Effective: From date and time RCS is issued (05/27/2021) until lease award by City Council.

All Respondents and their representatives will only discuss matters of these RCSs with the respective Procurement Officer.

Discussion(s) may occur with the Mayor, City Council members, Deputy City Managers, Aviation staff, etc. ONLY at a public meeting as requested through the Procurement Officer.

As long as the RCSs are not discussed, Respondents may continue to discuss business with City Staff.

RCS 21-018 Overview: Minimum Qualifications

Each Respondent’s Response must demonstrate it meets the Minimum Qualifications as required in the RCS.Failure to meet the minimum qualifications will result in a non-responsive Response.

1. Respondent and Respondent’s joint venture partners, if any, must clearly demonstrate its/theirfinancial ability to fund the initial capital investment proposed by Respondent.

2. Respondent must have three (3) or more years of continuous experience within the last five (5)years in ownership or executive management of a common-use airport lounge in a large hub airportwith active involvement in the day-to-day operation and management of the lounge operation.

3. Respondent’s onsite General Manager must have a minimum of one (1) year of continuousexperience in the last three (3) years managing and supervising lounge services in an airport.

4. Respondent must have minimum annual gross sales receipts in excess of $500,000 in at least oneairport lounge managed in one (1) of the last three (3) years.

Respondents who do not meet the minimum qualifications are encouraged to joint venture partner orsublease with more established firm(s).

RCS 21-018 Overview: Response Guarantee

Each response MUST be accompanied by a Response Guarantee in the form of a cashier’s check payable, without condition or restrictive endorsement, to the City of Phoenix.

Each Respondent’s Response Guarantee must besubmitted in a sealed envelope clearly marked“Response Guarantee” along with the Response.

Response Guarantee Amount:$10,000.00

RCS 21-018 Rent & Lease Term

Contract Term:10 years

Minimum Annual Guarantee (MAG) or Percentage Rent• A minimum of $250,000 or greater • Percentage Rent will be 13% • First year of the primary term of Lease, rent will be:• Proposed MAG, or % Rent, whichever is greater.

For all subsequent years of the Lease, MAG will be 85% of the prior years’ annual rent revenues or 103% of MAG for the prior year, whichever is greater.

Hours of Operations:• 7 days a week• 365 days per year• Opening 90-minutes prior to the first T4 flight departure • Remaining open 30-minutes after the final departure from T4

Business hours are be subject to change at the sole discretion of the Aviation Department.

RCS 21-018 Operational RequirementsCustomer Service:• Provide exceptional customer service and operate in an efficient, customer friendly,

well-run manner to meet the needs of passengers and other customers. • Expediting the checkout process by accommodating virtual wallets and mobile payment

options.

Customer Correspondence• Collect, respond to, or elevate to Aviation Department Representative. • Ensure customer correspondence is addressed in an expeditious manner as follows:

o Written complaints or concerns answered within twenty-four (24) hours.o If received through the Mayor or City Council offices response will be immediately.

Lost and Found• Make reasonable attempts to identify and return lost items to customers.

• Take measures to protect any personally identifying information included in the lost items such as identification cards, credit cards, etc., in accordance with all applicable regulations.

RCS 21-023 Overview: Minimum Qualifications

Each Respondent’s Response must demonstrate it meets the Minimum Qualifications as required in the RCS.Failure to meet the minimum qualifications will result in a non-responsive Response.

1. Respondent and Respondent’s joint venture partners, if any, must clearly demonstrate its/their financial ability to fundthe initial Capital Investment proposed by Respondent on Attachment F (Proposed Capital Investment by Concession Space and in the Aggregate). Documentation must be provided in the Response consisting of audited financial statements for fiscal years 2019 and 2020 and/or current letters of intent from financial institutions.

2. Respondent must have three (3) or more continuous years in the last five (5) years of ownership or executive management of a Retail business operation in an airport with active involvement in the day-to-day management of the retail business operation (qualifying business). If Respondent is a newly formed entity, Respondent must demonstrate that owners, which may include JV partners, of Respondent who, in the aggregate, own 51% or more of the entity each satisfies this experience requirement.

3. Respondent’s qualifying business must have achieved minimum gross sales of $2.5 million dollars for one (1) of the last five (5) years.

Respondents who do not meet the minimum qualifications are encouraged to joint venture partner or sublease with more established firm(s).

Each Respondent’s Response must demonstrate it meets the Minimum Qualifications as required in the RCS for Package # 2 (Coffee Focus plus Café Bar) *Small Business Opportunity Only.Failure to meet the minimum qualifications will result in a non-responsive Response.1. Respondent and Respondent’s joint venture partners, if any, must clearly demonstrate its/their financial

ability to fund the Capital Investment proposed by Respondent.

2. Respondent must have three (3) or more continuous years, in the last five (5) years, of ownership or executive management of a Food & Beverage business operation in an airport with active involvement in the day-to-day management of the Food & Beverage business operation (qualifying business).

3. Respondent’s must be a Small Business Firm, as that term is specified in Section I (B), and direct lease with the City.

4. Respondent’s qualifying business must have achieved minimum gross sales of $700,000 for one (1) of the last three (3) years.

Respondent(s) who do not meet the minimum qualifications are encouraged to joint venture, partner or sublease with more established firms (all Respondents and their partners must meet the Small Business requirement).

F1: Food Hall including seating Create an engaging experience & attract consumers from all age groups that showcase the different varieties of cuisine that a city has to offer. They are typically a mix of local artisan concepts, ethnically diverse foods, tasting bars and other food and beverage-oriented specialties. Gourmet burgers, custom sandwiches, salad bars, poke bowls, sushi, street tacos, hand tossed pizzas, freshly baked pastries, etc. are consideration as well as quick serve concepts augmented with fresh and healthy food choices.

F3: Coffee Focus Plus Café BarDesignated primarily for a coffee concept and must be developed into a national brand or local/regional coffee concept selling a variety of freshly brewed coffees and teas including lattes, cappuccinos, espressos, flavored teas, and iced and decaffeinated coffees and teas. Hot chocolate and milk should also be offered. Offer a variety of food and beverage items including pre-packaged sandwiches, packaged snack foods, baked goods, and other non-alcoholic beverages.
