    3. Has your office instructed FCPD to refrain from disclosing information

    about

    this case?

    The FCPD was not asked

    to

refrain from disclosing information about the shooting.

However, the FCPD was advised not to disclose information about the federal

    investigation.

    4. Has FCPD refused to provide to

    your

    office any information

    or

    documents

pertaining to this case--including the personnel file of

    the

    officer who allegedly

    shot Mr. Geer?

    f

    so, please explain

    what

    was withheld

    and

    the reason given

    for

    withholding?

There have been a number of challenges in investigating this case. Issues concerning

withheld materials were favorably litigated by the Department in a court matter that is

    and remains filed under seal.

    5. When was this case

    transferred

to your office from Fairfax County

    Commonwealth s

    Attorney

    Ray

Morrogh? What was the reason for the

    transfer?

The Fairfax County Commonwealth s Attorney referred this matter to the USAO on

    January

    7

2014. The Criminal Section became involved on February

    10

    , 2014.

    t

    is

not unusual for our offices to receive police-involved shooting investigation referrals

    from local prosecution offices.

We hope this information is helpful. Please do not hesitate

    to

    contact this office

    if

    we

may provide additional assistance regarding this or any other matter.

    Sincerely,

    Peter

    J

    Kadzik

    Assistant Attorney General
