01: WHEREAS, on 20 January 2020 (Mon), the Bids and Awards Committee 1 (BAC1) posted an Invitation to Bid at PhilGEPS Website, DAP Website, and DAP-Pasig conspicuous places for the Project above-stated, sent Invitation to six (6) Observers, and directly invited 20 Prospective Bidders, through email-invitation, to participate in the Competitive Bidding for the Project;

02: WHEREAS, among the 20 Prospective Bidders directly invited, only two (2) sent their Letter of Intent, namely: [1] Accent Micro Technologies, Inc., and [2] Trends and Concepts Total Interior Solutions;

03: WHEREAS, on 05 February 2020 (Wed), the Pre Bid Conference was conducted on DAP Building, San Miguel Avenue, Ortigas Center, Pasig City, wherein nine (9) Prospective Bidders attended, namely:

01. Kergie Enterprises;

02. E & S Builders;

03. Accent Micro Technologies, Inc.;

04. Astram Marketing General Contractor, Inc.;

05. Trends and Concepts Total Interior Solutions;

06. Jaymar Builders;

07. FFJJ Construction;

08. Biometrics; and,

09. MZR Builders.

04: WHEREAS, from the above-named Prospective Bidders and those who have requested in the PhilGEPS’ Document Request List, four (4) bought the Official Bidding Documents (OBD), namely:

01. Kergie Enterprises;

02. E & S Builders;

05: WHEREAS, on 22 November 2019 (Fri) the interested Bidders who participated in the Conference raised concerns which immediately responded by the BAC1, as follows: 01: Q1: from Mr. Erik Anthony Libranda (Mr. Libranda) of Kergie Enterprises re:

Specific Brand of Materials.

R1: The BAC answered that the Contractor still have to submit a mock-up or document with all the actual specification of the materials that has to be installed. TWG Chairperson Engr. Vener V. Maderaje (Engr. Maderaje) added that materials to be installed shall be approved first by the DAP according to the specifications provided in the OBD and will not exceed the Approved Budget for the Contract.

02: Q2: from Mr. Libranda of Kergie Enterprises re: 90-calendar days project duration.

R2: The BAC answered that the entire Project Duration shall include the processing and approval of the Building Permits and the actual Project Implementation.

03: Q3: from Mr. Erik Anthony Libranda, VP-Operations of Kergie Enterprises, re: Payment Method.

R3: The BAC answered that upon receipt of complete documents from

the Contractor, the DAP allotted 28 working days, as the maximum days on processing payment.

04: Q4: from Ms. Quiroz, Mktg Officer of MZR Builders, re: Finalization and Approval of Design/Plans.

R4: The BAC answered that the End User together with the DAP Engineers are in charge of reviewing and endorsing the final floor plans for approval of the Head of the Procuring Entity.

06: WHEREAS, on 20 February 2020 (Thu), the Submission and Opening of Bids was conducted and three (3) out of four (4) Bidders attended the proceeding, namely: [1] Kergie Enterprises, [2] E & S Builders, and [3] Accent Micro Technologies, Inc.;

07: WHEREAS, at exactly 10:18AM, the BAC1 Chairperson called the meeting to order and the order of opening of bids were based on the time it was submitted: [1st] Kergie Enterprises (KE) submitted at 08:15AM, [2nd] E & S Builders (ESB) submitted at 09:16AM, and [3rd] Accent Micro Technologies, Inc. (AMTI) submitted at 09:34AM;

08: WHEREAS, prior to the opening of their Bids, BAC Member Gerald Y. Cruz confirmed the presence of the Authorized Representatives for the three bidders as named in their Letter of Authorization;

09: WHEREAS, for the third bidder, AMTI’s named Authorized Representative, Ms. Charisse Charmaine M. Castro, was not present during the Opening of Bids;

10: WHEREAS, the summary of the Opening of Bids are as follows:

11: WHEREAS, the Bid submitted by ESB was declared as “FAILED” on the reason

that the document tagged as “E03” does not contain ESB’s Valid Mayor’s/Business Permit and manifested that they will no longer filed a Request for Reconsideration (RR) and accepted the decision of the BAC1;

12: WHEREAS, the Bid submitted by AMTI was also declared as “FAILED” on the reason that AMTI was not properly represented since the authorized representative named in their Letter of Authorization was absent during the Opening of Bids and the BAC Chairperson asked AMTI whether they will file an RR and Architect Edgar Delovino, Jr. of AMTI answered that they will no longer file an RR and accepted BAC’s decision;

13: WHEREAS, on 20 February 2020 (Thu), the BAC1 and its Technical Working

Group (TWG) conducted a Bid Evaluation on the submitted bids by Kergie Enterprises (KE);

14: WHEREAS, on 21 February 2020 (Fri), the BAC1, through the BAC Secretariat,

furnish a Notice of Single Calculated Bid1 (SCB) to KE;

15: WHEREAS, on 02 March 2020 (Mon), during the Post-Qualification Stage, the BAC1, through the BAC Secretariat, sent a Clarificatory Questions2 to determine KE’s capability to undertake the Project since on their Proposed Key Personnel, the personnel assigned to be a Site Engineer, which was required to be “Full Time” for the Project was also assigned to other DAP’s Project contracted to KE and to clarify the status of KE’s on-going projects with other agencies;

16: WHEREAS, on 03 March 2020, KE sent their Response3 to the Clarificatory

Question;

17: WHEREAS, on 04 March 2020, the TWG conducted the continuation of their Post Qualification to verify, validate, and ascertain KE’s bid and its response to the Clarificatory Question;

18: WHEREAS, on the same date, a Memorandum4 addressed to the BAC1

Chairperson signed by the TWG Chairperson, recommended to declare the bid submitted by KE as the SINGLE CALCULATED AND RESPONSIVE BID based

on its compliance to the Eligibility, Technical, and Financial Requirements of the Project;

NOW, THEREFORE, be it RESOLVED, as it is hereby RESOLVED;

01. That the bid submitted by KERGIE ENTERPRISES be declared as the Single Calculated and Responsive Bid in consideration of its total amount of SIX MILLION NINE HUNDRED SEVENTY NINE THOUSAND SIX HUNDRED FORTY PESOS AND 22/100 (₱6,979,640.22;);

02. That, a Notice of Single Calculated and Responsive Bid5 be issued to KERGIE ENTERPRISES;

03. That, we, the members of the Bids & Awards Committee1, as per Special Order No. 2020-035, recommends to the President & Chief Executive Officer the approval of this BAC Resolution; and

04. That, a Notice of Award (NOA), be issued to KERGIE ENTERPRISES upon

adoption and approval of this BAC Resolution.
