Vice-President’s CommuniquéMy Dear Members,
As we enter into one of the busiest months of the year and try to complete deadlines relating to finalisation of audit, filings and other statutory obligations there are some important developments taking place all around which affect us all in some way or the other. From the last communication there have been notable developments that have taken place and shall have a great socio-economic bearing.
The first and foremost change that has taken place is of GST constitutional amendment finally becoming a reality and paving the way for introduction of GST in immediate future with the formation of GST Council also being approved by the Central Cabinet. The issues relating to rates of GST, subsuming of taxes, rights of Centre and State and such other issues shall now be in forefront of the economic and political debate till the final law emerges across the nation to realise the dream of “one nation, one tax”. Keeping the development in mind BCAS had organised two full day seminars on GST Law which saw participation of over 650 members in engaging discussion on the various aspects of the subject by learned speakers. Notable feature of these seminars was the active participation of our outstation members in large numbers. Since the Place of Supply Rules are at the heart of the entire concept of dual GST, the Society has organised an interactive lecture meeting on 3rd October 2016 “GST-Place of Supply Rules” by CA Bhavna Doshi at K C College.
At BCAS we have also made representation at Central as well as State level on various aspects of GST for the consideration of administrative authorities at different levels for better implementation of the proposed change. We also had a joint meeting with the Minister of Finance of State of Maharashtra to put across various issues that need consideration before the law is introduced at State level and the authorities have been very receptive to the suggestions made.
The next important change that took place after much speculations was appointment of new RBI Governor from 5th September, 2016. Few days ago the Reserve Bank of India (RBI) got its 24th Governor, Mr. Urjit Patel. He is an economist and the ninth economist who has been made the RBI governor. He and his predecessor Mr. Rajan are both PhD’s but from the West. They are therefore bound to view things differently, including their place in the government’s scheme of things. problems because it causes the inflation. Only a handful of governors have succeeded in taming the government and in turn inflation. To be a successful governor you need to be lucky with inflation and self-effacing with the government. Let us wish Mr. Urjit Patel all the best in achieving equilibrium between the two!!
5th September is also celebrated as Teachers Day. For a student of the CA course, Articled/ Practical Training is the core to his curriculum and is its back bone. The Principal of any Articled Trainee is the most important Teacher for a CA student. Apart from academics, as the Principal, he imparts practical training on various areas such as auditing, law, accounting, management among others. Besides he also teaches inter personal skills, guides for career growth and grooms articles to be an all rounded professional. The articled training is probably the only phase where a student has the same teacher for 3 years! The Principal teaches finer and applied nuances of the profession and ensures that his articled trainees succeed in life by passing exams and become

worthy chartered accountants. At BCAS it is our endeavour to groom the students through various programs throughout the year.
As we try to beat the deadline of completing the audits and tax filing obligations for our client one of the major change that has been a challenge of sorts is “Internal Controls over Financial Reporting” (ICFR) for medium, small and non-complex entities. The Accounting and Auditing Committee of the BCAS has come out with a well-timed Handbook for Private Companies and their Auditors and I am very sure this will help in complying with the implementation and reporting requirements of both the auditees and auditors. On similar lines the ICAI has come up with “Implementation Guide on Audit of Internal Financial Controls over Financial Reporting with Specific Reference to Smaller, Less Complex Companies”. This will go a long way in helping the members in discharging the onerous responsibility in much better manner.

As a part of social cause we at BCAS had organised Blood Donation drive on 27th August where 56 members/family members donated blood. The Drive was carried out successfully with help of the team from Tata Memorial Hospital. At BCAS we are thankful to all the members who donated blood or expressed their desire to donate blood as also the team from Tata Memorial.
There is also an unexpected breather provided by the tax department for filing the Returns of Income and Tax Audit Reports which are due on 30th September as the due dates for filing the same and declarations under the window of Income Declaration Scheme are falling on the same day. Foundation operates a Right to Information (RTI) Clinic on a regular basis. The Clinic provides help and guidance to BCAS members as also to non-members, i.e., all citizens, for making applications under the RTI Act and also assists in resolving any related difficulties on the subject of RTI. The RTI Clinic operates on Saturdays from 11 am to 1 pm. The next RTI Clinic days accordingly are 17th, 24th September 2016 and 1st, 8th, 15th and 22nd October 2016. Friends one continues to hear about the pace of change more frequently nowadays in professional as well as social circles. We are living in an age where what is true today may not hold well tomorrow. The pace of change in technology is second only to the speed of thought nowadays and coupled with ease of access to information, this has definitely made economic sphere more open and transparent for one who wishes to plunge and take risks. This also brings about high redundancy levels for humans as well as organisations. What has stood through the tide and time of centuries may well be washed away in a wave coming in unpredictably. This in a way has led to reduction in span of highs and lows of business cycles. One has to continuously keep on changing the manner of one’s processes of thinking, working, planning, positioning, serving to survive in the maddening pace of life and work which many of us are unaccustomed of. One cannot achieve anything by resisting the change or its harbingers for change is the only constant and adaptability has been the hallmark of human species in its race for survival. At BCAS it has been our constant endeavour to keep the members attuned to the changes taking place by holding timely seminars, events and by way of publications in sharpening their professional skills so as to meet the challenges of change successfully.

The recent news on international tax arena is known to all. The European Commission ruling; that a sweetheart tax deal between Apple and the Irish tax authorities amounted to a huge implication of taxes. As a result of which Ireland has been asked to recover from Apple Euro 13Bn plus interest.
Google has also done pretty well at avoiding taxes on foreign profits. Nearly 53% of company profits come from overseas, which would be a hellacious tax bill if it ever came completely due. Google has managed, through a deft series of overseas subsidiaries and tax havens, to shave $3.1 billion off its tax bill over the past three years.
These are just a few cases we have heard of recently. What is the story behind them and how has BEPS and Equalization levy taken shape as anti-avoidance measures in the field of International taxation? What will be the effects on: indian taxation, foreign investors’ corporate structuring etc.?

gSt thE gAmE ChAngErIt is said that GST will be a game changing reform for Indian economy by developing a common Indian market and reducing the cascading effect of tax on the cost of goods and services. It will impact the Tax Structure, Tax Incidence, Tax Computation, Tax Payment, Compliance,CreditUtilization andReporting leading to a completeoverhaul of the current indirect tax system.GSTwill have a farreaching impact on almost all aspects of the business operations in the country, for instance, pricing of products and services; supply chainoptimization;IT,accountingandtaxcompliancesystems.TheGovernmenthasalreadyplacedinpublicdomainthedraftModelGST Law (prepared by Empowered Committee of State Finance Ministers), and, the reports on GST business processes in respect of Registration, Returns, Payment of Tax and Refunds, etc., have already been released earlier.
The Model Law has been ratified by atleast half the States in their respective legislative assembly and finally received the President Ascent on 8th September 2016.
Since the time the Model GST Law has been out, the Society has been making representations to the Government at various forums. BCAS was invited by Deputy Commissioner (GST), CBEC, Ministry of Finance, North Block, New Delhi on 18th August for an interactive session on the Model GST Law. BCAS has also made representation on the Model GST Law to Maharashtra Finance Minister Shri Sudhir Mungatiwar on the 7th September 2016.

BCAS founDAtIon
The BCAS Foundation was formed on 23rd may 2002 and is registered as a Public Charitable Trust under
Bombay Public Trust Act, 1950 and is also registered under Section 12AA of Income-tax Act. The principal
activity of the Foundation is to apply its income and the corpus to various public charitable purposes
such as relief of poor, education, medical relief, rural development and other object of general public
utility. BCAS Foundation has always been a pioneer in funding projects on disaster management in the
country. It had undertaken the task of rebuilding the schools destroyed by various natural calamities.
The initial rebuilding of school after the Gujarat earth quake was undertaken by BCAS as at that time
BCAS Foundation was not in existence. The BCAS Foundation had undertaken the task of rebuilding of
school at puducherry which was destroyed by tsunami, rebuilding of Subhashnagar School in
gopeshwar at uttarakhand which also received the award from huDCo. For the Chennai floods it
has donated `5 lacs to ramakrishana math for participating in school building construction by them.
The BCAS Foundation regularly participates with the Dharma Bharati Mission in its project “Chalo
English Sikhaye” which was started in the year 2010-11 and contributes in teaching conversational
English and imparting values to children from vernacular medium schools and Municipal schools. All
most 20 schools (mostly vernacular medium schools) are covered by this project during 2015-16.
One of the major activities of BCAS Foundation today is the rtI Clinic. Late Mr. Narayan Varma who
was an active RTI activist and one of the founder trustees of the Foundation was vigorously pursuing
this activity. BCAS has been organising regular RTI clinics at its premises since many years providing
freeguidancetoanycitizen,intendingtomakeaRTIapplication.the rtI Clinic operates on Saturdays
from 11 a.m. to 1 p.m.Volunteers,MrsHemaSampatandMrKamleshShahregularlycomeandprovide
guidancetocitizens.Citizenswhoparticipate in theclinic feel that theguidancewasgoodanduseful.
Various people put forward their queries and find that the meeting with the co-ordinators are satisfying
and informative.
The BCAS Foundation has also been a supportive of the Go Green initiative and since past few years
has taken up the tree plantation program at Dharmpur District, Valsad - Gujarat. Like every year this
year too the program received excellent response and trees were planted for captive plantations on the
farmer’s field which would generate income for them in future.
On 27th August 2016 BCAS Foundation organised Blood Donation Drive jointly with Tata Memorial
Hospital which received a good response. We whole heartedly thank all people who came forward to
participate in this noble cause and also the team of experts from Tata Memorial Hospital for their time
and efforts.

Terms and Conditions
1. BCAS Hall can be used for educational purpose in the field of Chartered Accountancy by a Member only and in accordance with the policy of the Society and for no other purposes either directly or indirectly or for commercial purpose.
2. The hall usage is made available by the BCAS to facilitate education of its members in the field of chartered accountancy atnominalcost/charge.Thecurrentchargesareasunder,tillanyrevision:
a. Aboveratesaresubjecttoservicetax/GSTasapplicable.
b. Hall can be booked only 45 days prior to the date of educational event subject to availability except Sundays and BCAS Holidays.
c. Combined capacity of the hall is about 90 people in theatre style seating and 50 people in classroom style.
d. Refund of security deposit will be after 10 working days from the date of the event.
3. Any member wishing to make reservation for use of the BCAS Hall for the purpose stated in point 1 above should pay such charges and deposit 100% in advance.
4. Extension of time will strictly be subject to availability and there being no booking for next session and solely at the discretion of BCAS. Extension beyond 8.00 pm will not be permitted. ` 1,500 will be levied for every additional hour or a part thereof.
5. The Society reserves the right to accept or reject any application.
6. In case of cancellation of booking by members, a letter in writing duly signed by the member has to be received, 25% of the Hall charges will be deducted, in such case and balance will be refunded in 15 working days. In case of cancellation of booking by BCAS office, the entire amount will be refunded.
7. It is not permitted to stick any papers, balloons, pictures etc. on the wall, ceiling or curtains. In case of any damage caused to the property of the Society, the BCAS will have the right to recover compensation for such damages or disfiguration out of the refundable deposit.
8. The vehicle/softhevisitor/stotheBCASHallwillnotbepermittedtobeparkedintheJollyBhavanSocietypremises.The use of the Hall is solely at the risk of the member and BCAS does not undertake any obligation for any loss or damage to the member or other persons attending such event.
