2014- Time to sort out yourCompany Pension?

We are now more than a yearsince Auto Enrolment pensionsstarted and the first companiesin reached their staging dates,the date by which they had toprovide employees with apension that met the relevantcriteria and qualified as an AEpension. During 2014 we willsee many medium sizebusinesses reach their stagingdates with those employing 90or less employees starting fromJuly.

Those who employ less than50 are then phased in batches

from June 2015 right throughuntil April 2017. So you may bequite a way off before you needto comply with the legislationbut that is no reason to becomplacent.Before auto enrolment, whenemployers set up pensionschemes on a voluntary basis,providers could generally

implement a group pension inas short a time as a week, oreven a few days. But ourexperience so far is proving timeand time again that becauseauto enrolment brings so many

other complications andconsiderations, it can take manymonths to implement a pensionscheme, regardless of its size.

Integrating the AE rules andregulations in an employer'sbusiness is more difficult.Amongst other things: changesmay be required to payrollsystems and processes legal andHR advice might be required,and decisions need to be madeabout roles and responsibilities.

As a result many providersare setting out strict lead intimes. Most will now require atleast six months where nopreparation has taken place.And, in line with The PensionsRegulator, we continue to en-courage employers to at leaststart thinking about AE at least12-18 months before theirstaging date.

And there's another issue.Employers who don't prepare

early might find out too late thatthey need advice, and there willbe very few people around toprovide it.

According to the FCA, thereare a total of 21,684 financialadvisers in the UK as at 31 July2013. But how many will beinvolved in giving autoenrolment advice? Probably onlya few thousand, if that. In otherwords, demand will far outstripsupply.

Providers are also expectingto reach capacity later this yearor early next year so Employerswho do not start early will befaced with an ever decreasingrange of suppliers as time runsout. They could end up beingforced to use a pension providerthat may not provide them withthe solution that best fits theirbusiness.

It is estimated that over 65%of people in England & Wales

don’t havea Last WillandTestament.It is a myththat if youmake aWill, it’sthe downhill slopeto ‘boot

hill’. Yes this would be the casefor those who make a ‘deathbed’ Will and often these endup as a disputed due to theargument of the ‘state of mind’of the deceased should lovedones be excluded.

Similarly,signing thewrong Will. Therehave been caseswhere a husbandand wife havesigned eachothers Willinstead of theirown, despite theclear intention to

make a Will legally a mistakenlysigned Will (even whereidentical to the spouses Will)has beendeemed to beinvalid, causingthe testator todie intestate(without a Will).

Dyingintestate is not astraight forwardas the term‘everything goesto the wife anyway’ is notnecessarily true and can causesignificant complications. Thereare thresholds which will goautomatically to the survivingspouse but once over and abovesaid threshold, the estate can bedivided up between remainingfamily members.

It has been our experiencethat Wills designed by‘unregulated’ companies orprepared personally, are theones most likely to causeconcern. It is also ourexperience that many of theseunregulated companies whovisit you at home, have a slidingscale of charges, usually gaugedby your perceived wealth. Wehave also noticed that suchfirms often include themselvesin your Will, for example asExecutors, giving them carte

blanche to charge fees inconnection with your estateonce you have passed on…..be

cautious.

Usually asuccessful combination, it will beinteresting come award season if Leowill pick up any awards having neverwon an Academy Award for hisprevious work. Will The Wolf finallychange that? I guess we’ll have towait to find out.

Telephone: Unscrupulousscammers usually call you upclaiming to be from Microsoft orBT. Microsoft will NEVER call youabout your computer, and BTwon't call you to give youtechnical support you have neverasked for. A good way to dealwith anyone who calls you to tellyou something is wrong, is to tellthem that you haven't got acomputer! If you want to turn thetables on these pests, say thatyou will call them back, get theirphone number and report it toTrading Standards. In a recentsurvey by Which?, the ConsumerAssociation magazine, threequarters of respondents said thatthey had not been caught out byscam callers, but almost a tenthsaid that they had handed overmoney or may have allowedmiscreants to access theircomputers.

year. For some, though, theplans may be a bit moreambitious – perhaps it’s time tostart a new business. Peopleoften dream about working forthemselves and, whether theyare in a job, not working atpresent, or just ambitious toachieve more, at some pointthey may decide “Now is thetime to go for it!”.

Questions and concerns canhold people back. Questionslike “What do I need to do,legally, to start a business?”, “Ismy idea good enough to makemoney?”, “How do I keepaccounts and handle tax?” and“What are the risks?” needconsidering. Some people areput off by worries about tax,bookkeeping, laws andregulations. In reality, though,for most types of business,these matters are straightforward and easily handled. The

real challenge for any newbusiness is in looking atcustomers, sales, costs andprofit.

A discussion with abusiness coach can help tofocus on the key issues. One ofthe first things I do with anyonewho comes for advice on a newbusiness idea is to sketch out arough plan of how muchmoney the business couldmake. To do that we need toknow what products or servicesthe business is going to sell,and how much would becharged for each. We thenneed to take a view on howmany sales they would expectto make each day, week ormonth. That can be quite hardto do and sometimes it helps tolook at different scenarios:what we reasonably thinkwould be achievable, versuswhat we think the absoluteworst case might be. Then weneed to look at the costs ofrunning the business, howmuch would be spent onbuying in supplies, on payingfor overheads, on marketingthe business – and how muchthat leaves at the end for thebusiness owner to live off.

Some types of business arecheaper to set up and run thanothers. If you need premises

from which to run the business,if you need to employ staff, or ifyou have to spend a lot onstock, you will have to generatea lot more income to breakeven than someone withoutthose costs. A domestic cleaner,or a gardener for example willhave lower running costs andmost of what they earn asincome will stick with them asprofit.

For every new business,though, the key is inunderstanding the potentialmarket. Who might mycustomers be, how will I makethem aware of what I have tooffer, and how will I persuadethem to buy from me? Newbusinesses do not need to becomplex or innovative tosucceed, but they do need to becarefully planned and wellexecuted.
