Millions of tonnes of asbestos were imported into the UK between the 1930s and 1970s.

It was used extensively in building and industry.

Although it was known to be hazardous before World War II it continued to be used for decades.

Most of the asbestos imported is still present in schools, factories, shops and homes.

The UK has one of the highest incidences of asbestos-related illness in the world.

The rate of diagnosis of asbestos-related illnesses continues to rise.

Asbestos illnesses can affect people who have worked in a very wide range of occupations, as well as the family members of workers who have been exposed to asbestos dust brought home on their hair, work clothes or overalls. People who lived or worked near asbestos factories, teachers and pupils exposed to asbestos at school and even prisoners who were used as free labour on work gangs may be at risk. Most people exposed to asbestos will never suffer any adverse effects. Some, however, can become unwell, usually decades afterwards. Asbestos can cause various different illnesses, some of them benign and generally asymp-tomatic, others very serious indeed.

3. Asbestos-related illnesses

Mesothelioma

An aggressive asbestos-related cancer of the lungs or abdomen, and rarely the testicles. Mesothelioma can affect workers, family members and people who came into contact with asbestos as a result of living near asbestos factories.

Around 2,500 people are diagnosed with mesothelioma in the UK every year, and this figure is still rising. Treatment can hold the disease in check, but there is currently no cure.

Mesothelioma can be caused by very low levels of exposure to asbestos. It usually occurs several decades after the exposure.

Typical compensation awards for people diagnosed with mesothelioma exceed £100,000. Obviously no amount of money can really compensate you and your family for this illness, but making a claim can give you the peace of mind of knowing that your care needs will be met and your family provided for. It can help you feel more in control.

Lung cancer

The risks of lung cancer are increased for those exposed to heavy levels of asbestos over a prolonged period, usually decades before.

For those who were heavily exposed to asbestos and were also smokers, the risks of lung cancer are multiplied.

If you have been diagnosed with lung cancer and have a history of working with significant amounts of asbestos, you may be able to make a claim and apply for benefits.

You probably won’t have been asked about your working life by your doctors, and they are unlikely to have advised you that your cancer may be linked to asbestos. However, asbestos-related lung cancer is thought to affect at least as many people as mesothelioma.

This is a complex area of the law, and if you have been diagnosed with lung cancer then specialist legal advice is really important. Otherwise you risk being short changed. We are specialists at tracking down employers that other law firms have failed to find. The amount of any award for lung cancer will depend on various factors, in particular what treatment you have received and how your illness has responded. However, awards of less than £50,000 are rare.

Asbestosis

Asbestosis is a disease which can cause thickening and hardening of the lungs and progressive shortness of breath for those exposed to heavy levels of asbestos over prolonged periods. Confusingly “asbestosis” is often used to describe all asbestos-related illnesses – even by doctors. If you have been told you have asbestosis it would be very useful if you could obtain a copy of

any correspondence from the doctors to confirm your diagnosis.

Again, asbestosis typically occurs many decades after exposure to asbestos.

Compensation and benefits may be available to people with asbestosis.

Diffuse pleural thickening

Asbestos-related diffuse pleural thickening is the scarring and thickening of the lungs. It is benign but can become symptomatic if it is widespread.

It takes many years to develop.

Our lungs can also develop diffuse pleural thickening as a result of various different factors, including tuberculosis, rib fractures, pulmonary embolisms and heart disease. Various drugs can also cause thickening of the lungs. As can be imagined, claims for diffuse pleural thickening are complex and you will need specialist advice.

Pleural plaques

Pleural plaques are localised, benign (i.e. non-cancerous) areas of scarring to the lungs. They are harmless in themselves, although they are indicators of previous exposure to asbestos. They rarely, if ever, cause symptoms.

It is not possible to claim compensation for asymptomatic pleural plaques arising out of exposure in England and Wales with an English or Welsh company. It may be possible to claim for exposure in Ireland or Scotland or with a company that was or is based there.

You may have pursued a claim for pleural plaques previously and feel you are now getting worse. If so, contact us for advice. There may be more compensation due to you, even if you settled your previous claim on a “full and final” settlement basis. The landmark decision in the case of Lloyd v Humphreys and Glasgow (see p.13), where we represented Mrs Lloyd, confirmed this.

“I was exposed to asbestos many years ago. My employers didn’t know it was dangerous, surely?”

Unfortunately unsafe working practices in industry often continued after the knowledge of the dangers of asbestos developed. Since the mid 1960s at the very latest, all employers should have known that exposure to even low levels of asbestos was dangerous. Before that they should have been aware of the health risks of more substantial exposure. However, many industries continued to use asbestos without providing their workers with any protection. This means a claim is often possible even where it can’t be shown that your own boss was actually aware of the dangers of asbestos.

“My employers went out of business many years ago.”

That is often the case for our clients. We try and track down their insurers and make a claim against them. We pride ourselves on not giving up easily, and have often found insurers after other law firms had failed. If insurers can’t be traced, we will advise you about the best course of action. It may be you can still claim because you were exposed to asbestos elsewhere.

Alternatively, you may qualify for a payment from the government, or under the mesothelioma fund of last resort.

“It’s so long ago now. What if I cannot remember who I worked for and when?”

Don’t worry. We will talk to you about your working history. It’s understandable that dates become muddled after so many years. The most important thing is to try and remember who you worked for and what you were doing for them. We can work out the dates and fill in any gaps by obtaining your employment records from the Inland Revenue.

“I worked in the building trade and was on a self employed ticket, so I never went through the books. Can I still claim?”

Possibly. Many building workers were on a ticket in the 70s and 80s. Often, they worked for an employer who determined their hours of work and what they would do each day. If the “employer” exercised a lot of control over the worker, the courts will often treat them as “effectively an employee” – and a claim may well be possible, despite you being officially self employed.

“I don’t remember ever working with asbestos.”

Many of our clients don’t. Maybe you weren’t told that the materials you worked with contained asbestos. You might have called them by a trade name or nickname “Asbestolux” or “big 6’s” or “compound/compo” or even “monkey muck” or “pig muck.”

Alternatively, you might not have worked with asbestos. Maybe you lived near an asbestos factory or maybe one of your relatives worked with asbestos.

We will explore all the various possibilities with you and advise you about the best way forward.

“My Dad passed away and after he died the inquest said it was an industrial disease. I’m not really sure what his job involved – although I know he worked in large factories and heavy industry. A local solicitor says that unless I can get evidence about his work, I can’t claim. Is this right? My Mum is totally lost without my Dad, as he was also caring for her before he became unwell.”

You do need evidence to bring a claim but we never expect our clients to gather this evidence without our help and guidance. There may be some information in your Dad’s medical records or Inland Revenue history. We may have acted for someone who had a similar occupation or who worked at the same place as your Dad. We can help piece together your Dad’s working life. We commonly help families like yours bring a claim, even when other solicitors say they can’t help. While nothing can ever compensate your Mum we would seek to recover the cost of caring for her within any claim.

“I had a settlement of a few thousand pounds many years ago, when they first found signs of asbestos in my lungs. I have now been diagnosed with mesothelioma and am very worried about my future and my family. Is there anything more I can do?”

Possibly. It will depend on what basis your compensation was agreed before. If it was a “provisional damages” award then it should be a fairly simple matter to reopen the case and seek further damages. If, however, it was a “full and final” settlement then that option would not be open to you, unless a potential defendant had been missed. We succeded in the landmark case of Lloyd v Humphreys and Glasgow (see p.13) after two other reputable firms refused to pursue a claim and another asbestos specialist barrister had advised there was no case. You might also not have had proper advice before agreeing to settle on this basis, in which case a claim against your previous lawyers might be possible. We are happy to advise you.

“I am worried about the cost of making a claim.”

Don’t be. We would act on your behalf under a “no win, no fee” agreement. This will protect you against the risk of a big legal bill and also means there will be nothing to pay if you lose. Unlike many other firms, we won’t ask you to pay upfront for anything.

“Is there a time limit for making a claim?”

Strictly speaking, you have 3 years from the date when you were diagnosed with a symptomatic asbestos-related condition to claim compensation. It can sometimes be quite difficult to assess when this time limit begins to run, and we can advise you on this. If more than 3 years have passed the court has a discretion to allow your claim to proceed – but many lawyers are too cautious to take on out of time cases. You really need a specialist fighting your corner. We regularly succeed with cases that are officially out of time.

6. Professional negligence

You may have settled a claim for damages for an asbestos-related illness years before. You may still be able to make a claim now if your illness has developed. This might be a claim against your employers, or a claim against your former solicitors.

We will be able to advise you on this in detail. The time limit for pursuing previous solicitors is 6 years from the time the negligence caused you a loss, or 3 years from the date on which you developed a worsening in your condition which made you appreciate the solicitors had done something wrong.

It may be that your previous solicitors advised you to settle your claim for too little. This may have occurred for several reasons:

1. They may simply have undervalued your claim. They may have failed to properly consider the medical report and/or to appreciate the seriousness of your condition or the additional losses that you have suffered. For example, we pursued a claim against a well-known trade union firm of solicitors where they had undervalued the claim by more than £50,000, because they had misread or overlooked the prognosis in the medical report which said their client would die several years earlier than he should have done.

2. They may have not made full or reasonable efforts to track down all your previous employers. In most cases, this would mean that the damages recovered would be reduced. You may have a claim for the additional damages that should have been recovered if the solicitors had been more thorough. We recently advised a client where the previous solicitors had only tracked down 3 employers out of a total of 10. We quickly traced 5 of the missing ones.

3. They may not have advised you about making a claim for benefits. Some benefits have strict time limits, and if you have missed out because of your solicitors you may have a claim against them.

4. They may have failed to commence court proceedings within the time limits, or pursue them quickly, prejudicing your right to make a claim.

5. They may not have advised you properly about tactics. The most likely example of this is in relation to mesothelioma or lung cancer claims. This is because they are such serious illnesses, and the timing of a settlement can have a big impact on the amount of compensation received. If you didn’t receive any advice about this, you or your family member may have received insufficient compensation. The same may have happened if there was a delay in pursuing your claim, without good reason.

6. You may have had a diagnosis of asbestosis, lung cancer, pleural thickening or pleural plaques. With all of these conditions there is a small risk that further conditions will develop and to reflect this it would have been possible to seek “provisional damages” or settle on a “full and final” basis – you may have received inadequate advice about your options. Your solicitors may not have carried out any analysis of the likely compensation if you did develop further conditions, which they should have done in order to advise you properly.

7. They may have dropped your claim without proper investigations. For example, they may have considered only one potential type of claim and decided the evidence wasn’t strong enough, and failed to ask you about other potential exposures to asbestos. An example of this is if they

concentrated on one of your employers and ignored other potential defendants. Alternatively they may not have thought about other exposure. There may still be time for your new solicitors to pursue your claim against employers or original defendants. If it is too late to do this, then a claim against your previous solicitors may be possible.

8. Recent settlements

Widow of Swansea welder wins High Court battle

This was an important decision. Mrs Lloyd’s husband Cliff, a retired welder, died of mesothelioma in 2012. Shortly before he was diagnosed, he had settled a claim for asbestosis for just a few thousand pounds. The case was settled by his then solicitors on a “full and final” basis which meant that if he went on to develop more serious asbestos-related problems he could not seek further compensation from the defendants.

His solicitors had not included Humphreys and Glasgow, one of his previous employers, in the claim. At the time Humphreys and Glasgow were refusing to pay out on claims as they were waiting for the decision in another long-running court case to determine which insurers should deal with historic asbestos claims. The case was eventually decided just six weeks before Mr Lloyd died.

When Mr Lloyd was diagnosed with mesothelioma, he asked his original solicitors to help, but they said that nothing more could be done - even though not all of his previous employers had been pursued.

Mr Lloyd then instructed a second firm, but they were advised by a senior barrister who thought the claim was an abuse of process and believed that the previous settlement prevented this second claim from being pursued. In any event, he said, the time limit for bringing a claim had expired.

Mrs Lloyd then instructed Helen Childs of our firm, who took a different view. Helen took on the case, and when Humphreys and Glasgow’s solicitors confirmed that they would not be accepting responsibility, she issued court proceedings in the specialist asbestos claims court in London. Recognising the importance of the case, the court ordered that it should be heard by a senior High Court Judge in February 2015 to decide the preliminary issues of whether the claim should be prevented from proceeding, either because of the earlier settlement, or because it was too far out of time.

The court’s judgment was resoundingly in favour of Mr Lloyd, whose employers finally admitted responsibility for his illness and death in July 2015. The claim has now settled for a significant six figure sum.

Sadly it was too late for Mr Lloyd, but his widow said: “We are relieved that we may at last be able to see justice done. Cliff was a fit man until industry ruined him. He lost his hearing and then he lost his life all through working in dreadful conditions. He was a grafter. He was a loving, hands on, friendly man who loved to make toys for his children, nephews and grandchildren. We had such plans for our retirement. I know what I have lost, his companionship, his love, my best pal and my gentle husband of 55 years, a father and grandfather who we all miss dreadfully. Cliff suffered terribly and died the most horrible and painful death. I would hate to think of other people having to go through what we went through.”

Cliff had a thirst for knowledge and told us that if life had dealt him a different hand of cards he would have loved to have been a teacher. As a tribute to him, we have established the Clifford Lloyd Education Fund and are offering discretionary £250 bursaries to professionals involved in the care and treatment of patients with mesothelioma and lung cancer. The bursaries are to assist with the costs of attending the National Lung Cancer Forum for Nurses and British Thoracic Oncology Group annual conferences.

Over £500,000 agreed in settlement for a retired Post Office worker

Mr M worked for the Post Office for many years. He was unknowingly exposed to asbestos and diagnosed with mesothelioma in the autumn of 2013. Mr M instructed Helen Childs at our firm in October 2013. We issued proceedings, judgment was entered and we secured an interim payment of £100,000 in May 2014.

In common with many such cases, Mr M’s personal claim was less valuable than a claim brought after his death on behalf of his estate. In this case there was a difference in excess of £100,000.

After concerted efforts to persuade the defendants to negotiate, Mr M made the difficult decision to not proceed with the assessment of damages which was listed for February 2015, and for his family to conclude the claim after his death. At this point, we secured a further £100,000 interim payment.

The Court ordered the defendants to attend a joint settlement meeting by February 2015 to discuss an enhanced lifetime settlement. The settlement discussions took place in March 2015, and the claim was settled for over £500,000, which was substantially more than Mr M’s personal claim would have been.

Sadly Mr M has since passed away, but he was very pleased to have the peace of mind of knowing he wasn’t bequeathing a legal battle to his wife.

Enhanced lifetime settlement for lung cancer

Our client Mr A started work as a lagger and docker in London’s East End in the 1950s.

Mr A was diagnosed with lung cancer in 2013 and instructed us in April 2014. As is common with claims for terminal diseases, the lifetime claim was worth considerably less than the fatal claim for Mr A’s wife would have been. By issuing proceedings speedily and maintaining pressure on the defendants we got them to agree to a joint settlement meeting. At the meeting, an enhanced lifetime settlement was agreed which amounted to several hundreds of thousands of pounds and was in fact very close to what the settlement for our client’s widow would have been. The claim was concluded within nine months of instruction.

After the settlement Mr A commented: “In Helen, my wife and I found someone who we felt did not only deal with the issue in a professional and competent manner, but with the degree of sensitivity that was important to us. Throughout the case, my wife and I have become increasingly impressed with her and Royds Withy King in every aspect of the matter in hand. Her excellent handling of the technical issues was matched by her dealings with us on the emotional front.

me to the degree that Helen Childs has. I would have no hesitation in recommending her to anyone requiring the highest level of technical competence and client satisfaction as any such person could have complete confidence in her abilities. Equally important is her ability to put people at ease when they are almost certainly going through some considerable emotional turmoil.”

Other settlements

• £220,000 settlement for a woman who worked at the old Charing Cross Hospital, London in the 1960s. The case was settled during her lifetime and in accordance with her wishes.

• £150,000 settlement for a retired carpenter who had worked for Sir Lindsay Parkinson & Co. in the 1960s.

• £220,000 settlement for an ex Greater London Council (GLC) worker settled in just over five months from instruction and with less than a week to go to the assessment of damages hearing. It was vital that this claim be settled in the client’s lifetime because as a widower the compensation for his estate after his death would have been substantially less. His son said that the settlement had “exceeded their expectations.”

• £90,000 settlement in a complex fatal mesothelioma case for a boiler maker. We overcame evidential difficulties caused by the deceased’s widow’s statement to the coroner saying her husband had consistently denied exposure to asbestos.

• £100,000 payment secured for a printer via the Government fund of last resort.

• A six figure settlement for a widow whose husband had died of testicular mesothelioma more than five years previously. We overcame the time limit arguments and the client was delighted by her settlement.

• £90,000 settlement for a carpenter based in Oxfordshire. This was one of the first cases to be submitted to the Government fund of last resort, settled within six months.

• £100,000 settlement for a widower of a laundry worker who had laundered dusty asbestos-contaminated overalls from the Atomic Weapons Establishment (AWE). This case was recommended by a previous client and settled within six months of us receiving the file.

• Over £140,000 settlement for an ex Morris Motors assembly line worker within ten months of instruction.

• Over £100,000 for an Oxfordshire carpenter. This claim was settled within six months of instruction. Poignantly the settlement was agreed on the day our client died.

• Over £200,000 for a journalist and author who died of mesothelioma in 2016. He worked as a prop man at Pinewood Studios, where he helped construct the sets for “Battle of Britain” and “2001: A Space Odyssey”.

• Over £100,000 for a fatal mesothelioma claim. Mr Chad worked in numerous power stations in England, Scotland and overseas. He was diagnosed with pleural thickening several years before, and his previous solicitors only submitted a claim to the Turner & Newall Fund. His mesothelioma claim was theoretically out of time, but we succeded in full.

• Over £300,000 for a 59 year old HGV driver/plant repair mechanic who worked at a paper mill and a plant hire company in the 1970s. The defendants disputed his claim and it was only settled a few days before a High Court trial.

• Over £450,000 for a Warwickshire woman exposed to asbestos when laundering her husband’s overalls. He was a manager at Westbury cement works.

• £140,000 for the widow of an electrician, employed by Clark & Bridle Limited, who was exposed to asbestos while working in close proximity to other tradesmen during refurbishment of Woolworths stores around the country.

• £240,000 for a Mr M, a former apprentice engineer who was exposed to asbestos while working at Swindon Railway Works. Mr M required care from Prospect Hospice and we were also able to recover their costs.

• Over £200,000 for Mr T, a former construction worker who had served an apprenticeship with Vickers Armstrong and then worked for several building companies. He had been extensively exposed to asbestos: he and his fellow apprentices even used to have snowball fights with balls of asbestos. Mr T was 71 when he developed mesothelioma in January 2016. He instructed Maggie Powell in our Industrial Diseases team. Mr T had no dependants, so it was important his claim be concluded in his lifetime, or significantly less compensation would have been payable. We issued proceedings, got judgment, arranged care evidence and settled the claim for over £200,000 within ten months of instructions, allowing Mr T to make provision for his children and grandchildren, and pay for care and assistance to enable him to stay in his own home.

• Over £200,000 in compensation for Mr C, a retired industrial painter, despite the defendant company arguing that the level of our client’s exposure to asbestos has been insufficient for them to be at fault. Mr C faced the very difficult decision about whether to settle his claim personally or for his wife to conclude it after his death for a higher settlement; when he died in summer 2015, his widow took over the claim. The defendant contested the widow’s right to bring the claim until there was a Grant of Probate, but we were able to successfully argue that she was entitled to bring the claim as she had been appointed Executor under Mr C’s Will. The defendants then investigated the widow’s own state of health attempting to argue that she had health problems that would have impacted on her life expectancy. The expert evidence did not support this and the claim concluded in April 2016 for over £200,000.

After his death, Mr C’s widow wanted to buy us a gift. Instead, we asked her to make a donation to Mesothelioma UK to support the valuable work they do in supporting others who have been diagnosed with or affected by mesothelioma.
