I do not and will not support a .05 metre compromise I have encountered runoff water damage onto my rear outdoor living area from the illegal building on my fence line. Please also be advised that I will not support the application in its current design and completions configuration and will expect the building code of a minimum of one metre from my boundary be applied and any/all other minimum requirements adhered to. Please be advised that I wish the building to be set back one metre from my fence line as per the legislative requirements and building code. Each time we have a moderate downpour of rain their roof drainage cannot cope and I suffer water ingress to my property.

At the moment it is very difficult to secure construction funding on favourable terms. No changes are proposed to what has been approved.

ATTACHMENT: Summary of Applicant's Justification DV17.37 - LOT 6 (NO. 140) RAILWAY PARADE, WEST LEEDERVILLE APPLICANT'S JUSTIFICATION Background Kidsafe WA is the leading independent not-for-profit organisation dedicated to promoting safety and preventing childhood injuries and accidents in Western Australia. Injuries are the leading cause of death in Australian children aged one to fourteen, accounting for nearly half of all deaths in this age group. More children die of injury than die of cancer, asthma and infectious diseases combined. Many of these deaths and injuries can be prevented. Kidsafe WA works in the community to educate and inform parents and children on staying safe at home, at play and on the road. Kidsafe WA has recently completed a redevelopment of an existing building at 140 Railway Parade, West Leederville. This new site incorporates all of Kidsafe WA’s services, including a Safety Demonstration House; a Child Car Restraint fitting and checking service; a new Community Education facility and the organisation’s research, injury prevention and administration base. The new facility has provided Kidsafe WA with an environment that represents the organisation appropriately, by being safe, family friendly, accessible, contemporary and appropriate for clients, community groups, staff and volunteers. Whilst the organisation is based in West Leederville, the reach of the organisation’s work aims to positively impact the lives of children statewide. Kidsafe WA’s Rear Wall Advertisement Proposal In Western Australia, the leading cause of death and the third most frequent cause of hospitalisation for children aged 0-14 years is transport related injury. Motor vehicles accidents are one of the most common causes of transport related injury for children. Whenever children are passengers in a vehicle they should be seated in the most appropriate child restraint for their age and size to provide the best protection. Kidsafe offers a cost effective service for those who are unsure about how to fit their child’s car seat or those that just want to check that they have fitted their seat correctly. This service, the Child Car Restraint Service, is located at the rear of the building, off Bamford Lane. In looking at the current space, Kidsafe WA believes there is an opportunity to display up to 4 wall advertisement signs. The addition of wall advertisement within this area would not only add visual interest to customers accessing the service, but also provide a small revenue opportunity for our not-for-profit organisation. Kidsafe WA would take careful consideration when accepting and displaying any advertisement signage. Any business advertisements Kidsafe WA agrees to display would need to align with the organisation’s vision, mission and business activities. In addition the advertisement would need to have an appropriate fit for purpose, with a strong focus on lifestyle imagery (and not pricing information). Kidsafe WA will be reviewing all proposed advertisements before installation approval is given. Advertisement spaces would be available on a yearly purchase basis, with the intention they will be in place for the full year and not changed on a monthly or weekly basis.

ATTACHMENT: Summary of Applicant's Justification DV17.37 - LOT 6 (NO. 140) RAILWAY PARADE, WEST LEEDERVILLE The proposed advertisements are located at the rear of the building and will not be visible from the road (Railway Parade or South port Street). They will only be visible to people coming to Kidsafe WA for child restraint services as well as a few of the businesses who have windows at the rear of their properties. Advertisements will be fixed to the existing brick walls using advertisements will not be illuminated or have any flood lighting of any kind. Careful consideration has been entered into when deciding to include wall advertisements into this space. It is not Kidsafe WA’s intention to detract from the current space, nor cause disruption or distraction for customers or neighbouring businesses. Kidsafe WA expects that not all advertisement spaces will be filled at all times. The organisation believes that up to 2 may be filled on an ongoing basis, however this application has allowed for up to 4 wall advertisements. Each advertisement space can be purchased for $2000 per year.

Neighbour Comments - No. 6 Hovea Crescent, City Beach (North) I have received the letter from you about an application of Lot 83 (No. 6) Lowanna Way , City Beach. 1. About the height. It is too high. We don't agree with it. 2. About visual privacy setback. It is higher and too near to the sides/eastern and

northern. We don't agree with it. Neighbour Comments - No. 8 Hovea Crescent, City Beach (North-East) We believe that this development will have a very significant impact on our ability to enjoy our life in our property. No 6 Lowanna Way is located directly to the west of us and very much down the natural slope from our residence. The existing multi story dwelling is below our sight lines and does not intrude on our view. We spend a very considerable amount of time in our back yard. One of the original reasons for purchasing this block, with its very steep slope, was the fact that our back yard could never be overlooked and with the endowment land regulations could not be subdivided and we could not have our view obstructed. We have viewed the submitted plans this has not helped us assess the impact that the proposed dwelling would have on both our view and our enjoyment of our backyard. It would help considerably if the architect could include details of the existing dwelling indicating the changes in profile and height. Neighbour Comments - No. 10 Hovea Crescent, City Beach (East) Our home is behind/east and one lot removed from the proposed building, which therefore lies diagonally west/southwest of our home. Already the upper walls and roof of the existing building (with visible windows) constitute a significant restriction to our westward view to Rottnest - see attached print. Without a clear indication of the change in roofline (particularly with the proposed lift shaft/roof) a three storey development which then further breaks the code in terms of height and setback may significantly impact on our amenity, destroying our view and subsequently devaluing our asset. We have just invested a considerable sum in renovations. Had we been aware of this proposal we would have reconsidered the work. If the new building results in a higher roofline compared to the existing profile, we are opposed to this development.

RE: 200 DAGLISH ST: POST- ARCHITECTURE CAPABILITY STATEMENT

We write to allay your concerns. This house at 200 Daglish Street is not a folly. It is not ill conceived and it is not disrespectful of local history or its neighbourhood context.

Although I’m sure that all designs that land on your desk arrive with the best of intentions, I am also sure that the built reality of said designs, more often than not, fail to meet their lofty aspirations. Or even more often, the design promise is big on bluster and bombast but short on sensitivity, sophistication and contextual awareness.

I’d hope that we can convince you that we are a firm with a predilection for careful, thoughtful and respectful work. We currently have a suite of residential work in progress around Perth - in North Fremantle, East Fremantle, Mosman Park, North Perth and Shenton Park - that are both contemporary and sensitive. All of these projects have been produced under the same philosophy that has shaped our response for 200 Daglish and all have, or are currently, clearing planning.

We are led by Nic Brunsdon, winner of the Emerging Architect for Western Australia in 2014 and the winner of the Emerging Architect for Australia in 2015, being only the second West Australian to have won it. Also on the team is Adam Reynolds, winner of the Peter Hunt travel prize in 2009, and with recent experience at highly regarded firms Donaldson & Warn and CODA Fremantle. Further, we have attached our Capability Statement for your information.

We sincerely hope that you believe, as we do, that this in an exemplary design approach showing rational responses to building bulk (pushed to the rear away from the street and overshadowing), solar access (preserving northern light), cross ventilation (shallow plan), private open space (large northern sheltered yard), roof form (clean and unobtrusive), material (using local palette) and building massing (low and respectful to the street).

We look forward to hearing from you and would welcome the opportunity to further present our proposal to you should you see that as necessary.

ATTACHMENT: Summary of Applicant's Justification and Neighbour Comment DV17.41 - LOT 355 (NO. 34) ARUMA WAY, CITY BEACH APPLICANT'S JUSTIFICATION We propose two nil setbacks to boundaries and belive both are similar in that they do not have any adverse effect on the amenity of adjoining properties ie:- • No overlooking or impact to the privacy of adjacent lot yards • No overshadowing to adjacent lot yards of existing windows as it's from the west not

the north (with regard to overshadowing in June) • The floor levels for both are at the existing levels with the TV room extending from the

main house • The wall will have a positive effect on the adjoining neighbours as it well help (to some

extent) to enclose or trap noise from the existing swimming pool and alfresco area. • A 1.0 metre setback to the wall would allow us to put in a highlight window in the side

wall which could be openable and therefore increase the sound transfer. NEIGHBOUR COMMENT Submission One (No. 32 Aruma Way) Believe that a nil setback is inappropriate for any development, particularly taking into account that the room to be added is a TV room, presumably with a TV in it. My outdoor sitting area is on the western side of my property so adjacent to where the new TV room will be. We are not interested in listening to someone's TV which will essentially be located on the boundary wall. Of course we will hear it. I note also that the height of the roof will be 56cms above the height of the existing dividing wall between our properties. This wall is already well above 2 metres in height and was built without consultation with me by the previous owners of the adjoining property. This proposal will take the height of what will essentially become the diving wall to approximately 3 metres. The TV room will greatly overshadow our garden and outside entertaining area if the 1 metre setback is not adhered to On the basis of not meeting deemed to comply provisions of the Codes, I believe the Council should reject the application.

ATTACHMENT: Summary of Applicant's Justification and Neighbour Comment DV17.42 - LOT 1849 (NO. 64) ALEXANDER STREET, WEMBLEY APPLICANT'S JUSTIFICATION As per the application the proposed carport is to be located on the front northern boundary with the entry from Alexander Street. Unfortunately there is a Camphor Laurel Tree that would be in the middle of the proposed carport. As stated in the letter attached with the application it will be necessary to remove one tree only as this wis the only suitable position for a carport and the only accessible point for vehicles to enter and exit the property. Currently due to its location this particular tree also hinders vehicles reversing from the property and this poses a hazard to pedestrians using the footpath. Every effort has been made to position the carport so as there’re is no unnecessary removal of trees. When the carport is constructed it is planned to reduce the existing paved area by approximately 15 square meters, clean up the existing ground cover and relocated mature plants from the rear of the property to the front. Even though this proposal does not meet exactly with the Town of Cambridge's setback ratio, from greenery perspective 64 Alexander Street already presents aesthetically better than a lot of properties in the area. The carport is of a completely open design giving full view to the front of the existing dwelling with a low profile gable roof. The design and building materials are to match the existing dwelling. The property presents well with existing trees and plants and has much more street appeal than most new developments in the area.
