NECF HISTORY

• Ministerial Council on Energy (MCE) started consultation in 2006.

• Ausgrid commenced background work in 2006.

• Legislation passed in SA March 2011.

• Ausgrid established five work streams to bring together the NECF changes.

• NECF was meant to start in NSW on 1 July 2012, delayed by NSW Government to 1 July 2013.

• NSW Adoption Regulations enacted NECF April 2013.

• NECF already introduced in Tasmania, ACT and SA.

WHAT IS NECF?

The National Energy Customer Framework (NECF) is the next stage in national energy reform. It involves:

• Harmonisation of state based regulatory frameworks for the retail energy market and energy distribution sector (Electricity and Gas Networks and Retailers),

• A single set of national rules and laws to replace State based laws and regulations. The concept started as a retailer initiative as retailers operate across state borders,

• A range of energy specific consumer protections, e.g. ‘network connection offers’ that lead to a contract for connection services,

• Commences 1 July 2013.

LEGISLATION CHANGES

• Connection services will now be governed by the National Energy Retail Law, the National Electricity Law, and rules and regulations under those laws.

• Chapter 5 of the National Electricity Rules is a key component, it applies to registered participants in the NEM, and Chapter 5A applies to all non-registered participants.

• Relevant NSW legislation:

– National Energy Retail (Adoption) Act and Regulation,– Energy Legislation Amendment (National Energy Retail

Law) Act 2012. Amends Electricity Supply Act,– Electricity Supply (General) Amendment (National

WHO IS IMPACTED BY THIS CHANGE?

Everyone who is involved in the connection and supply of energy to customers will be impacted. This includes:

• Ausgrid employees who process connection applications, undertake connection works, manage connection assets, undertake planning, manage projects, deal with customers and those involved with design and compliance,

• ASPs who provide services to both customers and Ausgrid,

• Any people applying to connect to the network or applying to modify their existing connection in any way,

• Retailers who provide an interface with customers and Ausgrid will need to be aware of the changes.

HOW WILL IT AFFECT CUSTOMERS?

• All new and altered customer connections in NSW will have to follow the new Chapter 5A contract process.

• Customers arranging either a new connection to the network, or an alteration to their connection will have new forms to complete.

• Ausgrid will respond to the application within 10 business days with a connection offer for the connection services that we provide to connect the customer.

• The connection offer becomes a contract for delivery of these services if the customer accepts the offer.

• There will be a new ‘Deemed Standard Connection Contract’ that replaces the Standard Form Customer Connection Contract.

HOW WILL IT AFFECT CUSTOMERS?

• It will apply to ongoing connection services after electrification of the service. This contract sets out the connection services that we must provide and the customers’ obligations once connected to our network.

• This contract is based on a model contract required under the NECF rules with only variations permitted by the NSW specific requirements.

• All existing customers will automatically roll onto this deemed standard connection contract.

• This continues over from the Chapter 5A connection contract.

CHAPTER 5A – KEY CHANGES AND IMPACTS

• All customer connection offer terms and conditions must include:

–Timeframes for commencing and completing the work,

–A description of the connection and the costs.

• Connection services include design services, market system updates, meters, construction work and substation commissioning.

• The connection offers will be on the Ausgrid website as “Model Standing Offers” (MSO) that a customer can obtain and read. Once accepted, the MSO becomes a contract.

• There are defined timeframes for Ausgrid to send an offer in response to a connection application.

• Timeframes for Ausgrid to commence and complete its part of the project will be in the contracts.

• Failure to meet these timeframes is a potential contract breach and a reportable regulatory breach.

• A standard connection offer must be sent to the applicant within 10 business days of receiving a connection application.

• A negotiated connection offer must be sent to the applicant within 65 business days of receiving a connection application.

• There is an “expedited option” for connection offers.

TRANSITION

• New NECF forms and connection offers required from 1 July 2013.

• ES9 agreements still used until 1 July 2013.

• Connection applications received by Ausgrid from 1 July 2013 must use a new NECF connection application form.

• All projects with an existing ES9 agreement will continue, using current non NECF processes through to electrification, unless the applicant wants to submit a new connection application form.

• Parallel processes to be managed in the short term.

BASIC CONNECTION OFFERS

• There are three Basic Connection Offers (100 amps, Micro EG, and > 100 amps).

• These apply to customer connections where there will be minimal or no network augmentation.

• The only network augmentation is the service cable and metering equipment (ASP/2).

STANDARD CONNECTION OFFERS

There are four Model Standing Offers targeted towards the more common customer connection work that occurs on our Network:

– Ausgrid off site augmentation,

– Ausgrid augmentation (substation upgrade),

– Ausgrid on site augmentation,

– Model standing offer Standard Connection Services for Contestable ASP/1 Premises Connections no greater than 11kV (MSO).

NEGOTIATED CONNECTION OFFERS

• Under NECF, the applicant has the right not to accept a MSO, and to negotiate an offer. If negotiation is required, a process will be available on our website.

• If our MSO’s are not suitable for the proposed connection, Ausgrid will propose a negotiated connection offer.

• A 65 business day timeframe for preparing and sending an offer will apply.

• Ausgrid can require an applicant to pay any reasonable costs incurred in negotiating an offer.

Model standing offer Standard Connection services for Contestable ASP/1 Premises Connections no greater than 11kV (MSO).

• This applies to connections where there will be network augmentation. This offer is for contestable connections where an ASP/1 installs new infrastructure.

• Note: Relocation projects are not required to have connection offers. However, relocation projects are expected to be managed with a similar contestable process.

EXPEDITED OPTION IN ALL OFFERS

There is an “expedited option” for connection offers:

• If an applicant agrees to one of Ausgrid’s model offers then there is no need to have a formal offer and acceptance,

• To accept this, the applicant or its representative must indicate this on the relevant connection application form,

• If expedited, the contract commences on the date the connection application was “completed” with the certification number,

• Ausgrid has the option not to accept a connection offer as “expedited” if it believes the offer nominated on the application form is not suited to the connection application.

• If the connection application indicates an expedited connection, the contract commences on the certification date (i.e. the date the connection application was “completed” with the certification number),

• While all Basic and Standard offers will be able to be expedited, it is anticipated this option will be mostly associated with works that typically involve ASP/2 work only.

All designs must comply with the requirements of the Work Health and Safety Act 2011 (NSW) and the Work Health and Safety Regulation 2011 (NSW).

Ausgrid requires the designer to provide adequate information regarding any plant, substance or structure associated with the design of any network asset, including overhead or underground distribution mains, overhead or underground subtransmission mains, distribution substations, street lighting, etc. In so doing, the designer must:
