    This is a question commonly

asked by people who want to

that they are eligible to apply for

    that specific citizenship.

    British citizenship by descent is

what they refer to the kind of

    citizenship that children assume

when they are born outside the United Kingdom to a parent/s who is

a British citizen. There are rules that have to be met regarding the

father is born a British citizen and has retained that citizenship up to

the time of the marriage to your mother, then you are entitled to

receive dual citizenship and a British passport.

The necessary documents that one needs to present include: birth

certificate of your father which states his British citizenship, marriage

certificate, among others. You have to secure these, etc. when you do

    apply for the citizenship.

Do keep in mind that some countries do not recognize dual

citizenship. Some countries would require you to give up your

citizenship if you choose to receive British citizenship. Fortunately for

as proof that your father or mother is a British citizen at the time of

    your birth.

Before the implementation of the 1983 Act, women were not able to

pass on their British citizenship to her offspring.

For those children whose parents were not married at the time of

    their birth, the UKBA states:

If the parents were not married when the child was born, but then get

married, the marriage might legitimate the childs birth. If it does, the

child would become a British citizen (and would be regarded as having

been one from birth) if the father was a British citizen (or settled) when

the child was born. Children of a void marriage may also, in somecircumstances, be treated as legitimate.

If you think you are eligible to receive British citizenship, then you

must continue researching the UKBA website. Talk to those who are

well-versed with the rules of citizenship to know about your options.

It pays to have the right knowledge and information pertaining to

    Claiming British nationality

    citizenship should not be a

problem if you are aware of the

    rules regarding acquiring

citizenship through your fatherand mother. The UKBA rules

simply state that if your father

There are a number of categories of a British national. British citizen,

British subject, British Overseas citizen, are among the kinds. Each

    category has limitations and benefits.

For example, a British Overseas citizen may not have an automatic

right to live in the United Kingdom. However, being a British Overseas

citizen enables the applicant to undergo a much easier and simpler

way to acquire British citizenship. An applicant will register instead of

    undergoing naturalisation.

BOCs are those men and women who have a connection with a

former British colony, Kenya, for example, and those who did notbecome citizens of the country when it became independent and did

    not become British citizens.

Historically, Indians were plenty in Kenya because British colonialists

brought them to the country to build the Kenya-Uganda railway.

Many stayed in the country and have started a new life in Kenya.

(Indian Kenyans were able to retain their culture and religious

practices as evidenced by the presence of Indian temples andmosques around the country.)

The UKBA explains the status of a British overseas citizen:

You became a British overseas citizen on 1 January 1983 if you were a

citizen of the United Kingdom and Colonies on 31 December 1982 and

you did not become either a British citizen or a British overseas

When it comes to dual citizenship, Kenya only permits the nationality

for minors. At the age of majority, Kenyan citizens must renounce allother nationalities. Minors will lose their Kenyan citizenship during

the age of 21 if they do not renounce their British nationality (BOC)

These BOCs will be de-facto stateless should they reach the age of

citizenship but you are not sure

whether you are eligible for it.

Let us take this example to

    understand if an Australian can

    gain British citizenship through

    mother.

A young man, born in Australia

in the year 1985, is inquiring

about his eligibility to gain a

    British passport:

I just want to know if I am eligible to gain British citizenship through

my mother. I was born in Australia in 1985. So far, I have stayed here in

Adelaide my entire life. My mum was born in the United Kingdom. She

then moved to Australia when she was just 4 years old.

citizenship in 1996. I think this makes me qualified to gain dual

the UKBA website to find out what I should do. I find it hard to

understand the terminologies that are being mentioned there.

My father was born in Austria but moved to Australia at a tender age

    Johnny A. from Adelaide

Will Johnny A. be able to apply? The answer is, yes. He may apply to

get his British citizenship through mother because according to

    UKBA:

Whether or not you are a British citizen depends on the type of

citizenship your parents had. This may be British citizenship by descent

    or otherwise than by descent.

    British citizenship may

you are a British citizen by
