Decision Regarding Designation of Bodicote Neighbourhood Area Members are advised that the area originally proposed by Bodicote Parish Council for the Neighbourhood Plan covered the whole of the existing Bodicote Parish Council area (Map 1 Enclosure 8a). Cherwell District Council considered the comments received and at a meeting on 4 January determined that an alternative area should be designated (Map 2 Enclosure 8b). The reasons for this are set out in the 'Decision Document' which is available on the Council's website at http://www.cherwell.qov.uk/neighbourhoodplanning/index.cfm?articleid=11049. In summary this decision was made because from April 2016 land currently within Bodicote Parish will be within Banbury Town Council's administrative area following a review of the Parish Boundaries in 2013, and it was considered that the Neighbourhood Plan area should follow these revised boundaries.

9. Notice of Temporary Traffic Order Banbury, Middleton Road - Prohibition of Vehicles Date of Order: 8 February 2016 Coming into force: 15 February 2016 This Order is being introduced because of sewer repairs which are anticipated to take 3 weeks to complete. The effect of the Order is to temporarily prohibit any vehicle proceeding in the length of Middleton Road from its junction with McKeevor Place to its junction with Duke Street. Appropriate traffic signs will be displayed to indicate when the measures are in force. Exemptions are included for emergency services and for the works and for access to premises which are only accessible from the closed section of road. The alternative route is via Middleton Road, Ermont Way, Hennef Way, Concorde Avenue, Bridge Street and vice versa. This Order will remain in force for a maximum period of 18 months or until the works have been completed whichever is the sooner.

interests as necessary as soon as practicable after their arrival even if the item in question has been considered;

(ii) In such circumstances, the Member must withdraw from the meeting room, and should inform the Chairman accordingly.

Councillors Clarke declared that as a Member and Councillor Beere declared that as an Alternate Member of the Planning Committee of Cherwell District Council, any views expressed at the meeting would be based on the information currently available and that final decisions, which in the light of further information, might differ from previous views, would be made at the Local Planning Authority Meeting.

IT WAS RESOLVED that the Minutes of the meeting held on 16th December 2015 be approved as a correct record and signed by the Chairman.

PL.92/15 Planning Applications to be Considered The Committee considered various planning applications that had been referred to the Town Council for consideration by Cherwell District Council (CDC) and were matters that had been delegated to the Planning Committee or where a Ward Member had referred a delegated application. IT WAS RESOLVED that the comments, as set out in Appendix 1, be forwarded to the Local Planning Authority.

PL.93/15 Planning Applications Delegated to the Town Clerk The Town Clerk had submitted a schedule containing details of planning applications which had been delegated to him in consultation with the Chairman, setting out the observations that had been forwarded to Cherwell District Council. IT WAS RESOLVED that the report be noted.

PL.94/15 Decision Notices Members were advised that 4 Decision Notices had been received where the decision of the Planning Authority was contrary to the observations of the Town Council. Application No. 15/00514/LB & 15/00513/F (38 High Street), where the Committee had objected to the change of use from ground floor retail to residential usage, had both been granted. Application No. 15/01270/F (119 Bretch Hill), where the Committee had no objections, was refused due ‘to the positioning and scale of the proposed extension resulting in a visually incongruous form of development affecting the visual amenities of the locality.’

IT WAS RESOLVED that the report be noted.

PL.96/15 Cherwell District Council – Nominations for Non-designated heritage assets Members were advised that Cherwell District Council had now assessed several nominations put forward by the Town Council and others and determined that they should be included on the list of Non-Designated Heritage Assets. The following properties were nominated by the Town Council: x 60-62 Broad Street, Banbury x Duke of Wellington Public House, 101 Warwick Road

The following building had also been put forward by others: Neithrop Methodist Chapel, Boxhedge Road Non-designated heritage assets were identified in the National Planning Policy Framework (NPPF) as “A building, monument, site, place, area or landscape identified as having a degree of significance meriting consideration in planning decisions, because of its heritage interest”. Cherwell District Council would take a balanced judgement with regard to the scale of any harm or loss and the significance of the heritage asset.

Since 2006 when the building had a two storey rear extension, there has been a significant amount of tree works at this property. If this application is permitted, 15 trees will have been felled from this property since 2009.

Cherwell District Council, as Local Planning Authority has No Further Comments or Objections to the stated proposals described in the above-mentioned Section 211 "Notice of Intent". OBJECT- This proposal is considered to be overdevelopment of the site. The proposal will fail to enhance the setting of the neighbouring listed building. The application form states that there will be an additional parking space provided (making 8) but on the proposed plans there are only 7. Access to the waste bin area will be impossible if there is a car parked in space No.1. No sizes of the flats have been offered and no scale bar is contained on the drawings - so it is not possible to deternmine the overall size of the flats. It is, howeveer, felt that the size of the apartments and the lack of windows will offer a poor standard of amenity to the future occupants.

Granted: 06/01/16 Subject to 6 x conditions. PLANNING NOTES The proposed building is situated immediately adjacent to a curtilage listed wall within the courtyard. This planning permission does not grant consent for any works to this listed structure and the proposed development must not touch the wall or involve any works to the wall.
