Even though CPT Hoffmann plans to be in the office at the above times, he may be scheduled to be out of the office or called away unexpectedly in support of his clients (such as in court, at CID, interviews, traveling, etc.). CPT Hoffmann will respond to requests for appointments as soon as possible. FORT LEE & FORT EUSTIS ARMY SVC Who is eligible for SVC services? In general, if a victim of sexual assault (unrestricted report, restricted report, or have not yet reported) fits into one of the following categories, he or she may qualify for SVC services: o Active Duty Soldier (no matter whether the offender was a Soldier or not) o Active Duty Initial Entry Soldier (no matter whether the offender was a Soldier or not) o Adult or Child Family Member Dependents of an Active Duty Soldier (if you have a military ID or the child would qualify to have a military ID if the child was the requisite age and the offender was a Soldier or activated under Title 10) o Army DoD civilian employee (if the offender was a Soldier) o Foreign military personnel (if the offender was a Soldier) If a Reserve or National Guard Soldier, he or she may qualify for services under his or her component's own SVC Program. I can provide information for a Reserve or National Guard Soldier. If a Servicemember or Family Member of another branch of the Armed Forces is sexually assaulted by a member of the Armed Forces, he or she may qualify for SVC services through his or her branch of service (e.g., Navy, Air Force). What is the SVC Program? The SVC Program provides a no- cost military attorney, a SVC, to victims of sexual assault who qualify for SVC services. What does an SVC do? SVCs provide legal representation to qualifying victims of sexual assault throughout the military justice process and answer questions about the process along the way. SVCs primary duty is to zealously represent clients’ interests, even if these interests do not align with the interests of the government. SVCs accompany, advise, and represent clients during interviews, hearings, and courts-martial. Additionally, SVCs provide legal consultation about the various programs and services available to assist clients and provide legal assistance services as needed. What are a victims rights in a court-martial? o Right to be treated with fairness and with respect for your dignity and privacy; o Right to be reasonably protected from the accused; o Right to be notified of and to be present at all public court proceedings related to the offense, with some exceptions; o Right to confer with the government attorney in the case; o Right to available restitution; o Right to information about the conviction, sentencing, imprisonment, and release of the offender. Confidential Communications! A SVC is bound by rules of confidentiality. With limited exceptions, a SVC cannot share confidential information that a client provides him or her without the client’s permission.
