I. Call to Order
Chair Jim Lane called the February 15, 2011, Roundtable meeting to order at 12:05 p.m., atthe St. Etienne Room, Armory Building, 602 Robert D. Ray Drive, Des Moines, IA.

V. (A.) Energy Effici ency and Conservation Bloc k Grant Fund Amendment
Mindy Moore explained the City of Des Moines received a grant last year that was to be used on Bike Month, trail maps, to provide League Cycling Instructor (LCI)training, and to host a Bike Rodeo. However, the LCI class and Bike Rodeo did notmaterialize, and the City of Des Moines would like to reallocate those grant funds to
be used for Bike Month 2011 and for bike education efforts. This amendmentrequires approval from the Roundtable.

Vern Willey asked about the amount of money in question. Ms. Moore responded that $4,000 is available for Bike Month and $3,650 is available for bike education.
Discussion ensued about where within Bike Month the funds would be used.
Discussion ensued regarding why LCI training and the Bike Rodeo never
materialized. Ms. Moore noted LCI training required a minimum of 10 persons,which they did not get, and the Bike Rodeo did not meet the grant requirements.
The Roundtable agreed with to allow the City of Des Moines to reallocate funds.Chair Lane directed MPO staff to draft a letter noting this approval.
V. (B.) Update Unified Bicycle Ordinance Draft
Ruth Randleman explained the MACs subcommittee revised the draft ordinance,and the MAC is asking for comments on the revised draft before taking the finalversion to the MAC in March. Ms. Randleman emphasized that each localgovernment, not the MAC, will need to adopt the ordinance.
Discussion ensued about the various changes made from the first draft.
Chair Lane asked whether a provision for a three-foot passing clearance should beadded. Ms. Randleman noted the MAC subcommittee did discuss this but left it outas it would be difficult to enforce.
Discussion ensued about ways the subcommittee tried to make the ordinance easy toenforce, which included the removal of specific measurements where applicable.
Discussion ensued regarding the section regarding motorized devices on trails.
Discussion ensued regarding provision for bike trailers. The roundtable suggested revising Section 16 of the draft ordinance to remove the phrase and shall not tow or be towed by another bicycle or vehicle.
Marco Alvarez asked if the Roundtable and other communities could have additionaltime for review of the draft ordinance.
Ms. Randleman asked for any comments to be made by the first part of March.
V. (C.) Letters of Support for the Partnership s Washin gton , D.C., Trip Projects
Chair Lane asked for any comments to the letter drafted by Lisa Hein in support of
continued Transportation Enhancement funds. No comments were provided.
Chair Lane and MPO staff announced a meeting with Congressman Boswell onFebruary 22, 2011, that will feature a discussion on transportation funding in the nextfiscal year.

V. (D.) Iowa Bicycle Summit
The Roundtable discussed highlights from the Iowa Bicycle Summit, held January28-29 in Des Moines.
Chair Lane noted he attended the Saturday events, which were good.
Discussion ensued about the congressional forum held on Friday of the event. The point made by the congressional staffers was that there is a ban on earmarks inCongress, but that local entities could keep providing projects in case any funds do
become available.
V. (E.) Bik e-Pedestr ian Project Updates
MPO staff asked for Roundtable participants to send any updates about trails thatwill be constructed over the summer. This will allow staff to update its trail gapsmap.
Stefanie Toftey suggested it would be beneficial to collect this information now,while communities are developing their Capital Improvement Plans, so that anychanges could still be made to those plans.
Chair Lane noted the Roundtable used to review these maps regularly, and he would like to see the Roundtable begin reviewing these maps again to understand what linksmight be missing.
Ms. Toftey noted that if there are any minor connections missing to transit facilities,DART may have funds that could be used to help make the connections.
VI. (A.) Trails Marketing MeetingChair Lane noted a trails marketing meeting is scheduled for February 18, 2011, atthe Greater Des Moines Partnership office. This meeting will feature Brian Leaderswith the National Parks Service and Mark Wyatt who will discuss a program todevelop tourism and marketing plans for Iowa trails.
VI. (B.) DART Bik e-and-Ride Counts
MPO staff reviewed the DART bike-and-ride counts for January. Staff noted countsfor CyRide were not available at the time of the agendas publishing.
VII. Other Items of Interest to the Roundtable
Loren Lown noted the US Department of Justice has released new Americans withDisabilities Act regulations that will allow persons with disabilities to use motorized mobility devices on trails with no limits on size or horsepower. Mr. Lown also noted the regulations make it difficult for trail managers to inquire about someonesdisability, potentially leading anyone to be able to use motorized vehicles, such asfour-wheelers or even automobiles, on trails.

Discussion ensued regarding the potential problems this new regulation could poseon trail managers. Chair Lane noted this will be an agenda item at the next meeting.
Ruth Randleman noted the Iowa Legislature is looking to cut funding for VisionIowa and Great Places, both of which have provided trail funding in the past.
VIII. Next MPO Roundtable Meeting Date
The next Roundtable meeting is scheduled for March 15, 2011, at noon.

V. (A.) Department of Justice Trail Usage Ruling
Discussion Item
The Central Iowa Bicycle-Pedestrian Roundtable:
At its February 2011 meeting, discussed the US Department of Justicesrecent ruling under the Americans with Disabilities Act (ADA) dealingwith the use of power-driven mobility devices on trails;
Notes the new regulation takes effect on March 15, 2011; Notes the new regulation permits persons with mobility disabilities to use
power-driven mobility devices on trails without restrictions on thedevices size or horsepower;
Notes the new regulation places limitations on a public entitys ability toinquire about ones disability status or need for a power-driven mobilitydevice;
Expressed concern that the new regulation could result in the use of four-wheelers or other all-terrain vehicles on trails by persons that do not
have a true disability; and, Noted that local governments with trails should review the new regulation
and be prepared for the changes that take effect on March 15, 2011.
The MPO staff:
Has shared this information MPO and the Central Iowa RegionalTransportation Planning Alliance;
Notes the organization American Trails held a webinar on February 23,2011, to provide additional information to trail managers;
Notes the Iowa Department of Transportation sent an email on February21, 2011, noting they are working to become more familiar with the new
regulation and will soon put together discussion items and possibleimplementation options for input; Will continue to update MPO member communities as new information
becomes available; Has included, immediately following, key sections of the new regulation
for the committees review; and, Notes some communities have expressed the need for local jurisdictions to
work together to develop uniform assessment metrics to ensure local provisions regarding power-driven mobility devices are consistent alongtrails that cross jurisdictional boundaries.

ADA Part 35 ( Title II)- NONDISCRIMINATION ON THE BASIS OFDISABILITY IN STATE AND LOCAL GOVERNMENT SERVICES
35.104 Definitions.
Other power-driven mobility device means any mobility device powered by batteries, fuel, or
other engines--whether or not designed primarily for use by individuals with mobility
disabilities--that is used by individuals with mobility disabilities for the purpose of locomotion,
including golf cars, electronic personal assistance mobility devices (EPAMDs), such as the
Segway PT, or any mobility device designed to operate in areas without defined pedestrian
routes, but that is not a wheelchair within the meaning of this section. This definition does not
apply to Federal wilderness areas; wheelchairs in such areas are defined in section 508(c)(2) of
the ADA, 42 U.S.C. 12207(c)(2).
Wheelchair means a manually-operated or power-driven device designed primarily for use by an
individual with a mobility disability for the main purpose of indoor or of both indoor and outdoor
locomotion. This definition does not apply to Federal wilderness areas; wheelchairs in such areas
are defined in section 508(c)(2) of the ADA, 42 U.S.C. 12207(c)(2).
35.130 General prohibitions against discrimination.
(h) A public entity may impose legitimate safety requirements necessary for the safe operation of its services, programs, or activities. However, the public entity must ensure that its safetyrequirements are based on actual risks, not on mere speculation, stereotypes, or generalizationsabout individuals with disabilities
35.137 Mobility devices.
(a) Use of wheelchairs and manually-powered mobility aids . A public entity shall permit
individuals with mobility disabilities to use wheelchairs and manually-powered mobility aids,
such as walkers, crutches, canes, braces, or other similar devices designed for use by individuals
with mobility disabilities in any areas open to pedestrian use.
(b)(1) Use of other power-driven mobility devices. A public entity shall make reasonable
modifications in its policies, practices, or procedures to permit the use of other power-driven

mobility devices by individuals with mobility disabilities, unless the public entity can
demonstrate that the class of other power-driven mobility devices cannot be operated in
accordance with legitimate safety requirements that the public entity has adopted pursuant to
35.130(h).
(2) Assessment factors . In determining whether a particular other power-driven mobility device
can be allowed in a specific facility as a reasonable modification under paragraph (b)(1) of this
section, a public entity shall consider--
(i) The type, size, weight, dimensions, and speed of the device;
(ii) The facilitys volume of pedestrian traffic (which may vary at different times of the day,
week, month, or year);
(iii) The facilitys design and operational characteristics (e.g., whether its service, program, or
activity is conducted indoors, its square footage, the density and placement of stationary devices,
and the availability of storage for the device, if requested by the user);
(iv) Whether legitimate safety requirements can be established to permit the safe operation of the
other power-driven mobility device in the specific facility; and
(v) Whether the use of the other power-driven mobility device creates a substantial risk of
serious harm to the immediate environment or natural or cultural resources, or poses a conflictwith Federal land management laws and regulations.
(c)(1) Inquiry about disability . A public entity shall not ask an individual using a wheelchair or
other power-driven mobility device questions about the nature and extent of the individuals
disability.
(2) Inquiry into use of other power-driven mobility device. A public entity may ask a person
using an other power-driven mobility device to provide a credible assurance that the mobility
device is required because of the persons disability. A public entity that permits the use of another power-driven mobility device by an individual with a mobility disability shall accept the
presentation of a valid, State-issued, disability parking placard or card, or other State-issued
proof of disability, as a credible assurance that the use of the other power-driven mobility device
is for the individuals mobility disability. In lieu of a valid, State-issued disability parking

placard or card, or State-issued proof of disability, a public entity shall accept as a credible
assurance a verbal representation, not contradicted by observable fact, that the other power-
driven mobility device is being used for a mobility disability. A "valid" disability placard or card
is one that is presented by the individual to whom it was issued and is otherwise in compliance
with the State of issuances requirements for disability placards or cards.

The Metropolitan Advisory Committee (MAC):
Has developed a draft Unified Bicycle Ordinance for metropolitancommunities to consider adopting;
Asked for comments on the revised draft by March 1, 2011; Reviewed and amended the ordinance, via a subcommittee, given
comments received by the March 1st deadline; Will present the final draft ordinance to the MAC at its April
meeting; and, Has provided, immediately following, the revised version of the
bike ordinance that will be provided to the MAC and to localcommunities for adoption.

Notes the MPOs Connect: Central Iowa Bicycle and PedestrianPlan Chapter 4, Action 1.3 states, Establish a process to updategovernments and agencies on new trail developments and connection to the state and regional trail system;
Notes the benchmark for Action 1.3 are the following:
1.3.1 Benchmark: Provide active project updatesroutinely to the Roundtable.
Has requested that MPO/CIRTPA member governments and agencies send updated GIS trail information to the MPO/CIRTPAstaff when projects are completed;
Requests that MPO/CIRTPA member governments and agenciescontact MPO/CIRTPA staff with any questions; and,
Notes that trail updates ensure that all trail information reflectscurrent activity in central Iowa and will allow local stakeholders totrack progress on connecting gaps and completing trails within theCentral Iowa Trail System.
