Do you need to find a lawyer? A good lawyer? Welcome to this issue of AY that highlights the lawyers of the Arkansas Bar Association. During the last 11 months, as president of the Association, I have had the honor and privilege of serving the more than 5,000 members of the Association. As a first-hand witness, I can testify that the legal profession in the state of Arkansas is in hard-working, competent hands.

Now, back to the initial question. You can find a good lawyer at arkansasfindalawyer.com. This is the official database for the Bar Association. You can search by city, county, the kind of case you have

(area of practice), and the last name of an attorney. Many of the best lawyers in Arkansas can be contacted with a quick and convenient search.

You can also find a good lawyer during January and February at your local high school, coaching senior high students in the Association’s statewide Mock Trial Competition. Every senior high school in Arkansas has the opportunity to be involved. The competition involves a high school teacher coach; an attorney coach; students who act the roles of witnesses and attorneys; and parents who support the entire process. Attorneys and judges from each locale judge the competition. If you are interested in bringing this project to your local high school, check out arkbar.com.

You can also find a good lawyer on almost any day in your community working on a board of a nonprofit organization; volunteering at your local church or temple; volunteering at one of the schools in your city; or participating in the local sports programs in your town. This month, you can find good lawyers in Hot Springs attending the Arkansas Bar Association’s 111th Annual Meeting. Inspired by Thomas Friedman’s The World is Flat, we will learn and experience how globalization has affected, and will affect, the practice of law in Arkansas. Not only will the Association offer more than 90 hours of continuing legal education, the Annual Meeting is an opportunity to develop new and deepen friendships. This issue of AY includes comments from some of our 50-Year Members as they reflect upon previous Annual Meetings. They are all good lawyers.

GRIF SToCkLEY, AuTHoR, HIS-ToRIAN AND ATToRNEY, ExPERI-ENCED A WATERSHED MoMENT EARLY IN LIFE.

He grew up in Marianna, Ark., “one of the poorest counties in the united States,” during a racially turbulent time in history. “our senior class was told to put on a minstrel show. It’s embarrassing and shameful to think I was in a minstrel, making fun of African Americans,” Stockley said. He served as senior class president, however, admits that he didn’t challenge those in charge. “I look back on that as a time I didn’t speak up. I wouldn’t have been able to change the course, but I could have spoken up.”

Stockley graduated, attended what is now Rhodes College in Memphis, Tenn., and in 1965 joined the Peace Corps. While in the corps, he was part of a team that developed local projects on the northern coast of Columbia. In 1967, he was drafted into the Army where he served two years. He then attended law school at the university of Arkansas at Fayetteville.

“My time in Columbia was a transformational experience. While there I was confronted intellectually and emotionally by the poverty,” Stockley said. When he returned to the united States, he was once again confronted by the racial conflict of the ‘60s. “I felt it was important to contribute in some way to justice. I thought the best way to do that was through the law.”

years, worked at the Legal Aid Bureau of Pulaski County (now the Center for Arkansas Legal Services) representing individuals who otherwise may not have afforded legal representation. “I handled cases such as landlord-tenant disputes, cases involving used cars, juvenile courts, class action suits, constitutional matters and your garden variety representation of indigent clients. I found it to be very meaningful work.”

All along, Stockley wrote. “I started writing three or four years after I finished law school, but I didn’t get published for many years.”

Stockley used his experience and knowledge as an attorney to pen five hugely-popular novels – Expert Testimony, Probable

Cause, Religious Conviction, Illegal Motion and Blind Judgment. The novels’ main characters are attorney Gideon Page and his daughter Sarah. Page and Sarah enjoy a close-knit relationship similar to Stockley’s with his daughter Erin, a corporate lawyer who lives in Virginia. She has three daughters, ages 5, 3, and 1; and Stockley visits the family, which includes Erin’s husband Dan, often.

Stockley’s other five books deal with the

issue of race in Arkansas. They are: Blood In Their Eyes: The Elaine Race Massacres of 1919; Race Relations in the Natural State; Daisy Bates: Civil Rights Crusader from Arkansas; Salted With Fire; and Ruled by Race: Black/White Relations in Arkansas from Slavery to the Present.

In these books, Stockley explores Jim Crow and its implications and “the effects of white supremacy in Arkansas. We must come to terms with our racial past,” he said. In the Bates biography, he specifically explores what she went through. “We must look at this kind of history … we have to be honest about what race relations have cost us in Arkansas. So much has been written about 1957, when in

Stockley maintains his law license, but three years ago, he was hired by the Central Arkansas Library System as their first Dee Brown Fellow. This move granted him time to complete Ruled by Race. He said he is indebted to other historians as their work allowed him to make the book a comprehensive look at

race issues in the Natural State. “I’m most proud of this book because

of what I was willing to acknowledge as the course of race relations in Arkansas. It’s absolutely crucial to tell the truth.”

“I started the draft for Ruled by Race in the 1970s. I called it Race Relations in Arkansas: Thank God for Mississippi,” Stockley said, laughing. “Someone once said about writing ‘I write not to be understood, but to understand.’ Writing really does that for you, I think. It makes you think through, very carefully, what you believe and what you care about.”

The publication of Ruled by Race has opened many doors for Stockley. In the last two months, he has had an average of one or two speaking engagements weekly. The groups he speaks to include high school and college students, Bar Associations, Lyons Clubs and other civic groups.

“The more I speak, the more people read the book,” Stockley said. He recently spoke at the Arkansas Literary Festival and on the air on kABF. “The audience is growing; it’s gratifying to know African Americans are reading the book and recommending it to others. Many people want to know what prompted me, someone who [went along with the status quo], to become someone who speaks out,” Stockley said.

Stockley has also written two plays; the latest “Truth! Reconciliation?” was recently presented at The Weekend Theater in Little Rock.

As a litigator, Stockley defended the civil rights of individuals who otherwise may not have had a legal voice; some of his most meaningful cases involved youth.

“one of my toughest cases involved challenging the constitutionality of the juvenile system; it was Walker vs. Arkansas Department of Human Services. We didn’t really have judges who heard dependency and neglect cases involving youth. As a result of the case, the Legislature passed laws that created a system of juvenile justice that provided due process to youth and families,” Stockley said.

He feels it’s critical that society develop foster care and rehabilitation services that allow children to remain in their communities and succeed.

Stockley said he has not quit being a lawyer. “I’m no less busy now. I’m always thinking about the next book.”

JuDGE JIM HANNAH HAS SERVED THE PEoPLE oF ARkANSAS FoR MoRE THAN THREE DECADES; ini-tially as a juvenile judge, then as a chancery/probate judge in what is now the Circuit Court. In 2001, he joined the Arkansas Su-preme Court and now serves as the chief jus-tice.

Hannah graduated from high school in Harrison, Ark., and earned degrees in accounting and law from the university of Arkansas at Fayetteville. “I started out in college on an athletic scholarship. For a time, I wanted to play baseball professionally, then become a coach,” Hannah said. He contemplated a career in business, but soon became a husband and father. “I needed to do something to better support my family. My [then] father-in-law introduced me to the legal community. I saw it as a way to help others. I thought I’d do tax work, but because I worked in a small-town practice, the practice was very broad. That’s typical in small towns.”

Hannah later served as the Searcy City Attorney and also represented several other surrounding cities. As he served in these small towns, Hannah saw a flaw in the system: county judges presided over juvenile matters.

Fair, Just andApproachable

J “Children were treated like little adults. The courts did no more than mete out punishment, but they needed help with their problems,” Hannah said. He established the Juvenile Court in White County through a federal grant and served as the White County Juvenile Judge for two years. When Hannah

speaks of his work with youth, his passion is obvious. He serves on a number of committees including the u.S. Supreme Court Committee on Federal-State Jurisdiction — he was appointed by u.S. Supreme Court Chief Justice John G. Roberts — and the National Judicial Leadership Summit on the Protection of Children.

“I have a keen interest in children.” When Hannah’s children were young, he served as a coach for their various teams. “My wife Pat says I’m going to be a coach when I grow up,” he said, smiling. As a member of the kiwanis, Hannah serves as chairman of the organization’s Little League Basketball.

“I didn’t plan to run to be a judge,” Hannah said. “I didn’t have any aspirations to serve on the Supreme Court … I thought I could help and bring any talents I might have to the Court.”

Arkansas Supreme Court Chief Justice James R. Hannah has an enthusiasm for the law and the people for Arkansas and works daily to ensure justice is served for each of its citizens.

Hannah has also helped serve Arkansas youth during his tenure on the Arkansas Supreme Court. “Some of the toughest cases [judges] hear involve the termination of parental rights. Trial judges do a great job of hearing these cases,” Hannah said, explaining. Termination of parental rights’ cases go to the Court of Appeals; often two or three

years would elapse before the Court reviewed the cases. “This is a lifetime for a child. We looked at this through the eyes of the children, and that was simply intolerable. The Supreme Court was able to change and institute rules to expedite the appeals, reducing the time from 18 months to six to seven months.”

As one can imagine, Hannah has had several mentors during his 41-year career. He named just a few: Ed Lightle; Cecil Tedder; Charles Yingling, who served as a municipal judge; and dear friend Darrell Hickman, who also served on the Arkansas Supreme Court.

Hickman gave Hannah a word of advice he follows to this day: “Treat people with courtesy. Treat people with respect just as you would want to be treated, and treat everybody equally. People will respond positively when they are treated with respect.”

Hannah was elected to the chancery/probate court of the 17th Judicial District, which is now the Circuit Court, where he served for 22 years.

“I didn’t plan to run to be a judge,” he said. “I didn’t have any aspirations to serve on the Supreme Court … I thought I could help and bring any talents I might have to the Court.”

A typical workweek is about 80 hours long for the chief justice. “I think the judiciary has more of an impact on our lives than any other branch of government. We [judges] have a tremendous burden. I feel that when matters are presented, we must listen and do the very best we can. It’s important to be expeditious and to do our best.”

Hannah was just 23 when he began practicing law, thus he has observed many changes during his career. One is that judges were older and appeared to be unapproachable. One way in which Hannah and the other justices have begun to shatter this image is to travel the state, speaking with members of the Bar Associations and to students and faculty in law schools.

“It’s very important to explain what the Supreme Court does and what our role is. As we speak to [various associations] and civic groups, we’ve found that they have responded and have a better understanding of our role.”

Hannah’s wife Pat is an attorney; together they have five children — two of whom are attorneys — 11 grandchildren and one great grandchild.

“This ideal of the law and of justice sparked my interest … maybe I read too many Superman comics growing up. It was either law school or the Ringling Brothers,” Fox said, laughing. “I wasn’t limber enough for clown college.”

He earned his bachelor’s degree in political science from Hendrix university and his law degree from the university of Arkansas at Fayetteville.

“I feel lawyers are good for society. It’s quite clear that society has to have rules and mechanisms. A healthy judicial system is extremely important to society.”

Fox began his law career as a general practice lawyer which, he said, is typical of small law practices. “Every case presents a challenge due to the organization aspect of it or the subject of the case. I did a lot of work involving domestic cases, such as divorce and

T custody cases.” Fox has practiced law since 1981 and, for

a time, worked as the assistant for the north Little Rock city attorney. He is currently serving his second six-year term. He strongly favors Arkansas’ system of electing judges

and found his own election “a humbling experience. most people ask about traffic tickets,” he said, with a smile.

“When you run for an office, the public wants to know who you are, what you stand for and your philosophy,” he said. “I talked to

folks about my background, what the court does … and, of course, they still asked about traffic tickets.”

Fox pointed out that all cases involve conflict, and domestic cases involving minors can be tough. “But if lawyers do their job well,

As a circuit court judge, Fox said his case allocation involves roughly 25 percent domestic cases and 75 percent civil cases. Civil cases involve matters such as medical

malpractice, accidents and car wrecks. These cases involve juries; domestic cases do not.

“I enjoy working with juries,” Fox said. “The dynamic of these 12 individuals … it’s a different experience each time. Every four months, we call hundreds of people out of their daily lives and ask them to serve. The overwhelming majority step up to the plate. They understand that it is very important that [the judicial system] has their voices. In Arkansas, juries make the recommendations on punishment, so [our juries] are truly the voice of the community.”

The Judge Tim Fox I met is not the Judge Tim Fox the average juror or lawyer has met or will meet in the courtroom. This Judge Fox was relaxed, personable and humorous. “Folks who aren’t in court regularly assume I’m mad or stern. Everyone has a default face. mine is a scowl. A judge cannot allow anything to be read into [his facial expression] and cannot communicate nonverbally. You must be consistent. Everybody must be treated exactly the same. It’s up to the jury to make decisions and as a judge, you cannot weigh that decision with a question or an expression.”

“I think one of my strengths, to be frank, and not egotistical, is being able to make a decision. Sometimes, the best thing you can do for the litigants is make a decision, quickly, but with thought and fairness.”

As one can imagine, Fox has heard and hears the strange, comical and unspeakable, but he maintains his scowl. “At the end of this term, I still don’t think I’ll have heard it all. I’ll still have my scowl, and I’ll always maintain an open mind. Every day is a learning process. Yes, there are some days when you wish you could sandblast out everything you just learned …” Fox said, smiling.

given a do-over, Fox would become a judge earlier. “You need more practice to become the ‘best.’” His advice to lawyers aspiring to become a judge? Have a good work ethic. “The legal community and the community as a whole respect a good work ethic.”

If he weren’t a judge and could be financially sound, Fox would, perhaps, have been an actor. He loves mel Brooks movies; “Blazing Saddles” is one of his favorites. Another favorite is “Ironman.” As a Superman fan, he’s also a Justice League buff, as well.

Fox also earned a master’s degree in judicial studies and is the first judge in Arkansas to do so.

This list is excerpted from the 2009 edition of The Best Lawyers in America, the preeminent referral guide to the legal profession in the United states. Published since 1983, Best Lawyers lists attorneys in 80 specialties, representing all 50 states, who have been chosen through an exhaustive survey in which thousands of the nation’s top lawyers confidentially evaluate their professional peers. The 2009 edition of Best Lawyers is based on more than 2.2 million evaluations of lawyers by other lawyers.

The method used to compile Best Lawyers remains unchanged since the first edition was compiled more than 25 years ago. lawyers are chosen for inclusion based solely on the vote of their peers. listings cannot be bought, and no purchase is required to be included. in this regard, Best Lawyers remains the gold standard of reliability and integrity in lawyer ratings.

The nomination pool for the 2009 edition consisted of all lawyers whose names appeared in the previous edition of Best Lawyers, lawyers who were nominated since the previous survey, and new nominees solicited from listed attorneys. in general, lawyers were asked to vote only on nominees in their own specialty in their own jurisdiction. lawyers in closely related specialties were asked to vote across specialties, as were lawyers in smaller jurisdictions. Where specialties are national or international in nature, lawyers were asked to vote nationally as well as locally. Voting lawyers were also given an opportunity to offer more detailed comments on nominees. each year, half of the voting pool receives fax or email ballots; the other half is polled by phone.

Voting lawyers were provided this general guideline for determining if a nominee should be listed among “the best”: “if you had a close friend or relative who needed a real estate lawyer (for example), and you could not handle the case yourself, to whom would you refer them?” All votes and comments were solicited with a guarantee of confidentiality – a critical factor in the viability and validity of Best Lawyers® surveys. To ensure the rigor of the selection process, lawyers were urged to use only their highest standards when voting, and to evaluate each nominee based only on his or her individual merits. The additional comments were used to make more accurate comparisons between voting patterns and weight votes accordingly. Best Lawyers uses various methodological tools to identify and correct for anomalies in both the nomination and voting process.

Ultimately, of course, a lawyer’s inclusion is based on the subjective judgments of his or her fellow attorneys. While it is true that the lists may at times disproportionately reward visibility or popularity, the breadth of the survey, the candor of the respondents, and the sophistication of the polling methodology largely correct for any biases.

Perhaps the most memorable Arkansas Bar Association meeting for me was the first

one I attended in early June, 1957. Pres. John Kennedy, then a senator addressed the Bar Association at its annual meeting.

His speech was generally lighthearted and well constructed; his appearance, the delivery of his address and the energy he created was something else. This was a time when the word “celebrity” carried little meaning, but he was certainly that. He presented an aura of youth, vigor and a sense of the changing of the guard, the entry into leadership of a new generation. There was an air of gaiety about him and love of life and the world around him. In all, he had the look, appearance and projection of a winner.

Three years later, he was president, three years after that, he was dead — killed by an assassin’s bullet. The day of his death, I was a young lawyer working in Little Rock. I remember where I was when he was killed. To this day, his death is a scar on the nation’s psyche. We recovered, in time, as best we could, as we must in such circumstances. But we have our memories, those of us who shared this time with him, and remember him and his service to the nation fondly.

I joined the firm of Wright, Lindsey & Jennings LLP as an associate in October

1965. My wife Elaine and I attended the 1966 Annual Meeting at the firm’s expense. We were at the Vapors late one night, and Elaine wanted to order a shrimp cocktail. The price was $3.25. I told her that was too expensive, and she would have to find something else to eat. I am sure my future partners appreciated this gesture. Elaine did not. To this day, she has neither forgiven nor forgot. There are occasions when standing on principles are not worth the effort … this is one example.

Three of Arkansas’ legal heavy hitters share some of their most memorable moments in the court room.

Legal Legends Reminisce

Attorney H. Maurice Mitchell of Mitchell, Williams, Selig, Gates & Woodyard, P.L.L.C., has been a part of many significant pieces of legislation, including: The Discovery Act, which was enacted by the Arkansas Legislature in 1953. This act provided that parties to litigation could obtain information from other parties and witnesses by requiring depositions. It also provided that a party could send a request for admission, which would require another party to either admit the facts set forth in the request or deny them under oath. Prior to the enactment of this law, trials in Arkansas were referred to as being “trials by ambush.”

He also was a part of work that resulted in the enactment of Amendment 43 to the Arkansas Constitution, which became law in 1956. Prior to that time, the salaries of state judges had been subject to a constitutional limit of $5,000 per year. This amendment provided that the General Assembly shall determine the amount of the salary of state judges.

William H. Bowen served many years as a tax attorney and as chief of staff for former Gov. Bill Clinton. He also served as dean of

the University of Arkansas at Little Rock’s School of Law, which is now the William H. Bowen School of Law. The following is an excerpt from his book The Boy From Altheimer: From the Depression to the Boardroom.

[In 1954], I was employed to represent the Reuben

Bredlow estate. The decedent owned a large farm in Scott, Ark., and was found dead in his office with his head almost blown off. It was a day or two before duck season and his shotgun was just under his chin. The case involved a claim of double indemnity (for accidental death) against New York Life Insurance Company, which raised the defense of suicide. The insurance company argued that if you are found dead with a shotgun across your body; and you have been depressed; and the Bible is open on the desk to the 23rd Psalm, then it is suicide. I argued that his Bible was always open to the 23rd Psalm because it was his favorite passage; and that his gun was out because duck season was about to start, and he was an avid hunter. I told the jury that even if he had been depressed, he would not have taken his own life, because he was looking forward to duck season. I also argued that the strongest presumption of the law is that one would never take one’s own life, unless proven otherwise. After two days of trial, the jury held that the death was accidental …

Sam Laser, founder of Laser Law Firm shares the following: Several years ago, the late Edward Lester of Little Rock, Ark., a

fine lawyer, and I represented co-defendants, the manufacturer and retailer of a cow feed product, which allegedly caused the death of a large herd of cows. When the time came for Ed to make his closing argument, he handed me a scrap of paper with a note on it. He also opened a box of the cow feed and began eating it, while talking to the jury. The jurors were obviously fascinated by Ed’s tactic. Both of our clients were found not guilty of negligence in the manufacture of the alleged defective product. Ed’s note to me read: “Sam, in the event this stuff kills me, sue the bastards for Mary Ellen and Jimmy!”

I [once] tried a case in which I defended a young lady driver of an automobile that collided with a motorcycle, causing personal injuries to the plaintiff cyclist. The motorcycle was a large, red, powerful machine known as a “Ninja.” One of the perspective jurors was a young man about the age of my very attractive, shapely client. He owned the same make and model motorcycle as the plaintiff. At the first recess, the judge called me into chambers and inquired, “Sam, why did you leave that young man on the jury? He will probably be a leader against your client.” I responded, “Judge, did you notice how good-looking my client is? I have told her to work on that young man throughout the trial ... I predict after two days, he will fall in love with her!” The second day of trial, that young juror came into the courtroom dressed in a dark blue suit. My beautiful young client assured me that she had done as I suggested the first day … not only did the young juror vote for my client, but he came out as foreman of the jury, and I learned later, had led the campaign for the defendant’s verdict! The last word the judge spoke to me as we left the courtroom was: “Sam, you’re not nearly as smart as you think you are right now!”
