Rail Safety Act 2006
• Compliance with Act a requirement for management
of the “competence” of “rail safety workers”
• Competence:
R39 (1) A rail operator must assess…
(a) by reference to:
(i) any applicable units of competence or qualification under
the AQF; or
(ii) any other competence specified by the Safety Director;
and
(b) by reference to the actual knowledge, experience and
skills required for the particular rail safety work to be
carried out safely.
Definition of RSW
S7 (a) driving, despatching, or any activity controlling/affecting the movement of rolling stock;
(b) signalling, and signalling operations, receiving and relaying of communications or any
other activity controlling or affecting the movement of rolling stock;
(c) coupling or uncoupling rolling stock;
(d) designing, constructing, repairing, modifying, maintaining, monitoring, inspecting or
testing (i) rolling stock; (ii) civil or electric traction infrastructure; or (iii) signalling or
telecommunications equipment;
(e) installing components in relation to rolling stock;
(f) any work relating to the design, construction, repair, modification, maintenance,
monitoring, inspecting or testing of rail infrastructure or associated works or equipment;
(g) installing or maintaining any part of rail infrastructure or telecommunications system;
(h) receiving and relaying of communications;
(i) any work involving certification as to the safety of rail infrastructure or rolling stock;
(j) decommissioning or disposal of rail infrastructure or rolling stock;
(k) development, management or monitoring of safe working systems for railways;
(l) any work in relation to ensuring the safety of (i) rail safety workers on a railway; (ii) any
persons working on or near a railway, whether or not the person working on or near the railway
track is carrying out rail safety work;
(m) any other work that is prescribed by the regulations as rail safety work.

RSW Identification
• ARTC captures the competencies of all Rail Safety
Workers, and issues a RSW Card which permits the owner
to complete RSW for ARTC

System Compliance
• Prior to contractors arriving onsite:
o During contract tender process - RSW compliance checked
o ARTC supervisory staff have been trained and provided viewing
access to the competency system to check contractor
competencies before they arrive on site
• Contractors arrive on site:
o checked for possession of RSW card at pre-work briefs
o safety officers trained in electronic auditing via Onsite and are
proactively ensuring possession of RSW cards
o Random audits by regulator and ARTC
o System hardware being explored to allow swipe access
