As per sub clause 2.5 [Employers Claims],

The notice shall be given as soon as practicable after the Employer became aware of the event or

circumstances giving rise to the claim. A notice relating to any extension of the Defects

Notification Period shall be given before the expiry of such period. (FIDIC 1999 Red Book,

1999)

The Contractor shall send, to the Engineer, details of any accident as soon as practicable

after its occurrence. The Contractor shall maintain records and make reports concerning

health, safety and welfare of persons, and damage to property, as the Engineer may reasonably

require.

As per sub clause 10.2 [Taking Over of Parts of the Works],

After the Engineer has issued a Taking-Over Certificate for a part of the Works, the Contractor

shall be given the earliest opportunity to take such steps as may be necessary to carry out

any outstanding Tests on Completion. The Contractor shall carry out these Tests on Completion

as soon as practicable before the expiry date of the relevant Defects Notification Period.

As per sub clause 10.3 [Interference with Tests on Completion],

The Engineer shall then issue a Taking-Over Certificate accordingly, and the Contractor

shall carry out the Tests on Completion as soon as practicable, before the expiry date of the

Defects Notification Period. The Engineer shall require the Tests on Completion to be carried out
