Schoolspiritismadeupofseveralthings.Itinvolvestreatingothers–fellowstudents,teachers,

Thisstatementofrightsisnotexpectedtocovereverysituationthatmayarise.Therightsofan
individualarepreservedonlybytheprotectionandpreservationoftherightsofothers.AllstudentsattendingLewis&ClarkSchoolDistricthavetherightto:

ACADEMICELIGIBILITY Lewis&ClarkPublicschoolswillhaveagradecheckupeveryweektodetermineifstudentsmeettheeligibilityrequirementofpassingallsubjectsinordertoperforminextra-curricularactivities.Duringthe1stand3rdquartersonly,thefirstgradecheckupwillbeafterthe2ndweekoftheterm.Eligibilitywillbedeterminedbycumulativegradesforthesemester.TheeligibilitylistwillbepublishedeachFridayandwillgointoeffectthefollowingMonday. Ifastudentisnotpassingallclasses,he/shewillnotbeallowedtoparticipateingames/contests.He/shewillalsonotbeallowedtoridetothegame/contestwiththeteam/group.Thestudentwillbeallowedtoattendpractices,however. ACTIVITYELIGIBILITY ThefollowingisacondensedlistofeligibilityrulescompiledbytheNorthDakotaHighSchoolActivitiesAssociationandtheLewis&ClarkSchoolDistrict.Thisappliestoallathleticandmusicalcompetitionorperformance,cheerleaders,andanyextra-curricularactivities.Intheareaofmusicalperformancewheretheperformanceispartofthelettergradeinmusic,studentswillbeallowedtoparticipateeveniftheyarenotmaintainingapassingaverageinalltheirsubjects.YOUARENOTELIGIBLE:ifyouhavenotbeeninclassesasmanydaysasyouhavemissedfromtheopeningofthesemester.ifyouenteredschoollaterthan10daysaftertheopeningofthesemester.ifyouhavecompetedinasportforfouryearsasahighschoolstudent.ifyoucompeteinasimilarathleticcontestonanout-of-schoolteamduringthesamesportsseasonorinpost-seasonathleticcontests.ifyouhavebeenenrolledinaninstitutionofhigherrankexceptasanacceleratedstudentcarryingadvancedworkinadditiontothreehighschoolsubjects.ifyoudidnotearncreditsinfoursubjectsduringtheprecedingsemester.ifyoudonotmaintainapassingaverageinallsubjectsincludingband,chorus,andphysicaleducationduringthepresentsemester.ifyouhavegraduatedfroma4-yearhighschoolorequivalent.ifyouhaveacceptedawardsotherthanthosehavingsymbolicvalueandcostingmorethantendollars.ifyouaretwentyyearsofageorolder.ifyouarenotanamateurorifyouhavecompetedunderanassumedname.ifyouhavetransferredfromanotherschoolwithoutcorrespondingchangeofresidencebyyourparents.ifyouareinyourninthsemesterofattendanceandhavereachedyoureighteenthbirthday.ifyouareinyoureighthsemesterofattendanceandyourseventhandeighthsemestersarenotconsecutive.Studentsmustmeettheeligibilityrequirementsofpassingallsubjectsinordertoparticipateinactivities.YOUARENOTELIGIBLE:ifyoudonothaveadoctor’scertificateofphysicalfitness(physical)issuedafterApril15priortothestartoftheschoolyear.ifyouhaveparticipatedinanypost-seasoninterscholasticfootball,basketball,hockey,gymnasticsorwrestlingcontest.ifyouuseorhaveinyourpossessiontobacco,alcohol,orillegaldrugs.*

*Theuseorpossessionoftobacco,alcoholoranycontrolledsubstanceasdefinedbytheNorthDakotaCenturyCodeisprohibited.Anyextracurricularparticipantwhoisinviolationoftheforegoingshallbesuspendedfromparticipationininterscholasticcontestsoractivitiesforaminimumperiodofsixconsecutiveschoolweeksforthefirstoffenseandaperiodofeighteenconsecutiveschoolweeksforanysubsequentoffense.Theperiodofsuspensionshallbeginfromthedateandtimenotificationisgiventothestudentbytheschooladministration.Presenceatagatheringwherealcohol,tobacco,oracontrolledsubstanceisbeingusedwillberegardedaspossession.Theadministrationwilltakeintoconsiderationwhetherthestudentwasatagatheringwherethestudenthadknowledgethatalcohol,tobaccoorcontrolledsubstancewerepresent,andwhetherornotthestudenthadareasonableopportunitytoremovehimselforherselffromsaidlocation. Anystudentinviolationofthetobacco,alcohol,orcontrolledsubstancepolicywillforfeiteligibilitytoletterorreceivepost-seasonindividualawards.ATTENDANCE&ABSENCESNorthDakotalawcontainscompulsoryattendancerequirementsforstudentsagesseventhroughsixteen.Inordertocomplywithandenforcetheserequirements,theBoardestablishesthefollowingattendancepolicy.DefinitionsForthepurposeofcompulsoryattendancereportingunderNDCC15.1-20-02.1(1-2):
ExcusedabsenceisanabsencethattheDistrictwillnotuseindeterminingifacompulsoryattendanceviolationoccurred.Anyabsencemaybeexcusedifitissupportedbyeitheraverbalorwrittenexcusesuppliedbythestudent’sparent,teacher,orschooladministrator.
Unexcusedabsenceisanyabsencenotsupportedbytheverbalorwrittenexcuserequiredforanexcusedabsence.AccumulatedUnapprovedAbsence(Disciplinarysanctions):TheBoardbelievesthatunapprovedabsencesareaformofmisconductandauthorizestheSuperintendenttoestablishgrade-appropriatedisciplinaryconsequences.StudentswillbeaffordedappropriatedueprocessrightsbasedontheseverityofthedisciplinarypenaltythattheDistrictisconsideringimposing.Studentsshallberequiredtocompletemake-upworkinaccordancewithadministrativeregulationsorwillreceivenocreditforincompletework. CompulsoryAttendanceViolationsNorthDakotalawdefineswhatconstitutesacompulsoryattendanceviolation.Suspectedviolationsofthecompulsoryattendancelawshallbereportedtoschooladministrationandinvestigatedinaccordancewithlaw.Whenacompulsoryattendanceviolationissubstantiated,theDistrictshallcomplywithlawenforcementreportingrequirementsunderlaw.ProceduretoFollowasaResultofAbsenceParentsshouldcalltheofficebetween8:00and8:30a.m.toinformtheprincipalorsecretarywhythestudentisorwillbeabsent.Ifthestudent’sabsenceisknowninadvance,parentsareaskedtocalltheofficethedaybeforetheknownabsence.TheprimaryphonenumberinPowerSchoolwillbecontactedat9:00A.M.ifyourstudentisnotinschool.Itistheresponsibilityofthestudenttomakeupthework.Missedworkmustbecompletedandturnedintotheteacherinalengthoftimedecideduponbytheteacherandthestudent.Ifstudentsareabsentfor½dayorless,theymayberequiredtotakethemake-upexamduringtheirnextfreeperiodupontheirreturntoschool.

Inordertoparticipateinpracticeorperformancesforextra-curricularactivities,thestudentsmustbeinattendanceatleast½day.Doctorordentistappointmentsorotherextenuatingreasonsmaybetreatedasspecialcircumstancesandwillbedealtwithonanindividualbasis.Inthatinstance,parentsneedtocalltheprincipal.BULLETINSANDANNOUNCEMENTS

DescriptorCode:ACEABULLYINGPOLICY
DefinitionsForthepurposesofthispolicy:• Bullying isdefinedasconductprescribed inNDCC15.1-19-17. TheSuperintendentshouldplacethis
definition, in its entirety, in student and staff handbooks and should develop guidelines to assiststudentsandstaffwithidentifyingthisconduct.
• Protectedstatusareclassifications/characteristicsprotectedfromdiscriminationbyNDCC14-02.4-01andfederallaw.Thefollowingstatusesareprotected:race,color,religion, sex, national origin, age, disability(physicalormental),andstatuswithregardtomarriageorpublicassistance.
• Schoolpropertyorthetermon-campusreferstoallpropertyownedorleasedbytheDistrict,schoolbusesandothervehicles,oranyschooldistrictsponsoredorschool-sanctionedactivity.
• School-sanctionedactivityisdefinedasanactivitythat:a. Isnotpartofthedistrict’scurricularorextracurricularprogram;andb. Isestablishedbyasponsortoserveintheabsenceofadistrictprogram;andc. Receivesdistrictsupportinmultipleways(i.e.,notschoolfacilityusealone);andd. Sponsorsoftheactivityhaveagreedtocomplywiththispolicy;ande. TheDistricthasofficiallyrecognizedthroughboardactionasaschool-sanctionedactivity.
• School-sponsoredactivity isanactivity that theDistricthasapproved throughpolicyorotherboardactionforinclusioninthedistrict’sextracurricularprogramandiscontrolledandfundedprimarilybytheDistrict.
• School staff include all employees of the Lewis and Clark Public School, school volunteers, andsponsorsofschool-sanctionedactivities.
• Truethreatisastatementthat,inlightofthecircumstances,areasonablepersonwouldperceiveasaseriousexpressionofanintenttoinflictharm.
ProhibitionsWhileatapublicschool,onschooldistrictpremises,inadistrict-ownedorleasedschoolbusorschoolvehicle,oratanypublicschoolorschooldistrictsanctionedorsponsoredactivityorevent,astudent[staffmemberorschoolvolunteer]maynot:1. Engageinbullying;2. Engageinreprisalorretaliationagainst:

ReportingProceduresforAllegedPolicyViolations1. Reportingrequirementsforschoolstaff: Anyschoolstaffmemberwithknowledgeorsuspicionofa
violationofthispolicyorwhohasreceivedanoralorwrittenreportofaviolationofthispolicyfromastudent,communitymember,oranonymouslyshallcontactthebuildingprincipal to informhim/herassoonaspossible.Iftheallegedviolationimplicatesthebuildingprincipal,theschoolstaffmembershallreportittotheSuperintendent.IftheallegedviolationimplicatestheSuperintendent,theschoolstaffmembershallfileitwiththeBoardPresident.
Shouldschooladministrationdeterminethataschoolstaffmemberknewoforsuspectedaviolationofthispolicyandfailedtoreportitinaccordancewiththeprocedureabove,thestaffmembermaybesubjecttodisciplinaryconsequencesor,forsponsorsofschool-sanctionedactivities,othercorrectivemeasures.
2. Reporting options for students and community members: Students and community members(includingparents)mayreportknownorsuspectedviolationsofthispolicyusinganyofthefollowingmethods:a. Completingawrittencomplaintform.Acomplainantwillhavetheoptionofincludinghis/her
nameon this formor filing it anonymously. TheDistrictwill place the form ina varietyoflocationsthroughouttheschoolandshouldinformstudentsandstaffoftheselocations.Theformmaybereturnedtoanyschoolstaffmember,filedinaschoolbuilding’smainoffice,orplacedinadesignateddropboxlocatedineachschool.
b. Complete and submit an online complaint form. A complainant will have the option ofincludinghis/hernameontheformorsubmittingitanonymously.
c. Fileanoralreportwithanyschoolstaffmember.
A complaint filed anonymously may limit the district’s ability to investigate and respond to the allegedviolations.
ReportingtoLawEnforcement&OthersFormsofRedressAnytimeaschoolstaffmemberhasreasonablesuspicionthatabullyingincidentconstitutedacrime,s/heshallreport it to law enforcement. Also, nothing in this policy shall prevent a victim/his/her family from seekingredressunderstateandfederallaw.
Documentation&RetentionTheDistrictshalldevelopaformtoreportallegedviolationsofthispolicy.Theformshouldbecompletedbyschoolstaffwhenthey:1. Initiateareportofanallegedviolationofthispolicy;or2. Receiveanoralreportofanallegedviolationofthispolicy.
Theformshouldbecompletedbyanadministratorwhens/he:1. Initiatesareportofanallegedviolationofthispolicy;or2. Receivesanoralreportofanallegedviolationofthispolicy.

All written reports of an alleged violation of this policy received by the District shall be forwarded to theappropriateschooladministratorforinvestigationandretention.
Reportformsandallotherdocumentationrelatedtoaninvestigationofanallegedviolationofthispolicyshallbe retainedby theDistrict forsixyearsafterastudent turns18orgraduates fromhighschool,whichever islater.IfastudentdoesnotgraduatefromtheDistrict,suchreportsandinvestigationmaterialshallberetainedforsixyearsafterthestudentturns18.
InvestigationProceduresSchool administrators (i.e., a principal, an assistant superintendent, or the Superintendent) are required toinvestigateviolationsofthispolicy(asprescribedunder“Prohibitions”),wheninreceiptofactualnoticeofanallegedviolation.Actualnoticeofanallegedviolationoccurswhenallegedbullying,reprisal,retaliation,orfalsereportingisreportedusingtheapplicablemethod(s)prescribedinthereportingsectionofthispolicy.Uponreceiptofareportofanallegedpolicyviolation,thedesignatedadministratorshallfirstdetermineifthealleged policy violation is based on a protected status—whether actual or perceived. Reports involving aprotected status shall be investigated in accordance with the district’s harassment/ discrimination policy,includingthetimelinescontainedtherein.Inallothercases,administrationshalldeterminethelevelofinvestigationnecessarybasedonthenatureoftheallegedviolationofthispolicyafterconsideringfactorssuchas,butnotlimitedto:theidentityofthereporterandhis/herrelationshiptothevictim/allegedperpetrator;theagesofthepartiesinvolved;thedetail,content,andcontextofthereport;whetherornotthisreportisthefirstofitstypefiledagainsttheallegedperpetrator.Basedonthelevelofinvestigationtheadministratordeemsnecessary,investigationsmayincludeanyorallofthefollowingstepsoranyotherinvestigatorystepsthattheadministratordeemsnecessary:1. Identification and collection of necessary and obtainable physical evidence (NOTE: In some cases
physicalevidencemaybeunobtainable,e.g.,aprivatesocialnetworkingprofile).
2. Interviewswith the complainant, the victim, and/or the alleged perpetrator. At no time during aninvestigation under this policy shall the victim/ complainant be required to meet with the allegedperpetrator.
3. Interviewswithanyidentifiedwitnesses.
4. Areviewofanymitigatingorextenuatingcircumstances.
5. Final analysis and issuance of findings in writing to the victim and bully and, if applicable,implementation of victim protection measures and disciplinary measures under this or otherapplicablepolicies.
Investigationsshallbecompletedwithin60daysunlesstheadministratordocumentsgoodcauseforextendingthis deadline. Such documentation should be sent to the victim and alleged perpetrator during theinvestigation.
Disciplinary&CorrectiveMeasuresStudentswhotheDistricthasfoundtohaveviolatedthispolicyshallbesubjecttodisciplinaryconsequencesand/or corrective measures. When determining the appropriate response to violations of this policy,administrationshalltakeintoaccountthetotalityofcircumstancessurroundingtheviolation. Measuresthatmaybeimposedinclude,butarenotlimitedto:1. Requirethestudenttoattenddetention;2. Imposein-orout-of-schoolsuspensionorrecommendexpulsion.Dueprocessprocedurescontained
inthedistrict’ssuspensionandexpulsionpolicyshallbefollowed;

3. Recommendalternativeplacement. ThisrecommendationshallbesubmittedtotheSuperintendentforapprovalordenial. TheSuperintendentmayapprovesuchrecommendationsonly if thestudenthasbeengivennoticeofthechargesagainsthim/herandanopportunitytorespond;
4. Createabehavioraladjustmentplan;5. Referthestudenttoaschoolcounselor;6. Holdaconferencewiththestudent’sparent/guardianandclassroomteacher(s),andotherapplicable
schoolstaff;7. Modify the perpetrator’s schedule and take other appropriate measures (e.g., moving locker) to
minimizecontactwiththevictim;8. Ifapplicable,contacttheadministratorofthewebsiteonwhichthebullyingoccurredtoreportit.
If themisconductdoesnotmeet thispolicy’sdefinitionofbullying, itmaybeaddressedunderotherdistrictdisciplinarypolicies.
Forbullyinginitiatedoffcampusandreceivedoncampus(e.g.cyberbullying),theDistrictonlyhasauthoritytoimposedisciplinarymeasures if thebullying substantially disrupted the educational environment or posed atruethreat.Inallothercasesofoff-campusbullyingreceivedoncampus,theDistrictmayonlytakecorrectivemeasuresasdescribedinitemsfivethrougheightabove.
Iftheperpetratorisaschoolstaffmember,theDistrictshalltakeappropriatedisciplinaryactionincluding,butnot limited to: a reprimand, modification of duties (only if allowed by applicable policy, the negotiatedagreement, and/or the individual’s contract), suspension,or a recommendation for termination/discharge inaccordancewithanyapplicablelaw.
VictimProtectionStrategiesWhentheDistrictconfirmsthataviolationofthispolicyhasoccurred,itshouldnotifythevictim’sparentsandshallimplementvictimprotectionstrategies.Thesestrategiesshallbedevelopedonacase-by-casebasisafteradministration has reviewed the totality of the circumstances surrounding the bullying incident(s) or otherviolationsofthispolicy.Strategiesmayinclude,butnotbelimitedto,thefollowing:1. Additional training for all students and applicable staff on implementation of this policy and/or
bullyingprevention.2. Noticetothevictim’steachersandotherstafftomonitorthevictimandhis/herinteractionwithpeers

Lice:Headlicearetobeconsideredhighlycommunicableandnottobeassociatedwithfilth,poorhygiene,orsocioeconomicstatus.Headlicecanbehighlycontagiousandcanbetransmittedfrompersonto

personthroughclosepersonalcontact,sharingofheadgear,and/orsharingoffurniture/bedding.Whenacaseofheadliceissuspected/reported,schoolpersonnelwillfollowtherecommendationoftheNorthDakotaStateDepartmentofHealthregardingcontroloftheschoolenvironmenttopreventthespreadofheadlice.Staffmembersshallbetrainedtoinspectandre-inspectstudentsforliceandnits.Publichealthpersonnelandtrainedvolunteersmayalsobeusedasneededandavailable.
Whenacaseofheadliceisidentified,allclassmates,siblingsinschool,andallchildrenridingthesamebusmaybeexamined.Whenliceornits(eggs)aredetected,thestudent’sparent/guardianshallbecontactedimmediatelyandthestudentshallbesenthomeassoonaspracticablewithinstructionsfortreatment.Thestudentwillbere-examineduponreturnandwillnotreadmitteduntilfreeofbothliceandnits.Absenceswillbecountedasexcused.
Ifacaseofheadliceisdiscoveredinaparticularclassroom,theschoolwillsendhomealettertoinformtheparents/guardiansoftheirchild’sexposure.Safetyprecautionsandpropercleaningprocedureswillbetakenatschooltopreventre-infestationorthespreadofinfestation.
Parentsareencouragedtoreportcases,ifdiscoveredinthehome,inordertopreventapossibleoutbreakinschool.Itisthepolicyofthisschooldistricttoreportinfestationsofheadlicetopublichealth.
COMPLAINTS
IfstudentsfeeltheyhavebeenwrongedorareupsetoversomeaspectoftheirexperiencesatLewis&Clark,theyareexpectedtoexpressthemselvesinanappropriatemanner.Ifstudent-studentproblemsoccur,anattemptatcivilresolutionbetweenthestudentsisasked.Ifthisisnotpossible,student(s)shouldseekcounselofateacher,counselororprincipal.Negativephysicalorverbalexchangesarenotappropriateinthissetting.Instudent/adultconflict,privateconsultationsshouldbeheldtoresolvedifferences.Ifthisdoesnotresultinsatisfactionthestudentistoexpresshim/herselfprivatelyintheprincipal’sorcounselor’soffice.CONSULTATIVEREVIEW

Any10th,11thor12thgradestudentwhoseadmissiontoacollegelevelcourseisrecommendedbyaCounselororPrincipalmayenrollinacourseatanyoftheeligibleinstitutionsforpostsecondarycredit.PermissionfromtheSuperintendentwillberequiredtoapplythecoursetowardHighSchoolgraduationrequirements.Inadditiontoallowingthestudenttoenrollincollegelevelcoursestaughtatpostsecondaryinstitutions,thisDistrictmayoffercoursesthatqualifyfordualcreditincooperationwitheligibleinstitutions.Studentsenrolledinthesecoursesmayapplytothepostsecondaryinstitutionsfordualcredit.Anycostassociatedwithreceivingcollegecreditshallbetheresponsibilityofthestudentenrolledinthiscollegecourse.

Moderntechnologyhasprovidedawealthofelectronicdevicesforentertainmentandpersonalcommunication.UseofdevicessuchasMP3players,cellphones,pagers,iPods,etc.,areprohibitedatschool.Allpersonalelectronicdevicesmustbekeptoffandoutofsightduringtheregularschooldayunless1)thesupervisingteachergrantspermission,2)useofthedeviceisprovidedforinastudent’sIEP,or3)itisusedinanemergencythatisthreateningthesafetyofstudents,staff,andotherindividuals.

TheLewisandClarkPublicSchoolbelievesInternetaccessplaysanimportantroleintheeducationofstudents;however, the Internet also contains content that is not appropriate for students and staff to access. Inaccordance with federal law, the District has taken reasonable precautions to restrict access to materialsobscene, pornographic, and/or harmful to minors through the use of software designed to block sitescontaininginappropriatematerial.WhiletheDistricthastakensuchpreventivemeasures,itrecognizesthatitisnotpossibletofullyguaranteethatstudentsand/orstaffwillneveraccessobjectionablematerials.
EducationTheDistrictshallprovideeducationtostudentsaboutappropriateonlinebehavior, including interactingwithotherindividualsonsocialnetworkingwebsitesandinchatrooms,andcyberbullyingawarenessandresponse.
MonitoringUseInternetaccessisaprivilege,notaright.Networkstorageareasshallbesubjecttothesamescrutinyasschoollockers for students. GeneralProhibitionsTheLewisandClarkPublicSchooliscommittedtomaintainingalearningandworkingenvironmentfreefromdiscrimination and harassment in all employment and educational programs, activities, and facilities. TheDistrict prohibits discrimination andharassment basedon a student and/or employee’s race, color, religion,sex,genderidentity,nationalorigin,ancestry,disability,age,orotherstatusprotectedbylaw.
It shall be a violation of this policy for any district student or employee to harass or discriminate againstanother district student or employee based on any status protected by law. The District will not tolerateharassment or discrimination of a district student or employee by a third party. Definitions• Complainant is the individual filing the complaint. When the complainant is not the victim of the

ComplaintFilingProcedureThe Board shall create an informal and formal harassment and discrimination complaint filing procedure inboard regulations. Nothing in this policy or in the harassment/discrimination grievance procedure shallpreventanindividualfrompursuingredressthroughstateand/orfederallaw.
ConfidentialityAnindividualwishingtofileananonymousharassmentand/ordiscriminationcomplaintshallbeadvisedthatconfidentialitywilllimitthedistrict’sabilitytofullyrespondtothecomplaintandthatretaliationisprohibited.

ProcessAny individual who believes that the Lewis and Clark Public School has violated the regulations or lawgoverning a Title program should submit a complaint to the Superintendent at P.O. Box 185, Berthold, ND58718 (453-3484). The Superintendent shall investigate the complaint and provide the individual with awrittenresponsewithin30days.
