Did you know that a good buildersassociation creates more than bricks andmortar? It “builds” a foundation of supportfor its members, a source of common interest that unites those members in good times and bad.
As I begin this important year as your new president, I think it’s important to ask“Did you know?” about the services BASF offers its members. There will be subtle re-minders during the year that speak directlyto the importance of BASFnot only for our own businesses, but also our South Floridacommunity.
We recentlyunveiled the “Did you know?”marketing campaign at theboard of directors’ planningsession and expect the membership will soon be getting their firstlook. The campaign will highlight the manyreasons we decided to join the associationand it will also encourage everyone’s participation.
As with any professional organization, weneed the input of individual members to helpidentify goals that keep us responsive andencourage growth. We urge members to giveus feedback on policies and procedures.Also, over the years BASF has profited from
the experience of its past leaders and I’ve already seen the benefits. Deborah Reyesdid a fantastic job facilitating our board retreat motivating us to think out-of-the-box.And, I was thrilled to welcome the input of past presidents Rick Horton andLuis Rabell.
Throughout the year, BASF plans a full slate of events for meeting new colleagues, networking with others in the industry and uncovering opportunities or
just having fun. We open doors to success with lunches, seminars, tournaments and other gatherings that
bring together South Florida’sfinest builders and suppliers.
In a few weeks, Florida’sannual legislative session
begins in Tallahassee. BASF is thereevery year with
knowledgeable staff and selected membersto represent our interests. Our affiliation withthe National Association of Home Buildersand the Florida Home Builders Associationgives us personal contact with state and national colleagues. We get access to up-to-date economic and housing data so important to success in this business.BASF also offers special training, continuing education and certification programs. Andthere’s the exciting annual golf and fishing
tournaments.You’ve got to havea little fun in themix.
Through goodyears and bad,BASF membershave a history ofgetting involved and giving generously to ourcommunities. We have strong associationswith Comcast Cares Day and Habitat For Humanity. We reach younger generations andtomorrow’s members through our FutureBuilders of America program. Individually,and together, our members eagerly step upto the plate and help others however we can.
For 65 years, the BASF has helped members adapt to changing conditions inSouth Florida. It’s no different in 2010. I hopewe are crawling out of the economic ditchthat has severely harmed our community,and the Executive Committee, the Board andI are committed to helping our members facethat challenge.

January – the start of a New Year, NewYear’s resolutions and new beginnings. InRoman mythology, Janus (whose name is applied to the first month of the New Year) is depicted with two faces; one looking backward and the other looking forward toward what lies ahead.
Janus is known as the Roman god of gates and doors, and is thought to representbeginnings. He personifies the belief that onemust pass through a door or a gate to enter a new place. Janus also represents transitionand was paid deference to at life’s most important beginnings such as birth, marriage,planting season, harvest, etc.
Gates, doors, transitions, important beginnings, reflecting on the past and lookingtoward the future are appropriate themes for the New Year and for members of theBuilders Association of South Florida (BASF).
We are entering a new decade with anticipation that our industry can help get the economy back on the right track. Weneed to find ways to stimulate job growth,help stabilize residential and commercial values, and encourage home ownership and business development.
As we transition from one year to the next,let’s keep a couple of thoughts in mind: We’rein this together, to win! We aren’t about to quit now and neither should you. The BASF is celebrating its 65th anniversary. Duringthat time, the leadership and members ofBASF have experienced good times, greattimes and challenging times.
Membership in the BASF is a form of business insurance, but unlike insurance, you can still collect a good return on yourmembership investment, even without something going wrong. Businesses in thebuilding industry have never needed outside
help to survive more than they have today. Ina nutshell, the sole purpose of the BASF is tooffer you business and learning opportunitiesas well as to advocate public policy decisionsthat will make it more likely that you willsurvive this downturn and be ready to prosper when the rebound hits.
BASF is watching your back 24/7 in thehalls of Congress, the halls of the state capitolin Tallahassee and the dozens and dozens ofcity halls scattered throughout South Florida.What other organization is constantly sponsoring educational programs at reasonable (sometimes free) attendance costs on how to market your company andsell more products? Your BASF! Who else ispublishing magazines and newsletters withthe latest information on the local housing industry? Your BASF! Who else is gatheringmembers together for fun “networking”events on a regular basis with the very peopleyou would want to work for? Your BASF!
It takes members to make these eventshappen. It takes YOUR membership to seethat it continues. I hear BASF members sayall the time how they’ve met some of theirbest friends through BASF. Many of thosemembers built relationships through BASF involvement and increased his or her businessprofitability as a result. Become engaged –get involved. This is not the time to be out of sight and out of mind – you could be out of business if you take that approach.

Make It Right states their mission is to help residents of New Orleans’Lower 9th Ward rebuild their lives and community in the wake of HurricaneKatrina. Their initial goal is to bring at least 150 families home to affordable,green, storm-resistant houses.

STATEWIDE ISSUES Attorney General issues favorable
legal opinion on 2009 statute providingbuilding permit extensions – the State Attorney General’s office responded to aquestion from the City of Maitland about thenature of the building permit extension provision in the 2009 Growth Managementbill (SB 360). Briefly, the blunt opinionstated that the law was self-executing, did not require review or approval of theapplication by an applicant so long as thebuilding permit for which the extension issought, is valid; and to obtain the extension,applicants have only to submit a request for the extension of a valid building permitby December 31, 2009, to have their permit extended under this provision of the law. Most municipalities in Miami-Dade are either not acting on extension requests or simply not responding to them.
Constitutional Amendment 4/Hometown Democracy on November2010 ballot – supporters of the HometownDemocracy effort have gathered enoughsignatures such that the Florida SupremeCourt has certified this question forstatewide public referendum on Tuesday,November 2, 2010. BASF and other groupsare opposing this misleading proposal – it is more correctly named, the “Vote onEverything” amendment. Contact BASF fordetails on the latest activity on this effort.
FHBA sets 2010 Legislative Agenda –Spring Legislative Conference scheduled for April 6-8 - The Florida Homebuilders Association met for its winter meeting andset its tentative legislative agenda. Amongother key issues, the focus will be: atailored growth management refinement effort; issues relating to proposed statewidemobility fee; Sadowski fund/affordablehousing funds; and condominium billamendments. Also, the Association’s SpringLegislative Conference has been scheduledfor April 6-8, 2010. This is BASF’s annualTallahassee trip where we meet with key
legislators on industry issues. Plan to joinus for this great two-day session!
MIAMI-DADE UPDATE: Omnibus Development Approvals
ordinance adopted on first reading – With the constant vigilance of the Legislative Committee and with the cooperation of County staff, this proposedordinance was heard on first reading andwill have been heard during County Commission Committee week set for thesecond week in January. BASF is confidentthat the proposed ordinance will be adoptedwithin the next 60 days. It would provide a two-year extension, by request, for anyadministrative approval, permit, approvedplan (except building permits) or similaragreement, related to a particular project. A list of all approvals which can be extended will be part of the final ordinance.Member Benefits to extending your hard-won approvals? Tens of thousands of dollars in time and money!
Six-month Building permit “tolling”ordinance extended another six months– The Miami-Dade County Commissionadopted a renewal of this ordinance at their September 2009 meeting. The initialordinance, prompted by BASF membersover a year ago, “freezes” an existing, validbuilding permit, providing the applicant with a six-month time-out until economicconditions improve. After that, the applicantcan choose to reactivate the permit, withoutpenalty or repayment of the same fees for the permit. Another ordinance was approved which extends building permits specifically for Developments of Regional Interest. (DRIs). New Mayors in the City of Miami andHomestead take the reigns of authority –The cities of Miami and Homestead electednew mayors as a result of the November 3 elections. BASF congratulates and
welcomes Miami’snew Mayor,Tomas Regaladoand Homestead’snew Mayor,Steve Bateman.
In addition toMayor Bateman,four new Homestead city commissionerswere voted in, while the City of Miami willhave completed its January 12 special election to fill two empty commission seats for Districts 1 and 5. Our LegislativeCommittee will be meeting with each mayor and other elected officials in thecoming months.
Miami 21 effective date delayed untilMay 2010 – resolution adopted by CityCommission – By unanimous vote of thethree sitting City of Miami Commissioners,the effective date for Miami 21, the City’szoning code overhaul, has been delayeduntil May 2010. The original implementationdate had been February 2010. However,with the upcoming special election, and thenewly elected Mayor’s concerns about thecode, the delay has been extended to May2010. During all public hearings, BASF continued to express its concerns, includingunresolved issues about non-conforminguses and structures, new terminology whichmembers think will create more complexcode interpretations, and a potential in-crease in takings lawsuits. BASF’s Miami21 Committee will continue to monitorthese issues closely and will keep membersupdated regularly.
Proposed ordinance would changeCommunity Councils structure – At theJanuary 14 County commission Committeemeeting, this item will have been heard fordiscussion once again. At the November2009 meeting on the matter, introduced byVice-Chair Jose (Pepe) Diaz, the key issuesrelated to reducing the number of councilsfrom the current ten to four, and changingthe combination of the number of appointedvs. elected council members.

EAR Master Plan 2010 Update - BASFmembers met recently with County staff todiscuss CDMP amendments in relation tothe possibility that Amendment 4 couldpass on the November 2, 2010 ballot. Thusfar, the EAR Working Group has met twice.Among the key issues BASF members thinkwill be most important during this cycle,are: how and where are green/sustainableissues included for implementation, needfor more refined acreage formulas for various land use categories, and more accurate population projections to better,correlate a more accurate residential landsupply. These topical issues are in additionto those required by law, which all planningdepartments must address in this seven-year plan update. All EAR issues will beadopted at a County Commission publichearing in 2010.
Climate Change, Green and Sustain-able Development Issues – even thougheconomic conditions are still finding a newequilibrium in our area, emerging regulatoryissues relating to green development willimpact construction and development. Several initiatives are underway simultaneously, so we are monitoring all of them. Eventually, they must beamended into the Florida Building Code or another local code for implementation. A brief overview of the key initiatives is set forth below. >> Mayor’s Panel on Sustainability –this group, with two BASF members seatedon it, is working with County staff and Commissioner Sorenson, as chair, to implement numerous county-wide green requirements for public buildings. Look
for some of these requirements to be
considered for private sector buildings. An initial comment period is open until January18, after which time the report will be forwarded to the County Commission for review. BASF is working hard to make sure there are incentives for any green requirements under consideration. >> Climate Change Advisory TaskForce – The County Commission appointedthis group about two years ago. They have had numerous committees with far-reaching recommendations, including a Science Committee that is preparing a sea-level rise map that could impact the location of future development. >> Implementation of HB 697 Re Energy Efficiency – This state law, adoptedin 2008, requires all local governments toimplement energy efficiency and greenhouse gas emissions reduction policies intotheir Comprehensive Development MasterPlans. Local planners are preparing CDMPmodifications now for implementation overthe next 12-18 months. The Department ofCommunity Affairs (DCA) has rules pending. >> Cities start adopting LEED/GreenBuilding standards – the cities of Homestead, Aventura and Miami haveadopted some green ordinances into theirmunicipal or zoning codes. Aventura andHomestead include voluntary provisions forbuilding green with incentives for buildersto use them. The City of Miami has beenadopting individual ordinances relating to heat islands, and landscaping, as an additional series of green or sustainableinitiatives. Even though Miami 21, the City’s
total overhaul to its zoning code, includes amandatory LEED Silver requirement forbuildings over 50,000 square feet codeadoption has been delayed until May 2010. (See Miami 21 article above). Generally, BASF staff has been promoting
a voluntary package of several standardsand incentives. Contact BASF staff for more information on this issue.
BROWARD LEGISLATIVE REPORTBASF Represented on the City of Hollywood’s Green Advisory Team – Jay Huebner from HSQ Consulting hasbeen representing BASF on this importantcommittee. This committee has prepared a final ordinance which will include privatesector green building requirements. These meetings occur at the Hollywood City Hallon the fourth Thursday of each month from6PM-8PM. BASF is greatly appreciative of Mr. Huebner’s participation on the Association’s behalf!
Water Task Force Considers conservation measures on HVAC Systems - One of the two environmentalissues tasks forces created by the BrowardCounty Commission met recently and considered water conservation relating toHVAC systems in new buildings. Further, anamendment would require retrofitting ofHVAC systems in existing buildings if thesystem requires repairs. The water savingswould be passed along to building owners.It is expected that this will be the first of a series of county-wide conservation ordinances. The second task force, theBroward County Climate Change TaskForce, will develop a countywide program to mitigate the causes and plan for the consequences of global warming and climate change. We are very grateful to Mr. Dylan Larson of Miller Legg, our BASF member on these two task forces.
Elected Leaders Continue their work on water supply issues – Thesesessions have included both elected officials and technical advisory group meetings, to discuss Broward’s water supply issues and challenges. For more information contact BASF staff orDylan Larson, PE, BASF’s representative to the Technical Advisory Work Group. This group will also be addressing ways to reduce Broward’s discharge ofwaste water effluent into the AtlanticOcean, which must cease entirely by the year 2025.

Since beginning a 3-year experiment inAmendment 4-style rule, St. Pete Beach residents have seen endless lawsuits, highertaxes and widespread economic turmoil. Inrecent elections, the citizens of St. PeteBeach voted to scale back their local versionof Amendment 4 so that only certain land use changes require a referendum. WithFlorida voters set to soon decide the fate of Amendment 4 – a statewide Vote on Everything initiative – it is telling that St. PeteBeach voters chose to rein in their own localexperiment by a decisive 60-40 margin.
More telling still are the words of WardFriszolowski, former St. Pete Beach Mayorwho retired in 2008. "St. Pete Beach residents are tired of voting on everything,especially issues that don't even relate to development," said Friszolowski. "This amendment doesn't work. No other state in the union has adopted anamendment as heavy-handed and extremeas the one now being sold to Florida voters asAmendment 4. Even the type of planning bysound bite that takes place in California
would pale in comparison to what is beingproposed in our state. However, we can drawlessons from the story of St. Pete Beach, thefirst community in Florida to adopt a localversion of Amendment 4.
The St. Pete Beach TIMELINE: November, 2006: St. Pete Beach narrowly
adopts a local version of Amendment 4, requiring a referendum for all changes to the local comprehensive plan. Amendment 4 supporters promise that they just want togive "the people a right to vote."
June, 2008: St. Pete Beach voters approvea new comprehensive plan at the ballot box.
June, 2008: After losing the election,Amendment 4 supporters in St. Pete Beachfile a string of legal challenges to invalidatethe will of the people.
September, 2008: Numerous administrative challenges are subsequently filed by Amendment 4 co-author and co-founder Ross Burnaman.
June, 2009: The St. Petersburg Times reports that St. Pete Beach has exhausted its legal budget months before the end of the fiscal year.
September, 2009: Amidst rising legal bills, St. Pete Beach raises taxes.
October, 2009: Court-ordered mediationcollapses when Amendment 4 supporters refuse to join the City and the business community in supporting a compromise.
St. Pete Beach is proof positive thatAmendment 4 is not designed to give thepeople a say on growth. It is designed to give anti-growth lawyers another legal avenue to stop commonsense progress, even when voters approve it. In St. PeteBeach, the taxpayers' legal bills continue tomount. Unfortunately, there is no end in sight.

The Builders Association of SouthFlorida’s Incoming President Fernando Martinez, First VicePresident Marianna Perez and the 2010 officers and board of directors took their oath of office at the annual Installation Gala at the Doral Resort & Spa and immediately offered a glimpse ofwhat to expect for the coming year.
Martinez, a partner at CaribeHomes, reminded those in attendance that the challenges the industry currently faces are not new to BASF, an organizationthat was formed in 1944. “Our organization has seen its share of good times and bad and has managed to persevere during the tough times.”

business development forums to help guidemembers in finding new work,” said AshleyBosch. “We learned directly from County directors about how to become a certifiedCounty vendor, and when and where to lookfor requests for proposals. I know Fernandoand his incoming board will continue to offerBASF’s many resources to its members.”
