Legislation Purpose - (minimum response 50-100 words)

The purpose of this policy is to applies relation to the sound environment. Firstly, this is to make sure the quality of acoustic environment that are suitable for human health. Secondly, this is to ensure the suitable environment for individuals such as sleep, study, work in an office and more. Finally, the quality of the environment can be improved.

Question 3. Go to the Redlands City Council website. Identify and describe two (2) local laws that relate to the environment including the penalties for not obeying them.

Local Law No. 3 (Community and Environmental Management) was imposed in 2015, it was set to regulate risk and threat from animal abuse, vegetation overgrowth and lighting of fires and natural fire hazards. For example, if a person sells or supply a declared local pest; or offer or display a declared pest for sale or supply could result in 50 penalty units.

2. Local Law No. 6 (Protection of Vegetation) was imposed in 2015, this local law regulates: damage against vegetation and miscellaneous matters regarding significant vegetation. For example, if someone damage protected vegetation, they could receive penalty up to 850 units

The level 2 water usage restrictions for the Mount Isa City Council was enforced from midnight 3 May 2015, and the restrictions are applied in private gardens, caravan parks, council facilities & area, fountains, sport ground & education facilities and other water related industry and facilities. Such as in private gardens: water use only in restricted times, 6:00am-8:00am and 8:00pm-10:00pm. Persons found in breach will be issued a $365.00 infringement notice.

Environmental Protection (Air) Policy was enforced in 2008 to improve the quality meanwhile intend to significantly reduce the industry waste and other air pollutions. The environmental values for the air environment and the air quality objectives for indicators. Also, the policy has states the management hierarchy for avoiding, recycling, minimising and managing air emissions.

ChemiCompany is a Victorian company that purchase several hazardous materials for its production needs. Imagine you are newly appointed environmental officer at the ChemiCompany warehouse facility. You decide to examine ChemiCompany’s procedures for reviewing compliance in the warehouse. You find the following procedures:

Answer Yes, I do, although ChemiCompany’s procedures do seems correct and thought through but it has neglected the importance of the environment risk and Process Risk, it could damage the company and its reputation. If ChemiCompany don’t take environmental risk and process risk seriously, the company could destroy the healthy environment and ecosystem around it. If its reported to relevant government department the company will facing large sum of fine and possibly a shutdown.

Question 7.2: Do you think that reviewing policies and procedures is sufficient to ensure that the above requirements are being complied with? Why? Why not?

Answer I don’t think reviewing policies and procedures is sufficient to ensure that the above requirements are being complied, because there is too much uncertainty involved. But I do think the problem could be solved if ChemiCompany is willing to hire relevant environment agency for help. They agency’s report could be the solution by outline the

current problem and its effect to the environment and the company’s future, followed by number of proposals to address the problem, it’s structure could be something like this: an introduction of its solution followed by the body of how the problem could be solved and the benefits of each resolution, end by a summary of the main fixes and which solution the agency recommends.

Question 7.3: Victoria’s WorkSafe information about employer’s legal duties regarding hazardous substances specify that employers must :

Do you think the ChemiCompany’s procedures for reviewing compliance are sufficient to ensure that the above requirements are being complied with. Why? Why not?

Answer I don’t think ChemiCompany’s procedures for reviewing compliance are sufficient, I recommend ChemiCompany to be more prepared to avoid or eliminate future incident, such as a detailed procedure to be followed every incident, from the day of the injury to the employees fully recovery date. Employee must report to his/her supervisors after injury, ambulance must to notified if the situation is getting out of hand. A document regard to the incident will be constructed, as a record for the company to analyse and improve the workplace safety. I recommend more washrooms and first aid to be placed around hazardous substance and heavy machinery areas

Answer I’m confident that the above procedures will ensure that ChemiCompany is complying with current legislation. Because creating a safe work environment is a legal requirement and critical to the long-term success of any business, Under Australian WHS/OH&S legislation businesses are legally obliged to: provide safe work premises, assess risks and implement appropriate measures for controlling them, ensure safe use and handling of goods and substances, provide a suitable working environment and facilities and much more. If any business attempt to disregard or non-compliance with Victoria's health

Question 8. Review the Planting People Scenario in page 3 of the Student Workbook then make a list of what needs to happen at Planting people to ensure that they complying with legislation. (Your response must be between 100 to 200 words)

Answer First of all, regrading to the duty of care, all employees and employers need to protect the physical, economic and emotional health of themselves and others. At the Planting, anyone has responsibly to make sure the pesticides are keep in containers with labelled corrected. In Queensland, the environmental negligence is under Civil Liability Act 2003. Same as another issue of those orchids and their habitat. Orchid is listed as endangered species which under the Environment Protection and Biodiversity Conservation Act 1999. Councils have a range of options in place to help them do this. These may include vegetation management strategies, plans and local guidelines, bushland acquisition programs, vegetation protection ordinances and conservation agreements with landholders. Talk to all employees about the issues for the threatened plants and provide up-to-date training. Reviewing the changes of legislation regularly.

1. Non-Discrimination – this is important for employees’ performance. The fair work environment such as male and female that can become equal. The affected individuals worker working without stressful conditions. Also, employees can have the same chances to go after opportunities and develop their skills.

2. Probity and ethical behaviour – Ethical employees which are able to recognize the difference between right and wrong. In a business which means employees have principles of honestly and fairness that apply to the customers. that benefit the company to build up the loyalty to customers and to build the company’s reputation.

3. Risk management – this benefits a company to consider the potential risk for the future. For example, when a company make an investment decisions. The process should involve identifying the amount of risk. Observe, measures and evaluate the rick to minimize the financial problems and good for the sustainable development.
