Would it occur to you in marketing your newly self-published book to send a copy off to a celebrity,

hoping for a bit of publicity? What if you knew she had aparticular interest in the subject matter? It wouldn’t hurtto try, would it?

In March 2008, after years of com-piling information and ideas aboutceliac disease (gluten intolerance),Susan Hassett self-published Livingwith Celiac Disease. She creditedher research and knowledge of thedisease with saving her life. Sherepublished the book in April 2009to number the pages and correctspelling errors.

On April 4, 2008, Hassett sent a copy of the book with apersonal note by certified mail to TV personality and talkshow host Elisabeth Hasselbeck. Hasselbeck, who suffersfrom celiac disease, did not respond.

In May 2009, Hasselbeck published her own book aboutceliac disease, The G Free Diet: A Gluten-Free SurvivalGuide. Hassett quickly identified similarities in G Freewith her book, although G Free did not contain thesubstantial recipe section that Living did. Instead it addedwhat Hassett called “approximately 100 pages of fluffdesigned to make [it] a popular commercial diet book.”

Hassett’s attorney fired off aletter to Hasselbeck about simi-larities in the books, copyingHasselbeck’s publisher, BarbaraWalters, Oprah and Dr. Oz.After the letter was ignored.Hassett filed a copyrightinfringement suit in federaldistrict court in Boston, askingfor injunctive relief anddamages against Hasselbeck, her publisher and an unnamedghostwriter.

The complaint pointed out alleged similarities in content, format and organization of the two books. The legal issuewas whether copying resulted in G Free being“substantially similar” to Living under copyright law.Examples of alleged similarities in content included:

Plaintiff Hasset’s Living:

· “Do not ever ‘double dip.’ This means use one knifefor our butter, one for our condiments. If your knifeis dirty get another one. For celiacs with severe cases, that one crumb in your jelly could be your last.”

· “A person with celiac disease should only shop in theouter isles (sic) of the supermarket. The reason beingthe only thing down the other isles (sic) is things youcan’t have.”

Defendant Hasselbeck’s G Free:

· “It’s important to label yourspreads, too, so that family mem-bers know not to stick theircrumb-encrusted knives in there.…I will have your head if I seeany breadcrumbs in my peanutbutter or jelly.”

· “The foods on the outer aisles ofthe supermarket should be thefoundation of your diet—of anydiet, really, with or without gluten.”

For purposes of ruling on a motion for summaryjudgment in December 2010, Judge Mark L. Wolfassumed copying took place. In his substantial similarityanalysis of the books, he removed from considerationthose elements not protected by copyright – “ideas, acts, individual words or short phrases and aspects of the workcustomary to the genre.” He found what was left – theexpression of ideas, which is what copyright law protects– was not substantially similar; that the two books variedin style, tone, and emphasis; and he dismissed the case. The dismissal was upheld on appeal, and the U.S.Supreme Court denied review.

This is a reminder of what copyright law protects. It isnot intended to express an opinion about how to marketyour book.

Interviewed by Brenda Warneka

Born in Trenton, N.J., Barbara Marriott grew up in thesmall, nearby town of Nutley. Nutley was frequently

the subject of hilarity on The Sid Caesar Show becausethe show’s writers thought the name was funny. Barbara, who has a wicked sense of humor herself, says, “I wasraised in a town that was a joke.”

After graduation from highschool, Marriott attendedSullins Jr. College in Bristol,Va., before going on toFarleigh Dickinson College(now University). Thereshe earned a B.A. in Englishand met Mike Marriott, herfuture husband.

Barbara’s first job, doingadvertising make-up forVogue and Glamour in NewYork City, was offered toher by Conde Nasté aftershe was a finalist in theVogue Prix de Paris contest,a competition previouslywon by Jackie Kennedyand Joan Didion. She thenwent to work at Hahne & Co., a prestigiousdepartment store in Newark, where shebecame the head copywriter.

Her next stop, in 1956, was Pensacola, Fla.,where as his recent bride, she joined Mike, whowas a newly commissioned naval officer andaviator. A 30-year jaunt around the UnitedStates and Europe as a navy wife followed. The Marriotts lived in Florida, Rhode Island,Virginia and New Jersey, but also on theFrench Riviera and in the village of Dorney,England, where her 14th century farmhouselooked across the river at Windsor Castle.

During those years, the Marriotts had a son and daughter, whom Barbara often raised on her own for months at atime while Mike was deployed at sea. When she could, she pursued her career in advertising. She worked parttime when the kids were growing up, as a fashion copy-writer, then an advertising creative director. When theywere living in Satellite Beach, Fla., she earned an M.A.in human emotions from the University of Oklahoma.

After Mike retired from the Navy, the Marriotts lived InPonte Vedra Beach, Fla. They started and ran an

international management consulting business for a fewyears. Then Barbara went back to school, earning a Ph.D.in cultural anthropology in 1991. Afterward, she taughtupper-level business management courses at the Univer-sity of North Florida. In 1996, their daughter convincedthe Marriotts to move to Tucson to live closer to her andher family.

In Tucson, Marriottreinvented herself as abook author and nowhas 12 books to hercredit. It started whenshe heard about thefamous people wholived in and visitedOracle, includingBuffalo Bill Cody.Delving into theOracle HistoricalSociety archival files, she produced her firstbook, Annie’s Guests,in 2007, a nonfictionpiece about fivevisitors to the historicAnnie’s Hotel.

Following Annie’s Guests, she wroteBanana River, about a little-knownWWII naval base. She then discoveredthe Steam Pump Ranch, a part ofTucson history, which led to the non-fiction Canyon of Gold. She originallyself-published her first three books, butBanana River was picked up by LooseLeaves Publishing. She next wrote twobooks for Globe Pequot about NewMexico at their request. Her most recentfiction book, Take the Train to Tucson, published by Fireship Press, comes outin June. She is returning to GlobePequot, now Rowman and Littlefield,

for her next nonfiction book, Two Six Shooters Beat FourAces. It will be out next year.

In addition to two children, the Marriotts have threegrandchildren.

Marriott joined APW at the recommendation of JanCleere to network, learn more about Arizona, and meetother women who share her interest in writing and thestate.
