BASIC ASSESSMENT FOR THE FOR THE UPGRADE OF THE SEA POINT AND MOUILLE POINT PROMENADE, CAPE TOWN INVITATION TO REGISTER AND COMMENT SEF REF NO: 505271 DEA&DP REF NO: 16/3/1/1/A7/24/3049/13 Notice is given in terms of Regulations published in Government Notice No. R.543 in Government Gazette No. 33306 18 June 2010, under Section 54(c)(i) of the National Environmental Management Act, 1998 (Act No.107 of 1998), as amended (NEMA), that the City of Cape Town proposes to undertake a Basic Assessment process for the proposed upgrade to Sea Point and Mouille Point Promenade of approximately 15 000 square metre in extent, situated in Cape Town which includes the replacement of the paving blocks on the Sea Point Promenade and to upgrade the Natural Beach Area in Mouille Point (which will entail the upgrading of the parking area, natural vegetation and installing wooden deck walkways and seating areas). This project will also include the upgrading of the existing playground, creating walkways between the Beach Road sidewalk and the Promenade, constructing seating areas from wooden decking and concrete, installation of new benches, public art (land art and sculptures), shade structures, signage and low seating walls. The proposed development is located between Sea Point and Mouille Point in Cape Town. In terms of Government Notice No. 544 (Listing Notice No. 1) of NEMA the following Listed Activities are triggered and therefore require Environmental Authorisation by way of a Basic Assessment Process: Listing 1 No. 14 (GN No. 544) The construction of structures in the coastal public property where the development footprint is bigger than 50 square metres, excluding the construction of structures within existing ports or harbours that will not increase the development footprint or throughput capacity of the port or harbour; the construction of a port or harbour, in which case activity 24 of Notice 545 of 2010 applies; the construction of temporary structures within the beach zone where such structures will be demolished or disassembled after a period not exceeding 6 weeks. Listing 1 No. 16 (GN No. 544) “Construction or earth moving activities in the sea, an estuary, or within the littoral active zone or a distance of 100 metres inland of the high-water mark of the sea or an estuary, whichever is the greater, in respect of – fixed or floating jetties and slipways; tidal pools; embankments; rock revetments or stabilising structures including stabilising walls; buildings of 50 square metres or more; or infrastructure covering 50 square metres or more – but excluding if such construction or earth moving activities will occur behind a development setback line; or where such construction or earth moving activities will occur within existing ports or harbours and the construction or earth moving activities will not increase the development footprint or throughput capacity of the port or harbour; where such construction or earth moving activities is undertaken for purposes of maintenance of the facilities mentioned in (i)- (vi) above; or where such construction or earth moving activities is related to the construction of a port or harbour, in which case activity 24 of Notice 545 of 2010 applies” Listing 1 No. 18 (GN No. 544) “The infilling or depositing of any material of more than 5 cubic metres into, or the dredging, excavation, removal or moving of soil, sand, shells, shell grit, pebbles or rock or more than 5 cubic metres from: (i) a watercourse; (ii) the sea; (iii) the seashore; (iv) the littoral active zone, an estuary or a distance of 100 metres inland of the high- water mark of the sea or an estuary, whichever distance is the greater- but excluding where such infilling, depositing , dredging, excavation, removal or moving; is for maintenance purposes undertaken in accordance with a management plan agreed to by the relevant environmental authority; or occurs behind the development setback line.”
