Relationship between ASEAN countries and Japan

①Production bases of Japanese companies have been transferred to ASEAN countries

②Sales of products in ASEAN countries

③Technical license to ASEAN countries (other than pharmaceutical industry)

・To acquire a patent right

・Investigate patent rights

Examples of business development in ASEAN countries

Business development in ASEAN countries is active actively

Page 4: ASEAN Patent Information Working Group

① Survey of local market (actual condition of use and brand power), grasp of local consumer needs

② Study on production and technology (Procurement of manufacturing equipment, materials and securing human resources)

③ Review from legal aspects (regulatory authorization / approval)

④ Confirmation of infringement risk (Investigation of infringement against intellectual property rights of other companies)

Product development in ASEAN countries

Page 5: ASEAN Patent Information Working Group

It is important to eliminate the risk of patent infringement of other companies by investigating the patents of these countries in advance.

However, it is difficult to conduct adequate investigation in databases available on the Patent Office site of ASEAN countries.

Many of the patent applications of ASEAN countries are

application from non-ASEAN countries.

Therefore, by using the priority information, it is possible to expect alternative search by the commercial database.

ASEAN's patent verification method

9

Investigation of infringement prevention against patents of other companies

EX. How to check the existence of WO2010/103844 ① PATENTSCOPE ② Espacenet ③ ASEAN PATENTSCOPE

Use priority information or PCT related information

Page 10: ASEAN Patent Information Working Group

10

Leveraging PATENSCOPE

Characteristics ・In ASEAN, Singapore, Vietnam, Brunei, Cambodia, Philippines Indonesia, Malaysia, Thailand are included. ・Search and display in ASEAN, as a rule, it depends on the language of each country. ・In text search, in principle, it is impossible to ASEAN's patent verification (Thailand native language notation)

Regarding the search / display of application number・・・・ display form is different for each ASEAN country →A corresponding search is required

Ex. Investigate WO2010 / 103844 using PatentScope

Page 11: ASEAN Patent Information Working Group

① PCT National Phase Entry

Page 12: ASEAN Patent Information Working Group

12

① PCT National Phase Entry

There is no information on National Phase entries to ASEAN countries

Page 13: ASEAN Patent Information Working Group

Page 15: ASEAN Patent Information Working Group

Investigate WO2010 / 103844 using ASEAN PatentScope

Enter PCT Publication No. WO/2010/103844

Page 16: ASEAN Patent Information Working Group

Searching by international publication number, the Vietnamese publication hit.

PCT Publication Number = WO/2010/103844=VN1201102616

Check PATENT FAMILY ★Confirm existence of patents for Indonesia, Malaysia and Thailand. ★Contains many unnecessary information but can not be found in other databases.

For example, there are “Title”, “Title Englishi”, and “Title Bilingual”. This distinction can not understand.

Leveraging ASEAN PATENTSCOPE

8 countries, Brunei, Cambodia, Indonesia, Malaysia, Philippines, including Singapore, Thailand and Vietnam

・ When conducting a survey of Brunei and Cambodia:

Currently, there is only database

・When number searches are performed, it is necessary to search in accordance with the number form of each country.

・IPC is not exhaustive.

In Addition ・・・・

・ Field name definition required ex: File Type, PCT pub Counry, APLICATION 、APPLICANT INVENTOR・・・・

・Sometimes nothing is contained in DOCUMENT LIST when opening a gazette.

Page 20: ASEAN Patent Information Working Group

Impression after verification

① When using PATENTSCOPE In principle, search and display by national language ★Malaysia, Philippines, Singapore: DB is provided in English

→ desirable

Indonesia, Thailand, Vietnam : →(Supplementary) Display in English is also requested

② When using ASEAN PATENTSCOPE →We would like you to maintain the field names.

Indication method of each country's number is different →Fairly tedious

Page 28: ASEAN Patent Information Working Group

There is a high probability that there is an application corresponding to a foreign country exists in the ASEAN patent.

Therefore, search for Japanese patents and confirm whether the application obtained from the search result exists in ASEAN countries.

ASEAN PATENTSCOPE can search patent documents in nine ASEAN countries

→acclaim

Patent search of ASEAN countries

Are they all covered? Can you search with text?

But・・・

Page 29: ASEAN Patent Information Working Group

・In the ASEAN countries, there are 10 to 17% of non-foreign born applications (investigated in 2017). They can not be searched with existing databases.

・Ultimately, ask the local office for a patent search.

However, we can not request all the patent search

matters to the local office.

Therefore, about 20% occurrence of inability to investigate.

Limitations of patent investigation in ASEAN countries

Page 30: ASEAN Patent Information Working Group

Number of patents in ASEAN countries

Recording year varies depending on the country

Request to ASEAN PATENTSCOPE

We want a minimum of 20 years for the recording year

Page 31: ASEAN Patent Information Working Group

Futuristic・・・・ Investigation is difficult if the number of applications only in your country increases

・Acquisition of IPC and recording of data without omission ・Maintenance of field that can search keywords

Patent search with existing database can be done
