Bysubmittingashortlengthnarrativeordocumentary(hereinafter“Film”)toBentonvilleFilmFestival,LLC(hereinafter“BFF”)forconsiderationinthe2017shortfilmcompetition(“Competition”)ofthe2017BentonvilleFilmFestival(hereinafter“Festival”),eachpersonorteamsubmittingtheFilmfortheFestivalCompetition(hereinafter“Applicant”)agreestobeboundbytheserulesandregulations(“RulesandRegulations”).1.LENGTHCAP:IftheFilm’sfinalrunningtimeismorethanthirty(30)minutes(exclusiveofcredits),theFilmmayNOTbesubmittedtothe2017ShortCompetition.TherulesfortheFestival’sfeaturelengthfilmcompetitionarelocatedhere:http://bentonvillefilmfestival.com/submissions/feature-film-competition/2.SUBMISSIONCATEGORIESANDELIGIBILITY:•ApplicantsmaysubmitFilmstoBFFforconsiderationfortheFestivalintooneoftwocategories:

NarrativeShortFilm:Forpurposesofthe2017Festival,anarrativeshortisdefinedasafilmthattellsafictionalstoryinatraditionalandlinearway(“Narrative”).DocumentaryShortFilm:Forpurposesofthe2017Festival,adocumentaryshortisdefinedasanonfictionalfilm(“Documentary”).

•FilmsmustmeettheBFFCompetitionQualifiers(listedbelow).•FilmsthathavebeensubmittedforFestivalconsiderationinpreviousyearsareeligibleforre-submissionfor2017Festivalconsideration,butonlyiftheFilmhasbeenchangedsignificantlysincethepreviousyearinwhichitwassubmitted.BFFshallhavethesoleauthorityanddiscretiontodeterminewhetheraFilmthatwaspreviouslysubmittedhasbeenchangedsignificantlyfromthepreviouslysubmittedversion.BFFreservestherighttodetermineapreviouslysubmittedFilm’seligibility,withoutrefundofanyorallsubmissionfeespreviouslycollectedfromtheApplicant,basedonthecontentofthenewlysubmittedversionofthefilmascomparedwiththepreviouslysubmittedversion.•U.S.andinternationalshortfilmsmaybesubmitted.ApplicantssubmittingFilmsthatcontainsignificantnon-Englishspokendialoguemustprovideon-screenEnglishsubtitles.BFFreservestherighttodisqualify,withoutrefundofanyorallsubmissionfeespreviouslycollectedfromtheApplicant,anyFilmthatcontainssignificantnon-Englishspokendialoguethatdoesnotincludeaccompanyingon-screenEnglishsubtitles.•Filmsthathavebeenexhibitedtheatrically,broadcastontelevision,releasedviaanyhomevideoorotherdistributionplatformareNOTeligibletosubmitforFestivalconsideration.3.BFFCOMPETITIONQUALIFIERS:

7.HOWTOSUBMIT:•ApplicantsmustfilloutthesubmissionformandpaythesubmissionfeeonWithoutbox(“WAB”):https://www.withoutabox.com/03film/03t_fin/03t_fin_fest_01over.php?festival_id=14359•Applicantsmayeither(a)uploadthescreenerontoWithoutbox,(b)emailapasswordprotectedstreaminglinkofthefilmtoBFFattheemailaddressbelow,or(c)mailadvdtoBFFatthemailingaddressbelow.DVDsmustincludetheentrynumber(theentrynumberisprovidedwhenyoucompletethewithoutaboxsubmissionandfee)andthefilmtitleclearlylabeledontheDVD.BFFMailingAddressforsubmissions:BentonvilleFilmFestival,ATTN:SummreGarber/FilmSubmissions,2500Broadway,SuiteF-125-1129,SantaMonica,California90404.BFFisnotresponsibleforsubmissionsthatarelost,stolen,ordamagedintransit.ItisthesoleresponsibilityoftheApplicanttoensurethestreaminglinkorDVD,asapplicable,isfunctionalandtheactiveatleastthroughMay8,2017.8.CONTACTINFORMATIONOFAPPLICANTS:Duringtheselectionprocess,BFFwillattempttocontacttheApplicantusingthecontactinformationprovidedonthesubmissionformtonotifytheApplicantoftheFilm’sacceptancestatus.BFFdisavowsanyresponsibilityfor,andwillnotbeheldresponsiblefor,anyfailuretocontacttheApplicantusingthecontactinformationprovidedonthesubmissionform.ItisthesoleresponsibilityoftheApplicanttoensurethatthecontactinformationprovidedonthesubmissionformiscorrectthroughouttheentiretyoftheFestivalselectionperiod(October3,2016–May7,2017).9.THEATRICALSCREENINGSDURINGTHE2017FESTIVAL:ApplicantsacknowledgethatBFFhasthesolerighttoselectthesubmissionsthatwillbeshowcasedorexhibitedattheFestivalandhasthesolerighttorejectsubmissions.BFFreservesthenon-exclusiverighttoscreenandshowcaseallsubmittedfilmsandorportionsofsubmittedfilmsduringthe2017Festival.AllticketsalesandproceedsarepropertyofBFF.10.WORLDPREMIER:Afilmwillbelabeledasa“worldpremiere”onlyif,whenitscreensattheFestival,itisthefirsttimethefilmwillscreenpubliclyintheworld.11.PUBLICITY:BysubmittingaFilmintotheFestivalCompetition,ApplicantspermitBFFandFestivalsponsors,andtheirrespectiveparent,subsidiary,andaffiliatecompanies,andadministrative,advertising,andpromotionagencies,andanyotherentityinvolvedinthedevelopment,administration,promotion,orimplementationoftheFestival(“FestivalEntities”)touseApplicants’names,likenesses,images,photographs,voices,biographicalinformation,titleoftheFilmsubmitted,theFilm’slogline,Deliverables,andtheCompetitionresultsforadvertising,publicityandpromotionalpurposesinanymediaorformatnoworhereafterknown,withoutcompensation,permission,ornotification.Throughvariousphasesofthejudgingprocess,submittedmaterialwillbeexposedtoanetworkofinfluentialthirdparties.Allsuchthirdpartyparticipationsarenotguaranteed.12.BFFRESEARCH:BFFworkswiththeBentonvilleFilmFestivalFoundation(“Foundation”)andGeenaDavisInstituteonGenderinMedia(“Institute”).BoththeFoundationandtheInstituteareresearch-basedorganizations.TheInstitutewasfundedbyGoogletodevelopacomputersciencetoolthatcouldquicklyandefficientlyassesshowwomenarerepresentedinfilmsaroundafewdifferentmetricsincludingtheamountofscreentimeandspeakingtimeinafilm.InconjunctionwiththeUSCSchoolofEngineering,theInstitutehasdevelopedabetatooltoassessthesethingsinitiallyandwillbeusingthe2017BFFselectedfilmsto

test.Wewillprovideareportwiththedatafollowingcompletion.TheteamatGoogleandUSCareusingbothfilmscriptsanddownloadableversionsofthefilmtogatherthisdata.IfyourFilmisselectedtoparticipateinthe2017BentonvilleFilmFestival,youwillberequiredtosubmittheselectedFilmscriptandadownloadableversionoftheselectedFilm.TheFestivalwillsendanemailtothesubmitter’saddressonfiletofollowupaboutsubmittingthematerials.Ifaresponsewiththerequiredinformationisnotreceivedwithinforty-eight(48)hours,theacceptanceofyourfilmforthe2017Festivalmayberescinded.13.DELIVERABLES:•InorderforaFilmtobeshowcasedattheFestival,BFFwillneedaspecificexhibitionformat.BFFwillnotifyApplicantsofsuchformat.Uponnotification,WinnersmustdelivertherequestedformattoBFF’sofficelocatedattbdbynolaterthantbd.•WinningFilmswillrequireadditionaldeliverables,asoutlinedbelow.14.BFFPRIZES:The“WinningShortFilms”aretheFilmsthatBFFawardsthefollowingawardsto:

•JuryAwardforBestNarrativeShort•JuryAwardforBestDocumentaryShort•AudienceAwardforBestNarrativeShort•AudienceAwardforBestDocumentaryShort

TheWinningShortFilmswillbeformallyannouncedatthecloseoftheFestivalandwillalsoreceivedistributionconsultationwithaBFFstudiosponsor.15.REPRESENTATIONSANDWARRANTIES:Applicantrepresentsandwarrantsthat(a)he/she/ithasthefullright,power,legalcapacity,andauthoritytolicensetoBFFtheFilm’srightsforthepurposeofexhibitionattheFestivalandtolicenseclipsoftheFilmandpublicityphotostotheFestivalEntities’foradvertisingtheFestivalfornocompensationtoApplicantoranythirdparty;(b)theFilm,andallpartsthereof,doesnotviolateanythirdparty’scopyrightorotherintellectualpropertyorotherrightsanddoesnotviolateanyindividual’srightofprivacyorpublicity;(c)theFilm,andallpartsthereof,isincompliancewithanyandallrelevantlaws,rules,regulations,whetherstate,federal,international,local,andthoseimposedbyanyunion,guild,orlabororganization;(d)ApplicantwillnotsubmittoBFF(whetherthroughWAB,email,dropbox,BFF’swebsite,etc)theFilmand/oranypartsthereof(includingbutnotlimitedtotrailers,clips,publicityphotos,loglines,summaries)ifsuchmaterialsviolateanythirdpartyrightsand/oranylaws;(e)ifanythirdpartyfeesbecomeduesuchasunionorguildfees,thenApplicantwillpayforsuchfeesandcosts.16.INDEMNIFICATION:Applicantagreestorelease,holdharmlessandindemnifyFestivalEntitiesfromandagainstanyandallliability,loss,damage,costandexpense,andcausesofaction(howevernamedordescribed)withrespecttoorarisingoutof(i)Applicants’Film,(ii)Applicant’sparticipationintheCompetitionorinanyCompetition-relatedactivity;or(iii)anybreachorallegedbreach,orclaimbyathirdpartywithrespecttoanywarranty,representationoragreementmadebytheApplicant.17.DISPUTERESOLUTION:EntrantexpresslyacknowledgesandagreesthattheBentonvilleFilmFestivalshallbeentitledtoinjunctiveorotherequitablerelief(an“Relief”)torestrain,preventorenjoinanybreachofthisagreementbyApplicant,andtheApplicantherebywaivesanyrighttonoticeofanyactionorproceeding
