The last few years have been challenging in America both politically and economically, but signs of improvement areshowing and things look bright for the future. Times continue to change, and we have tried our best to adapt and presentyou with cattle that will be profitable for all facets of the industry. This year our friends at JDJ have decided to have theirown production sale in their home state of Michigan; we wish them the best with this endeavor and thank them for theirtime as a part of our sales. As a result of this change, we have added a couple of Kentucky’s most progressive breedersas guest consignors. We think you will find that Five Springs Farm and Star C Farm have dug deep to bring you somereally good cattle that fit nicely with the philosophies of therest of the sale group.

There is a lot to do in this area during this time of year, andthis year Cane Ridge Cattle Company will be having a sale onSunday after ours, offering some powerful Simmental genet-ics. This is a great opportunity to attend two great saleswithin a few miles of each other in one weekend. Last year wefirst suggested the option to people of scheduling a fall vaca-tion around the sale in Kentucky, and several people took insome of the attractions and really enjoyed themselves. Theaddition of the Cane Ridge Sale to this weekend only makesthis more attractive. We suggest that you come and spend afew days, enjoy some great Simmental cattle and take insome of the area sites and activities.

The success of the genetics that have come from past Bluegrass sales has made a positive contribution to the breed andthe industry. We feel that the potential of the set of cattle we are offering this year is the best we have had to date.Collectively, our goals are to provide our customers genetics that excel in the economically important traits of fertility andefficient beef production. The most important factors in this are profitability, growth, calving ease, maternal and carcasstraits. We feel that these traits are best delivered in a functional, sound, easy-fleshing package.

The cow families and genetics available to you from our programs serve to support these goals. Some of the cows grazingthe pastures of this group include: Mindy, Dakota Gal 007D, Mindy 010G, 40B, Adalida, Dixie Chick, Valentina, Cameo,Applause and Cottonwood 595, who sells in this year’s sale, plus many other up-and-coming young donors. We started flushing 010G because she earned it based on the fact that thenatural calves she has produced just don’t allow her to be ignored. Afterseeing the Lucky Dice babies grow (see Lots 54 and 61), we realized wemade the right decision. Her natural calf by Black American was a featuredbred heifer in last year’s sale, selling for $3,000, and her natural son from lastyear is the Maverick bull that we are using that everyone who sees him justloves! 010G is a mate to the Creek’s Preferred Mindy, Mohler’s Denver saletopper, Preference, and Rains’ Mindy 012G. In the 2003 ASA cow award list-ing, seven Mindy x Preferred Stock daughters were recognized, including010G. Not to mention that there are at least eight sons from this mating whoshow up favorably in the Fall 2003 Sire Summary—several as Trait Leaders.These calves will be homozygous polled, homozygous black and, as you cansee from the projected EPDs, will have numbers that are hard to beat.We hadeight of these offspring born in September, and they look phenomenal!

BIDDING AND APPLICABLE LAW: All cattle listed in this offering comply withprevailing sale terms and conditions as set forth by the laws of the State ofKentucky. There are no warranties, expressed or implied, by either the auctioneer,the sale manager or the consignors, except as set forth herein, as to the mer-chantability or fitness for any particular purpose of any animal offered in this sale.The right to bid, or the right to reject the final bid, if done before the hammer falls,is reserved for all sellers unless otherwise announced from the sale block or asprohibited by law in the State of Kentucky.

ANNOUNCEMENTS: Any change of information other than that listed in the cat-alog will be announced from the auction block, and such announcements shalltake precedence over printed material. TERMS: Terms of sale are cash unless satisfactory credit arrangements havebeen made with the seller prior to the sale of any animal so affected, payableimmediately upon conclusion of the sale and before animals will be moved. Sellerwill reserve the right to require a certified check as settlement before releasing anycattle.

PURCHASER’S RISK: Each animal becomes the property of and therefore is alsothe risk of the purchaser as soon as it is sold, except it shall be the obligation ofthe seller to see that animals are fed and cared for, free of charge to purchaser,until loaded for shipment or until the expiration of twenty-four (24) hours after thesale, whichever occurs first.

HEALTH REQUIREMENTS: All cattle entered for sale must meet the health reg-ulations of the State of Kentucky. All other agreements regarding the health of theanimal will be between the buyer and seller and should be documented in writing.If sale cattle are returned to the seller for an adjustment, they must meet the healthrequirements of the state to which they are returned.

CERTIFICATE OF REGISTRY: Each animal which is cataloged, offered and soldas a registered animal shall have a certificate of registry available at time of sale.When an animal is sold as “eligible for registry” or “registry pending,” the seller shallbe responsible for obtaining the certificate of registry and for the proper transfer ofthe certificate to the purchaser, including full payment of transfer fees.

IDENTIFICATION: Each animal at time of sale must have a readable tattoo orbrand corresponding to that shown on the certificate of registration.

AUTHENTICITY OF PEDIGREE: When an animal, through blood typing, is deter-mined to have ancestry other than that reported on the registration certificate, thebuyer shall be entitled to a refund of the purchase price from the seller upon returnof the animal to the farm of the seller at the seller’s expense. The animal in ques-tion, at the buyer’s option, may be exchanged for another animal of equal value,or if agreeable with the buyer, the seller may have the certificate of registry cor-rected at the seller’s expense, with the corrected certificate returned to the buyer.Any adjustment provided herein, if selected, shall absolve the seller from furtherliability for authenticity of pedigree to the buyer.

BREEDING GUARANTEES AND DEFINITIONS:1. Females are guaranteed to be breeders with the exception of:

a) Female calves sold at side of dam;b) Injury or disease occurring to the animal after time of sale;c) Gross negligence or willful misconduct on the part of the purchaser;d) Females used in ovum transplant after time of sale;e) Females shown competitively after time of sale;f) Cows sold with calf at side or a female that calves after sale to a breeding

prior to the date of sale.

2. Bulls are guaranteed to be breeders (defined as the ability to settle healthycows by the time they are 18 months of age) with the exception of:a) Bull calves sold at side of dam;b) Injury or disease occurring to the animal after time of sale;c) Gross negligence or willful misconduct on the part of the purchaser;d) Bulls shown competitively after sale.

3. Any guarantees with respect to the ability to freeze semen shall be made byseparate agreement between the buyer and seller.

4. Safe in calf females are females that have been diagnosed pregnant by a com-petent veterinarian and are pregnant at time of sale.

5. A bred female is known to have been serviced by a bull, either by natural breed-ing or artificial insemination, but it does not necessarily mean that the female issafe in calf to that service.

6. A pasture-bred female has been pastured with a designated bull and has beenexposed for the time stated, but it does not necessarily mean that this femaleis safe in calf to that bull.

7. An open heifer is a virgin heifer that has never been exposed to a bull eitherthrough natural service or artificial insemination.

8. An open cow has not been exposed to a bull either through service or artificialinsemination since the birth of her last calf.

9. Calves sold off their dams (split pairs) shall carry the full breeding guarantee.

PRIVILEGE OF PURCHASER TO EXAMINE: The purchaser of a female animalmay have her examined within twenty-four (24) hours after the fall of the hammerand prior to removal from sale premises. The pregnancy status or breeding statusof any female so examined, when found not to be as represented at time of sale,is cause for the female to be returned to the seller as unsold.

EMBRYO TRANSFER: Sellers should provide, upon request, a complete historyof embryo transfer activity for any female offered for sale. Withholding informationon the existence of frozen embryos at time of sale would be considered an uneth-ical practice.

HORNED – SCURRED – POLLED DEFINITIONS AND GUARANTEES:DEFINITIONS:1. HORNED—An animal with a horn growth affixed to the skull that has or has not

been removed.2. POLLED/SCURRED—An animal with rudimentary horn growth that will not

develop into a horn. The rudimentary horn growth may or may not becomeaffixed to the skull at an older age.

3. POLLED—An animal with absence of horn growth. (An animal can have scursand still be genetically polled.)

4. SMOOTH POLLED—A smooth-polled individual has no scurs and does notdevelop scurs later in life.

GUARANTEES:1. If an animal is sold as polled or polled/scurred and proves to be horned, the

seller shall be obligated to refund the purchase price upon return of the animalto the farm of the seller at the expense of the seller or may be exchanged for apolled animal of equal value, whichever is acceptable to the buyer. The buyerhas thirty (30) days from date of sale to notify the seller that an adjustment isin order.

2. If an animal is sold as smooth-polled and proves to be scurred, the seller shallbe obligated to refund the purchase price upon the return of the animal to thefarm of the seller at the expense of the seller or, at the buyer’s option, beexchanged for another smooth-polled animal of equal value.

3. If an animal is sold as polled and develops scurs, the seller will not be obligat-ed to make any adjustment, as a scurred animal is considered polled.

4. If an animal is sold as polled and has scurs, it shall be so announced at the timeof sale that the animal has scurs. If it is not announced and the buyer findsbefore the animal leaves the sale premises that the animal has scurs, the buyermust notify the seller of the findings. The seller shall then be obligated to refundthe purchase price.

OPTIONS AND PRIVILEGES OF RETURN OR ADJUSTMENT: The following ad-justments do not preclude the right of the buyer and seller to mutually agree uponother terms and conditions for settlement of any dispute.1. All claims for adjustment or refund must be made in writing either within six (6)

months from the date of sale or no later than when the animal reaches 24months of age, whichever occurs latter, with the exception of claims involvingmisrepresentation of service sire or as otherwise provided herein.

2. In the event that an animal is claimed to be a non-breeder, the animal may bereturned to the farm of the seller, at the buyer’s expense, if in good physicalcondition and in compliance with the health requirements of the seller’s state.The seller shall be entitled to a six (6) month trial period following the return ofthe animal in which to prove that the animal is a breeder. If at the end of six (6)months the seller is unable to prove the animal a breeder, the seller shall, at theoption of the buyer, replace the animal with another of equal value or refund thepurchase price. Either option shall be deemed full satisfaction and settlement.

3. If a female is sold as “safe in calf” to a given sire or sires on a specified date ordates and proves not to be as represented, the buyer is entitled to a refund ofthe purchase price from the seller upon return of the animal and resulting prog-eny thereof to the farm of the seller at the seller’s expense.

4. If a female is sold as “open” and proves to be with calf at time of sale and exam-ined pregnant within sixty (60) days after sale, the buyer may return the animalto the farm of the seller prior to calving for refund of the full purchase price orfor another animal of equal value, whichever is acceptable to the buyer. It shallbe the obligation of the seller to bear any expenses incurred for transportationof the animal in question to the farm of the seller.

LIMITATIONS OF OBLIGATIONS:1. If the aforementioned Suggested Sale Terms and Conditions are adopted, they

should constitute a contract between the buyer and seller for each animal soldunder these terms, and as such should be binding upon both parties. Animalsresold following purchase in a sale shall constitute a separate transaction, andthe privileges and obligations of the two original parties connected thereto arenot covered by the terms and conditions of the sale.

2. The American Simmental Association, its directors or employees are not in anyway responsible or liable for enforcing the Suggested Terms and Conditions ofany agreements involving transactions between buyers and sellers.

3. As the sale manager, DP Sales Management acts only as an agent for the sell-er and has no responsibilities other than those involved in conducting the sale.
