3. ELIGIBILITY FOR QUOTING :

A. GENERAL CRITERIA:

- Should be a Public/Private company under Companies Act with a net positive worth and having office

in West Bengal.

B. PROJECT EXECUTION REQUIREMENTS:

- The firms should have experience of executing similar projects of not less than Rs.10 lakhs for at the least one such projects during at leasr 2 of the last three financial years.

C. CONDITIONS OF CONTRACT

- 1. Before commencement of the work the agency shall furnish a list of its employees to be engaged in the said work which shall include at least a supervisor (with the provision of leave substitute who shall be authorised to deal with the authorities in the WBSCTE).

- The list shall contain the following:- - i) Name ii) Present Address iii) Age iv) Identification Mark v) A specimen signature or LTI (on the event

of the employee being illiterate) vi) A passport size photograph duly attested by the selected quotationer. - 2. The WBSCTE holds no liability for any injury, accident or accidental death etc. of any person engaged

by the agency which may occur in course of the works pertaining to enforcement of the proposed security measures. The question of compensation arising out of such cases shall have to be settled by the agency

itself entirely at its own cost and responsibility. - 3. The agency is fully responsible to provide uniforms and implements required to perform the duty of

Security Guard/ Sweeper etc. - 4. All containers, disinfectants, chemicals including, chemicals including anti-mosquito chemicals,

deodorants, room-fresheners necessary for performing the job as specified in sl. 1 and 3 of the description of work shall be supplied by the agency.

- 5. Requirement of water for performance of the jobs shall however, will be made available by the State Government.

- 6. Work order for the entire job may or may not be issued at the same time. Separate work order may be issued for separate floors (or a portion of a floor) immediately or any later date as the authority in the WBSCTE may decide. Payment shall be made proportionately according to the specific work order issued and actual work done. In addition to the said job the agency shall be required to perform some or all of the same work as described in the details of work on any portion in addition to the floor area as specified at the rate accepted by the WBSCTE and on that instance payment will be made proportionately.

- 7. The agency shall have to check up all materials coming and going outside the said premises and shall have to maintain Gate Pass etc. as per requirement and direction of the Secretary, WBSCTE.

- 8. Selected agency must also ensure the deployment of fire fighting trained personnel in adequate Nos. - 9. Deployment of two plumber and two electrician each in 24X7X365 days. - 10. The agency shall follow strictly the minimum wage policy of the State Govt. as from time to time

vide orders of the Labour Department of the Government of West Bengal. The agency shall also provide facilities like E.S.I., Gratuity, Provident Fund, Scheduled Working Hours, medical benefit, Insurance etc.

- 11.. The agency shall deposit 2% (two percent) of the accepted value of the work for the period from April 2014 to March 2015 in Bank Draft before each work order is issued.

- 12. While performing the job the agency or its employees shall always act in a way so as not to cause any unreasonable embarrassment or inconvenience to the Ministers, Officers and other employees of the State

Government working in the premises or any member of public coming to VTI building on official business.

- 13. Payment shall be made on presentation of monthly bills along with pay slips and P.F details of the employees engaged by the agency for the said job and on satisfactory completion of the job. While utmost

attention will be paid for prompt payment, the state Government shall not be responsible for usual delay for observing necessary formalities for passing of such bills and preparation of cheques. Whether the job has been satisfactorily performed or not, the decision of the State Government shall be final and binding on all.

- 14. Bills shall be received at the receiving section of the WBSCTE at VTI building. Payment, when

becomes ready, shall be paid in cheque and will be disbursed by the Accounts Branch of the WBSCTE or at any place to be decided by the WBSCTE, on submission of receipt of the same.

- 15. The agency and its employees shall work in collaboration with official of the Technical Education and Training Department of the State Government having the charge of affairs of VTI building.

- 14. Income Tax as per extant Income Tax Act and Rules will be deducted from the bills which will be submitted by the selected agency from time to time on satisfactory performance of the job.

- 16. The agency shall strictly follow all relevant Provisions of Law in force while carrying out its job in VTI building in its respect and in the respect of its employees. The State Government shall not be put under any inconvenience or complication arising out of any fault or default of the agency or any of its employees because of non-fulfillment of such provisions.

- 17. If the agency fails to commence the work on the scheduled date or if the WBSCTE considers that the job is not being performed satisfactorily or any or all of the terms and conditions as specified herein have been violated, the State Government may terminate the contract forthwith and forfeit the Earnest Money deposited.

- 18. In any case the agency is not entitled to withdraw his contract without serving a notice to the Secretary, WBSCTE -at least three (3) month’s notice in advance.

4. SUBMISSION OF THE TENDERS:

All tenders must be submitted online as provided in Table below in compliance with Annexure detailing the scopes of work. Tenders will be opened in presence of such tenderers or their authorized representatives.

Tendering firm may inspect the VTI premises from 2-00 PM to 4-00 P.M. on working days with prior permission of the Joint Secretary of the TE &T Department.

The tender is to be submitted in a Two Bid System.

(i) “BID A”: One folder for “Essential Requirements of the Tendering Firm for participation” shall contain all papers

related to the essential requirements of the Tenderer for participation in the tender viz.

2. “BID B”: Another folder as “Financial Bid” shall contain the financial bids(BOQ) with the base rate per accounting

inclusive of all applicable Taxes and any other charges to be quoted.

3. During the tender evaluation process, the “Bid A” will be opened first. Those tenderers having qualified

for the essential requirements will be identified on the basis of the supplied documents. The Tender Selection Committee / Purchase Committee will assess the capability of the bidders for executing the deliverable service of the council during the tender period and then only in respect of those bidders who shall qualify in the opinion of the EXPERT COMMITTEE after the presentation, the “Bid B” will be

opened. The “Bid B” of those Tenderers, failing to meet the essential requirements of participating in the tender and subsequently failing to qualify in the opinion of the EXPERT COMMITTEE after the presentation, will not be opened and be rejected.

4. The Tenderer quoting the lowest rate in “Bid B” will be considered as successful if otherwise eligible.

5. THE DECISION OF THE TENDER SELECTION COMMITTEE / PURCHASE COMMITTEE WILL BE

FINAL IN THIS MATTER. LIST OF SCOPE OF WORK MAY BE SEEN IN ANNEXURES OF THIS TENDER DO

5. EARNEST MONEY: (a) Each tenderer must deposit Earnest Money in the form of Demand Draft/Pay Order for Rs 40,000/- (Rupees

Forty Thousand) only in favour of “West Bengal State Council of Technical Education”, before opening of Bid

–‘A’. The Earnest Money is to be deposited once for participation in the whole tender. A copy of the Demand

Draft/Pay Order of the Earnest Money deposited should be included with the documents submitted in “Bid

A”.

(b) The earnest money of the Tenderer is liable for forfeiture in case the Tenderer withdraws the tender as a

whole or for any particular item at any stage after the opening of the tender, or fails/refuses to enter into

written agreement for any or all of the items of its accepted tender within the time specified when requested

to do so/fails to furnish Performance Bank Guarantee within the stipulated time.

(c) The Earnest Money will be refunded after finalization of the tender or within 3 (three) months from the date

of opening of tender whichever is later against the specific prayer from the Tenderer.

(d) The EMD may be converted into security Deposit at the request of the selected agency.

All above documents/papers as applicable should be submitted with Bid –‘A’

6. BIS Certification/I.S.I. Certificate:

a) Items, for which BIS or ISO or other specifications have been specified, should be certified to be of the specified standard by the Bureau of Indian Standards (BIS) and have the necessary valid licenses at the time of the supply orders. In cases of non-availability of BIS certification and valid license, a certificate from a Government recognized test house should be attached specifically certifying that the supplied item

conforms to the IS/ISO standard as specified. If the specified IS/BIS/ISO standard has been superseded by a more recent standard, then the more recent standard will be considered by the Tender Selection Committee / Purchase Committee.

b) In items requiring mandatory certification under the relevant law, the manufacturer should have the necessary up to date licenses/certifications from BIS and/or other statutory authorities as applicable.

Non-compliance, if detected on a later date, will lead to summarily cancellation of the offer and penal provisions for fraudulent submission of tender will be invoked.

7. IMPORT LICENCE:

Only In Cases where it is applicable. Duly attested photocopy of the Import Licence with up to date renewal from licensing authority must be submitted.

8. RATE:

a) Rate should be quoted in Rs. Per hundred square meter of built up area of the building . b) Rates shall be valid throughout the period to be covered by the contract to be executed with successful

tenderers along with any extensions as may be made by the competent authority from time to time.

c) The basic rate per accounting unit should be furnished inclusive of all applicable Taxes and costs which shall be quoted separately for each item of work in the template for Bill of Quantities.

9. TESTING: a) WBSCTE will be at liberty to get the supplied items/services/deliverables tested at Govt.

selected/empanelled laboratory, Govt. approved Test Houses, BIS Labs and/or EXPERT COMMITTEE

nominated by West Bengal State Council of Technical Education, the identity of which shall not be divulged to the Tenderer.

b) A sum @.5% of bills exclusive of Govt. tax & duties or the actual cost incurred for such testing, whichever is less will be deducted from the bills of the supplies of items to meet the cost of testing charges.

10. WITHDRAWAL /CANCELLATION & PURCHASE POLICY OF TENDERING AUTHORITY:

i) The tendering authority reserves the right to withdraw any item from the tender at any stage. The selection of such item, if already made in favour of any Tenderer, shall be treated as cancelled.

ii) The tendering authority reserves the right to reject or accept any tender or part thereof at any stage or to split any tender without assigning any reason thereof. Withdrawal of tender or any revision after submission of tender by the Tenderer will not be allowed.

iii) The tendering authority reserves the right to accept or reject any tender, in part or in full, without assigning any reason.

iv) Purchase shall, however, be made following the existing purchase policy of the Govt of West Bengal and its amendment(s) or addendum made from time to time.

v) The tendering authority reserves the right to procure any item, of the tender directly from any agency in

pursuance of Govt. norms even if a tender for the same has been offered/accepted.

11. PENALTY CLAUSE:

(A) In case of sub-standard services, any such service determined by the appropriate authority will not be accepted and the payment for such service will not be made to the selected agency.

(B) Debarment from participation in next tender processes of the Technical Education & Training

Department: The Tender Selection Committee / Purchase Committee reserves the right to declare a firm/

Company blacklisted for five years due to the following reasons: If the supplier i) withdraws from agreement after being the “Lowest Quoted Tenderer” ii) Failure in supply within stipulated period.

iii) For supply of substandard items within tender period as determined by the Competent Authority.

iv) In consequence of submission of false or fabricated documents by any firm/ company for participating in the tender, if proved later on.

v) Tenderer who have quoted absurdly high or low rate in the opinion of Tender selection Committee, with the intention to vitiate the tender process.

vi) Submission of tender for the product(s) for which the concerned company has been blacklisted either by the state Government other State / Central Government Organization.

vii) Submission of tender during the period of blacklisting of Concern / Company either by Tender Inviting Authority or by any State Government or by other State/Central Government.

(C) Financial Penalties for deficiencies in services/supplies during the period of the tender and its subsequent extensions:

1. For supply of deliverable items/service not in pursuance of the objectives/principles/ procedures

within tender period or its extensions – Clause 15 will be followed. 2. For delay in the supply of deliverable service: (The procuring officer shall provide the evidence of

sending the order to the approved service provider or his authorised distributor or dealer, as the case may be). Partial execution will not be considered as delivery in full unless specified in the work order.

a. First time offence: If orders are not executed as per the schedule provided by the council - one day’s delay at any

stage of online counselling as mentioned in the work order – Caution to be sent along with the copy of the order.

b. Second time offence - one day’s delay occurring at any subsequent stage of online counselling: as mentioned in the caution notice as provided in a above - 1% of the total value of the order or Rs 50,000 (Fifty thousand) whichever is less will be deducted from the billed amount.

c. Third time or each subsequent offence - one day’s delay occurring at any subsequent stage of online counselling - 5% of the total value of the order or Rs.1,00,000 (One Lakh) whichever is

less will be deducted from the billed amount.: d. For firms who fail to supply the full order on five occasions within the tender period and its

extensions- the whole Performance Bank Guarantee will be forfeited and the firm and its principals will be debarred from participation in tenders of this council for the next five years.

3. The names of the defaulting suppliers will be put up in the Departmental website. 4. Enhancement of rates of raw materials etc or the fact that the tender period has been extended will

not be acceptable as a plea for not supplying the materials within the stipulated period as provided in the work order.

(D) Non–supply / Risk Purchase

i) If Tenderer fails to execute the supply within the stipulated period, the Tender inviting authority is at liberty to make alternative purchase of item/ items/services for which orders have been

placed from any other source, following provisions of the existing Acts/ rules/ Orders.

ii) For the situation as enumerated in points i), ii), iii) under Clause 14 (B), the supplier will be imposed penalty apart from forfeiture of Performance Guarantee. The excess expenditure over and above contracted prices incurred by the Tender inviting authority in making such purchases from any other sources or in the open market or from any other money due and will become due to the default supplier/service provider and in the event of such amount being insufficient, the balance will be recovered personally from the supplier or his pending bills, if any.

12. PENALTY FOR FORMATION OF CARTEL OR FURNISHING OF FRADULENT/MISLEADING DOCUMENTS:

If during the tender process or at any stage during the validity of the tender period, it is found that a Tenderer(s) has formed a cartel in whatsoever form or name to fix up the rates or suppliers to the detriment of the fairness of the tender process, penal measures shall be initiated. Similar penal measures shall also be initiated against those tenderers who have submitted false/ misleading/ fraudulent documents or made incorrect declarations. The penal measure will be –

i) Forfeiture of Earnest Money

ii) Forfeiture of Performance Bank Guarantee.

iii) Cancellation from the approved list of suppliers and debarment from further work orders

iv) Black listing from all Departmental tenders (called by the TET or others) of the Tenderer, the Principals of

the firm(s) and the concerned distributor(s) for a period of five years

13. APPEAL:

Appeal against the decision to impose such a penalty will lie with the Tender Selection Committee / PURCHASE COMMITTEE. Review against the decision of the Tender Selection Committee / Purchase Committee will lie with appropriate authority of West Bengal State Council of Technical Education. The Vice Chairman will be the appellate authority. Before imposing any penalty as per clauses mentioned above, the concerned supplier/service provider may appeal to the authority citing the proper reasons justifying for non-imposing the penalty as stated.

14. AGREEMENT: On a tender being accepted, intimation of acceptance will be forwarded to the Tenderer by the tendering authority. Such intimation may be forwarded either in one lot or in different lots. After communication of the

same, the Tenderer will have to execute agreement in the prescribed form with the tendering authority. This present document and the tender forms filled in by the Tenderer or copies thereof in so far as they are not inconsistent with these terms & Conditions will be incorporated as part of the agreement. Such agreement will be binding on the Tenderer.

15. VALIDITY PERIOD OF AGREEMENT:

The contract period will be for a period of one year which may be extended with prior approval of the appropriate authority of WBSCTE, if necessary.

16. ORDER & SUPPLY:

i) All Orders for the supply of service in this tender will be placed with the successful tenderer after the execution of the agreements, and such serce shall have to be provided in such instalments as may be fixed or spread over the period to be specified in the work orders to be made in pursuance of the agreements,

ii) An idea as to quantities of different items that may be required should be obtained by getting in touch with the WBSCTE, if the tenderers so desire. The assessed quantities may be increased or decreased at the discretion of the tendering authority at any time throughout the period of validity of the tender/ contract.

17. PERFORMANCE BANK GUARANTEE: (i) The performance bank guarantee will be mandatory for all suppliers and will not be waived in any case. (ii) The successful tenderers shall be required to furnish the ‘Performance Bank Guarantee’ equal to 5% of the

value of the supply order shall be kept with the procuring office as Performance Bank guarantee. (iii) ‘Performance Bank Guarantee’ should be submitted within three working days from the date of issue of

work order. (iv) The Performance Bank Guarantee will be liable to forfeiture as enumerated in penalty Clauses above.

18. PAYMENT TERMS:

Payment will be made after execution of deliverable service as ordered subject to: i) Submission of Performance Bank Guarantee in and subject to penalty as mentioned in relevant clauses. ii) Supply of the materials/services as per specification as provided in the tender documents and the work order

iii) Installation and Commissioning, if needed, up to the satisfaction of the competent authority iv) Successful passing of the test conducted on the supplied material/service by the Expert Committee of this

council. v) All materials/services which will be supplied from the council for the purpose of furnishing information and

all materials/services which will have to be supplied by the firm to the council under the contact, are property of council and vendor has no right to use it in any manner whatsoever beyond the period of the contract.

A prospective bidder shall have to offer rate for all items subject to fulfillment of conditions laid down hereinabove and conforming to production capacity to be laid down in the tender paper.

10. During the tender evaluation process, the “Bid A” will be opened first. Those Tenderers having qualified for the essential requirements will be identified and “Bid B” will be opened only in respect of those bidders who shall qualify in the opinion of the EXPERT COMMITTEE after the presentation. The “Bid B” of those Tenderers failing to meet the essential requirements of participating in the tender and not recommended by the EXPERT COMMITTEE after the presentation, will not be opened and be rejected. Scope of works 1. Daily ‘sweeping and cleaning’ of the total floor area including all the rooms and office space under the occupation of the WBSCTE, Technical Education and Training Department or other line Deptt. and the Directorates of the aforesaid

Departments [1st to 5th floor] along with the floor space of the office of the ‘VTI building’, Medical Unit and Driver’s Room, EPBAX Room, Grievance Cell and common space at entry point of each block at Ground floor for an area measuring about 1, 37,535 sq. ft. with water-soaked brush, disinfectants, deodorants, room-fresheners and floor cleaner (Phenol).

2. Cleaning of all toilets, latrines, urinals, wash basins including sweeping and washing of the floors of the toilets covered in the aforesaid floor space twice daily with disinfectants, chemicals including anti-mosquito chemicals, deodorants, room-fresheners.

3. Removing of dust from the tables and chairs and other furniture in all the rooms and office spaces daily. 4. Cleaning of cobwebs etc. from the ceilings, walls, window panes etc. of all rooms, office premises, passages and toilets on weekly basis. 5. Cleaning of the blades of the fans of all the rooms and cleaning sweeping and mopping office premises and passages with soap water and detergents in the aforesaid floor space on weekly basis. 6. Shutting of all windows and switching of all lights and fans in the aforesaid floor space after normal office hours. 7. Unlocking of the office rooms at 9.30 A.M. or earlier as may be necessary and closing of the same at 6.00 P.M. or till the last occupant leaves the office whichever is later. All rooms, office premises, lavatories etc. must be kept clean and dry before 9.30 A.M. 8. Placements of ever-green plants in pots in the office space from the front of the V.I.P. lift upto the end of the corridor in between the chambers of the Ministers, Secretaries and other officials in the 1st to 5th floor. 9. Guarding the entire premises of the VTI building [1st to 5th floor] along with the floor space of at and Medical Unit, Driver’s Room, EPBAX Room and Grievance Cell. The agency shall remain responsible for any loss or damage of materials or property. 11. Deployment of man power- two in each wing on each floor on all working days and skeleton manpower (6 Nos. in building) on holidays, 4 nos. in gate and outside the building for all days including holidays. Such employees shall be ready to attend any call during 9.30 A.M. to 6.00 P.M. from the WBSCTE relating to the performance of the said jobs of

the agency. 12. General Caretaking. 13. Maintenance of greenery/plants outside the premises at the ground floor and watering the plants. 14.
