Abusing Discretion Abuse of discretion occurs when a trial judge is deemed to have made a significant mistake that is “clearly against reason and evidence” or against established law and that results in a person being denied a fair trial. An appeals court may use such a finding of abuse as a ba- sis for reversing the previous court’s result. Examples of abuse of discre- tion include not allowing an important wit- ness to testify, showing bias, or making rulings on evi- dence that deny a person the chance to tell his or her ver- sion of events. Health Health Physically Speaking Better Health Today By Dr. Philip Pollock By Dr. Mark McDonald Avascular necrosis is an unseen adversary I read a recent article in one of my chiropractic publications where the author cited a study on back pain. This study was published in the “Jour- nal of the American Board of Family Medicine, January 2009.” The Title of the article was, “Over Treating Back Pain.” Dr. Dan Murphy pointed out some very significant points made in the study. Did you know that pain complaints are the leading cause of medical visits? The primary source of those pain com- plaints, are musculo-skeletal in na- ture, of which, the neck and back pain are the biggest reason for the consult. Because of the prevalence of back pain, a host of new tests and treat- ments have become the norm. The treatments include, injections, sur- gical procedures, implantable de- vices, and medications. While each form of treatment is valuable for some patients, much of the care is driven by professional concern, patient advocacy, market- ing, and the media, rather than sci- entifically valid indications. It is important to note that 25% of the U.S. adult population will report having back pain within the past 3 months. This fact has not changed for the past several decades. This goes to prove that expanded testing and treatment have not improved patient outcomes, but have in- creased complications, including death. From a Medicare standpoint: there has been a 629% increase in epidu- ral steroid injections; A 423% in- crease in expenditures for opioids for back pain, which, by the way, you should know actually increases the person’s pain sensitivity; A 307% increase in the number of MRI’s per- formed; A 231% increase in facet joint injections, and a 220% increase in spinal fusion surgery rates. As mentioned before, the patient out- comes or disability rates have not improved. Did you know that anywhere from 33%-66% of CT and MRI studies may be inappropriate? At $3,000 to $4,000 each, this is a significant cost, considering that positive find- ings such as herniated discs are common in asymptomatic people. There are no magic bullets for chronic back pain. In fact chronic back pain, like diabetes or asthma is a condition we can treat but rarely cure. I have made this statement before, “Once you injure a joint it will always be damaged and thus weak- ened. Over the years it will tend to degenerate faster or slower depend- ing on the number of times you injure it.” The number of times you injure the joint will usually vary directly with the amount of proper diet and exer- cise you give it. In a world of injuries - sprains, strains, fractures, etc. - one particu- lar complication of these injuries is the condition known as avascular necrosis (AVN). In AVN, as it is often called, the blood supply to the bone is affected by the injury itself, and as such, impairs the bones ability to repair as well as impairing it’s ability to thrive and live. Avascular necrosis takes several forms, one of the most common be- ing the avascular necrosis of the scaphoid. The scaphoid is a small peanut shaped bone in the wrist and following wrist sprains or fractures, the scaphoid can be broken at the neck of the bone leaving the proxi- mal pole of the scaphoid without a blood supply. When this vital nutrient source is removed, the remaining bone is un- able to repair and subsequently de- generates and dies. This necrosis is not limited to the bone, however, and also necrotizes the cartilage which is also nourished by the bone’s blood supply. One of the most insidious things about AVN is that it is often not immediately apparent upon x-ray. In fact, it is rarely apparent other than the fact that the particular areas which are affected are frequently the source of AVN related concerns. The scaphoid in particular is well known for its propensity to develop this necrosis. Therefore, any time that an injury affects the scaphoid whether it be a sprain or fracture, physicians are careful to re-evaluate the bone as time goes along to de- termine if there are avascular de- generative changes occurring to the bone and cartilage. Dislocations of the hip can also cause vascular necrosis to the head of the femur as Bo Jackson found out in his awful hip dislocation injury which was televised for the whole world to see. Once the hip is dislo- cated, the ligament teres which at- taches to the femoral head and which also carries with it the blood supply to a large part of the head of the femur is torn during the dislocation. With this vital nutrient “umbilical cord” broken, the blood supply to the femoral head is compromised as well as the blood supply to the carti- lage on this weight bearing joint, leaving the joint susceptible to bone death and cartilage degeneration. As Bo Jackson found and as many hip dislocation patient discover, avascular necrosis is a common side effect for this reason. Although the blood supply is not entirely from the torn vessel, often the damage is severe enough in AVN to necessi- tate hip replacement surgery or femo- ral head prosthetic hemi arthroplasty. Avascular necrosis also occurs in the foot in both the navicular and talus bone and is a less common but potential source of AVN following foot and ankle trauma and fracture. This is very difficult to treat as both bones are further traumatized being weight bearing structures. In short, avascular necrosis is a side effect of certain sprain, strains and fractures which should not be overlooked and when injuries do not seem to be healing properly, it is wise to consult with a skilled ortho- pedist regarding these reasons these injuries are not healing. Avscular necrosis is insidious and manifests itself weeks, even months, to the process of a healing injury where no evidence was present early on. Avascular necrosis is an unseen adversary

I read a recent article in one of mychiropractic publications where theauthor cited a study on back pain.This study was published in the “Jour-nal of the American Board of FamilyMedicine, January 2009.”
