CANCELLATION OR CURTAILMENT up to £3,000: If you have to cancel or cut short your trip due to illness, injury, redundancy, jury service, the police requiring you toremain at or return to your home due to serious damage to your home, you are covered against loss of travel and accommodation costs. See section headed Increased Excess for Pre Existing Medical Conditions for increased excesses applicable to claims arising from pre existing medical conditions. PERSONAL ACCIDENT up to £15,000: A cash sum for accidental injury resulting in death, loss of sight, loss of limb or permanent total disablement. MISSED DEPARTURE up to £500: Additional travel and accommodation expenses incurred to enable you to reach your overseas destination if you arrive too late at yourfinal UK outward departure point due to failure of the vehicle in which you are travelling to deliver you to the departure point caused by adverse weather, strike, industrialaction, mechanical breakdown or accident to the vehicle.PERSONAL LIABILITY up to £2,000,000: Covers your legal liability for injury or damage to other people or their property, including legal expenses (subject to the laws ofEngland and Wales).LEGAL EXPENSES up to £25,000: To enable you to pursue your rights against a third party following injury.EMERGENCY ASSISTANCEThere is a 24-hour emergency assistance service included in the policy so that any insured person may seek assistance in medical emergencies whilst on holiday. POLICY EXCESSES: Cancellation or Curtailment:The first £50 of each and every claim per Insured Person claimed for under this Section is excluded, increased to £100 where You are aged 66 to 75 years and to £150 whereYou are aged 76 to 90 years. Medical and Other Expenses: The first £75 of each and every claim per Insured Person claimed for under this Section is excluded. Where You areaged 66 to 75 years the first £150 of each and every claim per Insured Person claimed for under this Section is excluded. Where You are aged 76 to 90 years the first £300 ofeach and every claim per Insured Person claimed for under this Section is excluded. Other Sections: An excess of £50 applies to each and every claim each insured personunder the Personal Luggage Money & Valuables and Delayed Departure (b) sections, and £250 under the Personal Liability section.MEDICAL SCREENING: A special feature of this policy is that you only need to declare your medical conditions if you are travelling outside of Europe. MAIN HEALTH EXCLUSIONSWe will not pay for claims arising directly or indirectly from the following circumstances existing on the date of applying for this insurance:(a) Where You (or any person upon whose health the Trip depends) have or have had symptoms which are awaiting or receiving investigation, tests, treatment, referral or theresults of any of the foregoing, unless We have agreed in writing to cover You.(b) From any terminal illness suffered by You (or any person upon whose health the Trip depends).(c) From any medical condition for which You (or any person upon whose health the Trip depends) have within 12 months prior to the date of issue of this insurance beendiagnosed with a medical condition or have been admitted or undergone a procedure/ intervention.(d) From any reoccurrence of any psychiatric disorder, anxiety state and/or depression suffered by You (or any person upon whose health the Trip depends).(e) Where You travel against any health requirements stipulated by the Carrier, their handling agents or any other public transport provider.(f) Medical conditions existing prior to the payment of the insurance premium or any consequence thereof in respect of which a Medical Practitioner would advise against travelor that treatment may be required during the duration of the Trip.

Our Fair Trading Agreement on holiday information setsout clearly and simply the responsibilities which we at AVA Travel (Leyland) Ltdhave to you and which you in turn have to us when a contract is madebetween us. The contract is made when you make a booking and we accept itby written confirmation on the terms set out in this brochure. When signing thebooking form for your holiday you will sign on behalf of yourself and othersnamed in your party, that you have read, understood and have accepted theseconditions and the holiday information provided in this brochure. Yourobligation is to pay the price of the holiday and to recognise your liabilities ifyou wish to alter the holiday or have to make a cancellation. On our part wehave obligations to provide you with the holiday you have booked. When deciding how to respond to your complaint, we will take in toaccount the date you first drew the problem to the attention of our driver,courier or supplier. CONDITIONS OF CARRIAGEWhen you travel on an aircraft, train or ship, the conditions of carriage of thatcarrier apply and are subject to National and International conditions which maylimit or exclude liability. IF WE CANCEL YOUR HOLIDAYIt is necessary for there to be a minimum number of passengers in order tooperate a tour.In certain circumstances, therefore, we may have to cancel your holiday, and ifthis should occur we will return to you all the money you have paid to us, oroffer you a suitable alternative. However, we will not cancel your holiday:

(a) Immediately prior to the departure date unless you have not paid for your holiday in full, if we then cancel your holiday you will be entitled either a comparable holiday or a full refund.(b) After the balance due date, except as a result of hostilities, political unrest or other circumstances amounting to force majeure, (or other options as necessary).

If we have to cancel your holiday at any time, AVA Travel (Leyland) Ltd is liableonly for any money you have paid to AVA Travel (Leyland) Ltd at the time ofcancellation and for the compensation payments as detailed in paragraph 3above.5. WHAT HAPPENS TO COMPLAINTSAll complaints that are received are thoroughly investigated and customers keptinformed at each stage of the investigation. Sometimes the investigations cantake time when awaiting a response from hoteliers. We can normally agree anamicable settlement of the few serious complaints we receive if the complaint isfound to be genuine.6. OUR RESPONSIBILITY TO YOUWe accept responsibility for ensuring, that all component parts of your holidayas described in this brochure are supplied to you to a reasonable standard andthis includes Optional Excursions purchased through our employees or agents.If any such part is not provided in the advertised manner, we will pay youreasonable compensation unless the non provision was due to circumstanceswhich we could not predict and which were beyond our control such asadverse weather, road or traffic conditions or the matters referred to inparagraph 4 (b) above. Please remember that some amenities (e.g. hotel, lifts,swimming pools etc.) require servicing and cleaning and may not therefore beavailable at all times. Whilst we have no direct control over the provision of services toyou by suppliers, we will pay to our clients the equivalent of such damages as theywould be entitled to receive under English Law in an English Court for any personalinjury to the client including illness or death, caused by the failure to perform or theimproper performance of such services by the servants or agents of ourselves or anyof our suppliers contracted or sub contracted by us to provide any part of thearrangements for your holiday as described in this brochure where such failure orimproper performance is due to the fault of such person and not an event whichsuch person could foresee or forestall even if they had taken all due careNOTE: We will make payments as stated above provided: (a) that claims forpersonal injury are notified to us within three months of the return fromholiday; (b) the injured client(s) assigned to AVA Travel (Leyland) Ltd any rightsagainst a supplier or other person or party they may have relating to the claim,(c) they agree to co-operate fully with us should we or our insurers wish toenforce those rights which have been assigned to us or to which we aresubrogated and; (d) such payments is limited in the case of transport by wateror air to a maximum of such sums as would be obtained under the provisionsof the appropriate International Conventions. This assignment is necessary toenable us to try and recover from suppliers any compensation we have paid toclients, and associated costs, arising from personal injury to clients caused bythe fault of those suppliers. If we recover more than such compensation andcosts, any excess will be paid to the injured client.

PERSONAL INJURY(unconnected with arrangements made by us)Where appropriate and subject to our reasonable discretion, we will affordgeneral assistance to clients who through misadventure suffer illness, personalinjury or death whilst travelling on a AVA Travel (Leyland) Ltd holiday arising outof an activity which does not form part of the advertised itinerary nor part of anexcursion offered through the company, and which is the responsibility of athird party.

HOLIDAY INFORMATION (not part of contract)1. CHILDREN'S REDUCTIONSOn most of our holidays reductions are available for children aged between 5and 12 providing the child shares a room with 2 full fare paying passengers.Please enquire at time of booking.2. LUGGAGEWe ask you to keep luggage down to one medium sized suitcase per person,but a small holdall can also be taken on board the coach.3. SEAT ALLOCATION AND SPECIFICATIONRequests for particular seats can be made on most holidays when booking, butsince allocations are made on a first come first served basis, early booking isadvisable. When bookings are made with us you will be offered the seats thatare available on the coach at that time. In the event of the coach being nearlyfull we may contact any single person already booked to ask them to moveseats if necessary to accommodate a new booking from a couple. TRAVEL DOCUMENTSWhen you have paid the balance we will either send to you or the Travel Officethrough which the booking was made, all the necessary labels, so that youreceive them in good time before the holiday departure date. Certaindocuments for example, air or boat tickets, may have to be retained and yourdriver or courier will then issue them to you at the relevant port.6. SPECIAL CARE FOR THE DISABLEDThe holidays in this brochure have been carefully planned to include as much ofinterest as possible. Inevitably some of the holidays include lengthy periods oftravel and some walking on sightseeing excursions. Additionally, many of thehotels will have steps to contend with and may not possess lifts, and althoughwe will try our best to look after disabled passengers, it is important that youenter the word DISABLED in block capitals in the special requirements sectionof the booking form, together with a brief description of your disability. We willmake every endeavour to minimise the discomfort and inconvenience, but forobvious reasons are unable to make any guarantees.7. SPECIAL DIETSIf you require a special diet you must inform us at the time of booking with acopy of the diet.
