Terms & ConditionsTerms & ConditionsThe following conditions are accepted by buyer and seller.

DefinitionsIn these terms and conditions ‘the seller’ means Cosmetronic Global LTD, ‘the buyer’ means the purchaser of goods from ‘the seller’ and ‘products/goods’ refer to the services and products provided by Cosmetronic Global LTD under these terms and conditions. The seller will not consider any claims made by a third party, any dispute of the below terms and conditions will be between the original buyer and seller of the goods.These terms and conditions are subject to change at the discretion of the seller without prior notice. The seller reserves the right to terminate dealings with any buyer should these terms & conditions be breached. Should the buyer disagree with any points within these terms and conditions please do not use the seller’s products or services.

1. General - All orders are subject to these terms and conditions and the placing of an order by the buyer shall be considered as acceptance of these conditions and the conditions of the seller’s nominated courier. Details of the nominated couriers terms and conditions can be provided upon request. These conditions may not be modified or varied unless the seller agrees in writing and the company shall not be deemed to accept such other conditions nor waive any of these conditions by failing to object provisions contained in any purchase order or other communications from the buyer. No person has the authority on behalf of the seller to vary any condition except the Chief Executive Officer or Board of Directors. All goods are sold under the understanding that they will only be used for their intended purpose by fully trained, responsible persons or students under trained supervision.

2. Trade Only – The seller is a trade only wholesaler. By ordering products from us you are confirming that you a qualified professional, and as such are competent in using the products sold by the seller. The seller will not be held responsible for any injury or damages incurred by unqualified users of the seller’s products. We reserve the right to ask for proof of professional status and to refuse to fulfil an order, should the seller believe that the buyer is not a trade customer. All trade members are required to have suitable insurance to use the seller’s product or services.

3. Use of Information - Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on the seller’s website or printed materials for any particular purpose. The buyer acknowledges that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law. The buyer’s use of any information or materials on the seller’s website or printed materials is entirely at your own risk, for which we shall not be liable. It shall be your own responsibility to ensure that any products, services or information available through the seller meet your specific requirements.

4. Prices - All prices exclude VAT, delivery may also be excluded unless otherwise stated. The seller maintains the right to modify the sale price of goods and delivery charges at any time. Special prices and offers are correct at the time of print but are subject to alteration without prior notice.

5. Payment - All orders must be paid in full before delivery to the buyer. All products deemed as custom or pre-order require a minimum 50% deposit of the total sum to commence pro-duction. All orders require full payment to be held in stock if available. The seller accepts all major credit cards and transfer via BACS, CHAPS and PayPal. Cheques require a minimum clearing time of 10 working days before dispatching goods to the buyer.

6. Delivery - All delivery dates are given in good faith by the seller to indicate estimated delivery times but shall not amount to any contractual obligation to deliver at the time stated. No liability for direct or consequential loss or damage arising from delay in delivery will be accepted by the seller. The buyer accepts the use of the seller’s nominated courier and the courier’s terms & conditions. Details of the nominated couriers terms and conditions can be provided upon request. Delivery related disputes will be settled between the buyer and couri-er. Delivery charges will be calculated on a per item basis, cost of delivery will vary between small and large items. Small items are only delivered to the buyers chosen address between business hours (9.00am-6.00pm) unless otherwise stated by the nominated courier. These products may require the buyer to assemble them. Standard delivery of large items includes delivery to the buyers chosen address between business hours (9.00am-6.00pm) unless otherwise stated by the nominated courier. 2-Man service of large items includes delivery to the chosen address between business hours (9.00am-6.00pm) by two members of the sellers chosen courier service. 2 man services include delivery of the goods to an accessible location within the buyer’s premises and exclude basements, spiral staircases, lofts and all other areas that are deemed by the nominated courier to have unreasonably or unsafe means of access. All goods must be checked while the delivery driver is present and signed for accordingly. In the event that goods are damaged in transport the buyer must sign for these goods as damaged, goods signed for as undamaged or unchecked may result in the buyer incurring delivery charges or charges for replacement goods. If the customer is not present or there is no one with authority to sign for the goods, or the delivery of goods is refused, the seller will not be held responsible for any damage or additional charges thereafter. The buyer must notify the seller of any damaged goods within 48hrs, failure to do so will invalidate product warranty.

7. Force Majeure – The seller shall be entitled to cancel or delay delivery of orders if it is delayed, hindered or prevented from delivery through circumstances beyond its control. Such circumstances shall include (but are not limited to) industrial action, accident, fire, Act of God or failure to deliver by manufacturers or carriers.

8. Warranty / Returns – The seller will provide product warranty lasting one year on all products. This warranty includes the labour, additional parts or suitable replacement if the goods are deemed by the seller to be a faulty. Any products deemed to be damaged due to misuse, wear and tear, neglect, fire or any attempt to repair or modify by persons other than the seller will effectively void the product warranty. Product warranty excludes the cost of re-turn/resend carriage fees. Products must be returned to the seller for inspection before any repairs, parts or warranty replacements can be issued. Costs of repairs, additional parts or inspection outside of the warranty period will be the responsibility of the buyer. All returned products have a minimum repair time of ten working days once received, depending on the circumstances of the repair issue, however the seller with endeavour to return goods as quickly as possible . Product warranty does not include the cost of on-site repairs. Should the buyer request on-site repairs to be carried out by the seller, payment for travel expenses must be paid in full to minimum sum of £180+VAT and £20+VAT for each additional product thereafter, this excludes the cost of additional parts in non-warranty situations. On-site repairs are available for the following postcodes AL, B, BA, BH, BN, BR, BS, CB, CF, CM, CO, CR, CT, CV, DA, DE, DL, DY, E, EC, EN, GL, GU, HA, HP, IG, IP, KT, LE, LN, LU, ME, MK ,N, NG, NN, NR, NW, OX, PE, PO, RG, RH, RM, SE, SL, SM, SN, SO, SP, SS, ST, SW, SY, TN, TS, TW, UB, W, WC, WD, WF, WR, WS, WV, all other postcode areas will require return to base warranty, however if on-site repair is essential pricing can be provided. This payment must be made to the seller by the buyer before any service is carried out. In the event that on-site inspections determine that a product is not faulty during a valid warranty period, the buyer will be made responsible for the cost of replacements parts or products. The seller must be notified of any product fault within 48hrs, failure to do so may invalidate product warranty. All goods are returned at the buyers risk and must be safely packaged before collection. Goods are not sold on a Sale or Return basis. The seller reserves the right to levy an administration charge of a minimum 25% of the invoice total for rotation of products, all products must be safety returned in the original packaging.

9. Cancellation – Cancellation of an order prior to delivery will only be accepted on the following terms:A) The seller is notified by telephone within 72 hours of the delivery collection.B) Pre-order/custom products incur a minimum 25% handling fee.

10. Retention Of Title Clause – The risk in all goods passes to the buyer upon delivery but title in goods remains vested in the seller and shall only pass from the seller to the buyer upon full payment being made of all sums to the seller.

11. Overseas Order – Carriage will vary on destination and weight of the consignment. Please contact customer service for more information.

12. Quotations – Any quotations issued by the seller remain valid for 15 days, after this time all offers or prices must be revised by the seller. Stock will only be held once a 50% deposit has been received.

13. Technical Advice – The seller will provide the buyer with technical advice regarding its products or services, this information includes (but is not limited to) the application and main-tenance of the goods or services that the seller provide. Advice given by the seller regarding products and services outside of the seller’s product range are taken at the buyer’s risk.

14. Refunds – Refunds authorised by the seller will be credited as a quickly as possible, refunds will be issued to the credit card/transfer account used by the buyer or if payment was taken in cash, a cheque will be issued to the buyer. All handling fees incurred will be deducted prior to the refund being processed. All refunds must be approved by the seller.

15. Collection – The buyer may collect products that have been paid in full from the seller. The buyer must present identification to collect any goods. The buyer or the buyer’s nominated agent must sign collection documents provided by the seller to authorize collec-tion. All items must be inspected before collection by the buyer before taking the goods from the seller; any subsequent damage after collection will be the responsibility of the buyer. The seller has the right to deny collection to any party for any reason.
