I, Luis M. Villaronga, Executive Secretary of the Board of
Trustees of the
University of Puerto Rico, in the absence of the Secretary Rosa
Amelia Franqui Rivera,
DO HEREBY CERTIFY THAT:
The Board of Trustees of the University of Puerto Rico, at its
regular meeting of
20 February 2010, having considered the recommendation of the
President of the
University of Puerto Rico, approved the following:
WHEREAS: The University of Puerto Rico (the University) holds
inusufruct the former Ramey Ammunition Storage depot, alsoknown as
The Montaa Farm, that was ceded by the UnitedStates Department of
Education (the Department),pursuant to Quitclaim Deed number SA-II
PR-502 ofOctober 18, 1981 (the 1981 Deed), which imposed
certainrestrictions of use on the land that are currently in
force(the federal deed restrictions).
WHEREAS: Included with the boundaries of The Montaa Farm is
a100-acre parcel of land, for which the University isinterested in
securing the abrogation of the federal deedrestrictions and intends
to request for their abrogation.
WHEREAS: The federal deed restrictions on the 100-acre parcel
may beabrogated by the Department upon request and payment bythe
University of an abrogation fee of $41,801.76, that isequal to 14
percent of the current appraised value of theproperty.
THEREFORE: Be it resolved as follows:
1. The University of Puerto Rico hereby requests theDepartment
for the abrogation of all federal deedrestrictions over the
100-acre parcel of land locatedwithin the boundaries of The Montaa
Farm.
2. The University of Puerto Rico agrees to pay theabrogation fee
calculated in accordance with theabrogation provision in the 1981
Deed that amounts to

$41,801.76, which is equal to 14 percent of the currentappraised
value of the property.
3. The Interim Chancellor of the Mayagez Campus of theUniversity
of Puerto Rico is authorized and empoweredto act on behalf of the
University of Puerto Rico to doany and all things necessary to
carry out the intent ofthis resolution, including the authority to
request forabrogation of the federal deed restrictions over the
100-acre parcel of land located within the boundaries of TheMontaa
Farm; make any and all payments necessary tosecure abrogation, in
the amount an abrogation fee of$41,801.76, that is equal to 14
percent of the currentappraised value of the property; and sign and
execute all
deeds, documents and instruments required to completethis
transaction.
