SUPPLEMENT TO PETITION FOR EMERGENCY CLARIFICATION
The American Society of Association Executives (“ASAE”)’ filed a Petition for
Emergency Clarification with the Commission on July 25,2003 seeking an emergency
clarification of the rules governing unsolicited facsimile advertisements as they apply to tax
exempt nonprofit organizations. ASAE seeks now to supplement its Petition for Emergency
Clarification by adding as supporters of that Petition the following tax exempt nonprofit
organizations and other interested parties, listed in Exhibit A. These organizations have
members, donors, and other constituents collectively numbering in the tens of millions (one of
them alone has twenty million dues-paying members); and the organizations frequently
communicate via facsimile transmission. On behalf of these close to seven hundred tax exempt
nonprofit organizations and others, ASAE respectfully reiterates its petition that the Commission

promulgate, on an emergency basis, a clarification that unsolicited facsimile communications are
not prohibited when issued by or for tax exempt nonprofit organizations in pursuit of their
recognized and authorized tax exempt nonprofit purposes. Without such relief, the enormously
laudatory and valuable work of hundreds of thousands of membership organizations, charities,
advocacy organizations, and other tax exempt nonprofit organizations would be unnecessarily
interrupted or impeded.
