I recently had the pleasure of representing the SMBA at The Missouri Bar’s 2014 Annual Meeting in Kansas City, Missouri. I attended almost all of the events and plenary sessions, the last of which was “The Future of Lawyers: Challenges and Solutions to Practicing in a Rapidly Changing Profession.” In that session, Moderator James W. Tippen, of James W. Tippen & Associates, was a humorous, lively, and engaging facilitator for members of the audience and panelists Laurence R. Tucker, of Armstrong Teasdale, LLP, Koriambanya (Kori) Carew, of Shook, Hardy & Bacon, LLP, Adrenna Taylor, of the Port Authority of Kansas City, and Barbara Glesner Fines, of the University of Missouri-Kansas City School of Law. The session struck me as the most thought-provoking and generally-applicable of the plenaries, and its theme, comments and discussions have stayed with me vividly ever since. The theme of the session as stated in the program was: “Change is inevitable . . . but it also often can be disconcerting. Nowhere is that more evident than within the legal profession, where even the slightest shifts often have enormous consequences. Indeed, numerous studies, task forces and committees at the national and state levels have focused on the impact of change and the future of the legal profession—not to mention being addressed in blogs, legal publications, and wherever lawyers gather. Those concerns would seem to be well-founded, as it would appear that the legal profession is immersed in challenges—increased competition from inside and outside of the profession, concerns about diminished professionalism and declining value in the eyes of the public, increased stresses brought on by altered career opportunities, the enormous debt carried by many young lawyers, the unremitting impact of technology, and more. Faced with all of this, where do lawyers go from here? Join the panelists—themselves representing the multi-generational composition of the profession today—for an interactive discussion of the forces of change, their impact on lawyers in the trenches, and how change can be converted into opportunities for improvement.” The comments from the panelists centered around generational workplace issues, with Mr. Tucker representing the “Baby Boomers,” Ms. Carew

representing “Generation X,” Ms. Taylor representing the “Millennials,” and Ms. Fines providing an educational perspective on the next generation to come. Mr. Tucker started with a historical perspective on the increasing mobility of lawyers between firms, jobs, and even careers, noting that attitudes of lifetime loyalty towards institutions in other industries have deteriorated as well as a result of catastrophic bankruptcies, loss of pension benefits, and other business failures. Although Mr. Tucker’s main concern was that there now appears to be “less legal work but more lawyers,” Ms. Carew opined and Ms. Taylor agreed that meaningful work is the biggest concern for most lawyers today, along with more diversity and a multi-generational workforce practicing multi-jurisdictionally (or even globally) in a collaborative, entrepreneurial environment steeped in technology (for further information, Ms. Carew recommended the American Bar Association’s e-book You Raised Us—Now Work with Us: Millennials, Workplace Success, and Building Strong Workplace Teams). In that connection, Ms. Fines discussed the teaching and development of the non-technical side of the law through the extensive feedback and individual assistance provided in her school’s clinics, externships and lawyering skills program. Ms. Carew cited author Brené Brown’s work for the proposition that we all have two basic needs: to belong and to connect; in addition, she submitted that we all need three things to do our jobs well: to be relevant, to be measured, and not to be anonymous. She suggested that most people leave their jobs because they do not feel valued or supported, or because of lack of mentorship or meaningful work (and not because of compensation issues as is commonly thought), and recommended sharing experiences as the best way to deal with change. Several audience members did so, and as a result an additional theme emerged around some lawyers experiencing symptoms akin to post-traumatic stress disorder as a result of the traumatic events they often experienced or witnessed in their practices and lives; the dialogue echoed presentations and discussions at several other sessions and programs on “lawyers in crisis,” and the work of the newly-formed Missouri Bar Joint Task Force on Lawyers Helping Lawyers (of which

Contrary to what my parents told me when I was an awkward teen, it’s good to be popular. Popularity is awesome, and almost always preferable to the alternative. OK, popularity isn’t everything, but it’s a good start and an encouraging indicator. And the November 4, 2014 ballots indicated that Greene County has the most popular judges in the state. This past election marked exactly six years from the day Greene County voters adopted the nonpartisan court plan. Since that time our 31st Circuit Judges have been on the ballots twice. Your state and local bar associations have worked hard to educate members and the public on the process and provide material so that voters can make informed decisions. Ten years ago I was not a supporter of the Non Partisan Court Plan. I wasn’t an opponent, just ambivalent. But in 2004 I changed my mind. I was contacted by an excellent young reporter with the News-Leader. She asked me about two candidates running for judge. She was trying to write an informative piece and she couldn’t get any information that she felt was relevant to their qualifications. She asked me why they kept focusing on their volunteer work and church activities. She specifically asked me “what was the difference” between the two candidates, a question that I artfully dodged. I did, however, respond to her question as to why the judicial candidates seemed to be avoiding law related topics. I told her that they really couldn’t speak to substantive issues, to do so would be precarious and potentially a breach of the judicial code. That conversation transformed my opinion of the process. I suddenly realized that in our bar of 700 members (in 2004) maybe 70 knew both men running for judge. If the lawyers didn’t know them, how in the world would the public be able to cast an informed vote? Fast forward ten years, to November 4, 2014. Voters in polling places across Greene County cast their preferences for legislators, Constitutional Amendments, and state court judges. When the results were tallied, our Greene County judges had the highest voting percentages in the state. Circuit Judge David Jones and Associate Circuit Judges Dan Imhof, Jason Brown and Mark Powell all received over 75% votes cast. Of the fifty judges up for retention statewide the majority received 55 to 65% of the votes,

and only one in the state joined our Greene County judges by passing the 70% mark, barely. The popularity of our 31st Circuit judges caught the attention of a News-Leader reporter, who wrote a story about it the next day. He interviewed Judge Mark Powell, who had the happy distinction of receiving 77% votes cast, the highest in the state. When Judge Powell was asked his thoughts on the matter he said “I think we do a pretty good job. I think it also has to do with the Bar Association. I think that the lawyers are very good at what they do. They get along and support the judiciary here.” I’m proud of our Greene County Courts. Through state and national organizations and appointments I’ve been exposed to the operations and challenges of other jurisdictions. I’ve learned that the 31st Circuit has an excellent reputation for being efficient, innovative and cooperative. And our own Presiding Judge, the Honorable Thomas Mountjoy, was recently named chair of the state’s Presiding Judges’ Executive Committee. In high school my parents told me it was more important to be intelligent and informed than popular. It might have been nice to be both, but I will never know. This year the Springfield Bar worked to help the public make an intelligent and informed decision in the judicial election. Under the Nonpartisan Court Plan, our 31st Circuit Judges are part of a rigorous review process. A local Judicial Evaluation Committee comprised of six lawyers and six non-lawyers reviews attorney surveys, juror surveys and writing samples. The evaluation committee makes a recommendation and provides a narrative description of their findings, along with the survey results, online. The members of our hardworking, local Judicial Evaluation Committee are Ron Baird, Morey Mechlin, Warren Harris, Teresa Grantham, Rodney Nichols, Matt Russell, Debbie Dodge, Annie Busch, Brad Bodenhausen, Brian Fogle, Francine Pratt and Mark McFatridge. I am grateful for their service. And I am deeply appreciative for our local chapter of the League of Women Voters. The league is our number one partner in getting the evaluation results to the public. And for any reporters that might like to do a story on the judicial election and evaluation process, go ahead and call me. Thanks to the Nonpartisan Court Plan and the Judicial Evaluation Committees, I’ve got something for you.

AMENDMENT ICongress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the government for a redress of grievances.

AMENDMENT IIA well regulated militia, being necessary to the security of a free state, the right of the people to keep and bear arms, shall not be infringed.

AMENDMENT IIINo soldier shall, in time of peace be quartered in any house, without the consent of the owner, nor in time of war, but in a manner to be prescribed by law.

AMENDMENT IVThe right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall issue, but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

AMENDMENT VNo person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a grand jury, except in cases arising in the land or naval forces, or in the militia, when in actual service in time of war or public danger; nor shall any person be subject for the same offense to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived

of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation.

AMENDMENT VIIn all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the state and district wherein the crime shall have been committed, which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have the assistance of counsel for his defense.

AMENDMENT VIIIn suits at common law, where the value in controversy shall exceed twenty dollars, the right of trial by jury shall be preserved, and no fact tried by a jury, shall be otherwise reexamined in any court of the United States, than according to the rules of the common law.

AMENDMENT VIIIExcessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted.

AMENDMENT IXThe enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people.

AMENDMENT XThe powers not delegated to the United States by the Constitution, nor prohibited by it to the states, are reserved to the states respectively, or to the people.

Chief Justice Presents Awards to Judges Lynch and Gaston

Supreme Court of Missouri Chief Justice Mary R. Russell named two SMBA members as recipients of the 2014 Chief Justice Awards. The awards recognize judicial civics, judicial excellence at the associate circuit, circuit and appellate levels, access to justice and a jurist’s efforts to improve the public trust and confidence in the courts. The Honorable Gary Lynch, Missouri Court of Appeals, Southern District received the Appellate Judicial Excellence Award, and The Honorable Douglas Gaston of the 25th Circuit, Texas County received the Judicial Civic Award. The awards were presented at the Judicial Conference Recognition Breakfast on Thursday, September 11, in Kansas City.

Dixon Recognized by Missouri Bar

State Senator Bob Dixon was honored by the Missouri Bar at the Annual Meeting Opening Luncheon, Thursday, September 11, in Kansas City. Dixon, who serves as chair of the Senate Judiciary Committee, received the Missouri Bar Legislative Award which recognizes significant contributions to legislation which affects the administration of justice and the integrity of the judiciary.

Strong and Smart Receive Missourian Awards

Past SMBA President, Tom Strong and Clif Smart received their awards in a banquet September 27 at the Capitol Plaza Hotel in Jefferson City. The Missourian Award honors the state’s citizens who have had significant impact on their community and on the state’s vitality. Nominees must have made an outstanding contribution in their community, state or nation in one of the following fields: civics, business, arts or politics.

Powell One of SBJ “Men of the Year”

SMBA member and past president, Gary Powell was chosen as one of Springfield Business Journal’s 2014 Men of the Year. Powell, an attorney with Spencer Fane Britt & Browne LLP Powell is one of 20 selected to be honored at the SBJ Men of the Year luncheon held August 22 in the White River Conference Center. The award recognizes the professional, philanthropic and civic contributions of men from across southwest Missouri.

Missouri Bar President-Elect Reuben Shelton presented SMBA member Susan Jensen with the 2014 Roger P. Krumm Family Law Practitioner of the Year Award during 14th Annual Missouri Bar Family Law Conference in Branson.

MLW Honors Five SMBA “Up and Coming”

Five SMBA members were honored in the Missouri Lawyers Weekly 2014 Up and Coming awards Friday, October 3, 2014 in St. Louis. The award identifies promising lawyers under 40 years old or within the first 10 years of their careers.

This year’s honorees include: Michael Miller, Lowther Johnson, Casey Clark, Missouri Secretary of State’s Office, Andrea Long, Legal Services of Southern Missouri, Jennifer Growcock, Polsinelli and Claire McClintic, O’Reilly Auto.

The Up & Coming lawyers were selected by the newspaper’s editors based on their academic and career accomplishments, their ability to overcome obstacles in their lives and careers, their community involvement, and their potential to make a difference in the profession, the legal system or the community.

SBJ Honors SMBA Members as Influential Women

Three SMBA members were selected for the 24th class of the Springfield Business Journal’s Most Influential Women. 2014 honorees include: The Honorable Becky Borthwick, Springfield Municipal Court, Amy Fite, Christian County Prosecuting Attorney and Jennifer Growcock, Polsinelli P.C.. Also in the 2014 class of honorees is Sharon Alexander of Legal Services of Southern Missouri, friend and supporter of our bar. They were honored with the entire 2014 class at a lunch on October 10, 2014 at University Plaza Convention Center.

Four SMBA Members Chosen for 2014-15 MoBar Leadership Academy

Twelve attorneys were chosen for the 2014-2015 Missouri Bar Leadership Academy. The academy, now in its 15th year, seeks diversity in gender, race, area of practice, and locality of practice with the goal of including attorneys from underrepresented areas to broaden and strengthen The Missouri Bar.

LEGACY CAMPAIGN

As the beloved character, Atticus Finch, of To Kill a Mockingbird said, “But there is one way in this country in which all men are created equal—there is one human institution that makes a pauper the equal of a Rockefeller, the stupid man the equal of an Einstein, and the ignorant man the equal of any college president. That institution, gentlemen, is a court. It can be the Supreme Court of the United States or the humblest J.P. court in the land, or this honorable court which you serve. Our courts have their faults, as does any human institution, but in this country our courts are the great levelers, and in our courts all men are created equal.”

In 1976, leaders of the Springfield Bar set the stage for equal access to justice in our community when it created the Legal Aid Association of Greene County, known today as Legal Services of Southern Missouri (LSSM). Over the years the Springfield Bar and LSSM have become independent entities but continue to work together so that those with limited means are not denied representation in our courts. To celebrate our linked past and help sustain this shared priority, the Springfield Metropolitan Bar Foundation (SMBF) and Legal Services of Southern Missouri have initiated the “Legacy Campaign.” The SMBF and LSSM are joining together to seek support from every attorney to raise $500,000 to help retire the debt of the LSSM and Springfield Bar buildings. Retiring the debt as soon as practical will free resources allowing LSSM

to increase client service and also allowing the SMBF to advance its mission to enhance public understanding and respect for the rule of law. In commemoration of the “Legacy Campaign,” the community room at LSSM Headquarters will be named the Springfield Metropolitan Bar Community Room. “Legacy Campaign” donors will be recognized on the community room’s Wall of Honor, listed in SMBA Bar News and LSSM’s Annual Report and newsletter, and on both organizations’ websites.

All of us wish to leave a legacy. We hope that our efforts, whether in the workplace, our homes, or community will continue and flourish long after we are gone. Your legacy can be a part of the Springfield Metropolitan Bar Community Room. The “Legacy Campaign” includes a range of pledge levels as outlined below, and we will work with you to manage your five-year pledge and the method of payment. You will be joining your colleagues who have already made a financial commitment.
