The defendant is sworn and advised of rights, Rule 11, F.R.C.P. and charges. Financial Affidavit is executed and approved. Attorneys Bobby Hutson and Jonathan Moffat, Federal Defender Services are appointed to represent the defendant. The court questions the defendant’s attorney and his attorney acknowledged the defendant understood the charges against him. The government advised of the potential penalties in this case and the defendant plead not guilty to the charges in the indictment. The government is seeking detention under 18 USC 3142 (f)(2)(A) stating the defendant is a risk of flight. The court proceeded with the detention hearing. Witnesses are sworn and testimony is heard. Attorney Bobby Hutson proffered information to the court re witnesses and testimony. The court heard closing argument from the parties. The court finds there are conditions in which the defendant can be released on. If the defendant violates in any way, he will be arrested and detained pending his trial. Order to follow.
