Both parties now wait for Justice D. G. Stinson’s decision. Toronto Taxi Alliance, the industry group composed of taxi owners and taxi fleet operators and represented by lawyer Michael Binetti, of Affleck Greene McMurtry L.L.P., argued, among other issues, that the Toronto Taxi Licence (TTL) was enacted inappropriately because the ten (10) recommendations before City Council had been deferred until February 2015 by the Licensing & Standards Committee. The TTA argued that Council failed to comply with its own Procedural Bylaw. Based on amount of evidence presented and the reams of documentation submitted by both parties we can only anticipate that the Justice D. G. Stinson’s decision will not likely be rendered until sometime in 2015. The Toronto Taxi Alliance originally filed an application for an interim court injunction to “quash” the City Taxi Bylaw in June 2014. The Ontario Superior Court of Justice ordered that the City of Toronto was forbidden from acting upon or implementing those sections of the new Bylaw (503-2014) that apply to Standard Taxicab Licence holders until the final adjudication of the Application by the Superior Court of Justice so as to permit the issuance of a Standard Taxicab Licence to the purchaser upon the sale of the standard taxicab. The Court further ordered that in the event the Bylaw is upheld by the Superior Court of Justice, no rights are conferred (awarded) by this order that would entitle a party who acquires a Standard Taxicab Licence after June 30 th , 2014, to be treated as if they had been a Standard Taxicab Licence holder prior to July 1, 2014. The Court upheld all aspects of the new City of Toronto Bylaw with the exception of the Standard Taxicab Licence as stated above. A.T.T.C.L. NEWS WINTER 2014/15

LATE BREAKING NEWS – LATE BREAKING NEWS

Taxi Industry awaits Court Decision

After three days of intense hearing held on November 17th, 18th and 19th before the Ontario Superior Court

of Justice, lawyers for both the City of Toronto and the Toronto Taxi Alliance (TTA) presented their closing

arguments. Both parties now wait for Justice D. G. Stinson’s decision.

Toronto Taxi Alliance, the industry group composed of taxi owners and taxi fleet operators and represented

by lawyer Michael Binetti, of Affleck Greene McMurtry L.L.P., argued, among other issues, that the Toronto

Taxi Licence (TTL) was enacted inappropriately because the ten (10) recommendations before City Council

had been deferred until February 2015 by the Licensing & Standards Committee. The TTA argued that

Council failed to comply with its own Procedural Bylaw.

Based on amount of evidence presented and the reams of documentation submitted by both parties we can

only anticipate that the Justice D. G. Stinson’s decision will not likely be rendered until sometime in 2015.

The Toronto Taxi Alliance originally filed an application for an interim court injunction to “quash” the City

Taxi Bylaw in June 2014. The Ontario Superior Court of Justice ordered that the City of Toronto was

forbidden from acting upon or implementing those sections of the new Bylaw (503-2014) that apply to

Standard Taxicab Licence holders until the final adjudication of the Application by the Superior Court of

Justice so as to permit the issuance of a Standard Taxicab Licence to the purchaser upon the sale of the

standard taxicab.

The Court further ordered that in the event the Bylaw is upheld by the Superior Court of Justice, no rights

are conferred (awarded) by this order that would entitle a party who acquires a Standard Taxicab Licence

after June 30th, 2014, to be treated as if they had been a Standard Taxicab Licence holder prior to July 1,

2014.

The Court upheld all aspects of the new City of Toronto Bylaw with the exception of the Standard Taxicab

Licence as stated above.

CITY OF TORONTO TAKES A STAND AGAINST UBER & UBERX

Municipal Licensing and Standards - Statement in Response to UberX

The City has significant concerns that UBER has launched a service, identified as UBERX, which may be in contravention of the City's bylaws, including those governing private transportation providers.

Based on the information currently available, the City is concerned that the UBERX service may pose a serious safety risk to the public, including those who are signing on as drivers. The City is concerned that the drivers do not hold a city-issued licence, which ensures the adequacy of the background screening, nor have the drivers taken the required training as mandated by the City, which would also include safety awareness training for the driver. The vehicles may not be equipped with the same security provisions as licensed taxis, such as cameras, nor have they undergone City mandated mechanical inspection and may be inadequately insured. The individuals who are participating as drivers for UBERX may wish to seek legal advice regarding their participation. We have engaged the expertise of the City's Legal department, and are reviewing every legal option available to us to address any potential breaches of law, with the objective of ensuring the protection of the public. NEWS ARTICLE (Globe and Mail) dated November 18, 2015 - City lawyers have now applied for an injunction with the Ontario Superior Court of Justice Tuesday, requesting that it order Uber to cease all operations in Toronto. A.T.T.C.L. POLICY – as ordered by the Board Directors While driving or operating a Co-op Cab or Crown Taxi branded licensed taxicab:

No driver or member is to use any device or communication tool for accepting calls from the public for taxicab service that has not been approved by A.T.

BANDIT TAXI CAB SAFETY and ENFORCEMENT ACT 2014 An Act to amend the Highway Traffic Act with respect to the transportation of passengers for compensation without a licence, permit or authorization. On Thursday, December 4th, M.P.P. Lisa MacLeod (http://lisamacleod.com/contact/) will be introducing a private members Bill at the next sitting of the Ontario Provincial Legislation, Queens Park, to give municipal enforcement officers the power to enforce the Bandit Taxi Cab Safety Act against anyone picking up a passenger for the purpose of transporting them for compensation without a license, permit or authorization. This will expand the authority from police officers only to MLS Enforcement Officers. The proposed Bill amends the Highway Traffic Act with respect to offences related to picking up a passenger for the purpose of transporting him or her for compensation without a licence, permit or authorization. The Bill gives municipal law enforcement officers the power to stop motor vehicles, request the surrender of a licence, permit or authorization and request identification to enforce these offences. The fines for the offenses are increased. In addition, the Bill provides for administrative impoundments of motor vehicles if an officer believes that a person has picked up a passenger for the purpose of transporting him or her for compensation without a licence, permit or authorization. You can show your support by attending the reading of the Bill at Queens Park on Thursday, December 4th.
