PORT BLAIR, APR 17/--/ Withother departments operating inthese islands, the top auditagency of the country has alsobrought the Building and OtherConstruction Workers’ WelfareBoard, Port Blair under its lineof fire. In its report tabled inParliament recently, the Comp-troller and Auditor General(CAG) of India took of a strongnote of the failure of the Build-ing and Other ConstructionWorkers’ Welfare Board,(BOCWWB) Port Blair, to applyfor exemption in compliancewith the Income Tax Act re-sulted in avoidable payment ofRs 34.68 lakh towards income
tax which would otherwise havebeen available for utilization onsocial welfare measures of theworkers and their families. Inits report, the audit agencystated Welfare Board(BOCWWB) was constituted inJanuary 2009 by the Andamanand Nicobar Administration inaccordance with Section 18 ofthe Building and other Con-struction Workers’ (Regulationof Employment and Conditionsof Service) Act, 1996. TheBOCWWB was established forthe welfare of building andother construction workersand hence satisfied the neces-sary conditions for income taxexemption under Section 10 (46)of the Income Tax Act, 1961.
Audit noticed that BOCWWBfailed to apply for exemption tothe income tax authorities andhence no notification forexemption had been issued bythe Central Government. In theabsence of a notification forexemption, tax deducted atsource of Rs 46.79 lakh wasdeducted by banks on interestearned on deposits kept withthem by BOCWWB betweenNovember 2013 and December2016. The Central Audit in itsreport said that BOCWWB filedan Income Tax Return (ITR) forthe Assessment Year 2015-16showing nil income and wasgiven a refund by the IncomeTax Department of the TDScollected by banks of Rs 12.11
lakh for that year. BOCWWBthus made an avoidable pay-ment of Rs 34.68 lakh towardsIncome Tax. The Board inFebruary last year stated thatan application for exemptionhas been submitted to theGovernment of India in view ofthe audit observation. “Thus,failure of BOCWWB to apply forexemption in compliance withthe provisions of the IncomeTax Act resulted in avoidablepayment of Rs 34.68 lakhtowards income tax. Had theexemption been obtained, thisamount would have becomeavailable for utilization onsocial welfare measures of theworkers and their families,” theCAG said.

Tomorrow, Swachh BharatParv will be observed across these islands, which as perthe direction of the government has achieved ODF statusbefore 31.01.2018. Under the GSA, all the Gram Panchayatsshall be celebrating Swachh Bharat Parv in the villages ,market area, schools and hospitals.
