CCQ OPERATION POSTS POSITIVE OUTCOME

This past March 1, the Attestation de Revenu Québec statement (in French only) became mandatory for signing certain construction, placement service, and temporary help contracts. The authenticity of this statement must also be verified through Revenu Québec’s online service “Mandatory Verification of an Attestation de Revenu Québec (in French only).”

Since September 1, businesses may incur penalties for failing to meet any of their obligations, so be sure that you comply with these requirements by going to attestation.revenuquebec.ca.

ELSEWHERE IN CONSTRUCTIONReminder about Revenu Québec mandatory statements

“We found that non-compliance fell by a third,” says Jean-Guy Gagnon, CCQ Vice-president of Operations. “Last summer, more than 15 percent of visits reported a violation, but that dropped to 10 percent this year, positive proof that the operation was effective.”

Readers will recall that an analysis conducted by the CCQ showed that the non-compliance rate tends to rise in summer on civil engineering and roadwork construction sites. That made it a strategic time to step up surveillance in the construction sector.

A strategy focused on intervention and raising awareness The operational objectives were achieved. For the two months of this operation, the CCQ maintained an unprecedented presence on civil engineering and roadwork construction sites. CCQ inspectors visited 597 different sites a total of 947 times and met with 4,736 officials and workers.

In conjunction with these field operations, the CCQ also took time to meet with several leading players to inform them of the operation’s key facets and answer their questions. These meetings included the Ministère des Transports, the Ville de Montréal, and the Ville de Québec.

Increased awareness and dialogue are important components of the CCQ’s approach. “In this summer’s operation, we obtained excellent cooperation from the various organizations we met. Sometimes, a single effective meeting is all that’s needed to obtain compliant behaviour. On other occasions, when dealing with ‘chronic offenders,’ a more dissuasive approach is necessary,” says Jean-Guy Gagnon.

Of the 201 non-compliant situations detected by CCQ inspectors during the operation, most (158) involved lack of a competency certificate.

Civil engineering and roadwork by the numbersThe civil engineering and roadwork sector accounts for almost 20 percent of all covered construction work in Quebec. There are several major sites: in mid-June, civil engineering and roadwork construction sites represented only 7 percent of open sites but accounted for more than 36 percent of the value of work in the industry as a whole.

NOTICES OF INSURABILITY TO BE MAILED OUT SOONPersons eligible to pay a premium for coverage under the construction industry’s insurance plan will soon receive a notice of insurability.

Notices for the insurance period from January 1 to June 30, 2017 will be mailed out around November 1, 2016. The deadline for replying is Monday, December 5, 2016.

Under the Act Respecting Prescription Drug Insurance in force in Québec, persons eligible for private insurance are required to participate unless they are covered by another private plan (their spouse’s plan, for example).

The choice of insurance coverage and payment of any premium may be made using the online services of the Commission de la construction du Québec (CCQ), until the deadline indicated on the notice.

SALARY INSURANCE AND HOUR CREDITS

ARE YOU AFFECTED

BY EXCLUSIONS?The construction industry’s insurance plan sets various limits on salary insurance coverage and hour credits.

Employers or members of the company therefore must review their status carefully to obtain appropriate disability insurance coverage.

Employers and members of the company insured by MÉDIC Construction may be affected by the following exclusions.

Persons insured under the construction industry’s social benefit plans but not covered by the Employment Insurance Act may be entitled to hour credits if their disability is recognized under the terms of the Regulation respecting complementary social benefit plans in the

construction industry. These hour credits allow disabled persons to continue to accumulate hours used to determine their insurance coverage. However, these persons are not entitled to payment of the first 17 weeks of the weekly compensation provided by the salary insurance plan.

Persons insured under the construction industry’s social benefits plan but not covered by the Act respecting industrial accidents and occupational diseases may obtain hour credits if their disability is recognized under the terms of the Regulation respecting complementary social benefit plans in the construction industry. However, these persons are not entitled to salary insurance benefits if their disability is the result of an industrial accident or occupational disease.

LAUNCH OF THE 2016–17 FIERS ET COMPÉTENTS CAMPAIGN

LET’S TALK TRAININGWITH RÉAL!

The Commission de la construction du Québec, in cooperation with the construction industry’s employer and union associations, is launching the third edition of its advertising campaign Une expertise, ça se construit. This initiative encourages workers to upgrade their skills by taking available training. In 2016–17, the Répertoire des activités de perfectionnement contains almost 500 training activities.

The campaign also encourages employers to use the corporate training service to develop customized training for their workers.

Once again this year, comedian Réal Béland ventures into the construction world for a face-to-face chat with experienced instructors in a training centre, to learn everything about the upgrading activities available. In addition, once a month throughout the year, Réal will provide advice in fun and informative short video capsules, featured exclusively on the Fiers et compétents Facebook page. In 2015–16, more than 24,000 places were filled at upgrading activities. This success reflects the determination and coordinated work of the construction industry partners going back more than 30 years.

The Association des entrepreneurs en construction du Québec (AECQ) requires all construction employers to pay basic dues of $225 (plus GST and QST). Remember that these must be remitted in a single payment with the October 2016 monthly report (which must be submitted no later than November 15).

For the construction industry, Monday, October 10 (Thanksgiving) and Friday, November 11 (Remembrance Day) are considered statutory holidays. Therefore, any work performed on these days must be paid at the premium rate under the provisions set out in the collective agreements for each sector.

To better meet client needs, the CCQ’s telephone service will be open from 8:30 a.m. to 4:30 p.m. on Friday, November 11 – Remembrance Day.

2016UNION VOTE

From June 1 to June 20, 175,545 workers were asked to choose their union allegiance. Of these, 109,462 were deemed voters, which meant that their choice was also counted in the calculation of union representativeness.

Here are the official results posted for the construction industry’s 14th union vote.

The various associations’ union representativeness determines their respective relative weight during the process of ratifying the collective agreements in the negotiations that follow the vote.

A total of 32,629 votes were counted. Note that workers who did not cast a vote had their union allegiance in effect at the time of the vote automatically renewed for the next four years.

CHANGE OF ALLEGIANCE IN SEPTEMBER MONTHLY REPORT Following the union vote, some of your workers may have changed their union allegiance as of September 1, 2016.

If so, this must be reflected in your September monthly report, which covers the period from August 28 to September 24, 2016. For these workers, you must fill out two separate lines in your report:

– One for the period August 28–31

– The other for the period September 1–24

Remember, your September monthly report must be submitted no later than October 15.

The Commission de la construction du Québec has signed an agreement with the Ministère de l’Éducation et de l’Enseignement supérieur (MEES) for systematic, faster validation of the school documents that it receives.

This new procedure has changed some forms by adding the “Permanent Code” field and changing the wording in the “Authorization” section.

Since September 1, 2016, only the new versions of the documents listed below may be used. Files submitted with the previous versions of these forms will now be rejected.

Here is the list of amended forms that you may be required to submit for one of your workers.

– Request for Recognition of Professional Qualifications

– Blaster Certificate Application Form

– Application for Registration or Modification of Identification File or Choice of Union Association

– Admission to the Qualification Exam – Employee

– Authorization for Authentication of Academic Documents and Validation of Certifications

– Admission to the Qualification Exam – Employer or Self-employed Worker

– Demande d’inscription personne diplômée Cours de connaissance générale de l’industrie de la construction (CCGIC).

All of these documents are available in the “Forms” section at ccq.org.

Application for Registration or Modification of Identification File or Choice of Union Association valid for one year The Application for Registration or Modification of Identification File or Choice of Union Association form identifies workers and confirms their choice of association. This document is used when an employer wishes to hire someone once a labour pool opens.

To be valid, forms must have been signed by the applicant within 12 months prior to submission of the file.

VALIDATION OF FORMAL EDUCATION

NEW VERSIONS OF FORMS

TO BE USED

Under the Regulation Respecting the Issuance of Competency Certificates, workers must take the Santé et sécurité générale sur les chantiers de construction course to obtain a competency certificate. As the body responsible for issuing certificates, the Commission de la construction du Québec (CCQ) must obtain evidence of successful completion of this course. The CCQ validates completion of the course by each worker through the Association paritaire pour la santé et la sécurité du travail du secteur de la construction (ASP Construction).

To strengthen compliance following an administrative tribunal ruling, ASP Construction, in cooperation with the CCQ, reviewed its information-sharing process. Under these changes, which take effect on October 26, 2016, you must provide the employee’s date of birth when making a reservation, in addition to the usual information. If you cannot provide this information at the time of your request, the CCQ will still make the reservation, but the worker will not be allowed access to the site until the CCQ has received the applicant’s complete file, including proof of successful completion of the course. It is also important that the worker’s correct name be provided (e.g., St-Pierre instead of Saint-Pierre).

As a participant in the construction industry’s pension plan, subject to certain conditions, you may be eligible for a pension at age 55 without reduction. In addition, since July 1, 2014, workers in the construction industry have a new partial retirement option.

This allows them at age 50, subject to certain conditions, to receive an initial pension (from the general account) while being able to continue contributing to the pension plan complementary account. These new contributions, added to those already accumulated in the complementary account, will be included in the calculation of a second pension.
