    TEXT OF ARTICLE 13 (1) (b) and (2)

    1. The General Assembly shall initiate studies and make recommenda=tions for the purpose of:

    b. promoting international cooperation in the economic, social,cultural, educational, and health fields, and assisting in the realiza-tion of human rights and fundamental freedoms for all without dis-tinction as to race, sex, language, or religion.

    2. The further responsibilities, functions, and powers of the GeneralAssembly with respect to matters mentioned in paragraph 1 (b) above are setforth in Chapters IX and X.

    INTRODUCTORY NOTE

    1. The arrangement of this study pertaining to the practice of the General Assembly inthe application of Article 13 (l) (b) and (2) corresponds vith that in the previousRepertory studies of this Article, and the material is presented under the same generalheadings.

    3. There is a close parallel between Article 13 (l) (b) and Article 55. As in thepast, the study of Article 55 in this Supplement covers the substance of the questionof international co-operation in the fields of economic and social activity and ofhuman rights, whereas this study of Article 13 (l) (b) is limited to the range andtypes of action taken by the General Assembly in the exercise of its functions ininitiating studies and making recommendations in these fields.

    5. Article 13 was referred to in the discussions of the General Assembly on severaloccasions» Thus, it was stated I/ that, under several specified Articles of theCharter, among them Article 13, the General Assembly had considered, studied and maderecommendations concerning the question of racial relations in the Union of SouthAfrica and was competent to deal with that question again; it could makerecommendations concerning human rights; under Article 13, specifically, it couldstudy and make recommendations concerning the question of race relations andapartheid, and it could do so because this matter concerned relations between States;Articles 13 and Ik Jointly gave the General Assembly special competence to discussquestions relating to human rights and fundamental freedoms.

    SUMMARY OF PRACTICE

    A. Studies initiated by the General Assembly

    6. Studies initiated by the General Assembly under Article 13 (l) (b) at the eleventh,twelfth and thirteenth sessions and the first, second and third emergency specialsessions are reviewed in the present study. They are listed in the annex under thefollowing headings:

    I. Studies requested from the Economic and Social Council and its subsidiaryorgans;

    II. Studies requested from the Secretary-General;III. Studies requested from other bodies and individual specialized agencies; andIV. Studies requested from several bodies jointly.

    In each case, the listing in the annex includes the number, the title and thepertinent provision of the resolution.

    B. Recommendations of the General Assembly

    7. Of the more than 500 resolutions adopted by the General Assembly during the periodcovered by this Supplement, 79 included recommendations which constituted anapplication of Article 13 (l) (b) since they dealt with the promotion of internationalco-operation in economic, social and related fields or with assistance in thepromotion of human rights or fundamental freedoms*

    Terminology

    8. As in the past, there was no consistent pattern in the terminology of theresolutions; such words as "invites", "requests", "urges", "calls upon" predominated,but other expressions, such as "recommends", "looks forward with interest", "drawsattention", "appeals", were also employed in operative paragraphs. The expression"solemnly calls upon" was used in General Assembly resolution 12*rô (XIII).

    9. During the period covered by this Supplement, there were several occasions whensuggestions, changes and discussions took place in the General Assembly concerning theuse of one particular expression in preference to another. Thus in clauses addressedto Member States the word "requests* was replaced 2/ by "invites" in a draftresolution on international economic co-operation. In another instance, a proposalwas made J5/ to change "recommends" to "requests" in one clause addressed to theEconomic and Social Council, since, it was stated, the General Assembly was a higherorgan than the Council» The word was changed to "invites" in the resolution finallyadopted, k/ Similarly, in another instance, "requests" was amended *J t° read"invites" in a clause of a draft resolution 6/ of the General Assembly addressed tothe Council.

    10. During consideration of a draft resolution on land-locked countries and theexpansion of international trade, one representative, without giving reasons,suggested jj that the word "urges" should be replaced by the word "invites" in aclause addressed to Member States, on the subject of giving full recognition to theneeds of land-locked Member States in the matter of transit trade; and the change wasmade. 8/ A resolution on the formulation of social policies related to economicdevelopment %J contained a clause addressed to the Economic and Social Councilconcerning the consideration of social programmes and policies designed to achievespecified objectives. In the discussion in the Third Committee, a vote was taken onchanging "calls upon" in the draft to "requests". The view was expressed 1Q/ inthis connexion that "requests" was more courteous than "calls upon". In another case,the expression "invites the World Health Organization to organize" an International

    Addressees

    11. Most of the recommendations of the General Assembly under this Article during theperiod under review were addressed to States, Governments, subsidiary bodies of theGeneral Assembly, the Economic and Social Council and the Secretary-General; thepractice did not differ significantly from that of previous years. 13/ Recommendationsdirectly or indirectly addressed to the specialized agencies also included theInternational Atomic Energy Agency on several occasions

    Subjects dealt with in the recommendations

    12. Recommendations made by the General Assembly during this period dealt withsubjects which were among those considered by it in the past. 15/ The new matters inthe field of economic activity included international trade of land-locked countries, l6/the collection of information on international economic assistance to less developedareas, 17/ a Special Fund for assisting integrated technical, economic and socialdevelopment of less developed areas l8/ and the question of principles of internationaleconomic co-operation. 19/ In the fields of social activity and human rights, the newsubjects related to relief for the Hungarian people and refugees, 20/ Chinese refugeesin Hong Kong and refugees in Morocco and Tunisia; 2j./ a World' Refugee Year; 22/community development; 23/ and international cultural, and scientific co-operation. 2k/The General Assembly also considered the question of international co-operation inthe peaceful use of outer space, 25/ a subject closely related to the objectives ofArticle 13 (l) (b) and (2).

    Types of action envisaged in the recommendations

    13. With a few exceptions, the types of action envisaged "by the General Assembly inits recommendations during the period under review were of the kind to be found amongthe recommendations of the previous periods» 26/ Among the additional types of actionrecommended to Governments in the economic and social fields were the greater use ofan existing international organ to solve a particular type of problem, 27/ and arecommendation to the Economic and Social Council to expand one of its subsidiarybodies. 2Ô/

    lU. The United Nations Educational, Scientific and Cultural Organization (UHESCO), theother specialized agencies concerned with the peaceful application of science, as wellas the International Atomic Energy Agency (IAEA), were invited to co-operate with theGeneral Assembly in connexion with a projected survey relating to the co-ordination ofthe results of scientific research. 29/ The other specialized agencies concerned andUNESCO were also invited by the General Assembly to formulate concrete proposals,regarding the needs of less developed countries in relation to media of information,and to include an account of their activities relating to freedom of information intheir annual reports to the Economic and Social Council. 30/ The World HealthOrganization (WHO) was invited to consider the question of organizing an InternationalHealth and Medical Research Year, preferably in 1961, and to inform the Council and theGeneral Assembly of its views. 31/

    15. The regional economic commissions and the specialized agencies were invited by theGeneral Assembly to co-operate with a new commission which it established to survey thestatus of the permanent sovereignty of peoples and nations over their natural wealthand resources.

    The General Assembly established a PreparatoryCommittee composed of representatives of sixteenGovernments and asked the Committee to preparea report for the Economic and Social Counciland the General Assembly, presenting theresults of its work along the lines specifiedby the General Assembly concerningestablishment of a special fund withoperations directed towards enlarging the scopeof United Nations technical assistanceprogrammes.

    "Requests the Technical Assistance Board tocontinue to consult participating countrieswhere middle-level training facilities areavailable" regarding the greater use of thesefacilities for training personnel of lessdeveloped countries, in view of the shortageof skilled technical personnel in thesecountries, and to report to the Economic andSocial Council at its twenty-eighth session.

    The General Assembly established an ad hocCommittee on the Peaceful Uses of Outer Spaceand requested it to report to the GeneralAssembly at its fourteenth session on thevarious aspects of this problem, including thequestion of international co-operation andprogrammes for the peaceful uses of outerspace.

    The Secretary-General was requested to circulateto Member States the preamble and nineteenarticles of the draft Convention on Freedom ofInformation for their views and suggestions, toinvite them to state the legal provisionsrelating to freedom of information in theircountries and to report on this consultation tothe General Assembly. The Economic and SocialCouncil was requested in the same resolution(a) to invite the Commission on Human Rights toconsider procedures for constant review ofproblems of freedom of information and to givespecial consideration to the problem ofdeveloping media of information in under-developed countries and (b) to transmit theCommission's report to the General Assembly withthe Council*s recommendations.

    In section III of resolution 659 B (XXIV), theCouncil had asked the Technical AssistanceBoard, and had invited participatingGovernments, to suggest measures forimplementing a substantially larger programmeof technical assistance.
