  • Respected Sir,

    I, Myaka Aneesh S/o Myaka Rajaiah, R/o Ho. No 1 – 51, Namiligundupally Village, Vemulawada

    Rural, Rajanna Sircilla District, Telangana, PIN – 505302. I belong to Scheduled caste ()

    I submit that, I am filing this complaint against the inaction of police officers who are willfully

    neglecting their duties that they are required to be performed under Scheduled Castes and

    Scheduled Tribe (Prevention of Atrocities) Act – 1989.

    I submit that, It appears to me that the police might have colluded with the accused who

    attacked me, my family members and kidnapped my wife and threatened to kill me as I have

    married a non scheduled caste woman, who belongs to a dominant OBC caste.

    I submit that I and Pothuraju Gouthami both have been in love with each other for the last two

    years. The parents of Pothuraju Gouthami did not agree to our marriage as I belong to a

    Scheduled caste (Madiga). They tried all ways to take Gouthami away from me. However, we

    have married to each other with free will in the Arya Samaj on 13/02/2020 as we both are

    majors.

    I submit that I am filing Aadhar Cards for me and my wife with this complaint for kind perusal

    of the National Human Rights Commission as Annexures – 1 and II and I am filing Our

    marriage photos and marriage certificate with this complaint as Annexures III, IV and V.

    I submit that, unable to digest our marriage, the parents of Gouthami, her father Pothuraju

    Pentaiah raised objections and threatened me with dire consequences if I continue our marital

    life. He also warned me that I should leave my wife and leave the village.

    I submit that, due to these threats from the father of Gouthami, I approached our local police

    station on 15/02/2020 and requested police to provide protection to me and my wife and my

    family. The police conducted counseling to both of us, me and my wife and said that, since both

    of you married with free will; the Gouthami’s father should not intervene in the matter. After

    this police assurance, myself and my wife Gouthami, went to our village and started living with

    my family, father, mother and sister.

    I submit that, to the utter shock my mind, on 01/03/2020, the accused Pothuraju Pentaiah

    along with around 15 other anti social elements attacked my house, they abused us in filthy

    language as “Madiga Lanjakodukulara” (Madiga Bastards), they attempted to kill me,

    brutally beaten up all my family members including my sister Srilatha who is nothing to do with

    the case.

    I submit that, after brutally beating and abusing my family touching our caste, they kidnapped

    my wife Gouthami and took her along with them forcefully. Since there are honor killings of

  • inter-caste marriage couples, I am scared that my wife Gouthami may be killed by her parents.

    My wife and I have life threats from the parents of my wife who are an aggressively dominated

    caste in our locality.

    After they beat up, abused and threatened our caste and threatened to kill us, I approached

    our local police station, Vemulawada Rural Police station. The Sub Inspector of police, Soumya

    Reddy is a non scheduled caste person and rejected my complaint initially. I requested her to

    take my complaint and register the FIR against the culprits and arrest them. Though she has

    taken the complaint, she did not act on it for 15 days. I am filing the copy of my first complaint

    along with this complaint as Annexure - VI

    I submit that, due to the willful negligence of Sub Inspector of police, Soumya Reddy, I have

    approached higher officer, Deputy Superintendent of Police – Vemulawada on 17/03/2020 and

    filed another complaint against the accused for attacking my family and kidnapping my wife and

    also against the Sub inspector for not taking action in collusion with the accused.

    I submit that, on my second complaint dated 17/03/2020, the higher police authorities have

    directed the local police to register a FIR, then only the local police have registered the FIR NO

    21 OF 2020 U/S 448, 363, 232, 506 IPC R/W 34 IPC U/S 3 (1) (S) of ST POA ACT 1989. I am

    filing the copy of FIR as annexure - VII

    I submit that, it’s been more than 3 months after registration of the FIR but police have not

    arrested the accused nor have they rescued my wife who was forcefully taken away from me. I

    and my parents and siblings are living in constant threat from the accused. We are running

    pillar to post to get justice, but Police not taking any action based on FIR registered against the

    accused

    In the light of above mentioned fact and circumstances, I pray this Hon’ble National Human

    Rights Commission to

    1. Direct the police to arrest the accused immediately

    2. Alter the FIR and invoke section 3 (2) V of SC and ST POA Act

    3. Direct the police to rescue my wife from her parents.

    4. Take stringent action against Sub Inspector of Police Soumya Reddy for willful

    negligence and not registering FIR based on my first complaint dated 01/03/2020

    Further, I pray Hon’ble NHRC to pass any other order or orders as this authority is deemed fit

    and proper in the facts and circumstances of the case in the interest of justice and render

    justice.
