WHEREUPON Roberto Fernandez was duly sworn to tell the truth by Kathryn Lopez, Notary Public, and testified as follows:
Q Will you state your name, please? A Roberto Fernandez.
Q What is your date of birth? A 24 April 1919.
Q Would you please give me your home address? A 1521 S.W. 7th Street.
Q Is that a house or an apartment?A Apartment #6.
Q Would you tell me where you are presently employed? A At the Ocean Pavilion Hotel, 5601 Collins Avenue, Miami Beach.
Q What is your position there? A • Houseman.
Q Mr. Fernandez, do you have a telephone? A No.
Q What is your telephone number here at work? A 865-6511.
Q Mr. Fernandez, do you recall anything unusual occurring that might have happened during the month of April, 19761 If so, would you tell me what day it was and what you recall about that day?
A I remember the month because it was my birthday. I recall being there during the day when the explosion took place.
Q Mr. Fernandez, would you tell us what you were doing there that day and how it came about that you were at S.W. 1st Street and 13th Avenue on the date of the Milian incident?
A Blanca wanted me to set up a date with Felipe. Blanca wanted·' to talk to Felipe away from the hotel, so I arranged a meeting at that location, which would be convenient for myself and her, because we don't have cars. The meeting was set up to be held in the vicinity of Garces Academy.
Q Was the meeting place set by Blanca or you or Felipe? A The meeting place was picked by Felipe, and I afterwards passed
on the instructions to Blanca •

To meet where and at what time? The meeting was set up for 6:00 p.m.
What time did you arrive at the meeting place? I arrived there around 5:45 p.m. Felipe arrived a few minutes later~ with the car. Felipe told me that he parked the car by the clinic.
Where is the clinic located? I don't know what clinic and--it is a clinic around the area. I don't know the name or where it is.
Did Felipe walk to you from where he parked the car? How did he get to you?Felipe walked back after parking the car. He walked up to where I was standing, which would be on the southeast corner of Flagler and 13th Avenue, Flagler Terrace, where there is a little cement ledge.
During the time' that you were standing on the corner by yourself, before Felipe arrived, do you recall noticing anything unusual in the WQBA parking lot? No. I really wasn't paying attention to anything. I was only waiting for Blanca.
Mr. Fernandez, did you notice anything unusual in the parking lot or the area of the parking lot after Felipe arrived?
• Yes, I observed a man that walked up to a car and took out a tool box, something that looked similar to a tool box.
Did you observe where that man with the tool box came from? I recall the man walking up to the car and opening the door and taking ,out the tool box, and he proceeded to walk across the street, and after that I didn't pay no attention to him.
When you say the man walked across the street, in what direction are you talking about? Would it be north, south or east? Which direction are you talking about? The man walked in a westerly direction across the street towards WQBA Station. After that, I paid no further attention to him.
Would you describe the vehicle from which the man removed the tool box? The car appeared to be a white car, a dirty white in color, approximately a 1960 model. I don't have a car, and I don't know much about cars. That's what it appeared to be .

Q Would you describe the person you saw walk to the car? A The man was approximately 5'10". He weighed'about 165 to
170 pounds, medium build, approximately in his forties.
Q How was he dressed? A He was dressed with dark blue pants and a light blue shirt.
He had dark hair.
Q Have you ever seen this person before? A No.
Q Mr. Fernandez, will you please try to recall where that man, who went to the car and took out a tool box, came from and where he went back to.
A When I first saw the man with the tool box I saw him coming from the parking lot located right behind WQBA. I also saw another man in the parking lot who appeared to be workingaround the car. He appeared to be cleaning the windshield.
Q Was the man who came to the car and the man you saw working or cleaning the windshield, were they in the parking lot together?
A No.
Q And it was not the same person? (Referring to the man with the tool box)
A • No.
Q Can you describe the car the man in the WQBA parking lot was cleaning?
A No. The car appeared to be a big car, and it appeared to have the front hood raised. The man that I observed in the parking lot appeared to be standing close or near to the car with the upraised hood.
Q Can you give us a description of the man standing near the car with the upraised hood?
A The man I saw appeared to have either blonde or dark brown hair and appeared to be heavy set. The man was wearing a blue shirt.
Q Mr. Fernandez, when this person came over to the car to pick up a so-called tool box, how far was he from you and how far was he from Felipe, and could Felipe have seen him?
A Yes, I saw Felipe turn around and he looked at the man and seemed to talk to the man or waive back at him.
(At this point in the hearing, the witness had to return to work and arrangements were made to pick him up at 3:30 and return to the scene at S.W. 13th Avenue and West FlaglerTerrace for the purpose of clarifying related facts)

Sgt. Tellez, Det. E. Mederos, Roberto Fernandez and Stenographer Kathryn Lopez proceeded to WQBA parking lot located on the corner of S.W.Flagler Terrace and 13th Avenue. Mr. Fernandez stated that he was standing on the southeast corner of S.W. 13th Avenue and West Flagler Terrace. He observed a car approximately 25 feet south of the corner of S.W. 13th Avenue and 'West Flagler Terrace, on the east side of S.W. 13th Avenue.
Sgt. Tellez then proceeded to the WQBA parking lot and Mr. Fernandez indicated the location of the parking space where the vehicle, which the subject with the light brown hair, had been working on was parked, which location was in the inside parking lot of the north side of the WQBA parking area, between the fourth and fifth parking spaces, from the west wall. The car was facing the WQBA building. When Roberto Fernandez left, he proceeded south on S.W. 13th Avenue.
(All of the above persons then returned to the CIC Office of MPD, 400 N.W. 2nd Avenue, for the purpose of completins the statement of Mr. Roberto Fernandez.)

How far away from you and Felipe was this man? Approximately twenty-five feet away from us.

• Did you at any time observe anything else or anyone else in that parking lot besides the man cleaning or working on that vehicle that had the hood upraised?No, nothing which would call my attention.

Did you observe any vehicles drive down 13th Avenue or any persons in the area of the WQBA station at the time you were standing on the corner, before or after Felipe arrived? I observed two or three people that went by on foot, .walking on the same sidewalk that I was on, and I saw several vehicles that drove by, but nothing called my attention to it.

Could you tell me approximately, or if you know exactly, what time it was when you arrived and what time you left the corner of West Flagler Terrace and S.W. 13th Avenue? I arrived in the area at approximately twenty minutes to 6:00 p.m., and I left a few minutes after 6:00 p.m., possibly 6:05 p.m•

Q Mr. Fernandez, I have two photo lineups that I would like for you to look at. I would like for you to study each photograph carefully and see if you can recognize anyone, and see if there is anyone familiar to you in the photo lineup.
(Mr. Fernandez was shown Photo Lineup "A" containing six photographs.)
Mr. Fernandez failed to identify anyone from Photo Lineup "A".
Q I am now going to show you Photo Lineup "B", which contains six photographs. I would like for you to look at this photo lineup and examine each photograph carefully and see if you can recognize anyone in these photographs, or see if there is anyone familiar to you.
Mr. Fernandez stated that he could not identify anyone in Photo Lineup "B".
Q Is there anything else that you can tell me at this time that might assist us in this investigation of Emilio Milian's bombing?
A No.
Q Mr. Fernandez, I would like for you to tell me everything you did the day of the incident, or in other words the date you met Felipe and Blanca at S.W. 13th Avenue and West Flagler Terrace,
• from the time that you got up that morning to the time you went to bed that night.
A I went to work at the McAllister Hotel. I usually went to work at 8:00 a.m.. I used to leave work at twenty minutes to 4:00.
Q Mr. Fernandez, how did get to work that day? A I rode to work on bus #5 which I usually took at S.W. 8th Street.
and 15th Avenue, and the normal amount of travel was fifteen to twenty minutes.
Q Mr. Fernandez, did you leave work at any time for lunch or otherwise? Did you leave your place of business that date?
A I don't recall exactly, but normally I would leave during the lunch hour to get my lunch and I usually went to El Recreo, which is located next door to the McAllister Hotel.
Q Mr. Fernanaez, would you tell me what kind of a system they have for employees there. Do you punch a clock or make out an employee attendance sheet? Would you explain what the system is that they have there?
A The system they used at the h6tel is the system of time cards which we used to punch out in the morning when we came to work or during the lunch hour and when we left work in the afternoon. However, due to my friendship and association with Felipe, I usually did not punch out in the lunch hour. I used to exit through the lobby of the hotel and return through the same way. I did not punch out.

Q After you left work where did you go? A I left from work about twenty to 4:00. I hung around Faustino'
Coffee Shop for about a half hour--I don't know exactly. From there, I took the bus to the area of S.W. 13th Avenue and 1st
T Street, where I arrived approximately twenty to 6:00. The explanation for the time is the bus was crowded and also the bridge might have been up tha·t day, and also I may have spent more than a half hour at Faustino's Coffee Shop.

Sgt. Tellez comenzo al lote de parqueo de la WQBA y el Sr. Fernandez endico el sitio de el espasio de parqueo adonde el carro en cual el subjecto con el pelo maron claro estaba trabajando. El sitio era dentro el lote de parqueo en la parte del norte en la area de parqueo de la WQBA entre el cuarto T quinto espasio de parquiar asi de la pare del oeste. E1 frente del carro dirijido asi e1 edificio WQBA. Cuando Roberto Fernandez se fue e1 comenzo asi a1 sur por S. W. 13 Avenida.

Yo lIege a la area aproximadamente 20 minutos antes de Ia 6:00 p.m. y me fui unos minutos despues de la 6:00 p.m. posiblemente la 6:05 p.m.

P Sr. Fernandez, yo quisiera que Ud. me dijera todo 10 que Ud. hizo el dia del incidente, 0 en otras pa1abras e1 dia que Ud. se site con Felipe y Blanca en la 13 Avenida del S. W. Y West Flagler Terrace, desde el tiempo que Ud. se levanto en 1a manana hasta que Ud. se acosto por la noche.
R Yo fui a trabajar a1 hotel McAllester y usua1mente yo estoy en el trabajo a las 8:00 y termino el trabajo a las quatro menos vente.
P Sr. Fernandez, como llego al trabajo Ud. es dia? R Yo cojo el omnibus #5 que usualmente cojo en 1a 8 Calle y 15
Avenida del S. W. La cant ida de camino eran 15 a 30 minutos.
P Sr. Fernandez, Ud. se fue del tranajo en algun momento para almorzar 0 otras cosas. Dejo Ud. su lugar de trabajo ese dia?
R No recuerdo exactamente pero normalmente yo me voy durante la hora de almuerzo ~ara bus car mi almuerzo y usualmente voy al recreo que esta 10ca1izado al lado del hotel McAllester.
P Sr. Fernandez, me podia decir Ud. que sistema tienen para los empleados ahi? Ud. poncha una tarjeta 0 hace una tarjeta de asistencia? Exp1iqueme Ud. que sistema tienen ahi?
R El sistema que se usa en e1 hotel es e1 sistema de tarjeta de tiempo que nosotros usamos para ponchar en 1a manana cuando ~enimos a1 trabajo 0 durante 1a hora de almuerzo y cuando nos vamos del trabajo por 1a tarde. Sin embargo por 1a mista y 1a asociacion que yo tengo con Felipe yo usua1mente no ponchaba en 1a hora de almuerzo. Yo salia por el salon del hotel y regresaba por e1 mismo camino y no ponchaba cuando sa1ia.
P Despues que Ud. se fue del trabajo adonde fue Ud.? R Me fui del trabajo aproximadamente a 1a quatro menos vente y
estube en 1a area de Faustino Coffee Shop por aproximadamente media hora yo no me recuerdo exactamente. Desde ahi yo coji e1 omnibus para 1a area de 1a 13 Avenida del S. W. Y I Calle donde yo lIege aproximadamente 20 minutos antes de 1a 6:00. La exp1icacion por e1 tiempo en e1 omnibus fue que estaba muy lleno y que el puente podia estar habierto ese dia y ta1ves yo me podia aver pasado mas de media hora en e1 Coffee Shop Faustino.
