PROCEEDINGS: Arraignment held on Indictment, doc. [1]. The defendant is sworn andadvised of rights, Rule 11, F.R.C.P. and charges. Financial Affidavit is executed and approved. Attorneys Bobby Hutson and Jonathan Moffat, Federal Defender Services are appointed torepresent the defendant. The court questions the defendant’s attorney and his attorneyacknowledged the defendant understood the charges against him. The government advised ofthe potential penalties in this case and the defendant plead not guilty to the charges in theindictment. The government is seeking detention under 18 USC 3142 (f)(2)(A) stating thedefendant is a risk of flight. The court proceeded with the detention hearing.
Witnesses are sworn and testimony is heard. Attorney Bobby Hutson proffered information tothe court re witnesses and testimony. The court heard closing argument from the parties.
The court finds there are conditions in which the defendant can be released on. If the defendantviolates in any way, he will be arrested and detained pending his trial. Order to follow.
