Buyer representation. We all believe in it, right? Then why are we sometimes reluctant to ask buyers to sign a representation agreement? Don’t blame consumers. It’s up to you to Understand the reason behind the agreement and get it signed. Here’s how to do it. Make a plan

Understand how a signed buyer representation agreement fits into your business plan. This knowledge will drive your presentation and interaction with buyers. Maybe you’re just starting out and don’t want to eliminate any possible opportunities—so you’ll want to gently introduce the topic. Or, maybe you’ve honed your skills and experience to the point that you’ve decided you’ll only work with buyers if there’s a written agreement—even if some walk out the door. If you aren’t clear about your own goals, you run the risk that buyers will push you in directions that don’t match your objectives. It’s for your protection

From a legal perspective, if you don’t have something in writing, you place yourself at a higher risk. List your exact responsibilities and where they begin and end. Clearly defining the scope and limitations of your services will reduce your risk and foster loyalty. You have the latitude to define your services within the absolute boundaries set by Texas agency laws and within the parameters set by your broker. Put your services in writing and adhere to your guidelines; by law, a written agreement doesn’t need to exist in order for an agency relationship to occur. Make sure you haven’t unwittingly entered into an undocumented but binding relationship. You don’t want to put yourself in a bad situation. Even if you prevail in a grievance—or worse yet, a lawsuit—it costs you time and money, and could leave a blemish on your reputation. Demystify the agreement

Rather than casting the impression that your representation agreement is an onerous legal document that restricts buyers, use it as a tool to demonstrate the real value you deliver to buyer-clients—the benefits you owe them.

Communicate with them

Buyers are looking for a solution-based service, so use a what’s-in-it-for them approach. Translate your services into language they will understand, and they should see the advantage to signing the agreement. Your industry knowledge is the most powerful means to get a buyer representation agreement signed. It enables you to demonstrate a solid belief in your level of service and the personal value you bring to the table. If that doesn’t work, show them

Simply telling clients about the benefits you provide may not be enough. Some buyers need to experience the difference between being a customer and a client. For example, one buyer’s agent offers a tale about buyers who didn’t want to sign a representation agreement, even after she’d discussed its advantages to them. She proceeded to take them on showings, and they began asking her questions, like “Why are they selling?” and “Is this home priced competitively?” In each case, she replied, “I’m sorry, but I can’t answer that question for you,” explaining that they didn’t have an agency relationship. Well, it wasn’t long before the buyers became frustrated and insisted on signing her agreement, just so they could get the information they desired. This buyer’s rep was smart, because she was very clear about what she could and couldn’t do for her buyer-customers versus her buyer-clients—and she stuck to it.

Meet a agent! One of our featured agents this month is Mike Cleavinger. He has been married to his kindergarten sweetheart, Criss, for 37 years. Criss is an attorney and they have two daughters – Mandy and Cassidy. Mandy is married to Jason Helton and they have a beautiful little girl, Ella. Cassidy is a surgical resident in Houston specializing in vascular surgery. Mike and Criss attend church at Victory Life Baptist and Mike sings in the choir. Prior to his real estate career, Mike farmed for 30 years. Six years ago, at the encouragement of several friends, Mike began his career in real estate. He loves to work with buyers and his specialty is farms/ranches. Mike enjoys reading and loves books about World War II history; he also enjoys reading Nelson DeMille novels with middle eastern terrorist/western intelligence themes. One of his favorite “getaways” is a remote area of northern New Mexico where he goes fly fishing. Something many people don’t know about Mike is that he is a pilot and absolutely loves flying. He has wonderful memories of “packing up the girls” when they were little along with Criss on a Friday afternoon and flying to Lake LBJ where his in-laws lived and spending the weekend at the lake. When Mike was asked what happiness meant to him he very quickly said “Going to bed at night with a light heart, giving my cares and concerns to God, and getting a good nights’ sleep”.

Angela Jones became a Realtor in 2006 and presently spends a lot of her time working as a transaction co-ordinator, as a part of the Townsley Group. Prior to real estate, Angela worked in the new car business for many years. The family owned new car dealerships in Brownfield and Odessa where she was the General Manager and at one time had 130 employees. No wonder she is highly organized and detail oriented! One thing that few people know is that in High School Angela was a 'Pep-ette' for the Permian Panthers. Go Mojo! Another fun memory from the past was white water river rafting in Colorado with a friend. They had to don wet suits due to freezing water temperatures. I think as the tour guide explained the how to's and what not to do's, Angela realized this adventure was not for the faint of heart. Weekends often find Angela on the road to Odessa to spend time with her Mom or going to the movies with her hubby. For Angela, happiness can be shopping or relaxing at home surrounded by her devoted pups Rocky, Cassidy, and Savannah who she rescued from the parking lot outside of PetsMart. She also has her kitty, Lacy, who simply tolerates life with the dogs. Angela shared her dream vacation. She would love to take a Riverboat cruise down the Nile. There would be side trips including two days in Jerusalem, visiting Egypt and a camel ride across the Giza plateau, and a few days perusing the treasures in Cairo at the Museum of Antiquities.

Shannon Cole grew up in Deming, New Mexico. What most people don't know is that she went to Nationals in cross country during her high school years. She moved to Lubbock to attend Texas Tech University and during her college years met her husband, Ronnie (who is from Lubbock). Shannon has been in the real estate business for three years and was attracted to the business because she likes to be around people on a daily basis and help them achieve their goals of owning real estate. A funny story related to real estate was when she locked the key of a house she was showing clients, inside the house. She had to call the other agent to open it up to put the key back in the key box. She loves traveling and one of her favorite places is New York City, which she visits yearly. She also enjoys going on mission trips and vacationing with family. Another love is watching home baseball games of the Red Socks. Their daughter Caroline got her name from the song "Sweet Caroline" that is played (Neil Diamond recording) during the seven inning stretch. Things are changing in the Cole family, so reading Karen Kingsberry (her favorite author) and all types of other magazines may be on the shelf a little longer as this sweet baby girl will take all their free time. Happiness is ...vacationing with family.

MAKING THE FIRST DAY EASIER

• Remind your child that she is not the only student who is a bit uneasy about the first day of school. Teachers know that students are anxious and will make an extra effort to make sure everyone feels as comfortable as possible.

• Point out the positive aspects of starting school: It will be fun. She'll see old friends and meet new ones. Refresh her positive memories about previous years, when she may have returned home after the first day with high spirits because she had a good time.

• Find another child in the neighborhood with whom your youngster can walk to school or ride with on the bus.

• If you feel it is appropriate, drive your child (or walk with her) to school and pick her up on the first day.
