We have reviewed the most recent version of theH-5 substitute and appreciate the opportunity to provide feedbaclc.

After careful review, we bold steadfast in our belief that HB 4257 in its current fonn would hurttelecom competition in Michigan. In this fractured Michigan economy, it's already difficult for high-techcompanies to make ends meet, but liB 4257 would make even more difficult. It would require CLEC's tolower the rates that long distance companies pay CLEC's to use their networks by requiring the CLEC'sto match the rates of compan ies like AT&T and Verizon which have huge economies of scale wh ichCLECs don't' have. We believe passage of this bilt in its current form would cost Michigan CLEC'smillions of dollars in lost revenue and undoubtedly force many to layoff workern, or worse, go out ofbusiness. Equally important, it would give thousands of CLEC customer.; like businesses., schools, andhospitals less ofa choice in choosing their teleeorn provider. Less choice to customer.; means higherteleeom rates for everyone across Michigan.

Competitive telecom companies are exactly the high-tech industry that Michigan oeeds to attract,not discourage. These companies are aggressively installing fiber optics throughout the state,interconnecting school districts and bringing the internet to rural areas where it was not available before.Also, in its current fOlID, HB 4257 not only costs CLEC's revenue, but also forces them to pay into a fundthat makes other telecom provider.; 'whole', while the CLEC's do not get to benefit from the fwld theyare contributing to.

We request that the committee consider an amendment which would accommodate our concerns.Instead of requiring CLEC's to set their 'access rates' at the same level as the giant telecom companies,we suggest an amendment that would allow CLEC's to set their rates at the state-wide average of 'eligibleproviders' as defined in the bill.

It is for these reasons that we must continue to oppose HB 4257 in its current fonn. We ask youand the rest of the committee member.; to consider amendments to the bill which will address theseconcerns. We are hopeful that once policymakers recognize the extremely negative impact this bill wouldhave on telecommunications competition in our state that you will work with US to alleviate this impact sothat Michigan will continue to be a leader in telecommunications policy. bill would make it harder. It would require CLECs to lower the rates that long distance

companies pay them to use their network by requiring the CLECs to match the rates of

CLECs don't have. This would cost Michigan CLECs millions of dollars In lost revenue

and undoubtedly put some out of business resulting in layoffs. Just as Important,

thousands of CLEC customers like businesses, schools and hospitals would have less

The enclosed annual report, Status a/Telecommunications Competition in Michigan, issubmitted on behalf of the Michigan Public Service Commission (Commission) in accordancewith Section 103 of the Michigan Telecommunications Act (MTA). This report, as well asreports from previous years, is available on the Commission Web site atwww.michigan.gov/mpsc. The purpose of this report is to describe the status of competition intelecommunications services in Michigan, including, but not limited to, the toll and localexchange markets in the state. The report includes information on the traditional wirelineindustry as well as services provided via diverse telecommunications technologies, such aswireless and Voice over Internet Protocol (VoIP). The report also contains informationregarding high speed Internet lines in Michigan.

In a trend that began in 2002, the total number of wirelines in Michigan has againdecreased. For 2008, the total number of wirelines in Michigan decreased by over 600,000 linesfrom the previous year. In 2005 and 2006, as noted in earlier reports, there was a decrease in thepercentage of lines served by competitive providers, however in 2007 the competitive providers'market share increased. For 2008, the competitive providers' share remained stable at 20percent.

While competitive providers can offer service to customers through a variety of methodsthat use the incumbent providers' networks, in 2008 we again saw a large increase, from 25.1percent to 32.5 percent, in the percentage of competitive lines served via the competitiveproviders' own facilities. This growth suggests that the competitive network infrastructure is, infact, continuing to shift toward facilities-based competition versus competition reliant solely onthe incumbents' networks. As in 2007, this trend is more evident in residential lines, as almostthree fourths of the lines provided via CLEC facilities are residential customers. Thepercentages of residential versus business lines provided by CLECs via the incumbents' networkare more balanced. Though the competitive rnaIket share is still below the 2004 high of27.5
