Due to the rotation of drought and heavy rains in this area of the country, you may be experiencing issues with your home or yard over the last few years. If heavy rain leads to pooling and puddling on the grounds, around your home, it’s only a matter

of time before the water drainage and erosion cause problems. There are a variety of solutions available to you, depending on the property, the area around the property and your budget. In this article we will discuss a couple of approaches.

PLANT TREES & PRESERVE CURRENT TREESThe far-reaching and deep root systems of trees effectively absorb water over a sizeable area. The trees’ canopy also reduces the fall of rainwater allowing the ground to soak up more water than it would otherwise.

RAIN GARDENSThese gardens are planted in slight ground depressions that collect water and allow the water to gradually seep into the soil. We use water-hungry plants, permeable soil and mulch in the garden so that considerable amounts of water can be absorbed swiftly, typically in a couple of hours. Rain gardens can be almost any size depending on the situation, and are typically planted at the base of a slope; anywhere where water naturally flows or can be directed.

RETENTION BASINSA retention basin is a permanent lake with landscaped plants and trees around it. This pool allows you to manage stormwater runoff; preventing flooding and downstream erosion.

DRY CREEK BEDSSometimes uneven slopes lead to erosion when excess water flows down, or puddles on the bottom of the slope. You can address the erosion or landscape drainage problem with dry creek beds. When it rains, water flows over an arrangement of lovely stones and boulders and slowly seeps between them, leaving the ground underneath firmly in place.

The next time a rain storm wreaks havoc on your home, take a tour around the property immediately afterwards. Keep an eye out for residual water that may be the sign of current or future water drainage problems. With preventative approaches such as these, you can enjoy the rain without worrying about potential property or grounds’ damage.

The National Council on Compensation Insurance (NCCI) has announced changes in the

formula that is used to calculate experience modifiers for employers in most states. Specifically, the primary/excess split point will be incrementally increased from the current $5,000 to $10,000 in 2013 and $13,500 in 2014. Thereafter, the split point will be tied to an inflationary index that will start at $15,000. NCCI cites medical inflation as the reason for the changes, and a need to make premiums more reflective of an employer’s loss experience. For example, in the first year of these changes, contractors with no losses greater than $5,000 should see a drop in their experience modification rating (EMR) factor, while those with a relatively large number of losses approaching or exceeding $10,000 will see an increase in EMR. There is no cap on how much an employer’s EMR can increase in a given policy year.

These changes will impact all industries but perhaps the construction industry more than most due to minimum EMR requirements imposed on contractors by many project owners just to qualify to bid on a project. Furthermore, it could affect eligibility for the contractors credit premium adjustment program (CCPAP), which provides discounts to contractors who pay higher than the state average hourly wage for employees in certain construction classifications. In some states, contractors must have an EMR of 1.0 or lower to be eligible for the CCPAP discount.

Unfortunately, because the experience rating period covers prior years’ losses, contractors will not have the opportunity to implement strategies that could reduce the impact of the changes before they become effective. Contractors should also discuss these changes with key clients to make them aware of coming changes in the EMR and make it clear that these changes are the result

of a formula change rather than an increase in losses or a relaxation in safety protocols.

These changes will become effective in 2013 for all states that follow the NCCI rating system. A few independent bureau states have made comparable changes. Changes to the primary/excess split point have not been proposed in the monopolistic states (North Dakota, Ohio, Washington, and Wyoming) or in most independent bureau states, including California, Delaware, Massachusetts, Michigan, New Jersey, New York, Pennsylvania, and Texas.

Every Kentucky employer with one or more employees is required to maintain workers compensation insurance. (KRS 342.630) There are no special exceptions for family member or part-time

employees. Out of state employers performing any work in this state are required to have Kentucky workers compensation insurance. Keep in mind that workers often referred to as “day labor or casual labor” are generally considered employees under the Workers Compensation Act.

Exempted by statute are farm laborers, domestic servants working in a private home of an employer who has less than two employees, workers employed by a homeowner for residential maintenance, remodeling and repair lasting no more than 20 consecutive work days, members of an established religious sect with a conscientious objection to receiving benefits of any public or private insurance and employees protected by federal laws, including railroad and maritime workers.

Compliance with the Act The Office of Workers Claims seeks compliance of all employers in the state. This is accomplished by regular inspections of employers to verify compliance. Non-compliant employers can be cited resulting in fines of $100 to $1,000 for each offense. The fine can be substantial since each employee and each day of violation shall constitute a separate offense. An

injunction prohibiting the employer from doing business until it comes into compliance can be obtained. Additionally an employer may be held liable to an injured employee (or employee of an uninsured contractor or sub-contractor) for income benefits including lost wages and medical expenses. An employer may not deduct policy premiums from wages or salary of any employee entitled to benefits.

Kentucky does not sponsor a state-run insurance program. Therefore, it is the employer’s responsibility to secure the insurance from a private carrier. Contact any Kentucky insurance agent that represents approved insurance companies to purchase a policy.

The Enzweiler Apprentice Training Program celebrates several milestones this year that speak to the support of the HBA Membership and the quality of the Staff and Students! To begin with, the Enzweiler Apprentice Training Program was honored by the NAHB with an Assoication

Excellance Award for Workforce Development for the Curriculum and Practical aspects of the school. Everyone is very excited to receive such a high honor, especially considering that there are more than 800 HBA’s competing for awards nationwide. It is a testament to the input of our members and the high quality of instruction that such an award was bestowed upon us.

Another remarkable feat this year has been the commitment of our HBA members to draw from the school to fill their employment needs. The Enzweiler Program can now boast that almost 95% of our students are gainfully employed in their trade and are earning credits towards their Journeyman Status! This is up almost 35% from last year! The support of our members makes this school what it is and only serves to provide Northern Kentucky with a well trained workforce capable of meeting the needs of our growing community.

If all those great things were not enough reason to be excited, the Enzweiler Apprentice Training Program has enrolled a record number of students for the 2012-2013 Academic year! Many of our classes are sold out to maximum numbers and a great majority of those students are already employed in their upcoming trades! It has been an exciting year!

For those unaware, the Enzweiler Apprentice Training Program has added two new trades, Plumbing and Welding to begin in the fall term. Corken Steel Products will be hosting the Welding Program and Plumbing will take its place here at HBA with the other trades. All courses are now being taught by Graduates of the Enzweiler Trade School or Members of HBA.

As the director, I would personally like to thank all of our members for their support, our teaching staff for their tireless work to make this program what it is, and our students who come ready to learn and better their lives!

2012 holds great things for our program and we look forward to seeing everyone in the fall!

Furlong Building Enterprises, LLC, a commercial and industrial construction firm, has completed a major expansion

project for FN Sheppard & Company at the company’s Erlanger, KY headquarters. The 16,000 sq. ft. expansion will house manufacturing and warehouse operations for the belting products manufacturer. The company was founded by Fred Sheppard and after his sudden death in July 1971, James E. Reilly purchased the company. Supporting James in the early years of taking over the company was his friend and colleague, Paul Hehman Sr. (father of Furlong CEO Jude Hehman) and several other individuals. For the past eight months, James Reilly’s sons Jim Jr. and Brian and Jude Hehman have been working together to plan and construct the expansion project, continuing the legacy that their fathers began four decades ago.

A building dedication ceremony followed by a company cookout was held on June 21, 2012 at 11 a.m. at FN Sheppard & Company at 1261 Jamike Drive, Erlanger, KY.

“Our fathers worked together nearly 40 years ago and I now have the privilege to work with the next generation of Reillys,” said Furlong Building Enterprises CEO Jude Hehman. Our working relationship has a special meaning knowing that we are building upon a valued relationship that began so many years ago by our fathers.”

FN Sheppard & Company has grown considerably since the early 70’s and now has third generation Reilly family members involved in the business and is operating in six states. “The expansion of our headquarters will allow us better functionality and efficiency,” said Vice President of Operations, Brian Reilly.

James Reilly continues to serve as leader-in-chief and at 85, has no plans to retire. “The credit for our success goes to our employees, many of whom have worked here since the 1970’s and 80’s,” said

James Reilly. “We have good open communication; everyone knows their roles and goals and it works for us,” adds James Reilly. Tour of Remodeled Homes: The 2012 Tour is scheduled for October 6 & 7. The early bird deadline has passed and the final deadline for entries is August 3. We hope to have several projects in Cincinnati again this year. If you need entry forms or any information about the TORH, please contact Melanie Meyer at the HBA office.

There will be project sponsorships available again this year. If you are a supplier who worked on a TORH home, please consider becoming a project sponsor for that home. Look for more information from Kirk Pies.

Lunch Sponsorships: We have opportunities to sponsor a Remodelers Council lunch meeting in October and December. If you are interested in

sponsoring one of the meetings, contact the HBA office.

Code Issues: The new International Energy Code will go into effect on October 1, 2012. The N.K.A.P.C. started energy inspections on July 1 to help remodelers get used to what they are looking for in the inspections.

The new Kentucky Building Code will go into effect on January 1, 2013. The Building & Housing Codes Committee will continue to meet with inspectors the remainder of this year to discuss the new changes.

If you are experiencing any code enforcement issues or have questions about these new Codes, please contact Brian Miller at the HBA office.

Awards: Congratulations to Dan Corbin for winning Northern Kentucky Magazine’s “Best Remodeler of Northern Kentucky”. The magazine ran a Best of Northern Kentucky Show at Receptions and Dan was the winner!
