally enforceable agreement demonstrating that the newcustomer is the rightful operator and/or user of the facility. If the Companydiscovers subterfuge on the part of present/previous customers of record

    1. The Company will own, maintain and operate all controlled arealighting equipment and service facilities. Line extensions to serve the arealight(s) must be made in accordance with Company's line extension policycurrently on file with the Public Utilities Commission.

    2. The Company will attempt, circumstances permitting, to service andmaintain the equipment within forty-eight (48) hours from the time the

    Company is notified of a maintenance requirement. The Companyassumes no responsibility for patrolling such equipment to determinewhen maintenance is needed.

    3. The Company will provide underground, ornamental, and other specialsystems for private thoroughfares when the additional installed cost inexcess of the construction allowance defined in the Company's extensionpolicy is paid by customer as a non-refundable contribution in aid ofconstruction. The Company will own, operate and maintain the specialfacilities.

    4. The customer will provide the Company, free of charge, the necessary

    permits, rights-of-way and excavation or paving cuts necessary forinstallation and operation of area lighting units.

    5. The customer must notify the Company if service is to be terminated. Ifservice is terminated, per customer request, before the two (2) yearcontract period elapses, the customer must pay the prorated balance ofthe contract amount. All or part of this payment requirement may bewaived by the Company if a successor, in effect, assumes paymentresponsibility for the predecessor's remaining contractual obligation bycontinuing private area lighting service under Street/Security Lighting RateSSL-1.

    1. Maintenance: The Company agrees to perform such maintenance as

    delineated below to restore any nonfunctioning street lights to anoperational state within forty-eight (48) hours after the discovery by eitherthe customer or Company that such facilities are no longer operatingproperly. However, it is the customer's responsibility to detect and reportfailures and malfunctions to the Company and, when such failures are dueto vandalism, mischief or a violation of traffic laws or other ordinances, toassist the Company in identifying the responsible party.

    a. Company Owned Equipment:The Company will operate and maintain all components ofCompany owned street lighting facilities.

    b. Customer Owned Equipment:(1) Type 1 - A type 1 installation consists of a customer ownedstreet lighting fixture of a type and design approved by theCompany. The luminare (including original lamp, photocell,ballast and glassware), the mounting bracket, the pole andfoundation are furnished and installed by the customeraccording to Company specifications and subject toCompany approval. The secondary wiring is provided,installed, owned and maintained by the Company.

    (2) Type 2 - A type 2 installation is the same as a type 1 withone exception: the secondary wiring is furnished, installed,

    owned and maintained by the customer.

    For both type 1 and type 2 installations, the Company will provideand install ordinary replacements of lamps, glassware andphotocells. Repair and replacement of all other elements ofcustomer owned units will be performed by the customer atcustomer expense.

    2. Special Systems: The Company will provide underground wiring,ornamental poles and other special systems in accordance with itsextension policy. The Company reserves the right to approve ordisapprove any special system so requested.

    3. Relocation of Fixtures: The Company will relocate a Company owned

    street lighting unit or replace the existing luminare with a luminare of thesame or lower lumen output on an existing pole or standard as directed bythe customer, the expense to be shared equally by Company andcustomer provided the unit has been installed eighteen (18) months ormore. The Company shall bear all the expenses for moving Companyowned street lighting units, installed more than eighteen (18) months,necessitated by change of grade, improving or widening of streets.

    4. Upgrade of Existing Fixtures: The Company shall, upon the request ofthe customer, upgrade existing street lighting units to provide higher levelsof illumination under the following conditions:

    a. The existing units must have been in place five (5) or more years.

    b. The Company shall replace, at its expense, existing Companyowned luminares and brackets with similar equipment providinghigher lumen ratings. The appropriate rates for the fixtures withhigher illumination will apply.

    c. The customer will reimburse the Company for the cost of anyrequested change or improvement other than that set forth in babove.

    5. Disconnection: When a customer requests that a street lighting unit be

    disconnected before five (5) years have elapsed since the date ofinstallation, the Company may require the customer to reimburse theCompany for the remaining life value of the street lighting facilitiesremoved plus the cost of removal less the salvage value thereof.

    Special Provisions: A. Residential Subdivision Street Lighting

    The Company will furnish, erect, operate and maintain all necessaryequipment in accordance with its standard specifications. It is theresponsibility of Home Builders Association or unincorporatedcommunities to pay monthly charges as per terms and conditions ofthe contract.

    In the event when Home Builders Association, unincorporatedcommunities or any other agencies dissolve, the customers related tothose lighting areas shall equally share the monthly charges asestablished as per terms and conditions of the contract.

    B. Cities, Municipalities and Governmental Agencies

    This B does not apply to individual homeowners, Home BuildersAssociations or any unincorporated agencies.

    Due to any reasons if cities, municipalities and governmental agenciesdecide to install street/security lighting to meet their specifications andnecessities, a special contract with the new rate will be issued by theCompany as dictated by franchise or special agreements. This shall atleast cover the cost necessary to provide energy and maintenance ofthe street/security lighting.

    Customers available under this rate have two (2) options. One optionis to convert MV to HPS and the other option is to stay with mercuryvapor lamps and continue with payment of the existing rate.

    The option of converting 175W Mercury Vapor (MV) to 100W HighPressure Sodium (HPS) would involve a one time conversion chargeand monthly payment rate for 100W HPS of $14.98 and 400W MV to250W HPS would involve a one time conversion charge and monthlypayment charge of $19.07.

    ENERGY COST ADJ USTMENTELECTRIC

    DEFINITIONS

    Test Period: The test period will be actual costs incurred during the period of March through Augustand September through February. The filing date for the March through August test period will beOctober 1 and for the September through February test period will be April 1. The recovery period willbe 30 days from the filing date and be effective for the next six months.

    Recovery Period: The billing months during which the Cost Adjustment Factor (CAF) for the previousTest Period is applied to retail customer billings on a per kilowatt-hour (kWh) basis.

    Costs: Costs eligible for Energy Cost Adjustment (ECA) will be the Companys total book costs for fuelconsumed in Company generating units, purchased power energy charges, transmission of electricityby others, and costs related to gas price volatility risk management. Costs do not include purchasedpower demand charges.

    Energy Sales Net Income: The net of Off-System Sales Revenue as recorded in FERC account 447and Fuel Off-System Other Production Expense as recorded in FERC account 547, Purchased PowerOff-System Sales Expense as recorded in FERC account 555, Off-System Transmission Expense asrecorded in FERC account 565, and Generation Dispatch & Marketing Bonuses as recorded in FERCaccount 926.

    Construction Savings Bonus (CSB): Pursuant to Commission Decision R10-102 in Docket No. 09A-415E, the portion of actual construction savings attributable to ratepayers. Once the final costs areknown and reviewable in a future proceeding, Black Hills shall recover its share of construction costsavings over a three-year period through the ECA.

    Incentive Sharing (IS): Determined on a calendar year basis, the previous calendar year Energy SalesNet Income shall be divided by two and included in the Companys semi-annual filing effective May 1stand November 1st each year. If the previous calendar year Energy Sales Net Income is negative, thenegative Energy Sales Net Income shall not be passed on to retail customers. If the previous calendaryear Energy Sales Net Income is positive, the positive Energy Sales Net Income shall be sharedannually with retail customers through the ECA as follows:
