1. General Information

a. Overview

This document serves as a user guide for district, city, and mayor’s court staff and case management system vendors. The intent of this document is to outline all aspects of reporting criminal, traffic and juvenile delinquency case data, DWI & DUI (Driving While Intoxicated and Under the Influence), Article 892.1, 893, 894 and failure to appear cases. On the whole, the user of this manual will be able to electronically report case data and dispositions to the Louisiana Supreme Court and correct errors that occur when reporting.

b. Purpose

The primary task of disposition reporting focuses on collecting criminal, traffic and non-identifying juvenile delinquency case data from the district, city, and mayor’s courts throughout the state of Louisiana. The project is maintained by the Court Case Management Information Systems (CMIS) division of the Information Technology department of the Louisiana Supreme Court. Criminal data and dispositions are forwarded to the Louisiana State Police, Department of Public Safety and Corrections (DPS&C) for inclusion in the Computerized Criminal History database (CCH) and in the FBI NICS system. Traffic dispositions are forwarded to the Louisiana Office of Motor Vehicles (OMV). Sharing and reporting arrest and final disposition information has practical benefits for all participants:

Law enforcement officers have access to arrest dispositions through CCH and it prevents violent offenders from purchasing dangerous weapons.

District Attorneys have access to convictions for bail hearings and habitual offender screening.

Clerks of Court receive fewer R-84 disposition requests from the FBI.

c. Legislation

As of January 1, 2014, all district courts are required by La. R.S. 13:753 (originally passed as Acts 403 and 404 of the 2013 Regular Session of the Louisiana Legislature) to report to the Louisiana Supreme Court, for reporting to NICS, the name and other identifying information of any adult who is prohibited from possessing a firearm pursuant to the laws of this state or 18 U.S.C. 922(d)(4) and (g)(4), (8), and (9) by reason of a conviction or adjudication in a court for that district for the following:

1. A conviction of a crime listed in R.S. 14:95.1(A). 2. A verdict of an acquittal of a crime listed in R.S. 14:95.1(A) by reason of insanity

pursuant to the provisions of Chapter 2 of Title XXI of the Code of Criminal Procedure.

3. A court determination that a person does not have the mental capacity to proceed with a criminal trial for a crime listed under R.S. 14:95.1(A) pursuant to the provisions of Chapter 1 of Title XXI of the Code of Criminal Procedure.

4. A court order requiring that a person be involuntarily committed to an inpatient mental health treatment facility pursuant to R.S. 28:54.

5. A court order prohibiting a person from possessing a firearm or restricting the use of a firearm (such as a condition of probation, a protective order or condition of bail).

6. A conviction for a violation of domestic abuse battery (R.S. 14:35.3) (this addition was made by Act 124 of the 2016 Regular Session of the Louisiana Legislature).

As of January 1, 2017, all city and parish court are required by R.S. 13:753 (passed as Act 124) to report to the Louisiana Supreme Court, for reporting to NICS, the name and other identifying information of any adult who is prohibited from possessing a firearm pursuant to the laws of this state or 18 U.S.C. 922(d)(4), (g)(4), (8), and (9), by reason of a conviction or adjudication in a court of that district for any of the following:

2. A verdict of an acquittal of a misdemeanor crime by reason of insanity pursuant to the provisions of Chapter 2 of Title XXI of the Code of Criminal Procedure.

d. Scope of Project

CMIS receives disposition data from participating courts on a nightly basis. Once the data is received, it is loaded into our database and qualifying records are forwarded to DPS&C and NICS on a daily basis. Actual turnaround is less than 3 business days. This database currently contains over 17.5 million adjudicated criminal case records from all 64 parishes in the state. CMIS has successfully submitted electronic criminal disposition data to DPS&C since 2002 and NICS since 2009. There is no monetary charge for courts to report criminal dispositions electronically to the DPS&C or NICS.

2. Basic Reporting Process

a. Information Sources

The information that is collected by the clerks and entered into their Case Management System (CMS) can generally be placed in one of two categories; demographic (name, dob, etc.) and arrest/case data (arrest date, docket, charge, etc.). Both types of data are required for proper reporting to CMIS and both are required when routinely updating case data. It is understood that the clerks can only enter information that they have access to and we will work with the clerks to maximize the usefulness of the sources available to them. The data will generally come from the following sources:

Bill of Information (District Attorney or City Attorney’s Office)

Criminal Affidavit/Affidavit of Probable Cause (District Attorney or City Attorney’s Office)

Arrest Report (Law Enforcement Agencies)

Arrest Register

Court Minutes and Court Orders

*Electronic Data Exchanges between Law Enforcement, District Attorney and Clerk’s offices.

*Electronic Data Exchanges automate the collection of data that originates with the Police/Sheriff and the District Attorney. Law Enforcement electronically sends arrest data to the DA and the DA electronically sends arrest and billing data to the Clerk on a daily basis, so when the Clerk initiates a new case in their Case Management System (CMS), much of the defendant’s information is already available or pre-loaded. These exchanges have proven to significantly reduce data entry effort and errors in the 16 JDC’s in which they have already been implemented. The Supreme Court is available to assist in implementing and funding an exchange in your JDC.

b. Clerk Reporting

The vendor of your Case Management System (CMS) will program your CMS to automatically generate an ‘export file’ with case data and transmit that file to the Supreme Court in a specified format, see Appendix B. Criminal/Traffic Records System File Layout. This process can occur as frequently as every day and is typically performed after normal business hours. The export file consists of case data containing docket numbers, names and codes representing a defendant’s demographic, arrest and disposition data. Every record in the export file can be thought of as representing a current snapshot in time of that case. A snapshot record is generated automatically, on the evening when the following events occur in a case:

When a case is filed

When a final disposition is entered

When a sentencing information is entered

When appeal information is entered

Anytime a correction is made after the sentencing info is entered. Simply put, each evening your CMS will search for any criminal, traffic and juvenile delinquency case where the above listed events occurred, generate an export file with the appropriate codes and transmit that file to CMIS. For details on the export file format and an explanation of the codes, see the appendices below.

c. Supreme Court Processing

When export files are received, CMIS will electronically review the file to determine if data errors have occurred. Valid records are saved in our database. By the 15th of each month, exception reports are prepared and mailed to the Clerks of Court, identifying those records with missing, invalid or inconsistent data; see Chapter 7. Error Reports. The Clerk of Court’s staff is encouraged to correspond with CMIS data analysts regarding correction of data errors. On a nightly basis, new records in the CMIS database that meet respective agency acceptance criteria are forwarded to the Louisiana Department of Public Safety and Corrections (DPS&C) for inclusion in their Computerized Criminal History (CCH) database, the FBI for inclusion in their NICS database and the Office of Motor Vehicles (OMV). 3. Regular Transmission of Production Data All courts are asked to report on a daily basis to CMIS. This ensures that all data submissions are reviewed in a timely fashion so that legally mandated timelines are met. These timelines are significant since the Louisiana Supreme Court, who has the responsibility for final transmission of disposition data, is subject to regular audits by state (La. R.S. 15:581) and federal agencies (28 CFR §20.20-23).

a. DPS Reporting Timelines

La. R.S. 15:597 requires that a disposition report be submitted to the Department of Public Safety, Louisiana Bureau of Criminal Identification and Information within 30 days following the termination of a case. To meet this requirement, CMIS must receive the disposition data as soon as possible after the event to review and validate.

b. NICS Reporting Timelines

La. R.S. 13:753 requires that qualifying reports of convictions and adjudications or orders of involuntary commitment be made to the Louisiana Supreme Court, in a manner and form as directed by the Court, within 10 business days of said event. Likewise, the Louisiana Supreme Court is required to submit the information in the report to NICS within 15 business days of receiving it. No clerk of court shall be held liable on the basis of the accuracy, availability, or unavailability of any information reported or required to be reported except in the case of willful or wanton misconduct or gross negligence.

c. OMV Reporting Timelines

La. R.S. 32:393 C (1)(b)(i) requires a court report to OMV CDL violations within 10 days and La. R.S. 32:393 C (1)(b)(ii) requires a court report to OMV non-CDL violations within 30 days. To meet this requirement, CMIS must receive the disposition data as soon as possible after the event to review and validate.

d. LCLE Reporting Timelines

Juvenile Delinquency Disproportionate Minority Contact (DMC) statistics are reported to the Louisiana Commission on Law Enforcement (LCLE) on an annual basis as required by 42 U.S.C. 5633 §223.

b. SID and Arrest Date

CMIS checks the accuracy and completeness of data by randomly selecting records, then electronically obtaining rap sheets from CCH to determine if the arrest records are updated with the dispositions. This review has uncovered the single largest weakness in the disposition reporting process, missing SIDs and Arrest Dates. To update the arrest record in CCH, DPS&C must obtain the State ID Number (SID) and Arrest Date (or the complete ATN) with each disposition record sent from CMIS. A disposition record from CMIS will not be accepted by DPS&C without this data because it is the link to positively connect the defendant with the AFIS arrest record and the Clerk’s disposition record. When arrest records are properly updated with disposition records, the result is fewer R-84 requests to the Clerk asking for a case disposition and more accurate CCH rap sheets.

5. Export File; Format

a. File Format and Transmission Method

CMIS accepts disposition export files in XML format. XML files are transferred from the Clerk of Court to the Supreme Court via Secure File Transfer Protocol (SFTP). SFTP is used to securely and reliably transfer data from one computer to another over the Internet. Our SFTP address is sftp.lasc.org. We will work with your CMS vendor to issue the required credentials to ensure proper and secure electronic transfer of data.

b. File Naming Convention

Files should be named using the following file naming convention:

For example, files created and transmitted on February 19th should be transmitted to our office with the following names:

For all TEST files, include the word “TEST” in the filename:

6. Export File; Testing

a. Reporting Test Procedures

The procedure listed below is our standard procedure to bring courts online for the first time or when courts make changes to their export file or their Case Management System (CMS). Overall this process can take place in 1 to 6 weeks. 1. Have your vendor generate an initial test file based upon the Supreme Court format

described in the appendices in the format “TEST[CourtName]yyyymmdd.XML”

2. A CMIS data analyst will review the test files to verify accuracy with the file specification and completeness.

3. The CMIS data analyst will correspond with your court regarding findings.

4. An error report will be mailed to court staff reporting findings.

5. Clerk of Court staff will then review the error report sent by the CMIS data analyst and correct errors.

Repeat steps 1 through 5 until Supreme Court specifications are met.

6. The Supreme Court will then submit a test file with at least 100 records to the DPS&C on behalf of the Clerk of Court.

7. The CMIS data analyst will review the results from DPS&C and correspond with your court regarding findings.

Repeat steps 1 through 7 until DPS&C specifications are met.

8. The Clerk of Court will then receive an official letter of approval from the CMIS Director.

9. The Clerk of Court will have their I.T. staff or vendor program their CMS to automatically generate and transmit export files to the Supreme Court.

10. Monthly error reports are mailed to the Clerk of Court, criminal records manager, and vendor.

11. The Clerk of Court then faxes a "Receipt Confirmation of Data Error Report" and a "Correction of Data Errors Notification" receipt to the Supreme Court data analyst; these documents are mailed monthly with each error report.

12. Clerk of Court staff corresponds with data analysts regarding correction of data errors.

Steps 10-12 are repeated on a monthly basis.

b. CMIS Testing

When CMIS reviews file records, we will look to determine if the data is both accurate with our file format and complete for forwarding to DPS, NICS and OMV. CMIS will subsequently generate an error report (step 11 above) and work with the court to make corrections (steps 12 and 13).

Technical Accuracy. We will verify that the xml tags are spelled and used correctly, check that the data conforms to the permissible field lengths and types, check that the correct date formats are used and that permissible codes are used (See technical appendices B-F, L and M).

Content Completeness. We then check each test file for completeness to determine if the records meet the minimum data requirements for further transfer to DPS, NICS and OMV. (See section 7.a. Essential data elements).

c. Contacting CMIS Division

7. Export File; Data Formatting

a. Data Fields and Codes

The format that the export file must adhere to currently contains 131 individual fields or 883 characters. This format is used for reporting criminal, traffic and juvenile cases although every field is not required for all case types. Below is a list of some of the fields collected and a short definition of each term. To see all 131 fields and technical details, see Appendix B. Criminal/Traffic Records System File Layout. Docket Number Docket number assigned to the case. This field is especially important to CMIS when updating case data. Arrest Tracking Number (ATN) Your CMS will export the ATN to CMIS as 4 separate fields. The ATN can be found on the arresting documentation or sent electronically to you via a District Attorney data exchange. This information is used by DPS&C for the purpose of matching the final disposition back to the arrest record in the CCH database.

o Originating Arrest Agency ID (ORI) – The first 4 characters of the ATN is the ID for the agency who arrested the defendant.

o AFIS Device – The next character is the code number for the type of AFIS device method used for fingerprints.

o Year – The next two characters is the two-digit year of the arrest. o Arrest Sequence Number – The last 5 characters is the sequence number of

arrest charge.

Charge Sequence Number Each separate charge and count filed against the defendant should have an incremental sequence number issued by the criminal case management system. For instance, if the offender has been booked with 3 counts of 14:102 (Cruelty to Animals) and 2 counts of 14:102.1 (Cruelty to animals, simple and aggravated), the Case Management System should also have the capability of showing a distinct final disposition for each count of each charge.

c. When Information is Missing

Please leave the field blank in your case management system if documentation is missing information that normally requires data entry. Please do not type NA, N/A, None, or “0”. It is not necessary to enter NA or “0” for posted and/or actual speed, defendant’s zip code, or agency code.

8. Error Reports To ensure good data quality, CMIS checks the export file data and sends a monthly error report to the Clerks describing any errors. The report summarizes the errors that occurred in the data transmitted for the previous calendar month. This report will be sent, with accompanying forms to be faxed back to CMIS, to ensure that the report has been received and that efforts are being made to correct the errors. Each court has an obligation to correct and retransmit accurate records so they remain active in the criminal database.

a. Summary Report

The Summary Report allows the clerk to see a high level summary of their data. It includes the number of records exported, percentage of records forwarded to DPS and NICS, and the total number of errors.

1. Title – Identifies the error report as to either criminal or traffic records. 2. Date Range – Range of dates in which the error record was received by the

CMIS repository. For example: if the date range is 09-01-2006 to 09-30-2006, all of the errors listed below are from records that were updated during this time period.

3. Name – Name of the District Court.

10. Number of Accepted Records by CMIS – Total number of unique records that were filed or disposed during a given date range.

11. Number of Filing Records – Total number of unique records that do not have either a Disposition or a Disposition Date.

12. Number of Disposed Records – Number of unique records that have both a Disposition and a Disposition Date.

13. Data Guide – Lists the minimum required fields for acceptance by DPS and NICS.

14. Number of Records Reportable to DPS – This is the total number of unique disposed records that were transmitted to the Louisiana Supreme Court. (Note: All disposed records are eligible to be sent to DPS, but not all will have complete information, this number will include those records).

15. Number of Records Sent to DPS – This is the number of disposed records that have all of the necessary fields for transmission to DPS.

16. Number of Records Successfully Accepted by DPS – This is the number of records that were actually accepted by DPS and will be used to update the Louisiana Computerized Criminal History database.

17. Number of Records Rejected by DPS – This is the number of transmitted records that were rejected due to a data defect (Ex: invalid SID, wrong arrest date, etc.).

18. Number of Records Reportable to NICS – This the number of records that meet the criteria to be sent to NICS (Note: this number will always be lower than the overall number of disposed records).

19. Number of Records Successfully Accepted by NICS – This is the number of eligible records that were transmitted and accepted into the NICS database.

20. Error Overview – This lists the number of disposed records and filings that either have an error or are missing critical data elements.

b. Summary of Disposed Records

This section breaks down the errors and warnings into summary groups so you can see at a glance the biggest areas of concern. In the sample below, null SID numbers should be addressed. This section also displays the names of the extracted files exported during the month.

1. Title – Lets you know that this page is the summary of the number and types that appear on the error report for the given period.

2. Error Description – Gives a brief description of what types of errors has appeared on the report for the given period.

3. Error Number – Gives the number of records that this particular type of error has appeared.

4. Extract Files – This is the list of export files generated and transmitted by the Clerk to the Louisiana Supreme Court. Each filename includes the name of the court, date and the “xml” extension.

This section breaks down each error from the previous section. Each error will show details of the case from which it originated. The Supreme Court analyst can refer back to the extracted file by docket number and work with the clerk to see why an error was generated.

11. Charge – This is where the R.S. code and charge sequence number is located. 12. Missing Charge Info – Lists any missing information related to the defendants

charge such as arrest date or sentencing information. 13. CMIS Errors – Lists any data quality issues that would require the direct

attention or assistance of CMIS. The list of possible CMIS Errors and their description can be found in Appendix L. District Court Error Codes.

14. DPS Exceptions – States why DPS did not accept the completed record. The list of possible DPS Exceptions can be found in Appendix M. DPS Exceptions.

d. Error Report Handling FAQ

1. How can we reduce the number of errors? The single most effective means in reducing the number of errors is by implementing a data exchange between local law enforcement with the District Attorney, and a data exchange between the District Attorney and the Clerk of Court. An exchange allows commonly used data to be entered one time at the earliest point known, then electronically shared with subsequent law enforcement and judicial agencies. This process removes the effort of double entry of the same information, and eliminates typos and erroneous interpretations of the data. CMIS has filtered out all Title 32 and 56 misdemeanors from the error report detail pages. Additionally, CMIS can stop reporting detail pages on errors that meet certain criteria which include; participation in a DA-to-Clerk data exchange, inability to correct the error and the error type. 2. How should I read the CMIS error report? Please refer to the docket number. A clerk may elect to physically pull a case record and or type in the docket number and perform a search (query) for a particular criminal case.

3. When are CMIS error reports sent to our court? Error reports are emailed/mailed by the 15th of every month for the previous calendar month’s data. For instance, an error report for the month of April 1st-30th will be mail on or before May 15th.

4. Who receives the CMIS error report? The Clerk of Court and the criminal records manager receives the error report at your office. The report is mailed to the court with the Clerk of Court listed on the outside envelope and a cover sheet stating that the criminal records manager at your court should receive the error report.

5. What do I need to do when I receive a CMIS error report? Please send the “Criminal Error Report Receipt Verification” to the CMIS criminal project manager via mail, fax or email. Furthermore, please mail, fax, or email the “Criminal Error Correction Notice” to the CMIS criminal project manager when data entry corrections take place and of any particular error that cannot be corrected. A sample of these documents can be found in Appendix I. Criminal Error Report Data Verification Procedure. 6. Is there a deadline for correcting errors on the CMIS error report? We ask that all errors be corrected within 3-6 weeks from the date the error report is received at your office. A good estimate is to use a correction of 1 page a day. Therefore, if an error report is 10 pages long, the Clerk of Court should allow for 10 working days. We do understand that staffing issues and mass error reports do take some time to correct. Please estimate a date on the ‘Criminal Error Correction Notice’. 7. Do I have to correct all errors? No, we realize all data entry errors cannot be corrected. For example, if a defendant is driving without a driver’s license, we expect that this field will be blank. It is advisable in the case where missing information on the traffic citation occurs to have the Clerk of Court notify your local law enforcement department to verify and validate missing information.

8. What is the procedure to correct a record at CMIS and DPS&C? If the record only needs to be corrected, send an updated, electronic export file with the information corrected, we will then overwrite our copy of the record and forward it on to DPS. If the record needs to be deleted or removed completely due to an error, then your court needs to mail a notice to the Supreme Court. Please send a certified copy of the court minutes and a letter explaining the updates that need to take place. Please send a hard copy in the mail at the following address:

disposition (Plead Guilty, Guilty Conviction, etc.) needs to be entered or the sentencing data needs to be removed. Check your court’s records/minutes to see which. If the final disposition is “NP or O”, there should not be sentencing data entered.

9. Charge is Null; Record Not Inserted The filed charge is blank, so the record will not be loaded into the CMIS repository. 10. Bad or Null Record Type The record type (supplied by your Vendor/IT Staff) is not valid. This is an error that will have to be resolved by your Vendor/IT Staff. Record types: e.g. K – Criminal, T – Traffic, D – Juvenile Delinquency, C – Civil, etc. 11. Null Docket; Record Not Inserted This field should record the docket number assigned to the case by the DA or clerk’s office. 12. Null Charge Seq #; Record Not Inserted Each separate charge and count filed against the defendant should have an incremental sequence number issued by the criminal case management system. Please contact your vendor if a problem occurs. 13. # of Records in Trailer Does Not Match Actual # of Records Each file that is sent to CMIS contains a trailer with the number of records contained in the file. If the number of records does not match the trailer, this error will appear. Please contact your Vendor/IT Staff to resolve this problem. 14. Invalid Appeal Flag Is this case on Appeal? Y – Yes or N – No. Values such as “0“ or “None“ in the extract file will not be accepted. Please contact your vendor. 15. Offense date greater than system date The date a record is recorded and transmitted should proceed the defendant’s violation date. 17. Dispo Date Greater than System Date The disposition date cannot be greater that the system date (Current date of entry). 18. Charge code not in CMIS charge code table Please contact your vendor regarding the most current charge code tables.

Warning Sentence Data Inconsistent with felony convictions CMIS is performing an edit check on each felony conviction during the extract file load process, to see if the sentencing data is consistent with the charge. If not, a warning message is generated which should prompt the court to double check this issue to make sure that the conviction charge has been entered correctly from the minutes. We have found that there have been occasions where the court did not indicate in the criminal record that the defendant was found guilty of a lesser crime when originally charged with a felony.

9. Special Case Scenarios

a. Expungements

As of January 1, 2015, under Title XXXIV of the Code of Criminal Procedure (passed as Acts 2014, No. 145), obtaining an expungement of certain [arrest and conviction] records allows for the removal of a record from public access but does not result in the destruction of the record. An expunged record is confidential, but remains available for use by law enforcement agencies, criminal justice agencies, and other statutorily defined agencies. As of August 1, 2017, pursuant to Children’s Code articles 903-922 (passed as Acts 2017, No. 362) juvenile records are no longer to be destroyed when expunged and sealed, but when an expungement is now ordered, all records related to a delinquency or FINS case, including all pleadings, exhibits, report minute entries correspondence and other documents, must be identified and protected from unauthorized view.

Data entry directions for an expungement

1. Check the box marked “Sealed/Expunged” in your Case Management System (CMS) when you receive an order to seal or expunge a record. Leave the name and other identifiers on the CMIS export record intact. It is imperative that CMIS receive the export record with the “Sealed/Expunged” field selected. This is the indicator that we use in order to identify it as sealed or expunged in our database. If the field is not checked, the record in the DPS database may be un-expunged when we forward the CMIS record to them. 2. Save the record. Once the updated version of the record has reached CMIS, you may then alter the criminal record or delete the juvenile record as needed in your database. When deleting a juvenile record from your database, please notify CMIS by phone or fax immediately so we can delete the same record from our database. 3. Follow up by faxing the motion/order to expunge to fax number (504) 310-2570 to the attention of Toni Thomas. Please make sure that the motion/order includes the following information: docket number, defendant last name, defendant first name, defendant date of birth, race, sex, charge, charge sequence number, arrest tracking number, state ID number and arrest date.

b. Entering a Life or Death Sentence

The following solution has been adopted which will only affect the Sentence Length in Years Field (SLEN-YRS):

If a Life Sentence without a benefit of probation, parole or suspension of sentence is given, the number 999 should be entered into this field.

If a Life Sentence with a chance of parole is given, the number 998 should be entered into this field.

If the sentence is Death, the number 666 should be entered into this field.

c. Operating a Vehicle While Intoxicated (DWI)

When a defendant is convicted of operating a vehicle while intoxicated under LSA-R.S. 14:98, OMV will determine if the offense is the 1st, 2nd, or 3rd, etc. offense (for their purposes) after submission of an electronic or pencil and paper driver's license suspension form. OMV will look up the defendants’ driver history record and record the DWI accordingly. When entering Blood Alcohol Content (BAC), please do not exceed a 2 digit number form 01-45, 88, and 99.

Valid entries for the Blood Alcohol Content are (01 - 45) which represents (.01 to .45).

If the blood alcohol level is unknown, then the value must be (88).

If the violation is not a DWI violation then the value to be entered is (00).

The fields in positions (230 - 287) are for DWI violations (OMV Violation Codes 001 and 482) only and are mandatory for these violations.

If the violation is not a DWI then space or zero fill these fields.

i. Article 893/894 DWI; Generally

Export records with sentences suspended or deferred pursuant to Articles 893 and 894 of the Louisiana Code of Criminal Procedure are treated as “Plead Guilty” when reported to DPS and the FBI.

Effective August 15, 2009, Act 366 changed La. R.S. 32:393 and 32:853 and removed the deferred reporting exception. Therefore, at the time the plea is accepted under Article 893 and/or 894, the court, clerk, or district attorney is to report the conviction to the Office of Motor Vehicles no later than thirty days after the data of the conviction/sentencing. If the Article 893 and/or 894 final dismissal is subsequently denied, that disposition must also be reported to the Office of Motor Vehicles and LASC JAO Court Management Information System (CMIS) Division. involved. OMV has specifically stated that the OMV driver history record database is not an interim database for holding records while action is still being processed by the courts, but rather a repository for records after final adjudication. Specifically, in the case of an 894 plea involved with a DWI offense, OMV does not want the record until all proceedings have been successfully completed by the defendant, e.g. suspended sentence, probationary period, etc. This requirement is defined by state statute. To ensure that OMV doesn’t receive interim DWI records, CMIS is requesting your assistance in the following:

For DWI misdemeanors where the defendant makes an 894 plea and the probationary / suspended sentence period has NOT been completed, please forward the record to CMIS as before with the disposition field left blank. This will indicate to CMIS that the record is in the interim phase. CMIS will then hold the record and will not forward to OMV until final adjudication.

For DWI misdemeanors where the defendant makes an 894 plea and the probationary / suspended sentence period has been SUCCESSFULLY completed, please forward the record to CMIS as before with the disposition field filled in with the 894 code. This will indicate to CMIS that the record has a final adjudication and should be attached to the OMV driver history record. This record will overwrite the previous record submitted with the disposition field left blank.

Should the defendant not successfully complete the probationary / suspended sentence period, then the disposition forwarded to CMIS will be a “guilty”.

Continue to check the 894 flag in your software to indicate that the defendant has requested an 894 plea from the court.

iii. Article 893/894 DWI; Disposition Changes

If the defendant does not complete probation and a judge states an alternative disposition such as “guilty as charged” or the 893/894 was reported incorrectly or the 893/894 was denied for any other reason follow the following steps. Step 1.

1 The Arrest Tracking Number (ATN) will be assigned by the arresting agency. This number will be composed of 4 individual fields: ORI (original arresting agency ID), AFISDEV (AFIS device, which indicates the method used to take the fingerprints), YEAR (year of arrest), and ARRSEQNO (arrest sequence number). The charge sequence number could be assigned by either the arresting agency, prosecutor, or court - depending upon the business practices of the district. This composite number ATN will be used to distinguish the number of counts for a certain charge. Each count will be stored in a separate record.

2 If the arrest tracking number has not been provided by the arresting agency and/or prosecutor, a charge sequence number must be generated for each individual charge that pertains to a docket number. For example, if the individual had three different charges filed under one case (or one docket), the 1st charge record would contain a charge sequence number of '001' the next record would be assigned '002' and the 3rd record '003'.

A charge code lookup window is one way for the software to assist case management system users in selecting the correct standardized charge code to use. When appropriate, it is preferable that any local statutes be converted to Louisiana state statutes. Refer to the accompanying charge codes document for a list of valid charge codes, or request an updated charge code list from CMIS. These are reviewed and updated annually by CMIS after a legal review of legislative updates.

6 When the final disposition is entered, the conviction charge field must also be populated. If there is a charge modifier, the CC-Modifier field must also be populated.

7 The DVCase field updates the state criminal history database with information that provides law enforcement and the judiciary with critical information about a defendant's past behavior of violence. When this field is populated, an earnest effort should be made to identify the defendant's relationship to the victim, and enter an appropriate value in the NICSRTV field.
